WORKSHOP ITEM: E September 9, 2019 MEETING ITEM COMMENTARY AGENDA ITEM: Zoning, Site Plan, and Subdivision Ordinances Draft 2 Workshop COUNCIL RESOURCE: Councilor Nathan Johnston (Liaison to the Zoning Ordinance Revision Steering Committee) Councilor Roger Gay (Liaison to the Planning Board) STAFF RESOURCE: Denise Clavette, Planning and Development Director Emily Cole-Prescott, City Planner Jessa Berna, Business Development Specialist BACKGROUND: On February 20, 2018, the City Council voted to adopt the 2018 update of Saco’s Comprehensive Plan. The 2018 Comp. Plan update was the result of two years of review and discussion by an adhoc committee and City Staff. As a community, our next step is to update the Zoning Ordinances to align with the City of Saco’s land use vision: The most forward-thinking land use policies in the State of Maine that ensure financial stability, environmental sustainability, and provides opportunities and accessibility to all. The City Council voted to establish a Zoning Ordinance Revision (ZOR) Steering Committee on October 15, 2018. After a competitive RFP Process, the City of Saco contracted with planning consultants TZM Planning and EF | Design & Planning, LLC (Consultants) to update Saco’s Zoning Ordinance (ZO) in the Fall of 2018. Together, the Consultants along with the ZOR Steering Committee, began in earnest to delve into the comprehensive review, study, and recommendations for revisions and changes to the City’s current Zoning Ordinance. In January 2019, the City and the consultants initiated an online survey of Saco residents and property owners soliciting input on zoning-related topics that warranted further discussion by stakeholders. A total of 1,080 people participated in the survey. A public Charrette was held on February 7 at the PeoplesChoice Credit Union, and over 70 Saco residents participated. Based on the public input and the feedback and direction from the Steering Committee, City Council, Planning Board, Historic Preservation Commission, Conservation Commission, other City boards and committees, and City Staff from all departments, Draft 2 of the land use ordinances were completed in and posted online here in late August. The ZOR Steering Committee and the Planning Board have held individual work sessions to review these documents,
WORKSHOP ITEM: E September 9, 2019 and they will be holding a joint work session on Monday September 9, 2019, just before the September 9, 2019 City Council meeting. Based on the feedback from these work sessions and other public feedback, staff has compiled a list of outstanding items to be addressed in the third and final draft. In addition, there are several focus areas, topics and portions of the existing zoning ordinance that merit further discussion, study, analysis, and revisions that will not be addressed as part of this current ZOR process. These items will undergo further review and study and will be brought up as individual amendments over the next year. This list is included in the exhibits for this Item Commentary. On September 9, 2019 (this City Council Workshop), City Staff and the Consultants are seeking feedback from the City Council on Draft 2. The City also will be hosting two public forums, both covering the same content (Tuesday, September 10th and Wednesday, September 11th in Council Chamber 5:30-8:00 PM). The evenings will start with refreshments and a summary presentation of the proposed changes. The remainder of the forums will be open-house style and give residents the opportunity to review maps and documents, ask questions, and provide recommendations to City staff and our consultant team. Feedback from these forums and other input from City boards and committees will be complied and integrated into a final draft, which will then go through a formal public hearing and adoption process with the Planning Board and City Council. WORKSHOP ITEM: E September 9, 2019 CHAPTER 230 Exhibit Item: 1 DRAFT 2_8.21.19 Purpose Authority This chapter was first enacted in 1985 pursuant to authority set forth in 30 M.R.S.A. § 4953, and was subsequently amended from time to time pursuant to that authority set forth in the following statutes, 30-A M.R.S.A. § 3001 (Home Rule), 30-A M.R.S.A. § 3003 (Adoption of Codes by Reference), 30-A M.R.S.A. § 4352 (Zoning Ordinances) and 30-A M.R.S.A. § 4403 (Subdivision Regulations). Purpose This chapter is intended to encourage the most appropriate use of land throughout the City; to promote traffic safety; to provide safety from fire and other hazards; to provide adequate light and air; to prevent overcrowding; to promote a wholesome home environment; to conserve natural resources; and to provide for adequate public services. Title This chapter shall be known and may be cited as the "Zoning Ordinance of the City of Saco, Maine," and will be referred to herein simply as "this chapter." District Regulations Official Zoning Map A. Adoption. A map entitled "City of Saco, Zoning Map" and dated [insert date 2019] is hereby adopted as part of this chapter and hereafter shall be referred to as the "Official Zoning Map." B. Exceptions. The Official Zoning Map shall be the final authority as to the boundaries of zoning districts, except in regard to the Resource Protection (RP) District, the Saco River Overlay District (SRO), and the Shoreland Protection Overlay District (SPO), all three of which are more particularly described in Article 8 herein. C. Copies of the Zoning Map. Representative maps which may be appended to this chapter are for reference only and shall not be construed to be the Official Zoning Map. District Boundaries A. Uncertainty of boundaries. City of Saco, ME ZONING ORDINANCE 1
WORKSHOP ITEM: E September 9, 2019 CHAPTER 230 Exhibit Item: 1 DRAFT 2_8.21.19 Where uncertainty exists with respect to the boundaries of the various districts as shown on the Zoning Map, the following rules shall apply: (a) Boundaries depicted as approximately following the center lines of streets, highways, or alleys shall be construed to follow such center lines. (b) Boundaries depicted as approximately following well-established lot lines shall be construed as following such lot lines. (c) Boundaries depicted as approximately following municipal limits shall be construed as following municipal limits. (d) Boundaries depicted as following shorelines shall be construed to follow such shorelines, and in the event of natural change in the shoreline shall be construed as moving with the actual shoreline. (e) Boundaries indicated as approximately following the center lines of streams, rivers, canals, lakes, or other bodies of water shall be construed to follow such center lines. (f) Boundaries depicted as following or measured from natural features such as the upland limit of wetlands or the limit of floodplains shall be construed to follow or be measured from the actual limit of the natural resource as located on the face of the Earth even if such location is at variance with the location shown on the Official Zoning Map. (g) Where physical or cultural features existing on the ground are at variance with those shown on the Official Zoning Map, except as provided in Subsection A(1)(a) through (e) above, or in circumstances where the items covered by Subsection A(1)(a) through (e) above are not clear, the Board of Appeals shall interpret the district boundaries. (h) The district boundaries located on the Zoning Map represent the City of Saco's ordinance. In addition, areas along the Saco River are also governed by the Saco River Corridor Commission. Separate, and in some cases more- restrictive, regulations exist for this area and must be consulted when development is contemplated. B. Division of lots by district boundaries. Where a zoning district boundary line divides a lot, the regulations applicable to either lot may be extended up to one hundred (100) feet into the other lot. City of Saco, ME ZONING ORDINANCE 2

Activities within the Saco River Overlay District are subject to the jurisdiction of both the City of Saco and the Saco River Corridor Commission (SRCC). Construction, development, and some other activities require approval from both the City and the Corridor Commission. Refer to 38 §951 thru 969 for Saco River Corridor Act, and to http://srcc-maine.org/regulations/saco-river-corridor-act-and-performance-standards/ for applicable performance standards. B. Activities within the Saco River Overlay District must conform to the applicable City regulations as well as to the Commission's regulations. C. To coordinate the review and permitting process, applicants or potential applicants should first determine if the proposed activity is allowed under the City's regulations. The applicant should then obtain a permit for the activity from the Saco River Corridor Commission. Once the SRCC permit has been obtained, the applicant should apply for City permits or approvals needed for the project. Obtaining a permit from the SRCC does not absolve the applicant of the requirement to obtain City permits and approvals. Prohibited industrial uses. The following uses and similar uses are not included under the definition of "heavy industry" or any other use in this chapter and are excluded from all districts because they have strong potential to be injurious, noxious, or offensive to a neighborhood by reason of the emission of odor, fumes, dust, smoke, vibration, radioactivity, noise or other by-products and are deemed to be unacceptable for one or more of the above causes: A. Blast furnace, metal or ore reduction or smelting. B. Coke manufacturing. C. Petroleum refining. D. Animal rendering plants. E. Nuclear power production facilities. F. Industries with high-level radiation hazards. G. Nuclear waste disposal. H. Petroleum and petroleum product tank farms. I. Ammonia, chlorine manufacturing, or the refining of hydrochloric, nitric, picric, sulfuric, sulphurous or similar acid manufacturing. Protect Saco’s historic, architectural and cultural heritage. The economic well-being of the City will be strengthened by preserving its architectural and historic setting, conserving property values in unique areas, fostering civic beauty, and promoting the use of historic or architecturally significant buildings for the education and welfare of the public. B. Assist property owners with maintaining the architectural integrity of the district. C. Protect, preserve and enhance the outward appearance and architectural features of structures. D. Prevent the demolition or removal of significant historic buildings or structures within designated districts or designated sites or landmarks. E. Preserve, protect and enhance the essential character of designated districts by protecting relationships of groups of buildings and structures. F. Accept new buildings and structures which are designed and built in a manner which is compatible with the character of the district. G. Promote the educational, cultural, economic and general welfare of the people of the City. §102 Historic Preservation Commission A. Membership. The Commission’s membership shall be comprised of regular members, associate members, and advisory members. B. Appointment. Members of the Historic Preservation Commission (the Commission) shall be appointed by the Mayor subject to approval by the City Council. C. Qualifications. The Commission shall include five (5) regular members and up to five (5) associate members. All members shall be residents of the City of Saco. Appointments shall be made on the basis of demonstrated interest, knowledge, ability, experience and desire to promote historic preservation in Saco. It is preferred that the members have architectural design skills or experience related to historic preservation, such as history, architectural history, landscape architecture, planning, engineering, law, archaeology and building construction. It is desirable that at least one member be a member of the Saco Historic Society. D. Length of term and vacancies. Regular and associate members shall serve terms beginning July 1 and ending June 30. Commission members shall serve for terms of three (3) years, except in those instances in which the appointment is made to fill a vacancy, in which case the appointment shall be for the remainder of the unexpired term. The Mayor shall act within sixty (60) days to fill a vacancy. Members may be reappointed. E. Compensation. Regular and associate members shall serve without compensation. Associate members shall participate in all hearings and discussions. They shall vote only if the Chairman appoints an associate to act in place of the regular member who is absent, has resigned, or has been disqualified because of a conflict of interest. G. Advisory members. In addition to the regular and associate members, the City Council may appoint other persons who shall serve on an advisory or consultant basis to assist the members of the Commission in the performance of their functions. Advisory members are not required to be residents. Advisory members shall not vote. H. Removal. Any regular or associate member may be removed for cause by the City Council upon receipt of written charges, followed by a public hearing. I. Officers. The Commission shall elect annually a Chairperson and Vice Chairperson from the regular members. J. Quorum. Four members shall constitute a quorum for the transaction of business before said Commission. K. The City Planning and Development Department shall be the authorized agent of the Commission, to whom the Commission may delegate any duties. L. Meetings. All meetings of the Commission shall be publicly announced, open to the public and have a previously available agenda. Public notice shall be issued ten (10) days prior to meetings of the Commission. M. Records. The City Planning and Development Department shall maintain a permanent record of the activities of the Commission, including, but not limited to such items as the number and type of cases reviewed and their disposition, new designations of historic sites, landmarks and districts, resumes of Commission members, attendance records, appointments to the Commission, correspondence and minutes of all meetings. N. Rules of Procedure. The Commission may adopt and amend rules of procedure. O. Applications. The Commission may adopt rules governing the requisite exhibits for applications. P. Gifts, grants, funding. The Commission may, subject to appropriations by the City Council or others, employ clerical and technical assistants or consultants, and may apply for and accept grants, money gifts, or gifts of services, and may hold or expend the same for all or any of the purposes of historic preservation in the City of Saco. A non-lapsing fund for gifts and grants shall be established by the City's Finance Director. Appropriations from the City Council shall be managed in accord with City policies and shall lapse each year if unexpended. §103 Duties of the Commission City of Saco, ME ZONING ORDINANCE ARTICLE XIX 180

Advise, and inform City officials and owners of historic buildings, structures or sites, regarding preservation, renovation, and rehabilitation. B. Advise and inform owners regarding compliance with the requirements of this section. C. Make recommendations for establishing historic districts, historic sites, or historic landmarks. D. Review all proposed additions, reconstruction, alterations, construction, removal, or demolition of properties that are subject to the commission’s jurisdiction. E. Review all proposed National Register nominations in Saco, and proposals for eligibility. F. Comment on (federal) Section 106 reviews. G. Serve as an advisor to City officials regarding local historical and cultural resources and act as a liaison between local government and those persons and organizations concerned with historic preservation. H. Conduct or cause to be conducted a continuing survey of local historic and cultural resources, in accordance with Maine Historic Preservation Commission guidelines. I. Work to provide local citizens with continuing education on historic preservation issues. J. Undertake other duties as deemed necessary or desirable by its members to advance the purposes of this section. K. Cooperate with federal, state and City officials in the pursuance of the objectives of historic preservation. L. Participate in land use planning efforts of the City, state and federal government. §104 Eligibility for Historic Designation The historic districts, historic sites and historic landmarks established in accordance with this chapter shall have one or more of the following characteristics: A. History of Saco. Structures, buildings or sites at which events have occurred that contribute to and are identified with or significantly represent or exemplify the broad cultural, political, economic, military, social history of Saco or the nation, including sites or buildings at which visitors may gain insight or see examples of particular items or of larger patterns in the North American heritage. B. Persons. Structures, buildings or sites associated with important historic persons. C. Ideas. Structures, buildings or sites associated with important examples of a great idea or ideal. D. Architecture. Structures or structural remains and sites embodying examples of architectural types or specimens valuable for study of a period, style or method of building construction, of community organization and living; landscaping; a single City of Saco, ME ZONING ORDINANCE ARTICLE XIX 181

E. Visual continuity. Structures or buildings contributing to the visual continuity of the historic district. F. National Register. Those sites or areas listed on or eligible for listing on the National Register of Historic Places or as a National Historic Landmark. §105 Establishment and Expansion of Historic Districts A. Amendment Process. Any person seeking to add or expand historic districts, sites, or landmarks shall request the amendment in writing to the Commission. Any proposal by the Council or Planning Board shall be referred to the Commission for comment before Council action. After receiving the Commission's recommendation concerning the request, the City Administrator shall place it the matter on the agenda of the City Council. Any applications or designation of buildings, structures, sites and districts shall be in writing. B. Application Requirements. Applications shall be in writing and shall include the following, as appropriate: (i) A concise description of the physical elements, qualities, architectural style, period and historical significance represented by the building, structure or site, including a consideration of scale, materials, workmanship and spatial qualities, as relevant. (ii) A concise statement of how the building, structure or site meets the review criteria of this chapter. (iii) Exterior photographs of the building or structure, or and a site map, illustrating significant details. In addition, the Commission may request photographs of interior features of particular historic significance. These interior photographs may be provided by the applicant on a voluntary basis and are not required submissions. (iv) A concise statement of the physical elements which justify making this area an historic district and a description of building types and architectural styles and periods represented. (v) An explanation of the proposed boundaries of the district. (vi) Details on the structures that do not contribute to the significance of the district. (vii) A map showing the location of all district structures. C. Studies & Recommendations. Before making its recommendation concerning the proposed establishment or expansion of an historic district, historic site or historic landmark, the Commission may conduct studies and research on the proposal. The Commission shall make a report to the City Administrator on every request received within six months.
