1) Association of Vacation Owners and Helpline
The Association of Vacation Owners (AVO) was founded in 1998 by an individual who had
purchased a timeshare and then found out that there was nowhere to turn for unbiased help
and education. Through the years, the AVO has blossomed into the largest association of
vacation owners in North America.

2) Cooperative Association of Resort Exchangers (C.A.R.E.)
C.A.R.E. (Cooperative Association of Resort Exchangers) is a trade association established in
1985 by representatives of timeshare resorts who found that by exchanging vacation inventory
among themselves, they were better able to satisfy their owners with increased vacation
opportunities. Today, member companies are also able to utilize inventory and generate
revenue through wholesale rentals while continuing to offer expanded exchange and fulfillment
options.
C.A.R.E. is not an exchange company, it does not own or control inventory or guarantee
fulfillment of travel requests, and/or rental or sale of any type of inventory, service or product.
C.A.R.E. provides a networking platform that offers the tools for individual business
enhancement while requiring its Member companies to adhere to its Code of Standards and
Ethics.
C.A.R.E. member companies currently offer 2500 vacation properties and service
approximately one million vacation owners and members. C.A.R.E. is an international
organization, with members throughout the United States, Canada, Mexico, Europe and
Australia.

23) Canadian Vacation Ownership Association (CVOA) CVOA is an industry association that is dedicated to furthering the ownership-based vacation and resort development industry, both at home and abroad. The association was founded in 1980 as “The Resort Timesharing Council of Canada” in response to the public demand for more information about vacation ownership. Since then, CVOA has become the preeminent industry association representing all forms of Vacation Ownership in Canada. The association provides general consumer information on its website as well as a consumer helpline 844-544-CVOA (2862) http://www.canadianvoa.org/consumer_information.shtml 4) Your Homeowners’ Association (HOA) Board Your HOA is there to serve individual owners. The board should be maintaining budget records, minutes of annual meetings, history of annual maintenance fees, current delinquency rates as well as a current listing of legal owners of the resort and information regarding any management company that may have been hired. GOVERNMENT AGENCIES 1) The Federal Trade Commission (FTC) The FTC maintains an excellent site with easy to understand, pertinent information on a variety of timeshare issues. https://www.consumer.ftc.gov/articles/0073-timeshares-and-vacation-plans 2) State Attorney General’s Offices As chief legal officers of the states, commonwealths, and territories of the United States, the Attorneys General serve as counsellors to state government agencies and legislatures, and as representatives of the public interest. The Attorney General is popularly elected in 43 states, as well as in Guam, and is appointed by the governor in five states (Alaska, Hawaii, New Hampshire, New Jersey, and Wyoming) and in the four jurisdictions of American Samoa, the Northern Mariana Islands, Puerto Rico, and the Virgin Islands. In Maine, the Attorney General is selected by secret ballot of the legislature and in Tennessee, by the state Supreme Court. In the District of Columbia, the Mayor appoints the Attorney General whose powers and duties are similar to those of the Attorneys General of the states and jurisdictions. CONSUMER SITES 1) The Better Business Bureau (BBB) The BBB’s mission is to be the leader in advancing marketplace trust. They see trust as a function of both integrity and performance. Not every business is eligible for BBB accreditation and they must be invited to join. Although BBB listing should not be the only consideration you look at, it is a good place to start. http://www.bbb.org 2) ARDA International Foundation (AIF) With a combination of education, research and fundraising, the AIF is the research and education division of ARDA. Their Mission Statement is: "Support, conduct and disseminate research and technical studies that will enhance and improve knowledge for the public and the industry, and develop educational resources that will optimize operations, value, acceptance and service for the industry and the public." Most of the research performed supports the investment in Vacation Ownership on a development level as well as its economic impact on our communities. http://www.arda.org/foundation 3) Consumer Affairs USA ConsumerAffairsUSA.org is a comprehensive resource for consumer-related facts and other information, with links to official, not-for-profit consumer protection websites, including those offered by national and state governments. The magazine, published six times annually, contains articles about resort destinations, tips on exchanging, what to watch for in buying or selling, straight-forward resort reviews by owners while on an exchange, and much more. 2) Inside The Gate A daily online privately owned news and information service dedicated to freely and openly sharing news, information, stories, opinions, insights, tips, etc. that affect the marketing, sales and ownership aspects of the worldwide shared ownership industry. http://www/insidethegate.com 3) International Timeshare Appreciation Day Each November 1st is dedicated to the celebration of all that is good about timeshare. They pride themselves on low fees, a simple approach to timeshare exchange, and legendary personal service. Timeshare owners are able to search, hold, book and confirm instantly, with a minimum of exchange rules. Membership is free and transaction fees are not charged until your exchange is confirmed. They will accept usage from members without requiring them to choose a specific resort. DEFINITIONS
Alternate Year (EOY or Biennial) -- A purchase or membership option whereby the owner or member has use of the purchase every other year. Typically, these products are at a lower cost and are used as an "entry level" or "starter" program. They may be upgraded to an annual product if the seller allows. Always inquire what the fee will be to upgrade. Banking -- If an owner does not use a week in a particular year they are generally allowed to save it for use the following year. Be sure to find out how long weeks are bankable. Most are only good or savable for two (2) years. Closing Costs -- Costs associated with the closing of a sale process, usually including: deed preparation or transfer of equity for right-to-use properties; recording costs; escrow fee; and administrative fees. When buying from the developer, often these costs are negotiable. When buying on the secondary market, often the seller is responsible for these costs. Cooling-Off Period (Rescission Period) -- The time given to a purchaser following signing of a timeshare purchase agreement, during which they may cancel without penalty and receive a full refund of all monies paid. Each state has its own legal cooling off period. Generally, these cooling-off periods are applicable only for purchases on the primary market. Deed -- A legal document providing title to your timeshare property, which gives you your ownership rights. Deeded Property -- True property ownership with deed recorded in the county where the property exists. This type of property has the same rights of ownership accorded to it as other deeded real estate. The owner may sell, rent, will, or give away the property. Estoppel Letter – A letter from the resort outlining the status of the timeshare. It generally explains any maintenance fees that are pending as well as outlining the rules and regulations on how the timeshare may be used. Exchange -- The ability of the owner or member to use their product at another place and/or at another time. Typically, there is a fee accessed each time an exchange takes place. Exchange Company -- The company that facilitates the owners’ ability to trade or exchange for usage at another property. Resorts are generally affiliated with either RCI or Interval International, but the owner is generally not limited to just those two. Exchange Fee (Usage Fee/Transaction Fee) -- The fee that the exchange company will charge the owner or member to exchange or trade their week/unit for another week/unit to another time and/or place. Fee Simple -- This type of interval ownership is the opposite of right to use or lease ownership and continues forever. The timeshare owner holds a deed in his/her name and the ownership of the property can be bequeathed to heirs. Fixed Week -- A type of ownership where the owner has access to their unit for a specific week of the year. Floating Week -- A type of ownership where the owner has access to their unit for a week of the year, but needs to reserve a specific time each year.
Fractional -- A type of ownership where the owner has access to more than one or two weeks a year. Typically, fractionals are periods of three (3) months. General Warranty Deed -- "The Highest Level of Conveyance" at common law pursuant to which the grantor warrants the title against all persons from inception of the interest. Leasehold -- A contract in which all or a portion of the real estate is subject to the lease, the expiration or end of which will terminate the use. This is not the same as a deed, which is in effect until sold. Most timeshares sold in Mexico and Hawaii are leaseholds, not deeded. Lockout/Lock-Off Unit -- A timeshare unit that can be divided into two (or more) independent sections, each with their own sleeping (and sometimes living) areas. Oftentimes, lockouts can be used as two separate weeks. Maintenance Fees -- The amount of money that the owner will be charged every year (or every other year) to maintain the property. These fees are set by the resort’s Home Owners Association or assigned management company. Points -- Generally, a more flexible type of ownership or membership where the owner or member purchases an allotment of points to be spent to obtain timeshare accommodations, hotel lodging or other benefits such as airline tickets, car rentals, etc. Note that there is no parity between different companies’ points. Points can be backed with real estate or a “pure points” type. . Primary Market -- Refers to timeshare that is purchased by the consumer directly from the developer, generally at a timeshare sales presentation. Public Offering Statement (POS) -- The required legal document that sets forth: owner rights; the resort’s management company; who the developer is; how the timeshare is to be sold; the resort’s budget (including individual owners’ maintenance fees, real estate taxes and special assessments); the legal description of the resort and the individual units; the timeline of construction to completion of the resort; current prices; types of intervals offered; the maximum number of timeshare units that the property will consist of; and any other information that has been deemed pertinent. POS laws vary from state to state, but all states require that purchasers receive a copy of the POS. Right-to-Use -- A license or contractual membership right of occupancy in a timeshare or other common interest subdivision that is not coupled with an estate in real property. This is not the same as a deed, which in most cases is in effect until sold. Season -- The time of year that the owner has a right to use their week. Seasons often determine the price of the unit and the availability or flexibility in trading or exchanging the unit. Seasons generally reflect the demand at that resort. Secondary Market -- Refers to timeshare that is purchased by the consumer either directly from another consumer or from a broker or listing service. Special Assessments -- The amount of money that the owner will be charged to cover items that are not covered by regular maintenance fees. Typically, resorts with ownership or membership on golf courses and waterfronts assess special assessments. Be certain to ask
about the history of assessment fees at your property, and if you have a vote in the issuance of these assessments. Special Warranty Deed -- Includes a warranty of title and an agreement to defend claims against tile arising during the company's ownership of the property. Owner is protected by title insurance from inception. Taxes -- The amount of money that the owner will be charged every year to pay for property taxes. Title Insurance – The insurance policy ensuring that the seller is the true owner of the property and retains all rights to sell it. Title insurance is generally not offered for primary market purchasers, but is recommended for secondary market purchases. Trading Power -- Refers to the ability of the owner to trade or exchange within an exchange company. Each exchange company values timeshare units differently, but both RCI and Interval International operate on a like-for-like basis, meaning that the owner of a 1-bedroom unit in Alabama in February has less power than the owner of a 2-bedroom unit on Oahu in December. Unit -- The specific room in a specific building (e.g. Unit 105 Building 3, which is a one-bedroom unit that sleeps four (4) people) that you purchase which will be recorded on your deed. Although you may have purchased a "floating" unit, there must be an actual unit assigned to your purchase to prevent overselling. Week -- The week or weeks that you purchase which will be recorded on your deed.
