1 INTRODUCTION 1.1 PURPOSE OF THIS REPORT Engen has appointed WSP Environmental (Pty) Ltd (WSP), as the Environmental Assessment Practitioner (EAP), to manage the Basic Assessment process for the Zenex Blend Plant (ZBP) decommissioning environmental authorisation application to the KwaZulu-Natal Department of Economic development, Tourism & Environmental Affairs (EDTEA). In terms of the National Environmental Management Act (Act 107 of 1998, as amended) (NEMA) and the Environmental Impact Assessment (EIA) Regulations promulgated in Government Notice (GNR) 326 of 7 April 2017, a Basic Assessment (BA) process is required for the decommissioning and removal of facilities previously used for storing dangerous goods. Stakeholder engagement is a fundamental part of the BA process and aims to include potential Interested and Affected Parties (I&APs) in the process by notifying them of the proposed project. The objectives of the stakeholder engagement process are to: — Ensure an open and transparent BA and consultation process; — Enable stakeholders to register their interest and provide input into the BA process and share information; and — Ensure that all relevant issues are addressed as part of the BA process. The stakeholder engagement process is being undertaken in accordance with the EIA Regulations. The process aims to ensure that potential stakeholders are identified and provided with an opportunity to review the details of the proposed project and to submit any issues and concerns. 1.2 OBJECTIVE OF THE STAKEHOLDER ENGAGEMENT PROCESS The objectives of the stakeholder engagement process are as follows: — To ensure an open and transparent Impact Assessment and consultation process; — To identify and inform stakeholders of the proposed project and associated environmental authorisation process; — Provide an opportunity for stakeholders to raise all issues, concerns and questions and ensure that these are considered in the environmental authorisation process for the project; — Ensure that stakeholders have an opportunity to make a meaningful contribution towards decision making by the competent authority, and — Compile a Comment and Response Report (CRR) of all issues, concerns and questions raised during the stakeholder engagement process.
2 STAKEHOLDER NOTIFICATION 2.1 AUTHORITY CONSULTATION A pre-application meeting was held on 10 February 2021 with EDTEA in order to discuss the Department’s requirements for the application. An environmental authorisation application was submitted to EDTEA on 5 May 2021and acknowledged by EDTEA on the 6 May 2021 with the reference number: DM-0011-2021. Local and Provincial authorities were provided with written notification via email. The notified authorities include: — Department of Economic Development, Tourism and Environmental Affairs (EDTEA) — KZN EDTEA: Coastal Unit — Department of Water and Sanitation (DWS) — KZN Department of Agriculture & Rural Development — KZN Amafa — eThekwini Municipality — Transnet National Port Authority (TNPA) (landowner). 2.2 ADVERTISEMENT The EIA Regulations require that an advertisement be placed in a local newspaper or official gazette for a project of this nature. An advert was published in the Southlands Sun and the Mercury on 23 April 2021 (Appendix A). The advertisement formally announced the commencement of the application process and requested that I&APs register their interest with the EAP. 2.3 PUBLIC NOTICES The EIA Regulations require that site notices be fixed at places that are conspicuous to and accessible by the public at the boundary or on the fence or along the corridor of the site where the application will be undertaken or any alternative site. Four site notices were placed at the following locations on in May 2021 (Appendix B). — Grosvenor Library — Lighthouse Family Grocer - Lighthouse Road, Bluff — Entrance of ZBP Site — Entrance of Cutler Permit Office 2.4 WRITTEN NOTIFICATION Section 41 of the EIA Regulations states that written notices must be given to the stakeholders outlined in Table 1. Other known stakeholders with a potential interest in the project were identified at the project outset. This included all relevant authorities (government departments and the eThekwini Municipality), and the surrounding community members / community representatives. Stakeholder database maintenance is ongoing. Those who registered with an interest in the project as a result of the notification process are included in the database. 2.6 DRAFT IMPACT ASSESSMENT REPORT DISCLOSURE The Draft BAR will be distributed for public review for a period of 30 days from Tuesday 22 June 2021 to Wednesday 21 July 2021. Hard copies and/or electronic copies of the report will be provided to the following relevant regulatory and local authorities for commenting: — EDTEA; — DWS; — KZNDARD; — KZN Amafa; — eThekwini Municipality; and — The Ward Councillor (Ward 32). Stakeholder will be notified of the availability of the Draft BAR for review Online on the WSP website: http://www.wspgroup.com/en/WSP-Africa/What-we-do/Services/All-Services-A-Z/Technical-Reports/ 2.7 FURTHER STAKEHOLDER ENGAGEMENT The below stakeholders have requested a site walkover at ZBP. WSP is in communication with Engen with regards to this request. Should necessary approvals be granted for the site walkover, this will take place during the 30 days stakeholder review period (Tuesday 22 June 2021 to Wednesday 21 July 2021): — South Durban Community Environmental Alliance (SDCEA), and — Community Development South Africa (COMDEV). A comment and response report will be captured in the Final BAR, which will outline the comments received from the stakeholders and responses provided by the applicant and EAP for consideration by EDTEA.
