2021
Dear client, You are about to fill in this reservation agreement and we thank you for this. To
avoid ambiguity and ensure that your holidays take place in the best conditions, we have taken
special care in preparing this document. We recommand that you read all the paragraphs
conscientiously before sending it back to us with your deposit payment. We thank you for choosing
the Domaine du Koukano and be sure we remain fully available for more informations. Please feel
free to contact us. We are looking forward to seeing you soon at the Domaine du Koukano.
The Kouka'team.CONDITIONS GENERALES DE VENTE
1 – Purpose
The terms and conditions aim to define the conditions under wich :

Will offer its individual clients the services available on his websites and his brochures and in
its mobile applications as the case may be. The main service offered under the agreement
concluded by the client consists of the renting of accomodation (defined below) on a
campsite pitches in France.
2 – Agreement
By booking accomodation (pitch or mobile home or tent or chalet) the Client acknowledges having read and
accepted these Terms and Conditions. Acceptance of the terms and conditions can only be full and unconditional.
Conditional acceptance shall be considered null and void. Conditional acceptance shall be considered null and void.
These Terms and conditions are up to date on the day of online publication and cancel and replace any previous version.
3 – Booking prices
All prices are given in euros, including VAT and excluding management fees, visitor taxes, environmental
charges and local taxes.
Our prices include the following :
- Use of the Accommodation, fully equipped as described on the Websites and in the brochures.
- One vehicle parking space for each accommodation (unless otherwise specified on the website or on the booking
voucher).
- Water, gas and electricity ;
- Client reception ;
- All facilities and services, except for any that may be fee-paying or optional.
Our prices do not include the following :
- Sheet rental ;
- Cancellation insurance ;
- A €25 management fee for all bookings made via our Websites or by phone .
- Cleaning ;
- Fee paying activities provided on the campsite (payable on the domaine du Koukano) ;
- Taxes and charges (including visitor charge(environmental tax/tourist tax/local taxes according to the campsite) ;
- A 300 € deposit .
- Any additional services (sheets, babies bed...)
- Visitors : campsites may levy a visitor charge for daytime visitors; they will be allowed to park their car on the parking
place but authorised to enter in the aquatic park only in certains conditions ;
- Price validity : all the prices listed are guaranteed until the end of the season. The applicable price is the price in force
on the day the booking is made, subject to availability. Estimates requested by the client always bear a validity date. The
price indicated in the estimate is only guaranteed until the validity date.
- Subject to article L.211-17-2 of the Tourism Code, in the event of a manifest error regarding the price displayed, for
instance if the price is derisory compared to the average prices for the same booking at the same period in time, the
Client shall be informed that the booking agreement is deemed to be null and void and that he or she shall receive a
refund of the deposit or the full price paid, as the case may be, without compensation.- Retroactive effect : Special offers and bargain offers made available by the Company after the booking date will not be applicable with retroactive effect. 4 – During the stay Rentals start at 2 :00pm (14 :00) on our campsite pitches (except those with private bathroom facilities). Pitches must be vacated before 12 :00 on the last day. For rented accommodation and campsite pitches with private bathrooms, check-in begins at 4 :00 (16 :00). These types of accommodation and pitches must be vacated before 10 :00(10 :00) on the last day. No refunds, including part refunds, will be made by the Domaine de Koukano if the Client arrives outside the authorised check-in times, after the booking date or leaves before the end date. Any Client who fails to check in by the day fllowing the expected date of arrival, without having notifieds the Domaine du Koukano’s representative, is liable to find their booking cancelled. The Domaine du Koukano may put the Accommodation back on the market withing 48 hours without any recourse from the Client. Except for campsite pitches, it is pu to the Client to conduct an inventory of the Accommodation (equipment, state of the equipement and cleanliness) within 24 hours of arrival. Similary the Domaine du Koukano’s representative must be notified of any problems arising during the Client’s stay, so that the representative can try to solve the problem. The Client undertakes to comply with and have others comply with the Campsite and swimming pool house rules applicable on the Campsite where the Accommodation is located. Clients are hereby informed that : - For hygiène reason, only guests wearing a proper swimming costume (swimming trunks or one or two-piece swimming costume) will be allowed access to the swimming pool : thongs, Bermuda shorts, shorts and T-shirt, wetsuits, burkini swimming costumes and long and/or swimming clothes are not allowed in the pool ; - Any swimming wear that is considered indecent will also be banned. Pool supervisors or representative have the right to expel anyone in breach of the rules. The use of electric barbecues and plancha griddeles as weel is forbidden. Gas-fired barbecues and plancha griddles are authorised. Should a Client and/or the accupants of a given Accommodation fail to comply with the rulesapplicable at the Campsite or the swimming pool, with these Termes and Conditions and/or behave in a way that disturbs the peace and quiet of the Campsite, the Domaine du Koukano may, after formal notice has gone unheeded or the spot in the cas of serious breaches of the rules, request that the person or persons responsible leave the Campsite before the end of their stay. Clients requested to leave before the end of their stay shall be entiled to no refund or part refund. Group booking guest must individualy comply with campsite house rules. Tents may not be installed on a mobile home, chalet or tent lodge pitch. Pets Dogs (excluding dangerous dos under French legislation – category 1 and 2) and cats must be check before booking. No dog must be left alone in the Accommodation. One single dog or cat is authorised in each Accommodation. All other pets are forbidden. Authorised animals must be tattooed or chipped. Clients must bring with them an up-to-date pet passeport. Dogs are under their owners’responsability and must be kept on a lead. They must never be left on their own on the Campsite whether in the Accomodation on the pitchor in a vehicle. 5 – Visitor tax The visitor tax is levied on behalf of the local authority (commune) ; an additional tax may be levied on behalf of the departement (country or district authority). An environmental charge or local tax may be levied. 6- Deposit The Client will be required to pay a deposit when receiving the keys to the Accommodation. The Client is responsible for checking that the Accommodation is in order and for notifying any problems on the day of arrival. Any complaints regarding the overall condition, the inventory or the state of cleanliness of the Accommodation must be notified to the lessor within 24 hours of arrival, so a solution can be found. No complaints may be entered beyond the 24-hour deadline. The deposit will be returned to the Client after the condition of the rented Accommodation, the inventory and the state of cleanliness has been inspected by the lessor. If the Client leaves ouside scheduled invoentory hours, the deposit will be « destroyed » and the Client will be informed by e-mail. - Rented accommodation must be left in perfect condition, tidy and with the inventory checked. The Client will be responsaible for all broken, damaged or missing item items and any refurbishment will be charged to the Client, as the case may be. - The Client is responsible for leaving the accommodation clean and tidy at the end of the stay.
- Even if the Client has chosen the « end of rental celaning » option (including a fee), the Accommodation must be left clean and tidy, including the kitchen and fridge, with dishes washed and bins emptied. If this is not the case, the Lessor reserves the right to charge an additional cleaning fee, which can be as much as the total cleaning charge for the rented accommodation. - If the Client has not chosen the « end of rental cleaning » option, the Accommodation must be left entirely cleaned and tidy, ready for the next Client. If the Client has not properly cleaned the Accommodation before leaving, the lessor reserves the right to charge the set cleaning fee, increased by €35 for rental property and €20 when equipped with private bathrooms. 7- Cooling-off period - Persuant to article L.221-28.12 of the Consumer Code, the Company informs the Client that the sale of accommodation services for a given date or according to a given period, is not subject to the 14-day cooling-off period. - Conversely Act 2014-344 of 17 march 2014 on consumer affairs entitles the Client to cancel insurance policies within 14 days of the subscription date, only if the insurance subscribed covers a risk for which the Client is already insured and can provide proof of such prior coverage. However, cancellation is only possible if no claim has been entered by the date on which cancellation has been requested. 8 – Liability Company Liability : outdoor leisure accommodation doen not come under hotel management liability as specified under article 1952 of the Civil Code. The Domaine du Koukano shall not therefore be considered liable in the event of losses,theft or damage to personal belongings on the campsite, car park or shared facilities (toiletsand showers...). All the information displayed on our website or brochure is accurate at the time of booking. It may however be modified from time to time. Clients are responsabilefor checking the said information before their arrival at the campsite. Any photos illustrating our Accommodation on the website and in the brochure are provided for information purposes only. The Domaine du Koukano shall not be held liable under criminal or civil law for any consequences resulting from an inappropriate or unauthorised use of the websites orof their content by end-users or by other third parties. No shall the Domaine du Koukano be held liable for its failure to perform or insufficient performance of the agreement, if this is due to a fault on the client’s part, to force majeure or to the unforeseen and unavoidable actions of a third party not involved in the delivery of the services hereunder. 9-Changes - Requested by the client : the client may request a change of booking (date and/or type of accommodation) subject to availability. Bookings cannot be carried forward to the following season. If the price of the new booking is higher, the difference will be due by the client. If the price of the new booking is less than the original booking, the difference will be paid back to the Client. The Client is hereby reminded that in the event of a booking change, any bargain offers that may have been made after his/her original booking will not be applicable to the new booking. The date of the original booking will serve as the reference date. If the Domain du Koukano is unable to satisfy the client’s request for a booking change, the original booking will apply, unless the client decides to cancel. - Requested by the Domaine du Koukano : the company may need to change thebooking before the starting date. In that event, the company will notify the client of any changes in writing, as promptly and as cearly as possible. Any effet on the price of the booking shall be specified when notifying the changes. The client must informe the Domaine du Koukano of his/her response to the new proposal within the timeline specified. o The client may cancel the booking. In that case the Domaine du Koukano will reimburse any payments that the client may have already made (including any booking management fees and insurance as the case may be) ; o The client accept the modified booking. If the change results in a reduction or increase in the price of the booking, the company will either refund the difference (if the price is lower) or meet the extra cost (if the price is higher) - If the Client fails to respond withing the timeline specified, the company will automatically cancel the booking. 10- Cancellation
Due to the client : if the booking is cancelled by the client - More than 12 weeks prior to the stard of the stay, the company undertakes to reimburse any sums already paid, minus a set management fee of €50. - Between 12 weeks and 9 weeks prior to the start of the stay, the company undertakes to reimburse 50 % (fifty per cent) of the booking price. The booking management fee included. - Less than 9 weeks prior to start of the stay, the company reserves the right to retain all the sums already paid, management fee included. - If the client as not paid the full booking amount less that 4 weekds prior to the start of the stay, the company will consider that the booking has been cancelled by the client and reserves the right to retain any sums already paid, management fee included. Due to the company : the company may concel the booking for whatever reason before thestart of the stay. In this case, all the sums already paid by the client will be refunded plus compensation equal to the penalty payment that the client would have had to pay if the cancellation had been due to the client at the same date (see above). Exceptional circumstances : if the booking is cancelled by the domaine du koukano or by the client prior to the stard of the stay due to exceptional circumstances beyond the company’s or the client’s control either on a near the point of destination and having a significant effect on the performance of the agreement, the full booking price will be reimbursed but no addional compensation will be duy by the Domaine du Koukano. Assignment The client may ofr a reasonable price ask the company for permission to assign his/her booking to another person who meets all the conditions required for the said booking. The client and his/her assignee shall be jointly liable for the payment of the balance of any sums due, plus any charges , fees or other additional costs that may be incurred due to the assigment. 11 – Cancellation insurance A cancellation or interruption insurance is proposed to the Client. The client is free to subscribe to this insurance coverage with the Gritchen affinity insurance company. The insurance premium must be fully paid up on booking the stay and is not refundable unless the client avails himself/herself of the privisions applicable to insurance policy subscription colling-off periods. The client must notify the company of any claims submitted, within 5 days of submitting the claim. The full insurance terms and conditions are available on request an accessible on line on https://www.campez-couvert.com 12 – Complaints Complaints should as far as possible be addressed directly by the client to the campsite director so that the latter can solve the problem or register the complain. 13 – Company details All booking payments must be sent to the following address : Domaine du Koukano – Lieu dit Combe Ramond 81470 MAURENS SCOPONT 14- Personal data Persuant to the Law on Data Processing and Civil Liberties N°78-17 dated 6 January 1978, as amended, and to the Gernal Regulation on Data Protection 2016/679, the Client is hereby informed that any personal data flagged as mandatory under the booking procedure as required for the performance of the accommodation agreement. Personal Client data are processed by the Company to create and manage the client account, manage the booking (payment, client reception), customise bargain offers, measure stisfaction and for marketing purposes (client profiling, tailored advertising, etc). For further information on the way we process your personal data, please send us an e-mail : contact@koukano.fr 15-General clauses Should one of the clauses hereunder become null and void due to changes in the lax, regularoty changes or by court ruling, this shall not in any way affect the validity and binding nature of these Terms and Conditions. The client must take out third party insurance coverage with the insurer of his/her choice. The client is hereby notified that hi/she may apply for extended insurance coverage for his/her campsite
accommodation, depending on his/her insurance company. The client is hereby notified and agrees that any of his/her comments regarding the holiday stay may be used on promotional material. In that case, the wording of the comments may be modified to increase readability. The Client’s positive or negative opinion will, however, remain unchanged. These Terms and conditions are governed by French Law. Any dispute arising between the Parties regarding the interpretation or performance of these Terms and Conditions which cannot be resolved by an amicable agreement, shall be subject to the relevant Court with jurisdiction for the matter, unless expressly required for public order reasons, notwithstanding multiple defendants or third party claims, even in the cas of summary proceedings.
