Agency and Brigade Reports 5.1 Shire Report - Chief Bush Fire Control Officer / Emergency Services Department 5.1.1/11/20 - Formation of Bush Fire Support Brigade (E20/12200) Responsible Officer: Community Emergency Services Manager Senior Officer: Director Development Services No officer involved in the preparation of this report has an interest to Disclosure of Officers declare in accordance with the provisions of the Local Government Act Interest: 1995. Authority / Discretion Executive The substantial direction setting and oversight role of the Council such as adopting plans and reports, accepting tenders, directing operations and setting and amending budgets. Report Purpose The purpose of this report is to request the Bush Fire Advisory Committee to consider the formation of the Shire of Serpentine Jarrahdale Bush Fire Support Brigade. This proposes to specifically recognise the Emergency Services Group as a Brigade Entity, which will provide further identity for its members and enable access to further opportunities of Local Government Grants Scheme funding. It is recommended that BFAC support this request, and recommend to Council the establishment of the Shire of Serpentine Jarrahdale Bush Fire Support Brigade. 10.1.14 - attachment 1 Minutes – Bush Fire Advisory Committee – 11 November 2020 Page 5 of 26 Background The Emergency Support Group is a group of existing Bush Fire Brigade members who provide incident management support at fire stations and crew the Incident Control Vehicle operated by the Shire. It is important to note that the Incident Control Vehicle is operated by the Shire under a memorandum of understanding with Department Fire and Emergency Services. Community / Stakeholder Consultation This matter was discussed at the Bush Fire Advisory Committee meeting of 16 April 2020 where it was resolved as follows: 5.10/04/20 BUSH FIRE ADVISORY COMMITTEE RESOLUTION That the Bush Fire Advisory Committee recommends Council NOTES the report from Emergency Support Group and supports research into a report of the possibility of the Emergency Services Group becoming its own independent Brigade/Unit. CARRIED EN BLOC BY ABSOLUTE MAJORITY 9/0 This matter was also discussed at a Brigade Captains Meeting of 16 July 2020 where a “feasibility study” was provided (attachment 1). Statutory Environment Section 36 of the Bush Fires Act 1954 “Local government may expend moneys in connection with control and extinguishment of bush fires A local government may, notwithstanding anything to the contrary contained in any other Act - (a) purchase and maintain appliances, equipment, and apparatus for the prevention, control and extinguishment of bush fires; (b) clear a street, road or reserve vested in it or under its control, of bush, and other inflammable material, for the purpose of preventing the occurrence or spread of a fire; [(c) deleted] (d) establish and maintain bush fire brigades as a part of its organisation for the prevention, control, and extinguishment of bush fires; (e) use any vehicle in controlling or extinguishing a bush fire or in the attempting so to do but the local government must pay to the owner or hirer of the vehicle, in respect of any damage done to a tyre of that vehicle while it was being so utilized, an amount assessed by an employee of the local government authorised by it to assess the cost of that damage; (f) assist the occupier of farm lands within its district to acquire appliances, equipment and apparatus for the prevention, control, and extinguishment of bush fires upon or threatening his land, including the sale, loan or exchange to the occupier of appliances, equipment and apparatus belonging to the local government.” Comment The Incident Control Vehicle is a strategic appliance that forms part of an integrated network of response vehicles within Western Australia. The response area for the Incident Control Vehicle includes areas outside of the Shire. This vehicle is mobilized regularly and for extended durations to incidents outside the boundaries of the Shire at the discretion of Department Fire and Emergency Services. The Group has requested consideration to be formed as a separate Support Brigade, similar to those already operating at the Cities of Swan and Wanneroo. 10.1.14 - attachment 1 Minutes – Bush Fire Advisory Committee – 11 November 2020 Page 6 of 26 a formal management within the Group, instead of being part of other Brigades, which in turn allows them to allocate responsibilities accordingly and create further emphasis on both attracting and retaining volunteers who are interested in incident support. Becoming a separate Brigade would enable direct recruitment, training and succession planning, which is key to long-term success. Through previous discussions, there are members of the community who are interested in becoming a part of the Group but are not keen on fire ground training or placement. At present, nearly half the members are active fire fighters who would still have the ability to help when they wanted to. As they are a support unit of the fire fighters, they would not have to strip Brigade members from active firefighting but would like the ability to recruit specific people who can no longer be active within the Brigades, or who may wish to be in a specific support (rather than firefighting) role. The Brigade would provide support to the Incident Management Teams both locally and out of Shire responses, with the potential to assist with logistics where personnel are available. The Brigade would continue to be based at the Mundijong Station at this point in time. Options and Implications Option1 That the Bush Fire Advisory Committee RECOMMEND to Council the formation of the Shire of Serpentine Jarrahdale Bush Fire Support Brigade. Option 2 That the Bush Fire Advisory Committee DOES NOT RECOMMEND to Council the formation of the Shire of Serpentine Jarrahdale Bush Fire Support Brigade. Option 1 is recommended. Conclusion The establishment of the Shire of Serpentine Jarrahdale Bush Fire Support Brigade will allow for specialized recruitment in logistical support, welfare management, administration control and public relations. The establishment of the Brigade from the Emergency Support Group provides grounds for the justification of further operating fund from the State Government through the ESL process. This will enable brigade planning and growth, and importantly support for the six brigades within the Shire. Report Purpose The purpose of this report is to request the Bush Fire Advisory Committee recommend Council approves amendments to the Terms of Reference of the Bush Fire Advisory Committee as detailed in attachment 2. Relevant Previous Decisions of Council Ordinary Council Meeting - 16 December 2019 -OCM296/12/19 In part That Council REQUESTS that the Chief Executive Officer present the draft terms of reference detailed in the Committees and Related Groups Handbook 2019 -2021 to the next available meetings of the Local Emergency Management Committee and Bush Fire Advisory Committee’s for the consideration of the respective Committees. Background At the Ordinary Meeting of Council held on 16 December 2019, Council was asked to consider a review of Committees and related groups. Through this process, Council was asked to consider revised Terms of Reference for the Bush Fire Advisory Committee. Council subsequently resolved that the proposed Terms of Reference be presented to the next meeting of the Bush Fire Advisory Committee for consideration by the Committee. Community / Stakeholder Consultation Nil Statutory Environment Section 67 of the Bush Fires Act 1954 (1) A local government may at any time appoint such persons as it thinks fit as a bush fire advisory committee for the purpose of advising the local government regarding all matters relating to the preventing, controlling and extinguishing of bush fires, the planning of the layout of fire-breaks in the district, prosecutions for breaches of this Act, the formation of bush fire brigades and the grouping thereof under group brigade officers, the ensuring of co-operation and co-ordination of bush fire brigades in their efforts and activities, and any other matter relating to bush fire control whether of the same kind as, or a different kind from, those specified in this subsection. 10.1.14 - attachment 1 Minutes – Bush Fire Advisory Committee – 11 November 2020 Page 9 of 26 (2) A committee appointed under this section shall include a member of the council of the local government nominated by it for that purpose as a member of the committee, and the committee shall elect one of their number to be chairman thereof. (3) In respect to a committee so appointed, the local government shall fix the quorum for the transaction of business at meetings of the committee and may - a. Make rules for the guidance of the committee: and b. Accept the resignation in writing of, or remove, any member of the committee; and c. Where for any reason a vacancy occurs in the office of a member of the committee, appoint a person to full that vacancy. (4) A committee appointed under this section – a. May from time to time meet and adjourn as the committee thinks fit; b. Shall not transact business at a meeting unless the quorum fixed by the local government is present; c. Is answerable to the local government and shall, as and when required by the local government, report fully on its activities. Comment The proposed Terms of Reference provided to Council at the meeting held on 16 December 2019 are contained in this report as attachment 2. The changes proposed are simple amendments and updated format that align the Terms of Reference with other committees of Council. This supports the effective operation of the Bush Fire Advisory Committee. Options and Implications Option1 That the Bush Fire Advisory Committee recommends Council APPROVES the amendments to the Terms of Reference of the Bush Fire Advisory Committee as per attachment 2. Option 2 That the Bush Fire Advisory Committee recommends Council NOT APPROVE the amendments to the Terms of Reference of the Bush Fire Advisory Committee as per attachment 2. Option 1 is recommended. Conclusion The Bush Fire Advisory Committee recommend Council approves the amendments to the Terms of Reference of the Bush Fire Advisory Committee as per attachment 2. Report Purpose The purpose of this report is to request the Bush Fire Advisory Committee endorse the Brigade Operating Procedures for the management of Bush Fire Brigades throughout the Shire of Serpentine Jarrahdale. Relevant Previous Decisions of Council There is no previous decision relating to this matter. Background Currently the Shire has a Bush Fire Brigade Local Law that does not provide any guidance for management of the Bush Fire Brigades in the Shire of Serpentine Jarrahdale. A new local law has been drafted for the strategic management of all personnel within the Shire of Serpentine Jarrahdale Bush Fire Services. This is presented as item 5.1.5/11/20 of this agenda. The local law references the Brigade Operating Procedures for the overall management processes. While the Local Law sits in draft, the complexities around establishing local laws will see an approximate date of gazettal in May 2021. Preparing and considering Brigade Operating Procedures in advance of this local law coming in to affect, will enable brigades the opportunity to familiarise themselves with the procedures and the expectations associated with them. It will for the first time provide an element of consistency across all of the Shire’s brigades, that will ultimately assist in a robust framework that continues to build the capabilities of the brigades. Community / Stakeholder Consultation All Brigades have reviewed the Brigade Operating Procedures Statutory Environment Section 62 of the Bush Fire Act 1954 62. Local government may make local laws (1) A local government may make local laws in accordance with subdivision 2 of Division 2 of Part 3 of the Local Government Act 1995 for and in relation to — (a) the appointment, employment, payment, dismissal and duties of bush fire control officers; and Ordinary Council Meeting - 15 February 2021 © Shire of Serpentine Jarrahdale 2021
10.1.14 - attachment 1 Minutes – Bush Fire Advisory Committee – 11 November 2020 Page 12 of 26 (b) the organisation, establishment, maintenance and equipment with appliances and apparatus of bush fire brigades to be established and maintained by the local government; and (c) any other matters affecting the exercise of any powers or authorities conferred and the performance of any duties imposed upon the local government by this Act. (2) Where a regulation made by the Governor under this Act is inconsistent with or repugnant to a local law previously made by a local government under subsection (1) and still in force, the regulation prevails and the local law to the extent by which it is inconsistent with or repugnant to the regulation is deemed to be repealed. [Section 62 amended: No. 14 of 1996 s. 4.] Comment The Brigade Operating Procedures seeks to unify and provide a consistent management framework, which reflects a contemporary set of processes and procedures, and which provides effective guidance in the management of brigades and their professional volunteers. It seeks to particularly support Captains in leading their brigades, and the broader Chain of Command in supporting Captains and their high performance brigade teams. The formulation of the Procedures has been undertaken in a consultative manner, with the Chief Bush Fire Control Officer working collaboratively with captains and deputies to gain input and understanding of the set of procedures. Preparing and considering Brigade Operating Procedures in advance of this local law coming in to affect, will enable brigades the opportunity to familiarise themselves with the procedures and the expectations associated with them. It will for the first time provide an element of consistency across all of the Shire’s brigades, that will ultimately assist in a robust framework that continues to build the capabilities of the brigades. Options and Implications Option 1 That the Bush Fire Advisory Committee ENDORSE the Brigade Operating Procedures to enable brigades the opportunity to familiarise themselves with the procedures and the expectations associated with them, in advance of the new draft local law. Option 2 That the Bush Fire Advisory Committee NOT ENDORSE the Brigade Operating Procedures. Option 1 is recommended. Conclusion The endorsement of the Brigade operating procedures for all Shire of Serpentine Jarrahdale Bush Fire Brigades will allow for sound management through specialized documented processes enhancing consistency across all brigades. Adopting these in advance of the local law being finalised will also enable brigades the opportunity to familiarise themselves with the procedures and the expectations associated with them. Report Purpose The purpose of this report is to update the Bush Fire Advisory Committee on the current status of advocacy for a Career Fire Station for the Shire of Serpentine Jarrahdale. Relevant Previous Decisions of Council Background The Shire of Serpentine Jarrahdale is the fastest growing local government in Western Australia. Year on year, the Shire’s growth rate exceeds 5%, and comprises nearly 2 families per day moving in to the Shire. The Shire currently comprises a population of 34,523, with this growing to more than double by 2036 (68,335), and extending beyond 100,000 people by 2050. The Shire previously received a letter from the then Assistant Commissioner Stringer on 25 July 2018, which highlighted the risk of structural response capability for the Shire. The Shire is considered to now require a career fire station facility, located centrally within the emergency services precinct on Mundijong Road, to meet the current and future community need. The Shire’s strategic emergency management planning has identified capability risks as they relate to these vulnerable areas. Significant gap exists in the Career Fire Station response capability for our community. Closing this gap is based on the long-term needs of the State, and results in a commitment to a career station now being required. The detailed justification and reasoning is contained in the letter at attachment 1. The draft Local Law seeks to introduce additional provisions and controls which seek to enable the effective management and administration of the Shire’s bushfire brigades. The updated local law particularly aims to support Captains and the Chain of Command in the effective day to day management of brigades, so that all members of brigades enjoy a clear, consistent and effective framework underpinned by good governance and principles of natural justice. Community / Stakeholder Consultation Should Council resolve to advance the draft Local Law, the Chief Executive Officer will give statewide and local public notice of the proposed local law. Statutory Environment Bushfire Act 1954 Section 43 of the Bush Fires Act provides that a local government which establishes a bush fire brigade shall by its local laws: … provide for the appointment or election of a captain, a first lieutenant, a second lieutenant, and such additional lieutenants as may be necessary as officers of the bush fire brigade, and prescribe their respective duties. Local government may make local laws (1) A local government may make local laws in accordance with subdivision 2 of Division 2 of Part 3 of the Local Government Act 1995 for and in relation to — (a) the appointment, employment, payment, dismissal and duties of bush fire control officers; and (b) the organisation, establishment, maintenance and equipment with appliances and apparatus of bush fire brigades to be established and maintained by the local government; and (c) any other matters affecting the exercise of any powers or authorities conferred and the performance of any duties imposed upon the local government by this Act. Local Government Act 1995 3.16. Periodic review of local laws (1) Within a period of 8 years from the day when a local law commenced or a report of a review of the local law was accepted under this section, as the case requires, a local government is to carry out a review of the local law to determine whether or not it considers that it should be repealed or amended. (2) The local government is to give Statewide public notice stating that — (a) the local government proposes to review the local law; And (b) a copy of the local law may be inspected or obtained at any place specified in the notice; and (c) submissions about the local law may be made to the local government before a day to be specified in the notice, being a day that is not less than 6 weeks after the notice is given. Reflecting an updated and clear local law, the draft integrates an effective set of controls and provisions, underpinned by principles of natural justice, to enable the effective administration of brigades. CARRIED UNANIMOUSLY 9/0 5.2 Department of Fire and Emergency Services A briefing on the weather analysis for the upcoming season and aviation support was provided to the meeting. Copies of the presentation as discussed, are attached to the minutes. 5.3 Department of Biodiversity, Conservation and Attractions Completion of Spring burns ending, which have all gone extremely well. Burning undertaken to the North East and South of Jarrahdale town site, including, Pipehead Dam, Gordon block and McKay Drive. The burn programme for Autumn includes Serpentine national Park to minimise the risk to the surrounding areas. DFES and DPAW have received confirmation from the Department of Transport regarding flame throwers attached to the back of utility vehicles. An exemption in licencing conditions is required to use this and the Department have been extremely helpful in cutting through red tape in order that these be operational again by Autumn. DPaW have received positive feedback from the Jarrahdale community regarding the burns that have taken place. DPaW, DFES and local Brigades have worked well together this season which is positive and builds bonds between the agencies. 10.1.14 - attachment 1 Minutes – Bush Fire Advisory Committee – 11 November 2020 Page 22 of 26 5.4 Byford Brigade Byford has 48 listed members currently with 10 of those in varying stages of probation and training. We are currently going through a pre-season skills audit for each member to ensure volunteers are all up to speed. We have 15 Cadet members meeting weekly with approximately half of them related to adult members. Both vehicles are in good shape having recently had significant repairs. There will be heightened awareness of looking after them this season. We have been attending community events to help with general awareness. There is a local Truck Show this month where we will be assisting with organising the parking area and accepting donations from attendees. Still undertaking hazard reduction burns on private and council land while we can. 5.5 Mundijong Brigade Brigade has eight new members this year, it is a young Brigade but have a wealth of knowledge. Brigade thanked DFES and Shire Officers for the maintenance of vehicles. Repairs were undertaken promptly. Mundijong is looking forward to a good season. 5.6 Jarrahdale Brigade Jarrahdale thanked all of the Shire trainers for their work this year, giving up weekends to undertake training, which was especially difficult this year due to COVID. Maintenance of the vehicles prior to the upcoming season has been great. Jarrahdale are still undertaking prescribed burns and also thanks DPaW 5.7 Serpentine Brigade The purpose of this report is to advise the Shire of Serpentine Jarrahdale Bushfire Advisory Committee of the activities that have occurred over the last reporting period, upcoming activities and any key matters pertaining to the Serpentine Volunteer Bushfire Brigade 1. Transition following 2020 AGM Following the 2020 Annual General Meeting, a new Captain and Lieutenant were elected into the Executive group, with no other changes. Over the last 3 months, the brigade has been transitioning to a new Operating Model whereby each of the Operational Officers are now directly responsible for a portfolio in the brigade (all directly reporting to the Captain). This has already proven to be of great benefit to the overall management of the brigade with clear division of responsibility and workload across the team. Following the AGM, the brigade has transitioned back to normal operations post COVID-19 restrictions. 2. Management and Administration The brigade currently has 49 registered members. Following a recent review of the membership list by the Operational Officers group, the breakdown now sits at: o Eleven (11) Non-Operational Support and Auxiliary Members; Ordinary Council Meeting - 15 February 2021 © Shire of Serpentine Jarrahdale 2021

In addition, there are also three (3) members in various phases of inductions. The brigade also currently has eight (8) cadet members following the resumption of cadets for the final term of 2020. Over this period, the brigade has supported a small number of community events, including a visit to the Byford Scouts, Serpentine Airfield Annual Fly in and the Community BBQ at Jarrahdale. 3. Operational Response The brigade has responded operationally to five (5) incidents so far this financial year, consisting of: o Three (3) Primary Responses. All were justifiable false alarms from controlled burns; and o Two (2) Support Responses within the shire with Mundijong (1) and Keysbrook (1). The brigade has continued to increase its use of the BART system to manage turnout with an increase in participation by brigade members. 4. Preparations and Readiness Over the month of October, the brigade has focussed its training towards the completion of Preseason Skills Assessments for all active brigade members. To date, 65% of all active registered members have completed their assessments, with the remainder targeted over the month of November. The key areas focused on are Safety and Survival, Radio Operations and pumping operations on both appliances. The brigade would like to thank DCBFCO3 Chris Wells for putting together a turnout package for us which has now been socialised with all members. Ongoing Hydrant and Water Supplies inspections are continuing on a regular basis. The brigade also had representatives attend both the WAFES Conference (2) and Metro Pre-Season Forum (2). 5. Fire Control and Hazard Reduction Burning There have been thirty five (36) permits issued across both of the Serpentine FCO districts during the 2020 Spring Restricted Season. Overall, discipline and adherence to the stipulations of Permits has been good. The brigade has undertaken three (3) hazard reduction burns during this period. These burns have consisted of: o Two (2) Private Pile Burns; and o One (1) Private Scrub / Grass Burns; During this period, both brigade FCO’s have undertaken detailed inspections of their districts to ascertain any key risks in these areas. Further work regarding bushfire response has been undertaken by the CBFCO with the Prison. 6. Training During this period, the brigade has seen the following training completed for new Members: o Seven (7) Brigade members have completed their on station inductions; o Four (4) Brigade members have completed their Bushfire Safety Awareness Training; and o One (1) Brigade member has completed Bushfire Skills Training Brigade Training o Brigade training over this period following the lifting of COVID restrictions have been focussed on core basic skills in preparation for the season. o Training has seen a steading increase in attendance in the lead up to the season. During this period, a number of brigade members have attended a number of accredited Training Courses; o Three (3) Brigade Members have undertaken First Aid Training; o Three (3) Brigade Members have undertaken Structural Fire Training; and o Five (5) Brigade Members have undertaken 4wd Training 7. Equipment and Facilities Appliances and Equipment o Both the Serpentine 3.4U and LT are fully operational in the lead up to the fire season with a number of defects being rectified on both appliances. The brigade would like to acknowledge the support and responsiveness of the shire in addressing these issues. Station o Just prior to the introduction of the COVID restrictions, the brigade completed a self-funded substantial renovation of the old LT appliance bay and office area into a meeting and training room. This was lead in no small part of two (2) brigade members with some fantastic support from the community. This room has boosted the liveability of the facility for the brigade and has been a significant morale booster. o The brigade has commence planning of the next phase of renovation to the kitchen and amenities area of the building, noting the increase in brigade members and the need for functional amenities that suit the requirement of the brigade and its members. 5.8 Keysbrook Brigade There has been no change in leadership within Keysbrook Brigade. Membership remains stable. A monthly training programme is now in place and the Brigade have responded to a couple of incidents. The Brigade and Community held an event last month in memory of Marie Gallin who recently lost her battle with cancer. They will also be in attendance at the Keysbrook Community Markets. 5.9 Oakford Brigade Members were very disappointed to hear the initial application for funding for the new Oakford Station was rejected by the LGGS funding board. After nearly 4 years with no plan, it was great to see so much positive progress on the project in 2020. Members are hopeful this is just a bump in the road and we can keep working towards a new permanent home for Oakford Bush Fire Brigade. COVID made a bit of a mess of our winter training schedule but thankfully we have retained a good amount of both new and established members and we are consistently seeing good numbers attending regular training and hazard reduction burns. This training season we have put 5 members through the new Bushfire Safety Awareness course, 4 through Bushfire Fighting, 3 through Bushfire Fighting Skills and 4 through External Structure Firefighting courses. I’d also like to acknowledge the efforts of the SJ training team as it is a big ask to give up their entire weekend to train our volunteers, being volunteers themselves. In addition, this year again thanks to COVID meant a very compressed training period. SJ Shire is very lucky to have them. The annual AGM saw only one change to the officers group with Ross Cooper taking up 2 nd lieutenant role. We also had numerous members put up their hands for support roles in the brigade. It was great to see so much enthusiasm from members in making the brigade function. Moving towards fire season I believe Oakford is in a healthy position with a good spread of enthusiastic new members and experienced members. Most of these members are also available during regular work hours where we have experienced shortages in previous years. 5.10 Emergency Support Group The Emergency support Group have been conducting training both within the Shire and with DFES. Their focus has been on roles and responsibilities and communication protocols. There have been a number of enquiries from persons who are interested in joining ESG without joining a Brigade.
