#gnometracker2019 Rules and Regulations EVENT PARTICIPANT WAIVER and ACKNOWLEDGEMENT OF RISK Part One - WAIVER and RELEASE By participating in the above mentioned event and utilizing the hashtag #gnometracker2019 (known hereafter as “the Event”), you accept and give consent for the following: In consideration of Woodlands County, accepting entry into the above named activity, I hereby for myself, my heirs, executors, administrators and assigns, release and forever discharge the above named organizations, their executive directors, servants, agents, sponsors, supporters, employees, contractors or volunteers (all of whom are hereafter the Releases) and to release the Releasees from any and all liability for any loss, damage, expense or injury including death that I may suffer or my next of kin may suffer as a result of my participation in the Event, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care owed on the part of the Releasees and further including failure on the part of the Releasees to safeguard or protect me from the risks, dangers and hazards associated with the Event as set out below in Part Two. I hold harmless and indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in the Event. I further waive and release any and all recourse which I may now have or may in the future have resulting from any decisions of the Releasees in association with the Event, including any claims I might have in connection with any cancellation or rescheduling of the Event for whatever reason. Part Two – ACKNOWLEDGMENTS Risks and Dangers: I acknowledge that participating in the Event involves risks and dangers including, but not limited to: accidents that occur traveling to or from sites for the Event; slips, trips, falls or collisions; encounters with other participants, obstacles (manmade or natural) or wildlife; steep and varied terrain, uneven conditions; adverse weather conditions, body temperature extremes, exhaustion. I freely accept and fully assume all risks, dangers and hazards associated with my participation in the Event and the possibility of personal injury, death, property damage or loss resulting therefrom. Health I declare that my physical condition, to the best of my knowledge, is adequate to participate safely in the Event and that no physician or other medically qualified individual has advised me against participating in the Event. I further acknowledge and agree that it is my choice whether I will obtain a physical examination prior to participating in the Event, and I hereby acknowledge and agree to assume all risks associated with not obtaining such examination, or if I do obtain an examination and am instructed not to participate in the Event, I hereby assume all risks associated with my participation. Follow Rules: I hereby agree to abide by the Rules and Regulations imposed by Woodlands County in association with the Event.
Cancellation or Rescheduling
I acknowledge that Woodlands County may choose to cancel or reschedule #gnometracker2019 if conditions are
deemed unsafe (e.g., weather, road conditions, health advisory). I accept that these organizations will not be liable for
any costs I may bear as a result of such cancellation or rescheduling.
Image Use
By Participating in the Event, I authorize and consent to the publication in any format or media by Woodlands County of
any materials containing my name, likeness or image in association with my participation in the Event, and I release to
Woodlands County and all persons acting under authority from them, from any claims I might have due to the initial or
subsequent publication of such material. By participating in the Event, I have read and understand the Waiver and
Acknowledgments and accept the terms and conditions of participation and confirm that all information is true and
accurate.

CONTEST PERIOD
1. Woodlands County #gnometracker2019 is run by Woodlands County. The Contest begins at
12:01AM MST Saturday, June 8, 2019 until 11:59PM MST Sunday, June 30, 2019.
ELIGIBILITY
2. To be eligible to enter the Contest, you must be at least 18 years of age.
3. Council members and Employees of the Woodlands County, as well as members of their immediate
family (such as their father, mother, brothers, sisters or children), their legal or common-law spouses,
or any persons with whom such employees reside, are not eligible to enter the Event.
METHODS OF ENTRY
4. NO PURCHASE NECESSARY
5. To enter and be eligible to win:
i) Participants must have transportation to and from attraction sites, a way to take digital photos and a
way to post photos to the Social Media platform of their choice before the end of the contest Period,
via cell phone, tablet etc. (and cover costs of data plan used).
ii) The deadline for entry submission is 11:59PM MST Sunday, June 30, 2019.
iii) Participants gain 1 entry per picture for each different gnome at each recreation site. Maximum
number of entries is five (5)- one (1) for each Recreation site gnome
iv)Participants that do not utilize Social Media platforms may gain an entry by having their pictures
validated at either the Fort Assiniboine Regional Office or the Main County Office in Whitecourt.
PRIZE
6. One (1) Grand Prize package will be awarded and valued at $750.00. It will be a combination of
multiple items.
ODDS OF WINNING
7. The odds of winning shall depend on the number of eligible entries received during the event.
DRAW/WIN
8. Each entry gathered via #gnometracker2019 or by validation at either Woodlands County offices
will entered into an online random name picker online (https://www.miniwebtool.com/random-
name-picker/)
9. Photos WITHOUT the correct hashtag WILL NOT be eligible.

10. Prize must be accepted as awarded, and no substitution for, or transfer of, prize will be allowed.
Woodlands County reserves the right to substitute a prize of at least equal or greater value, at its sole
discretion, in the event of the unavailability, for whatever the reason, of the advertised prize in whole or
in part.
11. Woodlands County will attempt to contact the winner at the Social Media platform utilized or
the telephone number included with a validated entry. If the selected entrant cannot be reached within
three (3) business days following the draw or declines the prize another entrant will be selected.
12. To be declared a winner, the selected entrant must, in addition to meeting the event
eligibility criteria and otherwise complying with the Contest Rules:
i) show proof of identification
ii) upon request, sign (and have witnessed) any declaration and release documentation provided by
Woodlands County
13. The selected entrant will be required to execute a legal agreement and release that confirms his
or her: (i) eligibility for the Contest and compliance with these Rules; (ii) acceptance of the Prize as
offered; (iii) release of the Woodlands County from any and all liability for any loss, harm, damages, cost
or expense arising out of participation in the event, participation in any event-related activity or the
acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to
personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy,
defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and
(iv) grant to Woodlands County of an unrestricted right, in Woodlands County’s sole discretion, to
produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt
and otherwise use or re-use the winner’s name, photograph or other likeness, and city of residence in
any and all media now known or hereafter devised, without payment or compensation of any kind, in
connection with the Contest and the promotion and exploitation thereof.
14. Delivery of Prize: The winner is responsible to pick up the prize within 14 days of being
contacted as the winner. Woodlands County will not deliver any prizes.
15. Disqualification: If the selected entrant declines the prize, cannot be contacted, does not
return the release as required, or fails to meet all of the conditions noted above, then the entrant will
be disqualified and shall not be entitled to receive any prize, and Woodlands County reserves the right,
in its sole and absolute discretion, to select from a further random draw another eligible entry, in
which event these provisions shall apply to such other selected eligible entry (and so on). In such event,
the previously selected entrant(s) will have no recourse against the Woodlands County in connection
with such entrant’s disqualification from the Contest.

16. By entering #gnometrakcer2019, you agree to abide by all official rules of the event as set out
herein. You will be deemed to have received and understood the rules by participating in the
event. The terms of this contest, as set out in these rules, are not subject to amendment or
counteroffer, except as set out herein.
17. Woodlands County’s decision on any contest issue, including without limitation those
concerning the eligibility or disqualification of entrants, is final and binding without right of appeal.
18. By entering the Event, each entrant acknowledges that Woodlands County shall not be required
under any circumstances to award more prizes than the number of available prizes, as set out in
these Rules. In the event that, for any reason whatsoever (including, without limitation, as a result
of an error, malfunction or defect in the design, advertising, management, implementation or
administration of the event, whether mechanical, electronic, human or otherwise). Woodlands
County reserves the right, in its sole and absolute discretion, to end the event in whole or in part,
without notice, and to award prize among the correct number of winners, selected in accordance
with these Rules from among those eligible entries validly submitted prior to the termination of the
event.
19.Without limiting the rights described elsewhere herein, Woodlands County reserves the right, in
its sole and absolute discretion, to modify, cancel, terminate or suspend the event, in whole or in
part at any time and without prior notice, in the event of any cause or circumstance, including,
without limitation, an event of force majeure or Act of God, any virus, computer bug or
unauthorized human intervention or any other cause that is beyond the control of Woodlands
County, that could corrupt or affect the administration, security, impartiality or normal course of
the Contest.
20. The validity of any Event entry is subject to verification by Woodlands County. Woodlands
County is not responsible for entries that are lost, late, destroyed, incomplete, invalid, unintelligible,
misdirected, or otherwise indecipherable due to technical problems, or any other reason, regardless
of cause. All such entries will be disqualified. Woodlands County may prohibit an entrant from
participating in the Event or winning the prize if, in its sole discretion, it determines that said entrant
is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception
or other unfair playing practices. Any attempt to deliberately damage any website or undermine the
legitimate operation of the Contest is a violation of criminal and civil laws and, should such an
attempt be made, Woodlands County reserves the right to seek remedies and damages to the fullest
extent permitted by law, including criminal prosecution.

21. By entering or attempting to enter the event, each entrant and/or purported entrant agrees to
release, discharge, and forever hold harmless Woodlands County and their shareholders from any and
all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties,
accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever
nature or kind arising out of, or in connection with, (a) the entrant's participation or attempted
participation in the Event, compliance or non-compliance with these Contest Rules and acceptance and
use of the Prize; (b) accessing the website or contest page, submitting an entry or otherwise participating
in any aspect of the event; (c) the receipt, ownership or use of any prize awarded; or (d) any
typographical or other error in these Rules or the announcement of offering of any prize. The winner
shall bear all risk of loss or damage to the prize after it has been accepted. Woodlands County makes no
representations or warranties of any kind concerning the appearance, operation, safety or performance
of any prize.
22. By entering or attempting to enter the Event, each entrant and/or purported entrant agrees that the
Woodlands County assume no responsibility or liability for (a) any incorrect or inaccurate entry
information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any
unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of the
Event (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in
operation or communications line failure, regardless of cause, with regard to any equipment, systems,
networks, lines, servers, computers or providers utilized in any aspect of the operation of the event;
(d) inaccessibility or unavailability of the Internet or the email server or any combination thereof; (e) any
lost, incomplete, late or misdirected entries; (f) failure for any reason whatsoever of a selected entrant
to receive notification or for Woodlands County to receive a selected entrant’s response; or (g) any
death, injury or damage to any person or property arising from, or relating to, that person’s or any other
person’s participation or attempted participation in the Contest or downloading any materials in the
Contest.
PERSONAL INFORMATION
23. By entering the Event and providing the required information, you consent to the use of such
information by Woodlands County to administer, implement and fulfill the contest.

24.0No telephone contact or other correspondence will be entered except with the selected
entrant.
25. Complete contest information and the winner’s name will be available during normal business hours
or can be obtained by sending a self-addressed stamped envelope along with the request to Woodlands
County, Box 60, 1 Woodlands Lane, Whitecourt, AB, T7S 1N3. Questions regarding the prizing or Contest
Rules can be emailed to heather.anderson@woodlands.ab.ca.
26. The Event is void where prohibited by law, and is subject to all federal, provincial and all other
applicable laws and regulations. The Rules are subject to change without notice in order to comply
with any applicable federal, provincial and municipal laws or the policy of any other entity having
jurisdiction over Woodlands County. All issues and questions concerning the construction, validity,
interpretation and enforceability of these Rules or the rights and obligations as between the entrant
and Woodlands County in connection with the Event shall be governed by and construed in
accordance with the laws of the province of Alberta, including procedural provisions, without giving
effect to any choice of law or conflict of law rules or provisions that would cause the application of
any other jurisdiction’s laws.
27. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules
and disclosures or other statements contained in any Contest related materials, the terms and
conditions of these Contest Rules shall prevail, govern and control.
