What to do with the week off in the middle of Desert Circuit...I ask myself that question all of the time. On the one hand, everyone needs a break, and on the other hand, we have everyone here. Last year we dipped our toe into the water and introduced Equitation Saturday. It gave a chance for the equitation riders to get into the Grand Prix ring and prepare for the second half of the season. We received great feedback on this and so we’re bringing that back this year. But still, should we do more? So this year we’re going to put the rest of our foot in and see how it goes. We look forward to your feedback. In addition to Equitation Saturday, we’re creating a fun day in the Grand Prix for the jumpers, with five $1,000 Classics ranging in height from 1.10m to 1.35m. Again, we think this gives a number of riders who might not get in the Grand Prix ring a chance to give it a try. Finally, we’ll be hosting the LEGIS League Finals. This will give an opportunity for folks who might not traditionally come to the Horse Park a chance to experience the place. As I said, we’ll give this a try and see what everyone things and we’ll continue to adapt each year. During this challenging times, we wanted to again highlight our COVID-19 plans, which are critical to the safety of everyone here for our shows. OUR COVID-19 PLANS We have now completed two circuits at the horse park. We have had a chance to test, refine, and improve our protocols as well as care for the few instances when positive tests have occurred on the property. We are now “properly experienced” in what to expect, what to do, and what resources we need. Our facility is uniquely positioned to carry on a horse show safely. We have 239 acres of land with 1.5 million square feet of schooling and competition space. Our barns are 100 feet apart and the vast majority of stalls are 12 x12. We have limited access to a single entrance with the remainder of the property fenced in and everyone arrives by car or truck. We have multiple outdoor dining options. Our new judges’ booths are 8 feet wide. We have developed new software so that all transactions can be done online. Everything about our facility allows for easy social distancing. And we have over 200 hand sanitizer stations and a very detailed protocol for keeping the facility clean, including daily resources dedicated to disinfecting across the facility. In the end, our focus will be on the three things that are most important to well-being. By now, this is well documented. If we all do the following three things, we can carry on safely: 1. KEEP A SAFE DISTANCE – We’ll reinforce everyone keeping 6 feet apart. Given our space, this is not a challenge. The number of instances where people will have to get “closer” is extremely limited. 2. WEAR A FACE COVERING – We’re asking everyone to wear a face covering whenever they are on the facility property. The exception is when riding a horse. 3. WASH YOUR HANDS FREQUENTLY – We will make this really easy. I’m pretty confident there will be a hand sanitizer station within reach of everyone at any time. The details of our plan will always be available on our website www.deserthorsepark.com and updates will be made constantly. If you have questions, just ask. We’ll make it easy with a “ask us” button. No matter what we do, this is a joint effort. We promise to do our part, but we need you to do your part. We’ll clean religiously. But when in doubt, do the three things that matter. So, in advance, thanks for pitching in. We cannot allow spectators. And visits to barns other than your own or throughout the property should be limited to what is necessary. Our credential system is essential to our operation and access to the property will be tightly controlled. If you have any questions, please reach out to the office. Finally, we have a commitment to meet the standards of multiple constituencies and do everything we can to ensure everyone is safe. We will not cut corners. There are also no guarantees that we can avoid, at some point, someone associated with the show testing positive for COVID-19. And when that happens, we will also do what is required and more. In accordance with current USEF standards, we will not notify the community at large when a positive has occurred, but with diligent contact tracing we will notify those impacted. Nonetheless, we are committed to transparency and will provide the appropriate information, as allowed, when anyone wishes to see it. eone associated with the show will test positive. RELEASE, WAIVER, HOLD HARMLESS, DEFEND, AND INDEMNIFICATION AGREEMENT THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS – PLEASE READ CAREFULLY BEFORE SIGNING The undersigned, as a participant, spectator, visitor, guest, invitee, volunteer, vendor, sponsor, and/or contractor, on his or her own behalf and, if applicable, as the parent or legal guardian of a minor participant, spectator, visitor, guest, invitee, volunteer, vendor, sponsor, and/or contractor (collectively “Participant”), for good and valuable consideration, agrees to the following terms and conditions of this Release, Waiver, Hold Harmless, Defend, and Indemnification Agreement (this “Release”): 1. Assumption of Risk and Waiver: Participant understands and accepts the risks of engaging in Equine Activities (as defined below), as well as merely being near a horse or pony (collectively “equine”), including, illness, injury, death, property damage, or any other loss (collectively “Loss”) resulting from faulty tack and equipment, a failure of Released Parties to make a reasonable and prudent effort to determine the ability of the E Participant to engage safely in the Equine Activity or manage safely the particular equine, and/or the result of a dangerous latent condition, as well as: (a) the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them (ex.: jump, run, kick, N buck, bolt, spin, rear up, strike, bite, stumble, fall, etc.), (b) the unpredictability of an equine's reaction to sounds (ex.: machinery, equipment, doors, rain, wind, thunder, voices, ATV’s, gun shots, cars, trucks, snakes, etc.), sudden movement (ex.: rider or jump falling, loose horse or dogs, etc.), and unfamiliar objects (ex.: jumps, poles, barrels, flowers, water, flags, golf carts, etc.), persons (ex.: riders, visitors/guests, spectators, etc.), other animals (ex.: leashed or unleashed dogs, cats, wildlife, etc.), or other things, (c) certain hazards such as surface and subsurface conditions (ex.: LI ground holes, uneven terrain, slippery, hard, or deep footing or flooring, construction material, other dangerous latent conditions of the property, etc.), (d) collisions with other equines or objects, and (e) the potential of a participant to act in a negligent manner that may contribute to injury to participant or others, such as failing to maintain control over the equine, or not acting within his or her ability. Participant understands the Loss that may result from the accepted risks of engaging in Equine Activities or just being near an equine, that equines are powerful and potentially dangerous, N even without warning, and that the risks listed in this Release are just a sampling and Participant is not relying on Released Parties to list all possible equine-related risks. Participant agrees that no warranties or representations as to the condition or safety of Released Parties’ facility have been made. Participant agrees that engaging in Equine Activities under this Release includes, but is not limited to, those defined under California law, as O well as petting, leading, feeding, watering, bathing, or grooming an equine, or assisting with any of these activities, and otherwise interacting with or merely being in the vicinity of equines (collectively “Equine Activities”). Participant understands and agrees that Participant is required to wear an ASTM-standard F1163/SEI-certified equestrian helmet (“Helmet”) while on an equine. Participant is not relying on Released Parties to provide, check fitting, or monitor the wearing of a Helmet. Participant accepts responsibility for the execution of this Release by anyone at Released Parties’ facility at Participant’s request, invitation, or permission, whether or not engaging in Equine Activities. Participant agrees to be responsible for IT his/her personal health and safety, to purchase and maintain his/her own insurance, remain financially responsible for his/her medical expenses, and hereby waives his/her right to any claims arising from participation in or observation of any Equine Activities or merely being present on property owned, leased, rented, visited, organized upon, or otherwise occupied or utilized by Released Parties, regardless of the reason for Participant’s presence on the property. The following shall be included as Released Parties under this Release: Coachella Horse Park LLC, doing business as M Desert International Horse Park, CHP Land Company LLC, CHP Show Management Company LLC, doing business as Apex Equisport, and each of their respective parent, affiliate and subsidiary companies, agents, successors, assigns, employees, volunteers, contractors, representatives, assistants, sponsors, members, managers, shareholders, officers, directors, owners, trustees, licensees, invitees, related entities, as well as any other person or entity acting on their behalf or in any manner connected with the ownership and management of the above listed parties (collectively UB “Released Parties”). Participant acknowledges that he/she hereby waives on his/her behalf and on behalf of his/her heirs and assigns, and fully understands the effect of such waiver, all benefits flowing from any state statute that would otherwise limit the scope of this Release, including but not limited to Section 1542 of the California Civil Code, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” 2. Release/Hold Harmless/Defend/Indemnify/Photo Release: Participant agrees to release, hold harmless, defend, and indemnify Released Parties TS for Loss incurred by Participant or Participant’s property, even if such Loss is caused by negligence or other fault of Released Parties (except gross negligence, recklessness, or intentional misconduct). Participant grants permission for Released Parties to use his/her photograph and video depictions in any format engaging in Equine Activities and/or related moments. 3. Governing Law/Time Limitation/Attorneys’ Fees/Jury Waiver: This Release shall be construed and enforced in accordance with California law. All disputes relating to the interpretation and enforcement of this Release shall be resolved exclusively by the state court in Los Angeles, California. Participant submits to this jurisdiction and venue for such purpose. Participant agrees that this Release does not expire and that any and US all claims and/or causes of actions for Loss by Participant against the Released Parties surviving this Release must be brought within one (1) year of the date accrued and any claim for personal property Loss is limited to Two Hundred Fifty Dollars ($250). Participant agrees to reimburse Released Parties for any attorneys' fees and costs incurred by Released Parties in enforcing this Release and/or in defending or prosecuting any claims or causes of actions involving, or in any way relating to, Participant. Participant agrees to waive trial by jury in any action, proceeding, or claim brought by Participant against Released Parties on any matters related to, arising out of, or connected with this Release. M 4. Severability/Modification: If any provision of this Release shall be determined to be invalid or unenforceable, the remainder of this Release shall not be affected thereby. Each provision of this Release shall be valid and enforceable to the fullest extent permitted by law. This Release can only be modified in writing signed by Participant and Coachella Horse Park LLC’s manager, President, or Chief Executive Officer. 5. Participant Certification: Participant certifies that he/she has read this entire Release and understands, agrees, and intends to be bound by all of these terms and conditions, certifies that Participant signs below voluntarily, understands that the signing below is required for Participant to participate in Equine Activities, and knows that Participant has other facilities to choose from to engage in Equine Activities. DIHP has implemented these Required Biosecurity Measures to decrease the risk of introduction and/or spread of contagious E or infectious disease at its shows. Hunt seat riders are eligible to compete in both rounds 1 and 2, even if the rider receives no score in the first round. Ribbons will be awarded through tenth, along with special prizes. Riders who win a specific LEGIS League Medal Final are no longer eligible to compete in that medal class. JUDGING - All finals will be judged by two judges sitting together. At least one judge must hold an UESF R license in equitation. For the jumper medal final, a jumper judge may serve as the second judge. SCORING - Judges will sit together and provide one score. Scores will be announced. In the hunt seat finals, scores from round 1 and round 2 will be averaged. In the jumper final, the work off score will be added to the first-round score to determine the winner. In the hunt seat finals, the work-off score will be added to the average of rounds 1 and 2, and then the average is taken again. Any ties that occur at the conclusion of the work-off among work-off riders will be determined by the rider with the highest work-off score. RESULTS - Final scores after the work-off will determine the final placing of the work-off riders. In the hunt seat finals, the remaining riders will be placed by their average score after rounds 1 and 2. Any ties will be broken by the round 2 score. In the jumper final, the remaining riders will be placed by their first-round score. Any ties will be broken by the time taken in the second phase of round 1. Riders will be placed through tenth. WORK-OFFS - Any rider with a score of 80 or higher after the first round of the jumper final or with an average score of 78 or higher in the hunt seat finals will compete in the work-off. Specifications for work-offs are listed below. CLASS CONDUCT - The order of go for the first round will be drawn, and the order for the second round will be the reverse of the first round. A horse substitution due to injury or illness will be considered providing a vet certificate is provided and decided by the Show Manager and the USEF Steward. Any special circumstances that arise will be decided by the Show Manager, USEF Steward, and official LEGIS League representative. Their decision will be final.w. AWARDS & PRESENTATIONS - Ribbons will be presented in each round, and championship ribbons and prizes will be awarded to the overall top ten. In addition, the LEGIS League Top Medal Finals Trainer (trainer of champions) will receive a special plaque. The first round course will consist of not more than eight obstacles in the first phase and not more than six obstacles in the second phase. Jumps will be set at 1.0m with spreads to 1.15m. The course must include at least one double combination, and a minimum of three oxers at 1.0m. A liverpool may be used but only with as an option jump. Time allowed in the second phase will be calculated at 350 m/m. There will be no time allowed in the first phase. WORK-OFF ROUND - Any rider with a score of 80 or above will return for a work-off over a jump-off style course. Riders are not expected to ride at speed but should demonstrate an appropriate time saving track and style. JUDGING - Riders will be judged on style, technical merit and use of an efficient, time saving pace and track with jumping and time faults being deducted from the riders equitation score (4 points deducted for each rail down and 1 point deducted for each time fault). Two refusals will eliminate. SCORING - The score from the first round will be added to the score from the work-off round to determine the overall winner. Those not participating in the work-off will be placed in the overall results based on their score from the first round. A rider must receive a score in the first round to be placed in the overall results. EQUIPMENT - Running Martingales used in the conventional manner are legal in the over fences phase only. Standing martingales, German martingales, draw reins, or restricted martingales are prohibited in all phases. Legal bits include snaffles, pelhams, gags, kimberwickes, and two or three ring bits. Enjoy quality courses in our spacious rings with excellent footing. We added some prize money for 1.10m and 1.20m riders. Come have fun! Eligibility: Any horse, regardless of winnings, is eligible to enter any .60m - 1.30m and Open Jumper class. Declarations: Nominated Jumpers must declare on the appropriate form in the Show Office by 5 pm the day before the class is to be held. Classes may be scratched the day of prior to the class starting with no penalty - exception: Special Classes. Classes entered on the Entry Blank constitute a Declaration. Jumper Tables: Refer to the Time Schedule. Time Allowed: The Time Allowed will be based on a speed of 382 yards per minute for all sections unless otherwise noted, and may be adjusted accordingly. Martingales: 1.30m or below: No martingale restrictions when used in a conventional manner. Draw Reins permitted in classes below 1.20m or below that do not offer prize money. Above 1.30m (and all classes restricted to young horses): Only running martingales used in the conventional manner.
