Section 1: Introduction 1.1. This Consultation Statement has been prepared to fulfil the legal obligations of the Neighbourhood Planning (General) Regulations 2012. (see Section 3 for specifics) 1.1.1 Part 5, Section 15 (2) of the Regulations defines a ‘Consultation Statement’ as a document which: a) contains details of the persons and bodies who were consulted about the proposed neighbourhood development plan; b) explains how they were consulted; c) summarise the main issues and concerns raised by the persons consulted; and d) describes how these issues and concerns have been considered and, where relevant, addressed in the proposed neighbourhood development plan; 1.1.1. The Overstone Neighbourhood Development Plan (ONDP) has been prepared in response to the Localism Act 2011 which gives Parish Councils and other relevant bodies powers to prepare statutory neighbourhood plans (NDPs) to help guide developments in their local areas. Through the preparation of the Neighbourhood Plan, local people can shape, direct and help to deliver sustainable development, by influencing local planning decisions as part of the statutory development plan. 1.2. : History of the ONDP (part 1) 1.2.1. In March 2014 Overstone Parish Council resolved to undertake the formation of an NDP for Overstone. A working group of four councilors was formed to oversee the devising of the document together with Sally Stroman from Wilbraham Associates who advised on Policy writing. 1.2.2. A Neighbourhood Area was approved by Daventry District Council (DDC) in Sept embe r 2014 and draft ve rs ions of t he ND P up t o and including Ve rs ion 5 we re dev ise d as of Novembe r 2016. 1.2.3. In July 2017, Overstone Parish Council ( O P C ) r e - applied to DDC for designation of the greater majority of the Parish as a Neighbourhood Planning Area, to include land to the west side of the A43. On 12th October 2017, Daventry District Council approved the Neighbourhood Area for Overstone. 1.3. : History of the ONDP (part 2) 1.3.1. Due to personnel changes within Overstone Parish Council, the NDP process was left on hold, until in July 2019 the Parish Council resolved to restart proceedings. 1.3.2. After a local publicity campaign (see Appendix 1) the Overstone Neighbourhood Plan Steering Group (ONPSG) was formed. The Steering Group comprised of nine members including three Parish Councilors’ and six interested local residents, to drive forward 3
the preparation of the Plan and to lead on the public engagement and consultation process. 1.3.3. In July 2020, OPC re-applied to DDC to include the whole of Overstone Parish within the Neighbourhood area. On 31st July 2020, Daventry District Council approved the Neighbourhood Plan Area for Overstone. 1.3.4. See Appendix 12 for the full timeline. 4
Section 2: Community Consultation Statement 2.1. : Aims of the Consultation Process 2.1.1. The aims of the Overstone Neighbourhood Development Plan consultation process were: a) To involve as much of the community as possible throughout all consultation stages of Plan development so that the Plan was informed by the views of local people and other stakeholders. b) To ensure that consultation events took place at critical points in the process where decisions needed to be taken. c) To engage with as wide a range of people as possible, using a variety of approaches and communication and consultation techniques; and d) To ensure that results of consultation were fed back to local people and available to read (in both hard copy and via the Parish Council website) as soon as possible after consultation events. 2.2. : Consultation Strategy and Publicity Process 2.2.1. The ONDPSG has used the following to publicise the Neighbourhood Development Plan during the various stages of the Plan’s preparation. a) A Neighbourhood Plan page was included on the Overstone Parish website https://www.overstone-pc.gov.uk/neighbourhood-development-plan.html b) Leaflet drops used to publicise surveys, exhibitions and consultations were made to each household and business in the Parish. c) Posters, providing links to https://www.overstone-pc.gov.uk/neighbourhood- development-plan.html were used to publicise surveys, exhibitions and consultations. d) The Neighbourhood Plan was included as a regular item on Parish Council Meeting Agendas. Parish Councillors on the Steering Group provided updates and these were summarised in meeting minutes. There have been a number of surveys and consultations as follows: a) The first key task undertaken by the Steering Group was to draw up a 5
Neighbourhood Plan questionnaire (see Appendix 11), to gather the views of all Parish residents and local businesses. i. The survey was publicised by a leaflet drop (250 in total) and posters prominently displayed around the Parish (see Appendix 1). ii. The survey was available for completion in both hard copy form and online. b) The results of the Neighbourhood Plan Questionnaire are contained in the Overstone NDP Public Consultation Questionnaire Results document (see Evidence Base). This includes a detailed analysis of the survey, using charts and tables as appropriate. i. This detailed consultation provided the depth required for the ‘Local Evidence’ sections of the Policies contained in the Plan. ii. 90 responses were received c) In September 2019, the Steering Group organised an ‘open day’ at Overstone Village Hall to gather residents’ views on the village, its future development and the need for a neighbourhood plan. The event was publicised by leaflets delivered to every household (250 in total), (see Appendix 1) and posters prominently displayed around the Parish. Feedback forms were made available for completion by attendees. See Appendix 3 for an example. See Appendix 2 for copies of the display boards available for viewing at the time. i. The responses obtained during the ‘open day’ were very general but gave a good indication of villagers’ opinions and confirmed the need to continue developing the Plan. ii. 60 people attended on the day. d) An informal meeting with representatives of local businesses and Landowners was undertaken in August of 2019. e) The Parish Council carried out a consultation event with the pupils of Overstone Primary School which took the form of a competition. Children were asked to write about what they liked about the village and design the front cover of the Neighbourhood Plan. f) In February 2020 leaflets (250 in total), (see Appendix 4) were distributed and Posters displayed throughout the village to update local residents on progress to date and to invite any final comments/ideas to be included in the plan prior to the ‘Formal Public Consultation’ period. A comments form was included (see Appendix 5) for completion as appropriate. g) A ‘Formal Public Consultation’ (Regulation 14) was planned for March 2020, however due to the Coronavirus pandemic it was advised by DDC to postpone until safe to do so. 6
h) Due to the re-designation of the ‘Neighbourhood Plan Area’ it was decided to commence with a second informal 4 week consultation period, starting 16th August 2020. The event was publicised by leaflets delivered to every household (300 in total) (see Appendix 5) and posters prominently displayed around the Parish. Comment forms were made available for completion by interested parties (see Appendix 6). 7
Section 3: Formal Public Consultation Statement (Regulation 14) 3.1. The intention of this phase was to circulate a readable presentation of the draft plan to all households/businesses/consultees so that the concerns and priorities identified to date could be read within the context of a proposed set of formal planning policies. 3.2. Neighbourhood Plan regulations require that a statutory consultation period of 6 weeks is undertaken by the qualifying body (the Parish Council) on the final draft plan prior to its submission to the Local Planning Authority in advance of their statutory Regulation 16 consultation. 3.2.1. The Regulation 14 consultation is specific about organisations and stakeholders that should be consulted. The legislation requires that prior to submitting the Plan to the local planning authority the qualifying body (the Parish Council) must: a) publicise it in a manner that is likely to bring it to the attention of people who live, work or carry on business in the neighbourhood area including: o details of where/when documents can be inspected o the availability of Online and hard copies of documents o how to comment and make representation as required b) consult any consultation body referred to in paragraph 1 of Schedule 1 whose interests the qualifying body considers may be affected by the proposals for a neighbourhood development plan. c) send a copy of the proposals for a neighbourhood development plan to the local planning authority. 3.2.2. Prior to the Overstone Neighbourhood Development Planning Committee meeting held on 30th September 2020, residents were advised that the Neighbourhood Plan was to be discussed at this meeting and publicity of this meeting was made by a number of methods including the Overstone Village Noticeboard, and website. 3.2.3. The Pre-submission Draft was tabled for discussion at this meeting and the committee resolved that the plan be agreed for the Pre-submission Consultation. 3.2.4. The Pre-Submission Consultation period ran for 6 weeks from the 19th October 2020 to the 1st December 2020, as required by the Neighbourhood Planning (General) Regulations. 3.2.5. All residents and businesses within the parish were consulted together with a range of statutory bodies and consultees (see Appendix 10 for list). A copy of the plan was also sent to the Local Planning Authority, Daventry District Council. 8
3.2.6. Posters advertising the Pre-submission Consultation were displayed in areas of the village with a high footfall and the Parish Council Noticeboards. Detailed information was also posted on the Parish Council Website and Facebook page. In addition, letters were hand delivered to every household and business in the Parish (300 in total). 3.2.7. Due to the Coronavirus pandemic and the Government’s restrictions on social distancing and related matters, an anticipated Open Day in the Village Hall to publicise and view the pre-submission draft was prevented from going ahead. However, in accordance with updated Planning Practice Guidance in relation to Covid-19 (as issued by the Government on 13th May 2020) a hard copy of the plan was made available upon request by contacting Steve Betts on 07973 228516 or by emailing overstonendp@gmail.com 3.2.8. A comments form (see Appendix 8) were made available to download and print or to complete online and hard copies were available on request. Response forms had to be returned by December 1st 2020: to Steve Betts, by emailing them to overstonendp@gmail.com , by hand or post to Steve Betts at 45 Sywell Road, Overstone, Northampton NN6 0AG or completed online at https://form.jotform.com/200744381235349 3.2.9. All responses received during the Regulation 14 six-week consultation period were recorded (83 in total), (see Appendix 12), along with references to what responses and amendments were prompted to the final Plan document. 3.2.10. A meeting of the Parish Council on the 12th January 2021 endorsed all comments and responses made as a result of the consultation period and approved the NDP for submission to DDC as per Regulation(s) 15/16. 9
Section 4: Conclusion 4.1. This Consultation Statement demonstrates that the Overstone Neighbourhood Plan Steering Group (acting on behalf of Overstone Parish Council) has prepared the Neighbourhood Plan in accordance with the legal obligations as set out in the Neighbourhood Planning Regulations 2012, Regulation 14. 4.2. All statutory requirements have been met and a significant level of additional consultation, engagement and research has been carried out. The Neighbourhood Plan Steering Group has made genuine and committed efforts to engage all those who live, work or have a business interest in the Neighbourhood Area and provided them with every opportunity to influence the content of the Overstone Neighbourhood Plan throughout its preparation. 4.3. This Consultation Statement and supporting appendices have been produced to document the consultation and engagement process undertaken and are considered to comply with Part 5, Section 15 of the Neighbourhood Planning Regulations 2012. 1 0

Appendix 12 - Timeline March 2014 The Chair reported back on a meeting held with Richard Wood, Planning Policy Manager and Tom James, Senior Policy Officer (Planning) DDC. It was agreed that a Neighbourhood Development Plan (NDP) would be the best way forward for Overstone. It was resolved for the Clerk to progress this and formally instruct Sally Stromans from Wilbraham Associates to undertake the policy writing of the document. It was resolved for Cllr J Cork to head the work on the NDP, with Cllr’s Delany and Owen assisting. Clerk to organise a meeting with NDP working group in the next month to detail procedure. May 2014 Progress Report on Neighbourhood Development Plan The application was submitted to DDC and the six-week consultation period began on 15th April. June 2014 The following working group was appointed o Neighbourhood Development Plan Working Group – Cllr J Cork, Cllr Delany, Cllr K Cork, Cllr Owen July 2014 Cllr Oliver, Cllr Sharp, Cllr J Cork, Cllr K Cork and the Clerk have met to progress the NDP. The six- week consultation period has now ended and the NDP area designation should be approved at the DDC Strategy Group meeting in September. Work was undertaken on the vision statement and photographs taken to illustrate the NDP. September 2014 The Overstone Parish Neighbourhood Area application was on the agenda of the DDC Strategy Group Meeting on Thursday 4th September and was recommended for Approval. November 2014 Cllr J Cork has met with Cllrs Oliver and Sharp and the group will use the Moulton NDP as a template. April 2015 Cllr J Cork spoke on behalf of the NDP subcommittee and explained that they were using the Moulton NDP as a template and working through the information to make it relevant to Overstone. September 2015 The first draft of the NDP had been handed to the Clerk for formatting into a document. Steering Group meetings and Public Exhibitions were to be held to discuss progress. November 2016 NDP version 4 was presented to the Parish Council. This was revised and Version 5 was produced. October 2017 The revised ‘Designated Area’ was approved. The original ‘Designated Area’ did not include the Parish area that is to the West of the A43. July 2019 Cllrs met with Officers Tom James (DDC) and Jane Parry (DDC) to review the NDP Version 5. September 2019 Overstone Parish Council ratified the Steering Group’s Terms of Reference. An informal consultation public meeting was held at Overstone Village Hall on the 14th September 2019 to enable residents, land owners and business people to express their views with regards the NDP. A meeting of the ONDP Steering Group was convened September 12th Cllrs met with Sally Stroman, Planning Consultant to discuss the progress of the Draft Neighbourhood Development Plan and how she could help to take it forward. The results from the informal consultation questionnaire were presented to the Parish Council. This is totally contrary to the purposes of preparing a Neighbourhood Development Plan, which should consider matters in more detail to the strategic policies and not seek to restrict or stifle development. The National Planning Practice Guidance states the following: “Decisions on planning applications will be made using both the local plan and the neighbourhood plan, and any other material considerations. Neighbourhood planning provides the opportunity for communities to set out a positive vision for how they want their community to develop over the next 10, 15, 20 years in ways that meet identified local need and make sense for local people. They can put in place planning policies that will help deliver that vision or grant planning permission for the development they want to see”. My client is of the view that Policy 6 of the NDP fails to set out a “positive vision”. This view is further emphasised by emerging Policy 3 of the NDP relating to the provision of community infrastructure. My client supports this policy and is in
agreement that new village facilities are needed and to be enhanced. The supporting text to the policy states that there is a need provide and enhance new recreational facility, playing fields and a village hall. Policy 3 states that new developments will be expected to contribute towards such facilities. However, with the NDP defining the village confines so tightly and stifling development, it is unclear how these facilities will be funded when there will be no or limited contributions via CIL or Section 106 agreements. If the village require such facilities, they need to take a drastically more positive approach to new development which may include development beyond their proposed village confines that could fund the facilities the village so obviously need.
