Tri-Cities Idol Front of the Line Pass Giveaway Official Contest Rules 1. CONTEST SPONSORS: This Contest, Tri-Cities Idol Front of the Line Pass Giveaway, (“Contest”) is sponsored by WJHL-TV (“Station”), 338 East Main Street, Johnson City, TN 37601 and Local Sponsors, Wild Wing Cafe, 71 Wilson Avenue, Johnson City, TN 37604; and Grand Home Furnishings, 3026 East Oakland Avenue, Johnson City, TN 37601; and 1535 East Stone Drive, Kingsport, TN 37660; and 3325 Lee Highway Bristol, VA 24201; and 157 Ridgeview Road SW, Wise, VA 24293 (collectively, the “Sponsors”). This Contest is void where taxed, restricted, or prohibited and is subject to all local, state, and federal laws. By entering, each entrant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor(s), which shall be final and not subject to appeal. This local Contest is NOT sponsored by American Idol. Local winners in this Contest are not guaranteed any appearance on American Idol. Details regarding American Idol auditions and its terms and conditions are available at: www.americanidol.com. Winning the Tri-Cities Idol Front of the Line (FOL) Pass Giveaway Contest does not mean you will be selected to appear on American Idol. Any FOL Prize winner’s subsequent audition for American Idol is subject to the American Idol Audition Terms & Conditions, available at www.abc.go.com/shows/american-idol. In the event production of American Idol is cancelled or postponed, the prizing may be cancelled without substitution or compensation therefor. “IDOL” and related indicia: ™/© FremantleMedia North America, Inc. & 19 Entertainment 2017. 2. ELIGIBILITY: The Contest is open to permanent legal U.S. citizens residents who reside within WJHL-TV’s viewing area and who are at least 15 years old at the time of entry. Current or former employees of WJHL, Nexstar Media Group, Inc. and its subsidiaries, the Sponsors, the other television and radio stations and multichannel video programming distributors in WJHL viewing area, their parent companies, subsidiaries, affiliates, advertising or promotional agencies (including anyone who prepares and/or distributes contest materials), and the immediate family members or persons living in the same household (whether related or not) of all the foregoing are not eligible to participate or win. The term “immediate family members” includes spouses, grandparents, parents, siblings, children and grandchildren. Participants are eligible to win a WJHL contest or sweepstakes only once every 30 days. Only one (1) winner per household is permitted in any contest or sweepstakes. Participants are eligible to win a prize valued at $600.00 or more only once every six months. Text, data, or messaging rates may apply. Participants are subject to additional restrictions below and must meet the following requirements:
A. On June 1, 2018 you must be 15 to 28 years old (which means you must be born on or between June 2, 1989 and June 1, 2003). If you were born before or after this window, you are not eligible to participate this season. If you are under the age of 18 at the time of any in-person audition for the Program or this Contest, you must have a parent or legal guardian present. B. You must be a legal U.S. resident (must show proof) and reside in the Contest Area with the unrestricted right to work in the United States throughout the entire competition portion of the Program and through the term of any post show agreements provided by Producer or any of the other Program Entities (as defined below). C. You may not have been one of the Top 10 contestants on Season 1 of the Program on ABC. D. To accept an invitation to participate in the competition portion of the Program (currently scheduled to begin in January 2019), you must be able to demonstrate to the satisfaction of Producer that you do not have any contractual arrangement that would prohibit you from fully participating in the show and/or entering into any contracts required by Producer, including, but not limited to, an exclusive recording contract, merchandising contract, a live and/or global touring agreement and an exclusive management contract (subject to paragraph E below). E. In the event that you already have a management contract prior to your first audition in front of the Program judges, the requirement to enter into a management contract shall not apply to you provided that you can demonstrate to the satisfaction of Producer and 19 Entertainment that such contract commenced prior to the date of your first audition in front of the Program judges. By accepting an invitation to be a participant, you must timely complete and return such participant agreements, releases and all exhibits, schedules and attachments thereto that will be furnished to you by Producer and/or 19 Entertainment. F. You must not currently be a candidate for public office and must agree not to become a candidate for public office until one (1) year after the initial exhibition of the final episode of the Program in which you appear (if selected to participate). G. As of May 5, 2018 and continuing through the completion of the competition, neither you nor any of your immediate family members or members of your household (whether related or not), may be an employee, officer or director of: (a) WJHL-TV and Local Sponsors, Wild Wing Cafe, and Grand Home Furnishings. (collectively, the “Sponsors”). (b) , Nexstar Media Group, Inc. and its subsidiaries, the Sponsors, (c) NEG Operations Inc. and all majority owned subsidiaries (including, but not limited to, 19 Entertainment Limited, 19 Entertainment, Inc., 19 Touring LLC, 19 Recordings Limited and 19 TV Limited) (collectively, the “19 Companies”); (d) American Idol Productions, Inc. (“Producer”); (e) American Broadcasting Companies, Inc. (“ABC”); (f) FremantleMedia North America, Inc. (“FremantleMedia”); (g) Telescope Inc.; (h) any of the foregoing entities’ respective parents, subsidiaries or affiliated companies; (i) any person or entity involved in the casting, auditions, development, production, distribution, or other
exploitation of the Program or any variation thereof; (j) any known, major sponsor of the Program; or (k) any person or entity supplying services or prizes to the Program, administering the Contest (including cast and crew) of the Daytime Tri-Cities (“WJHl-TV”) television show. The entities described in the preceding sentence shall be referred to herein, individually and collectively, as the “Program Entities.” H. You must accurately complete all documents provided by Producer, any of the other Program Entities or any other entity providing services to the Program. Please note that in order to enjoy the full benefit of any prize offered as part of the Program, you must be a legal U.S. resident with the unrestricted right to work in the United States throughout the entire competition portion of the Program and through the term of any post show agreements provided by Producer or any of the other Program Entities. Producer has the sole discretion to make determinations of contestant eligibility, which are binding and final in all respects, and Producer reserves the right to change any of the eligibility requirements at any time. In addition, you acknowledge and agree that Producer has the sole discretion at any time to render ineligible and disqualify any person who, in Producer’s sole discretion, is sufficiently acquainted with the development, production, administration, judging, exhibition or other exploitation of the Program such that his or her participation in the Program could create the appearance of impropriety. Please note that any audition for the Series given to the winner(s) is subject to the American Idol Audition Terms and Conditions, which is available for review at www.americanidol.com. 3. ENTRY: No purchase necessary to enter. All federal, state, local and municipals laws are regulations apply. Void where prohibited. This Contest will accept entries beginning at 7:00 A.M on Monday, July 30, 2018 and ending at 11:59:59 p.m. on Monday, August 6, 2018 (the “Contest Entry Period”). To enter the Contest, entrants must visit http://www.wjh.com/tri-cities-idol and fill out the entry form. Entrants must include their name, phone number, address, e-mail address, date of birth and the song they will sing (see NOTICE below) on live broadcast during daytime hours (6 a.m. ET - 10 p.m. ET). Entrants can also register at the following Grand Home Furnishings Locations: 3026 East Oakland Avenue, Johnson City, TN 37601; and 1535 East Stone Drive, Kingsport, TN 37660; and 3325 Lee Highway Bristol, VA. Entrant will sing one (1) a cappella song selection (no musical accompaniment or recorded track). If Entrant is a minor, entry must be submitted by parent or legal guardian, with the email address and contact phone number for parent or legal guardian. Maximum of one (1) entry per person during the Contest Entry Period. Maximum of one (1) winner per household during the Contest Entry Period.
NOTICE: The song cannot have any indecency, profanity or any suggestive references to lewd acts or behavior and must match the guidelines expressed by the Federal Communications Commission (FCC) at https://www.fcc.gov/media/radio/public-and-broadcasting#OBSCENE The FCC states obscene material is not protected by the First Amendment and cannot be broadcast at any time. To be obscene, the material must have all of the following three characteristics: ● an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; ● the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and ● the material, taken as a whole, must lack serious literary, artistic, political, or scientific value. Indecent material: The courts have upheld Congress' prohibition of the broadcast of indecent material during times of the day in which there is a reasonable risk that children may be in the audience, which the FCC has determined to be between the hours of 6 a.m. ET and 10 p.m. ET. Indecent programming is defined as “language or material that, in context, depicts or describes, in terms patently offensive as measured by contemporary community standards for the broadcast medium, sexual or excretory organs or activities.” Broadcasts that fall within this definition and are aired between 6 a.m. ET and 10 p.m. ET may be subject to enforcement action by the FCC. Profane material: The FCC has defined such program matter to include language that is both “so grossly offensive to members of the public who actually hear it as to amount to a nuisance” and is sexual or excretory in nature or derived from such terms. Such material may be the subject of possible FCC enforcement action if it is broadcast within the same time period applicable to indecent programming: between 6 a.m. ET and 10 p.m. ET. Incomplete or non-conforming entries will not be considered. All entries must be received by 11:59:59 p.m.ET on Monday, August 6, 2018. Only one (1) entry per person will be accepted. Sponsors are not responsible for telephone service outages, delays, equipment malfunctions, busy signals, hang-ups, errors or data loss of any kind, lost or unavailable connections, or late, lost, failed, illegible, incomplete, garbled or deleted entries, transmissions, or voicemails or other network or technological difficulties that may prevent an individual from completing his/her telephone call or online entry, or for printing errors in any advertisement, entry form, or the rules. Any automated or computer-generated entries, fake or duplicate identities, spam, or improper techniques (as determined by Sponsors) will be disqualified. Any questions regarding the validity, completeness, or number of entries submitted by an individual or the identity of the
authorized account holder of an e-mail address, phone number, or social media profile shall be determined by Sponsors in their sole discretion. The Sponsors reserve the right to disqualify any entrant who acts in a disruptive, harassing, vulgar, or unsportsmanlike manner, as determined by the Sponsors in their sole discretion. Entry materials that have been tampered with or altered are void. If the Sponsors determine, in their sole discretion, that there is any suspected or actual tampering with the Contest (electronic or otherwise) or if technical difficulties (e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors) compromise the security, fairness, integrity or administration of the Contest, the Sponsors reserve the right to void the entries at issue and/or modify, suspend, cancel or terminate the Contest and conduct a random drawing to award the prize among all eligible entries received as of the termination date. If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted online at www.wate.com. Sponsors reserve the right to disqualify any entrant that tampers with the operation of the Contest or website or violates the Official Rules of the Contest. Entries not conforming to announced entry specifications will not be acknowledged or returned. By entering this Contest online, participants agree to https://www.wjhl.com’s Terms of Use and the Privacy Policy located at https://www.wjhl.com/privacy-policy. All entry information becomes the property of the Sponsors, and entrants grant the Station the right to distribute all of their entry information to the other Sponsors. By entering, entrants grant the Sponsors the right to broadcast and distribute their name, image, likeness, voice, entry materials, and biographical information in any media whatsoever, including on the air on the Station and on https://www.wjhl.com, for any purpose whatsoever, worldwide, in perpetuity, without any further authorization from or compensation to the entrant. 4. ODDS OF WINNING: The odds of winning depend on the number of eligible entries received. 5. CONTESTANTS, FINALISTS, AND WINNER SELECTION PROCESS: Contestant(s) Performance at Wild Wing Cafe: On Tuesday August 7, 2018, Fifty (50) Contestants will be notified via email and later contacted by phone by WJHL staff. All fifty (50) Contestants will be required to perform their pre-approved song (See NOTICE under ENTRY in these rules) in a capella (no musical accompaniment or recorded track). The fifty (50) Contestants must verify via email or phone the song that will be performed. Contestants must be available to perform in a capella, on live broadcast at Wild Wing Cafe, located at 71 Wilson Avenue, Johnson City, TN 37604 on August 9, 2018 at 9:00 a.m. ET to 1:00 p.m. ET. Each Contestant will be given a time period to perform. The performance must be no more than sixty (60) seconds in length. The fifty (50) Contestants will only be allowed to sing pre-approved songs. No exceptions. Sponsors will be the official timekeeper for the Contest.
Finalist(s) Daytime Tri-Cities Performance: On or about Thursday, August 10, 2018, following the Contestant(s) Performance at Wild Wing Cafe, Sponsor will select eleven (11) Finalists based on the following “Judging Criteria”: vocal performance (50%), stage presence (30%), and overall appeal (20%). The eleven (11) Finalists will be notified via email and later contacted by telephone by WJHL Staff. All eleven (11) finalists will be required to perform live on WJHL-TV’s Daytime Tri-Cities on Monday, August 13, 2018 from 10 a.m ET. to 11 a.m. ET. The eleven (11) Finalists will be required to sing a pre-approved song (See NOTICE under ENTRY in these rules) in a capella and must verify via email or phone the song will be performed live on Daytime Tri-Cities on Monday, August 13, 2018. Finalists will only be allowed to sing pre-approved songs. No exceptions. No two Finalists may perform the same song. Finalists will be required to reply to the email received indicating their first and second song choices, no later than Friday, August 10, 2018. Finalists will be notified via email and/or telephone once permission has been granted for the performance of their song selection. On Monday, August 13, the eleven (11) Finalists will be required to arrive for the Daytime Tri-Cities broadcast at WJHL-TV Studios, located at 338 East Main Street, Johnson City, TN 3760, no later than 9:30 a.m ET and plan to be there until 11:30 a.m. ET. Finalists will perform approved song selection solo in front of a live “Judging Panel”, selected by Sponsor on the WJHL broadcast between 10 a.m. ET and 11:00 a.m. ET. Performance must be a capella (no musical accompaniment or recorded track) and no more than sixty (60) seconds in length. The order in which Finalists perform is totally at the discretion of the WJHL Executive Producer or his designee. The Judging Panel will evaluate and provide feedback to each Finalist as well as a score for his/her performance based on the Judging Criteria: vocal performance (50%), stage presence (30%), and overall appeal (20%). Following all performances, judges will discuss performances privately, ranking each Finalist in the order of judge’s score, the top scoring Finalist will receive the Grand Prize and the next highest scoring winners will receive First Prizes.. Should there be a tie, Daytime Tri-Cities’ Executive Producer or his designee shall make the final determination. Three (3) Grand Prize winners will be announced on Daytime Tri-Cities’ live broadcast on Monday, August 13 between the hours of 10 a.m. ET and 11 a.m. ET. In the event, the Grand prize-winner is deemed ineligible, fails to comply with contest procedures, or is unable to claim prize as specified, the Grand prize will be awarded to the second highest scoring Finalist, assuming timing allows. Final determination of winners is always conditional on verification of eligibility and compliance with all rules and procedures.
6. GRAND PRIZE: Three (3) winners will each receive one (1) “American Idol” Front of Line (“FOL”) Pass to be redeemed for the Chattanooga, TN Bus Auditions on Tuesday, August 28, 2018 at a location to be announced at a later date. Since an “American Idol” Front of Line (“FOL”) Pass cannot be purchased there is no retail value. FOL Pass allows Winner to jump to front of the main audition line to be seen earlier by producers of “American Idol.” FOL Pass does not guarantee an audition before “American Idol” celebrity judges and are strictly at the discretion of “American Idol” Executive Producers. All auditions for “American Idol” are subject to American Idol Audition Terms & Conditions available at AmericanIdol.com. Any Contest prize-winner under the age of 18 years must be accompanied by a parent or legal guardian for all “American Idol” auditions. All prize Winners will need to sign and submit the “American Idol” audition paperwork before they can be seen by Executive Producers of the show. The Sponsors reserve the right to select the panel of judges and the criteria for judging the auditions in its/their sole discretion. All results are unofficial until the winner is/are verified by the Sponsors. Prizes may not be exchanged, substituted, transferred or redeemed for other prizes by winner. Sponsor is not responsible for cancellation or preemption of show and/or audition event or for other circumstances that make it impractical or impossible to fulfill this element of the prize. This element of the prize has no approximate retail value, and if it becomes impractical or impossible to fulfill this element, Sponsor’s only obligation will be to provide the remainder, if any, of the prize. 7 . RELEASES: By participating, entrants agree to be bound by these official rules and the decisions of the Contest Sponsor, which shall be final in all respects. By participating in this Contest and accepting any prize that they may win, entrants agree to release WJHL-TV, Wild Wing Cafe, and Grand Home Furnishings. (collectively, the “Sponsors”). Nexstar Media Group, Inc. and its subsidiaries, the Sponsors, American Idol Productions, FremantleMedia North America, Inc., American Broadcasting Companies, Inc., NEG Operations Inc. and all majority owned subsidiaries (including, but not limited to, 19 Entertainment Limited, 19 Entertainment, Inc., 19 Touring LLC, 19 Recordings Limited and 19 TV Limited), Telescope, Inc. its parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and all majority owned subsidiaries, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereinafter created or conceived, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. Any attempt to deliberately damage any Website or undermine the legitimate operations of this contest may be a violation of criminal and civil laws, and should such an attempt be made, Nexstar Media Group, Inc. and its subsidiaries, reserves the right to seek damages from any person associated with such actions to the fullest extent permitted by law. Sponsor or its designated representative, reserves the right to cancel, modify or suspend the contest if it should become compromised in any way or if it becomes technically corrupted. To claim prize, (a) winner may be required to provide proof of age, identity and residency, (b) winner must sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification, and any other releases requested by Sponsor and/or Program Entities, in addition to any releases for guest/travel companion to sign and return, if any, all within the time period specified by Sponsor. 7. LIMITATION OF LIABILITY: Sponsors disclaim all liabilities to the winner with respect to receipt and use of the prize package. Winners and their guests or travel companions, by acceptance of their prize package, agree to release and hold the Sponsors and their affiliated companies, their advertising, promotion and production agencies, and their respective parent companies, subsidiaries, affiliates, officers, shareholders, directors, employees, agents and representatives harmless from any and all liability, claims, causes of actions, damages, fines, and costs of any kind whatsoever (including reasonable attorney’s fees) which may be sustained directly or indirectly to persons or property in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any Contest- or prize-related activity. 8. RESERVATION OF RIGHTS: Sponsors reserve the right to make changes to these Official Rules in their sole discretion which will become effective upon announcement. Sponsors reserve the right to cancel or terminate this Contest for any reason in the event that it cannot be run or administered as intended by the Sponsors. Any such changes or termination will be announced on http://www.wjhl.com. Any attempt by an entrant or any other individual to deliberately damage or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsors reserve the right to prosecute or seek damages from any such person to the fullest extent permitted by law.
9. MISCELLANEOUS: Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned. 10.
