AUSTRALIAN NEWS In preparation for implementing the remaining schedules of the Migration Amendment (Regulation of Migration Agents) Act 2020, the OMARA has advised on the following upcoming changes. New Form 956 A new paper version of Form 956- Advice by a registered migration agent/exempt person of providing immigration assistance will be released to allow legal practitioners to notify the Department of Home Affairs (the Department) of their appointment to provide Immigration assistance a client. The new version of the form will be titled Form 956 Appointment of a registered migration agent, legal practitioner or exempt person. Until Departmental systems are upgraded to facilitate the identification of legal practitioners lawfully providing immigration assistance (expected July 2021), the new version of the paper Form 956 must be used with all new clients as of 22nd March 2021, where a client has appointed a legal practitioner to provide immigration assistance under the Migration Act 1958. Registered Migration Agents will be notified when the new form is available on the ' 'Department's website for download. With the recent release of the score concordance research from PTE Academic and IELTS there has been some confusion that PTE scores have changed regarding migration applications. Registered Migration Agents have been advised that until a new legislative instrument is released changing the scores, the current scores will remain in force. The Migration Institute of Australia (MIA) has had no indication that the Department is considering changing the current English language legislation or considering the concordance report. PTE scores remain valid and reliable. There have been no changes to the Australia Department of Home Affairs English test score requirements for visas. Should there be any change in the future, the MIA would not expect the changes to be applied retrospectively to applications lodged prior to any changes. PTE English language results can continue to be used as usual. 02 04
AUSTRALIAN NEWS State Nominations for Skilled Migrants meeting the nomination requirements opened up on the 8th February 2021, with the same staying closed for any person who is currently residing offshore or in another state of Australia. Invitations to apply for Victorian skilled visa nomination are made on each selection day. If the applicant is not selected immediately after submission window, the ROI will still be considered on future selection days. AUSTRALIAN NEWS With the recent changes announced on 20th January 2021, the SC 485 Temporary Graduate visa program's primary and secondary applicants had severe confusion due to the miscommunication of the legislation with how these new changes were drafted and interpreted. The new law gave them an idea like the past secondary holders of 485 visa would no longer be eligible to apply as a primary applicant later on for a subclass 485 visa even after completing their studies and fulfilling other requirements in Australia. However, the Department of Home Affairs has clarified the changes and confirmed that the 485 visas are not changed. A person who's previously held a subclass 485 as a secondary visa holder is not excluded from applying or being granted another subclass 485 as the primary applicant as long as they meet the standard requirements and other criteria's. The Second recent issue with the 485 changes was the announcement that "SC 485 visa holders would be eligible for a second visa if they had studied and then lived and worked in a regional or other regional areas for two years", this also has led to questions as applicants 'weren't clear about the requirements as to whether the applicant must have undertaken their full course at a regional or other regional educational institution. After requesting clarification from the Department, The DHA stated that the applicant must have graduated from a regional or other regional educational institution. The Department of home affairs is expected to update its website with these clarifications shortly. 05 04
AUSTRALIAN NEWS Due to the Pandemic that has affected Australia's migration process since last year, the Department of Home Affairs has initiated concessions for various visa subclasses. Visa Subclasses and Concessions 1. From 27th February 2021, the following visas will be granted even while the applicant is Onshore. • Partner Visa (Subclass 309) • Prospective Marriage Visa (Subclass 300) • Child Visa (Subclass 101) • Adoption Visa (Subclass 102) • Dependent Child Visa (Subclass 445) 2. From 24th March 2021, the following visas will be granted even while the applicant is Onshore. • Contributory Parent Visa (Subclass 173) • Contributory Parent Visa (Subclass 143) • Parent Visa (Subclass 103) 3. All Temporary Graduate Visa (Subclass 485) streams have been granted concessions since last year for applicants who have been unable to travel to or left Australia due to COVID 19. Visa grants will be available for both Onshore and Offshore applicants for this visa category. 4. Concessions have been extended for the Safe Haven Enterprise Visa (Subclass 790), and applicants will be able to meet the requirements even if they have: • Accessed Special Benefits payments • Been unemployed • Worked outside a SHEV regional area in an essential service 5. Concessions for the Business Innovation Visa (Subclass 888) have been added so that applicants who had to spend time Offshore due to the Pandemic could not be present in Australia for one year within the last two years prior to applying. Time spent Offshore may be counted as time spent in Australia if the applicant held one of the following visas: • Business Innovation and Investment (Provisional) visa (Subclass 188) Business Innovation stream • Business Innovation and Investment (Provisional) visa (Subclass 188) Business Innovation Extension stream 06 04
AUSTRALIAN NEWS The ACT Critical Skills List was reviewed and updated last on 11 January 2021 and will be reviewed every four months and updated as required to ensure that the ACT Migration Program adapts and responds to the evolving critical skills needs of the ACT economy. http://www.canberrayourfuture.com.au/portal/migrating/article/act-critical-skills-list/ Cap on Occupations The number of ACT nomination places may be capped for each occupation on the ACT Critical Skills List. Invitations may not be issued when the monthly cap for an occupation is reached. AUSTRALIAN NEWS GLOBAL TALENT INDEPENDENT CHANGES - MASTERS AND HONORS STUDENTS Due to the recent changes in the Global Talent Independent program, students that did their Masters and Honours students have stopped receiving an invitation, as they are now sent based solely on their academic qualifications. This new policy change affects all future EOI assessments and applies to the new EOI entries made by candidates who have not yet got the invitation to the Global Talent program before 20th January 2021. EOI applicants who have already submitted the EOI prior to this new policy being introduced and have not got the invitation are advised to check their eligibility and apply again if they meet the new requirement. New eligibility requirements: Applicants must demonstrate that they are highly skilled in one of the target sectors and: • Prove, they are internationally srecognised with evidence of outstanding and exceptional achieve- ments • Still be prominent in their field of expertise • Provide evidence that they would be an asset to Australia in their field of expertise • Have no difficulty obtaining employment in Aus- tralia or becoming established in their field • Have a recognised organisation or individual in Australia, endorse them as global talent in the same field as the applicant Applicants should meet the high standards requested with a remarkable history of expert and outstanding accomplishments. This may include senior jobs, patents, professional awards, international publications, media articles and worldwide participations. Applicants should have the ability to attract a salary at or above the Fair Work high-income threshold. In assessing the applicant, the Department considers: • Current salary showed through payslips or a contract, or • Future job offers outlining remuneration, or • Recent PhD graduates and certain PhD students with relevant qualifications in the target sectors. 08 04
CANADIAN NEWS This is the Manitoba Provincial Nominee Program (MPNP)’s fourth draw of the year. Skilled workers and international graduates were invited through the following three streams: • Skilled Workers in Manitoba ; • International Education Stream ; • Skilled Workers Overseas. The Letters of Advice to Apply (LAAs) and the Expression of Interest (EOI) score requirement were issued as follows: • Skilled Workers in Manitoba: 158 LAAs and a minimum score of 457; • Skilled Workers Overseas: 21 LAAs and a minimum score of 698; and • International Education Stream: 28 LAAs (no EOI score re- quirement). In this draw, five LAAs went to Express Entry candidates. The Saskatchewan Immigrant Nominee Program (SINP) invited 299 candidates from the International Skilled Worker category on February 25. Only candidates who could be eligible for the SINP’s Express Entry subcategory were invited in this Provincial Nominee Program (PNP) draw. Candidates needed an Expression of Interest (EOI) score of at least 70 in order to be invited. They also needed work experience in one of the 70 in-demand occupations listed on the government webpage. Invited candidates had work experience in at least one of 70 in-demand occupations. CANADIAN NEWS Canada has required all incoming international travelers over age five to take a COVID-19 test since February 22. Proof of having a vaccine does not exempt travellers from the test requirement at this time. Generally speaking, travellers need to show a test that has been taken within 72 hours of entry at the border, or their scheduled departure time. Source:cicnews The Comprehensive Ranking System (CRS) cut off was 75, another record-smasher. every single person in the Express Entry pool who was eligible for the Canadian Experience Class (CEC) was invited to apply for permanent residence on February 13. The tie-break rule was reported as an administrative requirement but IRCC did not actually use it, according to a spokesperson. This means that there was no CEC-eligible candidate in the pool with a score of 75 or lower who submitted their profile before September 12, 2020. Source:cicnews 10 04
CANADIAN NEWS The Prince Edward Island Provincial Nominee Program (PEI PNP) issued a total of 121 invitations. Most of the invitations, 102, went to Express Entry and Labour Impact candidates. Business Impact candidates took home the remaining 19, as long as they had a minimum point threshold of 82. Provincial Nominee Programs (PNPs) allow Canada’s provinces and territories to select immigration candidates who meet their labour market needs. They sometimes align with Canada’s federal Express Entry system. Source: cicnews British Columbia invited 494 immigration candidates in two separate Provincial Nominee Program draws held on February 16, 2021. A total of 459 invitations went to candidates from the Skills Immigration (SI) and Express Entry BC (EEBC) streams of the British Columbia Provincial Nominee Program (BC PNP). More specifically, invitations were issued to candidates in the Skilled Worker, International Graduate as well as Entry Level and Semi-Skilled sub-categories of SI and EEBC streams. The minimum scores for this draw ranged between 85 and 104 points. Another 35 invitations were issued to candidates who work as retail and wholesale trade managers as well as restaurant and food service managers. Source:cicnews 11 04
CANADIAN NEWS Alberta invited Express Entry candidates to apply for a provincial nomination on February 10. The Alberta Immigrant Nominee Program invited a total of 200 Express Entry candidates to apply for the Alberta Express Entry stream. Invited candidates only needed a Comprehensive Ranking System (CRS) score of at least 301. In order to receive an invitation in this particular Provincial Nominee Program (PNP) draw, candidates needed to have a profile in the Express Entry system. Source:cicnews Ontario held a new draw on February 16, inviting 1,186 immigration candidates with work experience in the tech sector to apply for a provincial nomination. The Ontario Immigrant Nominee Program (OINP) issued the invitations to Express Entry candidates with Comprehensive Ranking System (CRS) scores between 453 and 467. The OINP issued invitations to candidates who may be eligible for a nomination under the Human Capital Priorities stream. Invited candidates will need to demonstrate that they have eligible work experience in one of the targeted occupations, in order to get the Provincial Nominee Program (PNP) nomi- nation. These six occupations include the following: • Computer and information systems managers (NOC 0213); • Computer engineers (NOC 2147); • Database analysts and data administrators (NOC 2172); • Software engineers and designers (NOC 2173); • Computer programmer and interactive media developers (NOC 2174); or • Web designers and developers (NOC 2175). Irish citizens can continue to freely enter, live and work in the UK. Free movement with the European Union (EU) ended on 31 December 2020 and there are new arrangements for EU citizens.
