IMPORTANT INFORMATION for competitors, parents and teachers Redlands Eisteddfod and COPYRIGHT PLEASE READ CAREFULLY From 1 January 2017, a new ‘APRA|AMCOS, ARIA and PPCA’s Blanket Licence Solution’ came into effect. It covers the use of copyright music and sound recordings at all eisteddfods throughout Australia. The APRA|AMCOS Forms used previously (1: Performer’s Declaration; 2: Adjudicator’s Copy; 4: Orchestral and Band Parts; 5: Accompanist’s Copy) are no longer to be used. They have been replaced by ONE Form, The Copyright Declaration Form for Eisteddfods, Competitions and Examinations. This fillable Form is available for download from our website and is also available at https://onemusic.com.au/media/Information-Sheets/Copyright-Declaration-Form.pdf Note: The Title, Composer/Lyricist/Arranger and Publisher of all musical works being performed at the Eisteddfod is now required to be listed on the Form (part 5, page 2). Each entry (defined as being one person or one group entering one event [Section]) attracts a Copyright licence fee. This fee is built into the applicable Redlands Eisteddfod entry fee for each section, so no additional fee is required from competitors. Accompanists may only use a (temporary) photocopy if the competitor(s) are performing from the original and the piano part is not published separately. Checking No. 3, ‘Making a temporary copy for an accompanist’, does not legalise mass photocopying. Temporary copies made for use by an accompanist (including digital copies) must be destroyed/deleted after the performance. Digital devices – tablets. Legal copies of print music may be transferred/scanned to a tablet (iPad etc.) for use in performance. This is termed ‘format shifting’ and is legal provided the source music is itself legal and the owner of the original does the ‘shifting’. The original source music should be present at the performance as confirmation, if required. NOTE: Competitors or Accompanists using music sourced ONLINE must, if requested, be able to prove either, a) that, if still in copyright, it was purchased from a reputable source [produce receipt] or b) that the music is in the public domain [attach an original page which clearly shows the year of publication]. ‘Copyright in music and lyrics generally lasts for the life of the artist plus another 70 years.’ ‘Generally, published works where the creator died before 1 January 1955 and unpublished works where the creator died before 1 January 1950 (rolls over every year) are now in the public domain.’ [Arts Law Centre of Australia and others] Only originals or licensed copies will be returned.
