LIEN LAP – PHONG HUY – PHONG NGUYEN ENVIRONMENTAL AND SOCIAL POLICY WINDFARMS As the Management Board of Lien Lap Wind Power Joint Stock Company, Phong Huy Wind Power Joint Stock Company, and Phong Nguyen Wind Power Joint Stock Company (individually referred to as the “Company” or collectively as the “Companies”), we understand that protection of the environment and nature, and supporting social communities associated with development of the Lien Lap, Phong Huy and Phong Nguyen Wind Power Projects (individually referred to as the “Project” or collectively as the “Projects”) are part of our business responsibilities to maintain a sustainable business environment and contribute to sustainable development. With this Environmental and Social Policy (the “E&S Policy”), the Management Board gives our highest commitments to identify, avoid if possible, minimize, and fully compensate and manage negative E&S impacts; conserve natural resources, ecosystem and biodiversity; respect human rights, especially affected and vulnerable people in compliance with Vietnamese regulations, the Asian Development Bank (“ADB”) Safeguard Policy Statement (“SPS”), and international good practices. This E&S Policy shall be applied to all the construction and operation activities and to all people who are working for or on behalf of the Projects. Our principal purpose is to achieve a remarkable E&S performance with strong commitment to the following principles: Comply with applicable Vietnamese E&S regulations, international protocols, and other applicable standards that the Company will hold itself accountable, e.g. ADB SPS, and/ or where practical, create a long-term and continuously supportive culture to achieve outstanding E&S performance; Avoid and minimize impacts on land acquisition and development by promoting and practising market-based negotiation and avoiding involuntary resettlement. For projects or activities that resulted in involuntary land acquisition and land use restriction, including government-led land acquisition and compensation process, we commit to comply with Vietnamese regulation and provide additional supports and efforts to ensure affected people receive full compensation and supports to restore their livelihood and improve living standards in alignment with ADB SPS. Develop and implement a comprehensive and effective E&S Management System, including E&S Management Plans to identify, manage and monitor E&S impacts and risks associated with our activities as well as maintain continuous improvement of our system. Commit to eliminate or where unavoidable, minimise all adverse environmental, health, safety and social risks and impacts from our activities to the environment, nature, and people working for or on behalf of the Company and communities. Protect, conserve and where practical, support development of the ecosystem and biodiversity at the Projects’ areas. We have no tolerance for illegal logging, poaching and hunting natural species, and polluting the environment. Promote a culture of safety, gender equality, non-discrimination, and mutual respect at the workplace, and establish and implement an accident-free and injury-free business. We prioritize local labour force and have no tolerance to forced and child labour in all our activities. Prevent, respond to and control potential emergency situations immediately to avoid and minimize risks on people, communities and the environment. We commit to implement remediation measures and provide appropriate compensation (in case of emergencies); Build a strong and on-going engagement and relationship with the local communities and authorities to understand and address their concerns relating to the development and operation of the Projects in an effective and timely manner through the implementation of a meaningful Stakeholder Engagement Plan. Where Indigenous Peoples are in or nearby the Projects areas, we commit to avoid irreversible impacts on them and prioritize our social program to engage and support these communities in alignment with ADB SPS; and Ensure that this E&S Policy is communicated to all relevant personnel and other stakeholders, as appropriate and that they receive adequate and appropriate E&S awareness, information, instruction, supervision and training. Relevant Functional Departments of the Owners and employees who are working directly for or on behalf of the Owners are responsible for the compliance and implementation of this E&S Policy.
