About Moot Shanghai Moot Shanghai is one of the official pre-moots of the Willem C. Vis Interna�onal Commercial Arbitra�on Moot (“Vis Moot”). It is also the only moot in China (except for Hong Kong SAR) that invites interna�onal par�ci- pants. The 11th annual will be held March 8-12 virtually. Over 400 students from 60 leading educa�on ins�tu- �ons in 22 jurisdic�ons are registered to this year’s compe��on. The compe��on is organized by East China University of Poli�cal Science and Law and Shanghai University of Poli�cal Science and Law, and it is co-organized by Shanghai Interna�onal Arbitra�on Center and The Interna- �onal Chamber of Commerce Court of Arbitra�on. The compe��on is supported by UNCITRAL Regional Center of Asia and Pacific, Shanghai Bar Associa�on, Hong Kong Interna�onal Arbitra�on Centre, China Academy of Arbitra�on Law, Singapore Interna�onal Arbitra�on Centre, Korean Commercial Arbitra�on Board, and China Legal Educa�on and Career Seminar Series. Moot Shanghai 2021 is sponsored by Dahui Lawyers and T&C Law Firm. It is hosted by Adaltys, Hui Ye Law Firm, Dentons, Fangda Partners, King&Wood Mallesons, Junhe LLP, Jin Mao Law Firm, Tiantong Law Firm, YuandaWinston, and Zhong Lun Law Firm, who will host the general rounds. The Compe��on Due to the con�nued impact of the COVID-19 on par�cipa�ng teams from different countries, this year’s Moot Shanghai will be held in hybrid mode. Moot Shanghai 2021 will use the case materials of the 28th annual Vis Moot. Teams will take on the roles as counsels for Claimant and Respondent to an interna�onal commercial arbitra�on. They will submit on a dispute arising from an interna�onal sale of goods transac�on under the framework of the United Na�ons Conven�on on Contracts for the Interna�onal Sale of Goods (“CISG”) and the Swiss Rules of Interna�onal Arbitra�on. This year’s case is based on a purchase and license agreement, and focuses on the development and sale of COVID-19 vaccines. It also involves the heated topics of virtual hear- ing and IP warran�es in the context of the global epidemic. The moot examines prac�cal skills in dispute resolu�on. It simulates and tests all segments of an interna�onal arbitra�on advocacy, including procedural challenges and substan�ve arguments. Tribunals of three arbitra- tors, composed of a�orneys, arbitrators, or business professionals, will hear the moot and evaluate the teams’ legal knowledge, advocacy skill, improvisa�on, and teamwork. The compe��on consists of a general round and an elimina�on round. The top 16 teams of the general round will advance into the elimina�on rounds.
East China University of Poli�cal Science and Law Founded on the site of the former St. John’s University in 1952, the East China University of Poli�cal Science and Law (ECUPL, formerly known as the East China Ins�tute of Poli�cs and Law) is among the first higher educa�onal ins�tu- �ons established by the People’s Republic of China specializing in legal and poli�cal science educa�on. ECUPL has demonstrated remarkable resilience and strength throughout the years and has developed a dis�nc�ve iden�ty in the na�onal higher educa�on landscape. History and Loca�on Located in Shanghai, a metropolis known as a financial center and transporta�on hub, ECUPL boasts two cam- puses: Changning campus (in the city center) and Songjiang campus (in the suburbs). The university inherited from St. John’s University not only historic buildings that have weathered through ups and downs, but also the strong wish to foster talents like Mr. LIN Yutang (writer), Mr. I.M. Pei (architect), and other alumni of the St. John’s University. II. Discipline Development ECUPL offers a diversity of well-structured disciplines, with law as its pillar, which is developing steadily and enjoys a remarkable edge over other academic ins�tu�ons. Over the past years, ECUPL has scored several na�onal firsts in the number of research projects funded or sponsored by the Na�onal Social Science Founda- �on of China (NSSFC) and the Ministry of Jus�ce. The discipline of law of ECUPL has con�nuously ranked among the top 10 in the Chinese mainland, compe�ng with over 700 law disciplines across the country. III. Talent Cul�va�on ECUPL is commi�ed to nurturing inter-disciplinary law professionals with in-demand skills and innova�ve minds by leveraging its advantages in legal studies and cross-disciplinary integra�on. Over the past five years, it has proudly maintained a remarkable graduate employment rate of over 95%, with most of its graduates ac�vely taking leading roles in various sectors. From among its talented and successful graduates, ECUPL has selected 125 alumni leaders who are influen�al in the business, poli�cal, academic, and art circles. IV. Interna�onal Coopera�on Ac�vely promo�ng interna�onal coopera�on, ECUPL has entered into partnerships with more than 180 univer- si�es and academic ins�tu�ons overseas. It has established 4 joint research centers with its partner ins�tu- �ons. It has run various student exchange programs allowing for cross-recogni�on of academic credits with over 60 overseas colleges and universi�es. ECUPL is also the first Chinese university running the World Intellec- tual Property Organiza�on (WIPO) Summer School and the first Chinese university whose academic credits are recognized by the American Bar Associa�on.
Shanghai University of Poli�cal Science and Law Since 2009, Shanghai University of Poli�cal Science and Law (SHUPL) has sent teams formed by its law students to over 40 interna�onal programs and compe- ��ons. SHUPL has con�nuously organized Moot Shanghai over the last 10 years by hos�ng conferences and sending moo�ng teams and staff. SHUPL is organiz- ing Moot Shanghai 2021 together with ECUPL. SHUPL was established in 1984. In September 2004, it was approved by the municipal government of Shanghai and turned into an independent higher educa�on ins�tu�on. Over its development of 37 years, SHUPL has accomplished the transforma�on from cer�ficate program educa�on to undergraduate and graduate degree educa�on. SHUPL is located in the renowned and beau�ful She Shan scenic area, which is the only mountain- ous area in Shanghai. The campus covers 1,050 mu (7 square KM). It enjoys a graceful and peaceful natural environment and is equipped with the latest educa�onal appliances. According to President Xi Jinping’s direc- �ve, SHUPL now has served as China Na�onal Ins�tute for Shanghai Coopera�on Organiza�on Interna�onal Exchange and Judicial Coopera�on as well as Legal Service Commi�ee Office for Shanghai Coopera�on Organi- za�on. The university is commi�ed to engaging with the development of Shanghai, China, and the world by enhancing its academic strengths in poli�cal science and law. Embarking on a path of development featured by unique disciplinary strengths, innova�on, and excellence, the university aims to foster high-quality “applica�on-ori- ented” talents with innova�ve thinking and a global vision. Our students receive moral and legal educa�on and grasp both the breadth and depth of knowledge. The university priori�zes legal studies, but other subjects such as poli�cal science, Marxist theory study, sociology, economics, management, literature, educa�on, jour- nalism and communica�on, and art have all been developing in a coordinated way, aiming at building a first-class “applica�on-oriented” university with a dis�nc�ve advantage in poli�c science and law.
Shanghai Interna�onal Arbitra�on Center Approved by Shanghai Municipal People's Govern- ment in1988, Shanghai Interna�onal Economic and Trade Arbitra�on Commission (also known as the Shanghai Interna�onal Arbitra�on Center; previous- ly known as the China Interna�onal Economic and Trade Arbitra�on Commission Shanghai Commission, here- ina�er referred to as "SHIAC") was established through a formal procedure and legi�mately registered, and has been ac�ng as an independent arbitra�on ins�tu�on all along, Providing independent, impar�al, professional and efficient dispute resolu�on services. As one of the earliest arbitra�on ins�tu�ons in China with rich experience in dealing with foreign- related arbi- tra�on cases, SHIAC has experienced 30 years' development and the number of cases has increased year by year. The types of cases mainly involve trade, finance, construc�on, equity transfer, intellectual property, real estate, shipping, joint venture, financial deriva�ve disputes, asset management, PPP, M&A, financial leasing, shipbuilding, franchising, energy, entertainment and media, and avia�on industry. Par�es from 77 countries and regions have par�cipated in arbitra�on proceedings administered by SHIAC. In addi�on to the par�es' ac�ve performance, the awards of SHIAC have been recognized and enforced in more than 50 countries and regions. The Panel of Arbitrators of SHIAC is cons�tuted by 965 arbitrators. All the arbitrators come from 74 countries and regions around the world, including 36 along the Belt and Road. 604 arbitrators, which take-up 62.59%, are from mainland China, while 361 arbitrators which take the rest 37.41% are from foreign countries and Hong Kong SAR, Macau SAR, and Taiwan region. SHIAC adheres the strategy of interna�onaliza�on. In October 2013, SHIAC established the China (Shanghai) Pilot Free Trade Zone (FTZ") Court of Arbitra�on and formulated the FTZ Arbitra�on Rules in line with interna�onal standards. In August 2014, SHIAC established the world's first avia�on arbitra�on pla�orm, the Shanghai Interna�onal Avia�on Court of Arbitra�on, to provide an important path to resolve interna�onal avia�on disputes. In October 201 5, SHIAC established the first inter- BRICS dispute resolu�on pla�orm, the BRICS Dispute Reso- lu�on Center Shanghai, to provide a solu�on mechanism for cross-border disputes among BRICS countries. In November 2015, SHIAC established the first China-Africa dispute resolu�on pla�orm, the China-Africa Joint Arbitra�on Center Shanghai, to provide dispute resolu�on legal services for Chinese and African commercial en��es. SHIAC also has a Taiwan-related resolu�on service center dispute resolu�on service center and a prop- erty rights transac�on arbitra�on center to provide more targeted media�on, arbitra�on, and other dispute resolu�on methods for commercial en��es and property rights par�es.in November2019, in order to build an interna�onal dispute resolu�on hub in Shanghai, SHIAC launched the Shanghai Interna�onal Dispute Resolu- �on Center to invite and gather interna�onal arbitral ins�tu�ons and dispute resolu�on bodies. SHIAC is one of the five interna�onal commercial arbitra�on and media�on ins�tu�ons included in the Supreme People's Court' s One- -Stop Diversified Mechanisms for Resolving Interna�onal Commercial Disputes. SHIAC was awarded by Global Arbitra�on Review (GAR") as the arbitra�on ins�tu�on impressed in the past year and runner-up for innova�on by an individual or organiza�on in 2015. At the same �me, SHIAC is also one of the major arbitra�on ins�tu�ons in China published in the Interna�onal Commercial Arbitra�on Council (ICCA) Yearbook. SHIAC has been making great efforts to give full play to the important role of arbitra�on in dispute resolu�on and the construc�on of the rule of law environment, serving na�onal strategy of the construc�on of China (Shanghai) Pilot Free Trade Zone and the Belt and Road Ini�a�ve, help Shanghai built into a global center of economy, finance, trade and shipping, as well as strive to build an Asia-Pacific and global arbitra�on center.
ICC Interna�onal Court of Arbitra�on ICC Interna�onal Court of Arbitra�on was established in 1923. It is an interna�onal arbitra�on ins�tu�on established by the Interna�onal Chamber of Commerce to serve the global business community. The Presidium of ICC Interna�onal Court of Arbitra�on is composed of 1 chairman and 17 vice-chairmen. Besides, the Commi�ee of ICC Interna�onal Court of Arbitra�on is composed of 180 legal professionals from 120 countries and regions, with exper�se in interna�onal law and experience in resolving interna�onal disputes. English, French, German, and Spanish are the Court’s official working languages. As an interna�onal organiza�on, ICC has a global network with na�onal commi�ees, regional commi�ees, and representa�ve offices in more than one hundred jurisdic�ons. Most of these ins�tu�ons are located along the “Belt and Road”, which endows ICC with global and regional exper�se to solve the inevitable disputes in the construc�on and infrastructure projects in the “Belt and Road” environment. For a long �me, ICC Interna�onal Court of Arbitra�on has won the trust of par�es involved in major public interests. Whether the case is based on a contract or an investment protec�on treaty, it has far surpassed other interna�onal commercial ins�tu�ons and consolidated its reputa�on as the most preferred arbitra�on ins�tu- �on in the world.
