38 May 12, 2021 The workshop meeting of the Borough of Riverdale Mayor and Council opened via Video Conference on the above date at 7:30 p.m. with the Pledge of Allegiance. Mayor Carelli presiding. ROLL CALL: Present: Desai, Kheyfets, Oswald, Purcell, Revis Absent: Pellegrini The Municipal Clerk announced that proper notice of this meeting was made as to time, date, place and agenda. APPROVAL OF MINUTES: April 28, 2021 Councilman Desai set forth the motion, seconded by Councilman Revis, to approve the above listed minutes as read. ROLL CALL: Ayes: Desai, Kheyfets, Oswald, Purcell, Revis Nays: None (5 ayes – 0 nays – motion carried) OPEN PUBLIC COMMENTS ON RESOLUTIONS: Mayor Carelli opened the meeting to the public for comments. Councilman Kheyfets commented on the progress of the roadwork project on Parkway.
39 May 12, 2021 COMMITTEE REPORTS (continued): UTILITIES: Councilman Oswald reported on the field bookings and we are still working to get the trail grant. We will be launching the webpage for the 5K race. He will send information for consideration of a tree grant that requires 25% matching funds. The community garden project is moving forward and the scouts will be making presentations for their Eagle Scout and Gold Award projects. COMMUNICATIONS: Councilman Purcell reported on plans for the Memorial Day parade. PUBLIC SAFETY: Police Chief Smith requested we give advance notice of the road closure for the Memorial Day parade. They are working out details to bring back the Junior Police Academy and will call it a Leadership Academy. Councilman Revis reported that the LOSAP program has not had a cost of living increase since 2012. FINANCE: Councilman Desai reported that the sewer project is moving along at a good pace. Linden Street is done and the residents have expressed their appreciation to the Council for working with them. Mayor Carelli discussed several ideas for capital projects and asked the Council for input and also to think about ideas to commemorate the 100 year anniversary in 2023. BOROUGH CLERK REPORT: No report. BOROUGH ATTORNEY REPORT: No report. MAYOR REPORT: Mayor Carelli reported that we will have the budget presentation at our next meeting and it will be the first meeting to be held in the Council chambers. He gave an update on the sewer project. The Memorial Day Parade will be on Monday, May 31st at 10:00 a.m. and it will end with an observance at the Municipal Building. Covid-19 cases are down and hopefully the numbers will remain low. We’re looking forward to bringing back Summer Rec, the concerts, Riverdale Day, and the street fair. There is a parcel of land that a resident wants to donate to the town. Council discussed some possible uses. Mayor Carelli reported that a letter has been drafted to JCP&L regarding possible acquisition of the property at 56 Post Lane. He updated the Council on the status of the unauthorized sewer connection. The Police Committee met with the Labor Attorney and he is handling the two police issues. We will be opening the Community Center to civic organizations only and will not be renting it to the public this year. We are not planning to rent the Glenburn at all this year. OPEN PUBLIC COMMENTS: Mayor Carelli opened the meeting to the public for comments. Keith Brady, 7 Halsey Avenue, stated he is a new resident and asked for information about the sewer expansion project. Mayor Carelli and Councilman Desai responded. There being no further comments, Mayor Carelli closed the public session. ALL IN FAVOR

BOROUGH OF RIVERDALE NEW JERSEY ORDINANCE NO. 04-2021 CALENDAR YEAR 2021 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 1.0% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the governing body of the Borough of Riverdale in the County of Morris finds it advisable and necessary to increase its CY 2021 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the governing body hereby determines that a 2.5% increase in the budget for said year, amounting to $154,309.50 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS, the governing body hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the governing body of the Borough of Riverdale in the County of Morris, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2021 budget year, the final appropriations of the Borough of Riverdale shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $216,033.30, and that the CY 2021 municipal budget for the Borough of Riverdale be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.
