SECTION 57A AMENDMENT 31 & 33 HOLDEN ST FITZROY NORTH
21 June 2021 Yarra City Council Planning Department PO Box 168 Richmond VIC 3121 RE: PLN20/0682 – 31 Holden Street Fitzroy North – Section 57A Amendment Submission To the Planning Department, Please see attached for the relevant drawings, application forms and title certificates for the proposed works located at the above address in conjunction with the proposed works located at the neighbouring property at 33 Holden St Fitzroy North. The amended proposal includes the following changes: 1) Proposed works at 33 Holden St a) The majority of this scope is to consist of the construction of a timber framed pergola with roof at the rear of the dwelling. The contributary Heritage component of the dwelling to the south of the site will not be affected due to the works being located to the rear of the site. No demolition works will be required. Refer to drawings TP1.01 – TP2.02 b) To ensure that adequate fire ratings are achieved for the pergola, the proposed east boundary wall of 31 Holden st has been realigned to be positioned and shared between the two titles. Refer to drawing TP2.02. An agreement has been reached between the Owners of 31 and 33 Holden st who intend to mutually benefit from the new boundary wall being built and to have their relevant proposals be constructed simultaneously, hence the amended application for a Section 57A.

19 July 2021 Yarra City Council Planning Department PO Box 168 Richmond VIC 3121 RE: PLN20/0682 – 31 Holden Street Fitzroy North – Section 57A Amendment Submission Dear Emily, Please find attached the updated drawings for the above proposal detailing the additional information as requested. We would like to comment on the following items; 2.c. We have assumed that the north facing door you are referring to is part of the proposal at no.31, not 33. Please refer to the note added to drawing TP2.02 3.c. The heights on the north-south section and west elevation differ due to the different NGLs at where the proposal is cut / elevated from. The dimension on TP3.01 and TP5.01 have been updated to more accurately show this. 4. The additional section has been included, confirming that the area between the eastern perimeter of the proposed pergola and the existing laundry roof will be open, with the exception of the minimal amount of timber posts required to support the pergola roof. We would like to address your concern raised about the amount of daylight available to the existing area and state that the removal of the existing laundry eave will have minimal impact due to the height and position of the existing building mass. The removal of this eave will also increase the structural and drainage difficulty of the proposal. 5. Area plans drawn on TP2.08 have been updated to include the POS of 33 Holden st both including and excluding the pergola within the calculations. We have had many councils and surveyors in the past who have included undercover areas within these calculations, and our study of regulation A17 and B28 cannot find any mention stating that a POS cannot be roofed. We would like some clarification on this matter, and have included both for your consideration. 6. Shadow diagrams have been correctly updated. There was a small error on our files that included a neighbours roof as a new item so was incorrectly displaying the shadows; apologies for any confusion. 7. The north-south section has been updated to show the proposed balustrade as a deep bench/ ledge. The purpose of this item to prevent the user from seeing beyond the 1.7m height of the screen as well as act as a safety barrier to prevent falling onto the roof. If this item were either a ledge or solid piece, it would still act and visually perform in the same manner. As we are unsure of the best construction method for it at this time, it is likely that there will be some vertical or block members that will be required to support the frame, however we would like to reiterate that this will have no impact in how it is viewed externally or how it functions.
