INVITATION TO TENDER The District of Oak Bay (The “District”) invites tenders from qualified bidders for Supply and Delivery of Public Works Crew Van. Bids clearly marked “INVITATION TO TENDER No. OBPW 16-2021, SUPPLY AND DELIVERY OF CREW VAN” will be accepted electronically until 2:00:00 p.m. local time, October 05, 2021. All bids must be submitted on the form provided. Tender documents may be obtained from BCBid and the District of Oak Bay website at https://www.oakbay.ca/municipal-hall/tenders-grants/tenders Enquiries should be directed to Kevin Evans, Procurement Advisor at purchasing@oakbay.ca. INSTRUCTIONS TO BIDDERS 2.1 General Conditions Bidders are directed to carefully examine the enclosed information. Failure to follow the instructions may result in disqualification of the tender. 2.2 Preparation of Tender A copy of the Form of Tender is enclosed and the tender must be submitted on this form. The completed tender shall be clearly marked, ‘INVITATION TO TENDER No. OBPW 16-2021, SUPPLY AND DELIVERY OF CREW VAN”. The tender form must be submitted on the printed form provided. The form must be manually signed by a duly authorized representative of the supplier. If erasures or other changes appear on the tender form, each must be initialed by the person signing the tender. Electronic Submission Only Submit a PDF copy of your tender, in accordance with the instructions contained herein, to the following specific email address: purchasing@oakbay.ca The tender must include any submittal forms that are required as part of the submission. i.e.: manufacturers specifications. The maximum file size accepted will be 20MB. It is the responsibility of the proponent to ensure the email submitted is within the maximum file size limit. Zip files will be accepted. Delays caused by any computer related issues will not be grounds for an extension of the Closing Time. The District cannot be held responsible in any way for lost, misdirected, illegible or obscured emails. It is the sole responsibility of the submitting party to confirm a clear receipt of the transmission to the correct email address. Tenders received electronically at the email address above with a time stamp after the Closing Time will be returned unopened to the Proponent. It is recommended that the Proponent request an email from purchasing@oakbay.ca to verify that their proposal has been received. The District reserves the right to extend the closing time at its sole discretion. Proposals must only be sent electronically. Hard copy proposals will not be accepted. There will not be a public opening for this Invitation to Tender. 892776
District of Oak Bay Invitation to Tender No. OBPW 16-2021 – Supply & Delivery of Crew Van Page 4 2.3 Explanation and Modifications The tenderer may not claim, after submission of a tender, that there was a misunderstanding with respect to the conditions imposed by the documents. No verbal agreement made or conversation at any time with any officer or employee of the District shall effect or modify any of the terms or obligations herein stated, nor be any representation or warranty. 2.4 Withdrawal of and/or Changes to Tenders Tenders may be withdrawn or amended if notice is received by email to purchasing@oakbay.ca up to 15 minutes prior to the tender opening. 2.5 Pricing and Taxes The prices tendered shall include all applicable taxes, plus duties on materials and goods purchased for and built into the item(s) tendered, and shall represent the entire cost to the District of Oak Bay for item(s) tendered. Prices shall be in Canadian dollars. Vehicles offered under this advertisement shall be new, standard production models of the latest design in current production. Materials shall be good commercial quality for the intended service and shall be produced by use of current manufacturing processes. Materials shall be treated to resist rust, wear and corrosion. The design of the mechanical components shall be such that the stress imposed through normal shock loads at maximum engine torque shall not cause rupture or permanent damage or undue wear of any member. Bidders should submit with their tender, the latest printed specifications and advertising literature on the vehicle they propose to furnish. The bidder shall list on a separate sheet of paper, any or all variations from, or exceptions to, the conditions and specifications of this bid. This sheet shall be titled as "Variations or Exceptions to Bid Conditions or Specifications" and shall be attached to the tender . The vehicle proposed by the bidder must meet or exceed all safety standards required by federal and provincial law in place at the time of manufacture. 892776

B.C. V8R 5L7 2.6 Acceptance or Rejection of Tenders Tender Award will be made to the lowest compliant bidder after: 1. Consideration is given to quality of vehicle offered. 2. The conformity with specifications. 3. The vehicle’s suitability to requirements. 4. Delivery terms and warranty clauses. 5. Evaluation outlined in Section 2.7 The purchaser reserves the right to reject any or all bids, to waive any informality in bids, to accept in whole, or in part such bid or bids as may be deemed in the best interest of the purchaser. Except as expressly and specifically permitted in this tender, no tenderer shall have any claim for any compensation of any kind whatsoever, as a result of participating in the tender, and by submitting a bid each tenderer shall be deemed to have agreed that it has no claim. 2.7 Vehicle and Equipment Evaluation Annual estimated maintenance cost Annual fuel economies Resale value Warranty program Maintenance manuals in CD format or on-line Turning radius The submissions may then be assessed and accepted by the Oak Bay Council. Vehicle delivery exceeding the time frame stated on the Form of Tender may result in cancellation b the District of the order without any penalty to the District of Oak Bay. 2.9 Trade Agreements The District is subject to the terms and conditions of the Canadian Free Trade Agreement and the New West Partnership Trade Agreement. This ITT is also subject to Chapter Five of the Canadian Free Trade Agreement 2.10 Additional Unit The District may wish to order an additional vehicle that is identical to the unit that is bid. Any additional unit(s) will be ordered at the time of the initial order. Indicate on Price Form if an additional unit is available at time of initial order. 892776
