Holder (Ret.), Memphis TN 9:30 AM – 9:40 AM BREAK 9:40 AM – 11:15 AM TULSA RACE MASSACRE FIRE INSURANCE CLAIMS— A MINI TRIAL EXPERIENCE On May 31 and June 1, 1921, mobs of White residents, many deputized and given weapons by city officials, attacked Black residents, and destroyed homes and businesses of the Greenwood District in Tulsa, the “Black Wall Street”. Many Black people were killed and many more were left homeless. Many homes and businesses were looted and destroyed by fire. Many of the properties were insured under fire policies, but the insurers denied coverage because of riot exclusions. We will conduct a mini trial to try the issue of whether the riot exclusion should apply, considering rules for interpretation of insurance policies, analyzing remote, proximate, intervening and concurrent cause issues. We will also look at the number of occurrences issue. Of course, these days coverage is provided for riot and civil commotion in most standard property forms. But there are some circumstances where coverage can be limited or excluded in the case of riot and civil commotion. MODERATOR: Jordan D. These claims raise issues across nearly every aspect of the industry. The ability to work remotely, and to perform all manner of professional services has been available for some time. But the realities of the pandemic compelled a broad array of professional service providers to dramatically alter how they performed their jobs. Now a substantial percentage of professionals are working at least part of the time from home or remotely from the main office. With the enormous cost savings that have come because of this new environment, and the concomitant benefit to personal and corporate bottom lines, it is almost certain that this sea change in how professional services is provided will not be reversed, and the provision of professional services in a substantially remote environment–with often widely disbursed members of various professional service organizations–is going to be the new normal going forward. At the same time, ever advancing technologies have changed the way professionals perform their jobs, and the level and manner of interaction they engage in with their clients and other professionals. Taken together, we are looking at potentially profound impacts on not just the performance and provision of professional services, but the errors and omissions risks presented. The registration fee includes admission to the program, course materials, breakfast, breaks, and reception.
