Albert-Eden Local Board OPEN MINUTES Minutes of a meeting of the Albert-Eden Local Board held in the Albert-Eden Local Board Office, 135 Dominion Road, Mt Eden on Tuesday, 17 August 2021 at 2.05pm; adjourned at 4.22pm, Tuesday, 17 August 2021 and reconvened at 4.00pm, Tuesday, 24 August 2021 via Skype-for- Business. CARRIED 16 Proposal to make a new Freedom Camping in Vehicles Bylaw Note: During the Albert-Eden Local Board 17 August 2021 business meeting, by agreement of the local board, it was agreed that the item lie on the table until the reconvened meeting on Tuesday, 24 August 2021. MOVED by Chairperson L Corrick, seconded by Member W McKenzie: That the Albert-Eden Local Board: a) generally support in principle the draft Statement of Proposal on Te Kaunihera o Tāmaki Makaurau Te Ture ā-Rohe Noho Puni Wātea ā-Waka 2022 / Auckland Council Freedom Camping in Vehicles Bylaw 2022. Albert-Eden Local Board 17 August 2021 b) note the improvements to this draft Statement of Proposal, as the Albert-Eden Local Board provided feedback in 2017, 2018 and 2019 and identified several concerns that have been addressed in the current draft. c) note the following features about the Albert-Eden Local Board area: i) it is densely populated; ii) is sited on the central isthmus, within easy reach of the airport and central city; iii) there is a heavy demand on local parks and carparks; iv) there are conflicting high-use activities on local parks; vi) the majority of possible freedom camping locations are small neighbourhood parks or carparks and are in close proximity to intensive residential areas. d) note that staff have been unable to provide the Albert-Eden Local Board with a list of which parks are held under the Reserves Act 1977 and which are held under the Local Government Act 2002, so there is no clarity on which parks are provided protection under the draft Statement of Proposal on Freedom Camping in Vehicles Bylaw 2022. e) note that there is significant exposure to freedom camping in Albert-Eden as the majority of reserves and parks in Albert-Eden Local Board area are held under the Local Government Act 2002 rather that the Reserves Act 1977, and this is significantly lower than other local boards for example, the five local boards who have undertaken omnibus Management Plans in recent years have an average of 94 per cent of their parks held under the Reserves Act 1977. f) note that the Albert-Eden Local Board engaged the community in 2019 and received feedback that littering, safety, capacity of facilities, damage to significant cultural or historical features and environmental impacts were the main concerns raised. Sandringham h) request the following parks held under the Local Government Act 2002 be classified as restricted in the draft Statement of Proposal on Freedom Camping in Vehicles Bylaw 2022: Park Area- specific restrictions a) Certified self-contained vehicles only. b) Must be parked within any marked lines in the designated parking area. c) Overnight only, don’t occupy before 3.00pm and must vacate parking space by 9.00am. d) Maximum 2 nights in a 2-week consecutive period. a. Windmill Park, Epsom i) request that all spaces that contain a boat ramp, urupā or cemetery are included on the prohibited schedule due to their sensitive use or nature. General rules j) support the principle of including general rules for areas that are not reserves or individually scheduled in the bylaw. k) support the following general rules: i) require freedom campers to use certified self-contained vehicles; ii) allow freedom campers to stay a maximum of 2 nights in the same road or off- road parking area; iii) require freedom campers to not return to the same area within two weeks. l) request the general rule relating to departure time include an arrival time restriction as follows: i) freedom campers must not occupy their parking space before midday on their day of arrival and must vacate their parking space by 9.00am on their day of departure. m) request staff investigate a new general rule which restricts freedom camping arrival time to after 4.00pm and departure time to before 8.00am within close proximity (for example, 50-100m) of a school or early childhood facility, which aligns to the Freedom Camping Act 2011 criteria of protecting the health and safety of people who may visit the area, given: i) the number of traffic and pedestrian movements, especially during peak times; ii) the risk to children’s safety around large vehicles. Impact on people experiencing homelessness n) support the intent that the draft Statement of Proposal on Freedom Camping in Vehicles Bylaw 2022 is not intended to manage homelessness across Auckland, which should be dealt with by other measures and support enforcement of the Freedom Camping in Vehicles Bylaw 2022 be done with a compassionate approach. Enforcement and implementation o) note that once operative the Freedom Camping in Vehicles Bylaw 2022 should be well monitored and enforced and areas properly resourced with appropriate infrastructure (including public toilets) noting that there appears to be an ongoing preference by freedom campers to use public facilities. p) request Auckland Council staff undertake a proactive promotion and advertising programme for a select number of suitable freedom camping locations across Auckland which: i) are identified by local boards as suitable locations; ii) have adequate supporting facilities and infrastructure; iii) are supported by additional compliance staff providing education, monitoring and enforcement; Minutes Page 15

Resolution number AE/2021/137 MOVED by Chairperson L Corrick, seconded by Member WM McKenzie: That the Albert-Eden Local Board: a) generally support in principle the draft Statement of Proposal on Te Kaunihera o Tāmaki Makaurau Te Ture ā-Rohe Noho Puni Wātea ā-Waka 2022 / Auckland Council Freedom Camping in Vehicles Bylaw 2022. b) note the improvements to this draft Statement of Proposal, as the Albert-Eden Local Board provided feedback in 2017, 2018 and 2019 and identified several concerns that have been addressed in the current draft. c) note the following features about the Albert-Eden Local Board area: i) it is densely populated; ii) is sited on the central isthmus, within easy reach of the airport and central city; iii) there is a heavy demand on local parks and carparks; Minutes Page 19
Albert-Eden Local Board 17 August 2021 iv) there are conflicting high-use activities on local parks; v) the majority of possible freedom camping locations are small neighbourhood parks or carparks and are in close proximity to intensive residential areas. d) note that staff have been unable to provide the Albert-Eden Local Board with a list of which parks are held under the Reserves Act 1977 and which are held under the Local Government Act 2002, so there is no clarity on which parks are provided protection under the draft Statement of Proposal on Freedom Camping in Vehicles Bylaw 2022. e) note that there is significant exposure to freedom camping in Albert-Eden as the majority of reserves and parks in Albert-Eden Local Board area are held under the Local Government Act 2002 rather that the Reserves Act 1977, and this is significantly lower than other local boards for example, the five local boards who have undertaken omnibus Management Plans in recent years have an average of 94 per cent of their parks held under the Reserves Act 1977. f) note that the Albert-Eden Local Board engaged the community in 2019 and received feedback that littering, safety, capacity of facilities, damage to significant cultural or historical features and environmental impacts were the main concerns raised. i) request that all spaces that contain a boat ramp, urupā or cemetery are included on the prohibited schedule due to their sensitive use or nature. General rules j) support the principle of including general rules for areas that are not reserves or individually scheduled in the bylaw. k) support the following general rules: i) require freedom campers to use certified self-contained vehicles; ii) allow freedom campers to stay a maximum of 2 nights in the same road or off-road parking area; iii) require freedom campers to not return to the same area within two weeks. l) request the general rule relating to departure time include an arrival time restriction as follows: i) freedom campers must not occupy their parking space before midday on their day of arrival and must vacate their parking space by 9.00am on their day of departure. m) request staff investigate a new general rule which restricts freedom camping arrival time to after 4.00pm and departure time to before 8.00am within close proximity (for example, 50-100m) of a school or early childhood facility, which aligns to the Freedom Camping Act 2011 criteria of protecting the health and safety of people who may visit the area, given: i) the number of traffic and pedestrian movements, especially during peak times; ii) the risk to children’s safety around large vehicles. Enforcement and implementation p) note that once operative the Freedom Camping in Vehicles Bylaw 2022 should be well monitored and enforced and areas properly resourced with appropriate infrastructure (including public toilets) noting that there appears to be an ongoing preference by freedom campers to use public facilities. q) request Auckland Council staff undertake a proactive promotion and advertising programme for a select number of suitable freedom camping locations across Auckland which: i) are identified by local boards as suitable locations; ii) have adequate supporting facilities and infrastructure; iii) are supported by additional compliance staff providing education, monitoring and enforcement; iv) may be sites listed as restricted or may be managed under the general rules and therefore less known to the general public to be suitable locations.
