List of Items Discussed and Decisions Taken
- The Council of Europe’s Committee on Artificial Intelligence (hereinafter referred as “the
CAI” or “the Committee”) holding its 1st Plenary meeting in Rome, Italy, in hybrid format,
from 4 to 6 April 2022, in conformity with its terms of reference adopted by the
Committee of Ministers, decided to:
Agenda item 1. Opening of the meeting
- Take note of the opening remarks of Mr Bjørn BERGE, Deputy Secretary General of the
Council of Europe.
Agenda item 2. Adoption of the Agenda
- Adopt the agenda without amendments.
- Address agenda item 4 after items 5-7.
Agenda item 3. Introduction by the Secretariat
- Take note of the Terms of Reference of the CAI and of the applicable procedural rules,
in particular Resolution CM/Res(2021)3.
- Take note of the information provided by the Secretariat regarding the procedure for
the organisation of elections for the positions of Chair, Vice-Chair and Bureau
members.
Agenda item 4. Exchange of views with Mr Gregor STROJIN, Chair of the CAHAI:
outcomes of the CAHAI
- Take note of the presentation by Mr Gregor STROJIN (Slovenia) on the outcomes of the
work of the Ad Hoc Committee on Artificial Intelligence (CAHAI) and in particular on
the document on “Possible elements of a legal framework on artificial intelligence,
based on the Council of Europe’s standards on human rights, democracy and the rule
of law”, and hold an exchange of views with him.
- Warmly thank Mr STROJIN for his dedication to the work of the CAHAI and having
ensured the attainment of its tasks.

Agenda item 8. Outline of the elements of an appropriate legal instrument
- Hold an exchange on the document prepared by the Secretariat on the Outline of the
elements of an appropriate legal instrument.
- Instruct the Secretariat to inform the Committee of Ministers of the outcomes of its
deliberations, notably that the CAI unanimously recommends that in order to ensure the
most efficient and comprehensive legal framework of the Council of Europe on the
development, design and application of AI systems which respects human rights,
democracy and the rule of law and is conducive to innovation, the “appropriate legal
instrument” referred to in its Terms of Reference should take the form of a legally
binding instrument, open also to interested non-member States.

Agenda item 9. Exchange of views on proposed working methods of the CAI and the
work plan for 2022-2023
- Take note of the provisional calendar of meetings prepared by the Secretariat.
- Hold its next plenary meeting in Strasbourg on 21 - 23 September 2022.
- Mandate the Chair to prepare a draft text for the appropriate legal instrument to be
submitted to the Committee well in advance of its next plenary meeting, taking into
account the relevant decisions by the Committee of Ministers at the Ministerial Session
in Turin, 20 May 2022.
- Invite Delegations to provide written comments on the draft text before the 2 nd Plenary
Meeting in September.
- Ensure an inclusive and transparent approach to the negotiations, including through the
use of consultations.
- Mandate the Chair to prepare a draft communication plan.
- Launch a written procedure on the decision on the granting of observer status to the
International Commission of Jurists ending on 28 April 2022.

- Take note that no issues were raised under item 10.
