Government Notices Roads and Maritime Notices ROAD TRANSPORT ACT 2013 EXEMPTION ORDER SECTION 19 Ministerial (Interstate Registration – Electric and Hybrid Vehicle Plan) Exemption Order 2019 I, Paul Lawrence Toole, Acting Minister for Transport and Roads, pursuant to section 19(1) of the Road Transport Act 2013, make this Order. PAUL LAWRENCE TOOLE Acting Minister for Transport and Roads Dated, this 15 day of April 2019 1. Citation This Order is the Ministerial (Interstate Registration – Electric and Hybrid Vehicle Plan) Exemption Order 2019. 2. Commencement This Order has effect on and from 19 April 2019. 3. Effect This Order remains in force up to and including 19 October 2019 unless revoked earlier. 4. Interpretation Words and expressions used in this Order have the same meaning as in the Road Transport Act 2013 unless otherwise stated. 5. Vehicles to which this Notice applies This Order applies to the heavy vehicle bearing vehicle identification number (VIN) JHDGH8JJ1XXX10053, registered in the State of Victoria, and bearing Victorian number plate 1NL8TT (‘the vehicle’). 6. Declaration This Order operates to exempt the registered operator and owner of the vehicle from the requirement in section 74(1) of the Act that prohibits a corporation from causing, permitting or allowing an interstate registered vehicle owned by the corporation to be used on a road in New South Wales. 7. Scope of Order This Order applies only as long as the vehicle remains registered to and owned by the operator of the vehicle at the time of the publication of this Order. 8. Publication This Order is published in the NSW Government Gazette. Explanatory notes: Transport for NSW released the NSW Electric and Hybrid Vehicle Plan (the Plan) on 21 January 2019. The Plan highlights the benefits of electric vehicle technologies for a range of purposes, including freight. This Order is designed to permit a specific vehicle participating in this Plan to remain for an extended period of six months in NSW – notwithstanding it is registered in Victoria and would be in contravention of section 74 of the Road Transport Act 2013 if it was not returned to Victoria every 90 days for at least 48 hours (see section 74(2)). Government Notices Other Government Notices CHARITABLE TRUSTS ACT 1993 ORDER UNDER SECTION 12 CY PRES SCHEME RELATING TO THE ESTATE OF THE LATE JOHN WHITTAKER COLE Section 9(1) of the Charitable Trusts Act 1993 permits the application of property cy pres where the spirit of the original trust can no longer be implemented. Under clause 3(t)(v) of the Will of the late John Whittaker Cole, which was executed on 6 December 2004, Mr Cole bequeathed the residue of his estate, in equal shares, to five named charities all located in New South Wales. One of those charities, the ‘Children’s Leukaemia and Cancer Society Inc (New South Wales)’ (‘the Society’), does not exist, nor did it exist at the time Mr Cole executed his Will. The bequest has an estimated value of $142,000.00. The bequest to the Society is considered to have created a charitable trust, as it is for the relief of the impotent and the advancement of education. A gift to an institution that has never existed but which manifests a general charitable intention may be applied cy pres. The Children’s Leukaemia and Cancer Foundation (ACN 074 617 271/ABN 68 074 617 271) (‘the Foundation’) was registered as a non-profit company in New South Wales between 1997 and 2009. It is possible that the Foundation was the intended recipient of the gift in cl. 3(t)(v) of the Will. Although the Foundation had ceased to exist as at the date of the testator’s death, it was affiliated with a registered charitable organisation in New South Wales, the Children’s Cancer Institute Australia (ACN 072 279 559/ABN 41 072 279 559) (‘the Institute’). The Institute carries on the work of the Foundation, with its main objectives being to raise funds to establish a research centre at the Prince of Wales Children’s Hospital and to provide grants to support other research projects throughout Australia. The Institute appears to be devoted to research into the causes, better treatments, prevention and cure of childhood cancer, with the four main types of cancer researched being leukaemia, brain cancer, neuroblastoma and sarcoma. The Institute is one of the only organisations based in New South Wales with a focus on researching children’s cancer including leukaemia. The executor of the estate has no objection to a cy pres scheme applying the funds to the Children’s Cancer Institute Australia. This is an appropriate matter in which the Attorney General should approve a cy pres scheme under section 12(1)(a) of the Charitable Trusts Act 1993. I have previously approved a recommendation that the Attorney General establish a cy pres scheme which would permit these charitable funds to be applied in a manner as close as possible to the original purposes of the trust. Pursuant to section 12 of the Charitable Trusts Act 1993, I hereby order that the bequest by the Estate of the late Mr John Whittaker Cole to the Society is to be applied to the Children’s Cancer Institute Australia.
