REVIEW OF MINUTES The board reviewed the meeting minutes of the January 2021 board meetings, and a motion to approve the minutes as submitted was passed unanimously. EXECUTIVE DIRECTOR’S REPORT- Daniel Biggins Mr. Biggins requested the Board excuse absences for the following board members: • Mr. Cathey • Mr. Kane • Mr. Lawson • Mr. Strickland Mr. Biggins also provided a brief update on the current Legislative session. With nothing further to report the Board voted unanimously to approve this report. CHAIRMAN’S REPORT- Ms. Wood Ms. Wood had nothing to report. With nothing further to report the Board voted unanimously to approve this report. PROSECUTING ATTORNEY’S REPORT- Ian Brown Mr. Brown had nothing to report. HEARING AND PETITIONS BOUDREAUX, ERNEST – MOTION FOR RECONSIDERATION Mr. Boudreaux was present with counsel. Mr. Milne presented this case stating Mr. Boudreaux’s application for a Certified Roofing Contractors license was denied at the May 2020 meeting of the Board for failure to demonstrate the required experience pursuant to section 489.111 Florida Statues and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed June 2020 and Mr. Boudreaux timely requested an informal hearing, which was heard at the September 2020 meeting of the Board. At that hearing the Board voted to uphold the previous denial. The Final Order Upholding Notice of Intent to Deny was filed November 2020. Mr. Boudreaux, through counsel, requested a Motion for Reconsideration. After further discussion, the Board voted to vacate the previous denials and to approve the application. CHRISTIAENS, RICHARD – INFORMAL HEARING Mr. Christiaens was present. Mr. Milne presented this case stating Mr. Christiaen’s application to qualify an additional business entity, FLCEA, INC., was denied at the October 2020 meeting of the Board for failure to appear as required by Rule 61G4-15.0021, Florida Administrative Code and failure to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the organization, as required by section 489.119, Florida Statues. The Notice of Intent to Deny was filed November 2020. Mr. Christiaens timely requested an informal hearing. After further discussion, the Board voted to vacate the previous denial and approve the application. COLLINS, JOSHUA – INFORMAL HEARING Continued 60 days. CORRIGAN, JOHN – INFORMAL HEARING Mr. Corrigan was present. Mr. Milne presented this case stating Mr. Corrigan’s application for a change of status (business to business) was denied at the October 2020 meeting of the Board because the applicant’s license, CGC062326, was in a Delinquent, Active status and with no Current, Active license before the Board to support the application, it must be denied until such time as the applicant meets all requirements for renewal and the license is renewed. The Notice of Intent to Deny was filed November 2020. Mr. Corrigan timely requested an informal hearing. After further discussion, the Board voted to vacate the previous denial and approve the application contingent on Mr. Corrigan renewing his license within 30 days. DOTSON, PERRY – INFORMAL HEARING Mr. Dotson was present. Mr. Milne presented this case stating Mr. Dorson’s application for a Certified Roofing Contractors License was denied at the October 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statues, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed November 2020. Mr. Dotson timely requested an informal hearing. After further discussion, the Board voted to uphold the previous denial. LAMONACO, JOSE – INFORMAL HEARING Mr. Lamonaco was present with counsel. Mr. Milne presented this case stating Mr. Lamonaco’s application for change of status from inactive to active of his Certified Air Conditioning Contractors License was denied at the September 2020 meeting of the Board as the applicant is subject to a Final Order in Case 2010039100, which imposed disciplinary sanctions against applicant’s license, including; failure to comply with or satisfy the pending disciplinary sanctions imposed against applicant’s license; and the applicant is currently under investigation or prosecution in a jurisdiction for an action that would constitute a violation of this chapter or the professional practice acts administered by the department and the boards, contrary to section 455.213(3), Florida Statues. The Notice of Intent to Deny was filed October 2020. Mr. Lamonaco timely requested an informal hearing. After further discussion, the Board voted to uphold the previous denial. MCGRAW, RICKY – INFORMAL HEARING Mr. McGraw was present with counsel. Mr. Milne presented this case stating Mr. McGraw’s application for a Certified Roofing Contractor was denied at the June 2020 meeting of the Board for failure to demonstrate good moral character pursuant to section 489.111(2)(b), Florida Statues. The Notice of Intent to Deny was filed July 2020. Mr. McGraw timely requested an informal hearing. After further discussion, the Board voted to vacate the previous denial and approve the application. OLIVEIRA, SAMUEL – INFORMAL HEARING Mr. Oliveira was present. Mr. Milne presented this case stating Mr. Oliveira’s application for a Certified Commercial Pool/Spa Contractors License was denied at the December 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statues, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed January 2021. Mr. Oliveira timely requested an informal hearing. After further discussion, the Board voted to vacate the previous denial and approve the application as a downgrade to a Pool/Spa Servicing Contractor’s license. Mr. Milne presented this case stating Mr. Stuart’s application for a Certified Mechanical Contractors License was denied at the October 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statues, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed November 2020. Mr. Stuart timely requested an informal hearing. After further discussion, the Board voted to uphold the previous denial. TORRES, JUAN – INFORMAL HEARING Mr. Torres was present with counsel. Mr. Milne presented this case stating Mr. Torres’ application to qualify Cold Concepts Refrigeration & Air Conditioning Corp was denied at the November 2020 meeting of the Board for the applicant being currently under investigation or prosecution in a jurisdiction for an action that would constitute a violation of this chapter or the professional practice acts administered by the department and the boards, contrary to section 455.213(3), Florida Statues, failure to appear as required by Rule 61G4-15.0021, Florida Administrative Code, and the failure to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the organization, as required by section 489.119, Florida Statues. The Notice of Intent to Deny was filed November 2020. Mr. Torres timely requested an informal hearing. After further discussion, the Board voted to vacate the previous denial and approve the application contingent on the applicant providing proof of 50% ownership in the companies the applicant currently qualifies, within 30 days. reciprocity agreements that Louisiana has with various states. After discussion, the Committee indicated that further review into the licensing scopes would need to take place, and that the Committee would draft a sample agreement to be reviewed at a future meeting. Mr. Feaster informed the Board that the Ad Hoc Committee would convene in March. With nothing further to report the Board voted unanimously to approve this report.
