Please join us in Baltimore, Maryland—Charm City—for the Seventh Annual TIPS
Section Conference at the Hyatt Regency Baltimore Inner Harbor.

Today’s Baltimore is a vibrant community that honors the past while keeping
a keen eye on the future. Baltimore is where you can see the largest public
collection of Matisse in the world (for free!), sip a craft beer in the sanctuary
of a converted church, and stay in a four-star hotel poised atop an historic
recreation pier. But the Baltimore experience is about more than exploring
neighborhoods and cultural sites. To really know this place, you have to meet its
artists, provocateurs, and visionaries who call Charm City home. And you can
do that and more because we are staying at the Inner Harbor, where Baltimore’s
shipbuilding and steel mills once stood. The Inner Harbor has everything, from
scenic waterfront views to fresh seafood restaurants to spectacular museums.
Highlights of the conference include a Wednesday welcome reception, a
Section reception and dinner on Thursday night, and the Women Trial Lawyers’
networking luncheon to end the conference on Friday.

With the help of many, we have put together a conference with a wide and
diverse array of programming for trial lawyers, insurance counsel, regulatory
counsel, young lawyers, and government lawyers. Our CLE offerings include:

DEI—Leaders in diversity and inclusion in corporations and law firms discuss what
companies are doing in real time to move the needle on this important issue.

Ethics—From addressing ethics in mediation to handling abusive clients, we
have several innovative ethics panels that approach ethical issues outside the
realm of traditional ethical concerns.

Cutting Edge Issues—Learn from the experts about how government collection
of personal data, including biometric data, is being addressed both legally and
ethically. Hear about how the proliferation of medical and adult cannabis laws
has led to growing legal issues that every practitioner needs to know. Listen to
experts discuss the rise and scope of animal law issues, including strategies for
mitigating conflict.

MESSAGE FROM
CONFERENCE CHAIRS
Trial Practice—Learn from a panel of judges how the courts have coped with
COVID-19 and the lessons learned from remote trial practice. Hear from an
expert panel on how to address business emergencies through temporary
restraints and preliminary injunctions. Listen as the fire and property damage
claims arising from the Tulsa Race Massacre are re-tried before a live audience.
Will the riot exclusion prevail again to preclude coverage?

Insurance Law—Learn about recent developments in molestation claims from
an expert panel. Hear from an expert panel on how the remote provision of
legal services and advanced technologies will affect professional liability
coverage. Did you ever want to teach insurance law? Learn how and where that
is happening and the best practices for doing so.

And More—We have a panel on autonomous transportation claims and how
corporations are addressing the rapid move toward autonomous vehicles.
Additionally, did you know that national firms are moving in on local communities
to press mass tort and other litigation? How does this trend affect you? And we
have a few more surprises.

In all, the TIPS Section Conference will have over 14 hours of CLE, including 2.5
hours of ethics.

So, don’t be crabby. Come to Baltimore and satisfy your CLE requirements for
the year while networking with clients and attorneys from across the country.
You will be charmed.

basics of what is biometric data, how it is collected, what it is used
for, what are its limitations, how it can be misused, and the legal
                     and ethical implications.

3:15 PM – 4:15 PM “TALES FROM THE SCRIPT!”: ETHICS IN MEDIATION
Join us for a serious yet entertaining screening of scripted
mediation sessions in which the conduct of advocates and neutrals
alike bends, and perhaps breaks, the bounds of ethical conduct.
Cloaked in confidentiality, what are the ground rules for proper
conduct in a mediation by parties and neutrals? Utilizing a series of
recorded video zoom vignettes, this interactive program invites our
audience to join our Moderator and “Script keeper” for a not too
scary tour of some mediation misdeeds. The standards at issue will
include: The Model Standards of Conduct for Mediators, and Model
                     Rules 3.3 and 3.4.
SPEAKER: Frederick Alimonti, Alimonti Law Office, PC, Valhalla, NY

4:15 PM – 4:30 PM BREAK

4:30 PM – 5:45 PM LEGAL WRITING: A JUDGE’S PERSPECTIVE ON THE SCIENCE
AND RHETORIC OF THE WRITTEN WORD
Judge Bachrach will explain this method, using psycholinguistic
studies to demonstrate the importance of putting old information
before new information and how to maximize the usefulness of this
method. He will use examples from famous oratory, including FDR’s
first inaugural address, and some select examples from well-known
advocates. This program will explain in a simple, direct way how
to maximize clarity, using these kinds of examples to demonstrate
how others make their oratory and writing so clear and to use
empirical data to show that these methods have been proven
effective in enhancing the clarity of one’s communication.
SPEAKER: Judge Robert Bachrach, U.S. Court of Appeals, Tenth Circuit,
                       Oklahoma City, OK

sought during emergencies in cases as diverse as shareholder and

9:40 AM – 11:15 AM TULSA RACE MASSACRE FIRE INSURANCE CLAIMS—
                      A MINI TRIAL EXPERIENCE
On May 31 and June 1, 1921, mobs of White residents, many
deputized and given weapons by city officials, attacked Black
residents, and destroyed homes and businesses of the Greenwood
District in Tulsa, the “Black Wall Street”. Many Black people
were killed and many more were left homeless. Many homes
and businesses were looted and destroyed by fire. Many of the
properties were insured under fire policies, but the insurers denied
coverage because of riot exclusions. We will conduct a mini trial to
try the issue of whether the riot exclusion should apply, considering
rules for interpretation of insurance policies, analyzing remote,
proximate, intervening and concurrent cause issues. We will also
look at the number of occurrences issue. Of course, these days
coverage is provided for riot and civil commotion in most standard
property forms. But there are some circumstances where coverage
can be limited or excluded in the case of riot and civil commotion.

AGENDA
11:30 AM – 12:30 PM AUTONOMOUS TRANSPORT CLAIMS 2024–COMPANY
                      PERSPECTIVE ON ADAPTABILITY
With transportation companies turning to emerging technologies
and advanced automation to keep up with consumer demand and
increase operational efficiencies across the spectrum of autonomy,
we explore the impact on employee/employer considerations in
the next few years and what liability can follow from autonomous
activity in 2024 and beyond. We also explore the view from the
C-Suite as to how advanced technologies are being implemented in
modern day operations as a means of risk mitigation. Experienced
commercial transportation and maritime counsel will discuss these
implications with in-house counsel thought leaders and owners in
                      the trucking and maritime industry.

11:30 AM – 12:30 PM NATIONAL FIRMS MOVING INTO YOUR NEIGHBORHOOD?
The influx of national firms entering the local bar to pursue mass
tort and other types of litigation affects both the plaintiff’s and
defense bars. This panel will discuss the implications of this
growing trend, including the effect on the dockets, what motivates
the legislature to allow it, how local judges perceive the effects of
the presence of outside firms, and the management of cases and
how they are assigned priority. Our speakers are at the forefront of
this litigation in the Baltimore area and will share their insights on
                      this trend.

                      CREATING WIDESPREAD LEGAL IMPLICATIONS
This session will encompass several areas of law including
cutting edge regulatory issues, ethics, medical marijuana,
and what is coined in healthcare as the 4 P’s (provider, payer,
patient, policymaker). Attorneys will gain insight on how cutting-
edge issues in cannabis can impact their clients’ rights and
responsibilities even for practitioners who do not practice cannabis
law. Ethical issues and potential minefields that may arise when

2:00 PM – 3:00 PM RECENT DEVELOPMENTS CONCERNING
                     MOLESTATION CLAIMS
With the recent news concerning the allegations against Larry
Nasser and US Gymnastics and the activity sparked by the revival
statutes for sexual assault claims enacted by several jurisdictions,
the insurance industry will likely continue to grapple with
molestation claims for years to come. These claims raise issues
across nearly every aspect of the industry. This panel will provide a
background of the law regarding molestation claims and describe
the types of claims being made; discuss the increase in claims and
the types of insurance policies implicated; analyze select policy
terms, number of occurrences, and trigger; and discuss theories of
liability. On the reinsurance side, the panel will discuss the insurer’s
determination of the number of occurrences or events; notice
issues; aggregation and allocation; and “follow the fortunes”/
“follow the settlements” provisions in reinsurance contracts

3:00 PM – 3:10 PM BREAK

3:10 PM – 4:10 PM THE COLLISION OF INCREASINGLY REMOTE PROVISION
OF PROFESSIONAL SERVICES AND ADVANCES IN
TECHNOLOGIES IMPACTING THESE SERVICES: WHAT THIS
MEANS FOR PROFESSIONAL LIABILITY E&O NOW AND
                     GOING FORWARD?
The ability to work remotely, and to perform all manner of
professional services has been available for some time. But the
realities of the pandemic compelled a broad array of professional
service providers to dramatically alter how they performed their
jobs. Now a substantial percentage of professionals are working at
least part of the time from home or remotely from the main office.
With the enormous cost savings that have come because of this
new environment, and the concomitant benefit to personal and
corporate bottom lines, it is almost certain that this sea change
in how professional services is provided will not be reversed, and
the provision of professional services in a substantially remote
environment–with often widely disbursed members of various
professional service organizations–is going to be the new normal
going forward. At the same time, ever advancing technologies
have changed the way professionals perform their jobs, and
the level and manner of interaction they engage in with their

HEALTH & SAFETY:
The ABA takes the health and safety of our members, guests, and staff seriously. We know that
the decision whether to attend a meeting is based upon a variety of personal and business
considerations. We will continue to monitor a variety of sources, including the U.S. Centers for
Disease Control and Prevention (CDC) and U.S. state and local health authorities for the latest
public health updates, as well as applicable restrictions on events and gatherings. The ABA plans
to hold this meeting in person but reserves the right to cancel or reschedule this event or convert
it to a virtual event if health and safety restrictions require it. We will update the registrants and
the website should the plans for this event change.
As part of the registration process to hold this ABA meeting in person, every attendee is required
to affirm his/her commitment to comply with the in-person meeting guidelines. Please review
the requirements carefully prior to registering for the meeting. You will be asked to accept the
following affirmations during the registration process:
o By registering for and attending the meeting, I affirm that I will provide, prior to the meeting,
either proof of full vaccination as defined by the CDC or a negative viral COVID test
administered by a healthcare professional taken within 3 days of my arrival at the meeting.
If a shorter interval is required by law, I will comply with the shorter interval testing, as
instructed by ABA staff. I will wear my meeting badge (provided on site after verification
of full vaccination or negative viral COVID test) in meeting and event spaces at all times. I
understand that collection of proof of full vaccination and negative viral COVID tests will
be handled by a third-party provider and instructions will be emailed to me closer to the
      meeting date.
o If I am bringing a guest, including minors under the age of 18, to the meeting, I understand
that my guest must be registered using a unique email address for the meeting to be in the
meeting space or group functions associated with the event and must submit either proof of
full vaccination or negative viral COVID test administered by a healthcare professional taken
within 3 days of my guest’s arrival at the meeting.
o By registering a guest, including minors under the age of 18, I understand that my guest may
not be allowed to attend certain events or meeting functions. The ABA entity hosting the
meeting will communicate which events are available to guests.
o By registering a minor, I understand that I will be required to complete and sign a parental
consent form provided by the ABA during on-site registration. By registering and bringing
a minor to the meeting, I understand that I will need to bring either the minor’s proof of full
vaccination as defined by the CDC or the minor’s negative viral COVID test administered by
a healthcare professional taken within 3 days of my arrival at the meeting. I also understand
that I, along with the minor, will not be permitted entry if proof of vaccination or negative
viral COVID test is not provided to the ABA staff at on-site registration.
o By registering for and attending the meeting, I affirm that I will comply with all CDC, federal,
state, local, and venue-specific laws, orders, directives, and guidelines related to COVID and
      attending the meeting.
o By registering for and attending the meeting, I affirm that I have read and will comply with CDC
guidance related to hand sanitation, social distancing, and use of face coverings. I affirm that
I will follow any more stringent state, local, or venue requirements related to hand sanitation,
social distancing, and use of face coverings in place at the location of the meeting.
o I will also follow all travel restrictions in place at the location of the meeting and my point of
origin at the time of the meeting.
o I will not attend the meeting if I have tested positive for COVID within fourteen (14) days
of the meeting, am experiencing symptoms of COVID, or have been in close contact with
someone who has COVID. If at any time during the meeting I begin to experience symptoms
of COVID, or am in contact with someone experiencing symptoms, I will immediately leave
the meeting and inform the ABA. If I test positive for COVID within 10 days after the meeting,
I will inform the ABA. The requirements in this affirmation also apply to any minor(s)
      attending the meeting with me.
o I understand that my guests, including minors under the age of 18, and I may be required to
complete health screening questions after arrival at the meeting to access ABA meeting and
      event spaces.
