DPA POLICY BACKGROUND • DPAs established in 1978 to identify coastal geographic areas that provide primary characteristics that are essential for water-dependent industrial (WDI) uses • DPA rules to protect WDI uses on water-side areas incorporated into Waterways Regulations (310 CMR 9.00) in 1979 • Jurisdiction of Waterways regulations (including DPA rules) expanded to include filled tidelands in 1984 • DPA regulations (301 CMR 25.00) setting forth procedure for establishing and reviewing DPA boundaries promulgated in 1994

DPA BOUNDARY REVIEW • The purpose of the DPA boundary review process is to determine: • if a DPA boundary should remain as it is currently established or • whether it should be modified to more appropriately protect water-dependent industrial uses and promote the goals of the DPA policy and overall state growth and environmental policy
EAST BOSTON DPA • East Boston DPA established in 1978 • East Boston DPA boundary reviewed in 2002 (decision issued in 2003) • Boundary at Boston East site modified in 2008
INITIATION OF BOUNDARY REVIEW • At discretion of CZM Director or at the request of: • A municipal body with authority to enact zoning (e.g., municipal official, planning board, City Council) • Any state/regional planning agency with authority over the area proposed for review • Owner(s) of area proposed for review • Any ten citizens of the Commonwealth • On January 30, 2020 BPDA requested review of East Boston DPA boundary • On March 16, 2020 CZM accepted request and expanded scope of review to include entire DPA
PUBLIC NOTICE OF BOUNDARY REVIEW • Notice of request for boundary review (February 10, 2020 edition of Environmental Monitor) • Notice of response to boundary review published in Environmental Monitor (February 10, 2021) and local paper (February 8, 2021 in the Boston Globe and February 11, 2021 in El Mundo) • CZM accepts public comments for 30 days (until March 12, 2021), which may be extended with public notice • Public information meeting within 30-day comment period (February 23, 2021)
CONSULTATION PERIOD • Consultation period begins at close of public comment period • Establish a work plan as a group, including: • Planning representative(s) • MassDEP • Operators of WDI facilities • Others as appropriate • Lasts six months unless otherwise agreed by participants
DESIGNATION REPORT • Designation report issued by CZM within 30 days of close of consultation period • Report includes: • Areas to be included/excluded • Maps of proposed changes • Data and analyses on which the proposed changes are based
PUBLIC COMMENT ON DESIGNATION REPORT • Notice of the designation report and public hearing published in Environmental Monitor and local paper(s) • CZM accepts public comment for 30 days (may be extended upon request and with notice) • CZM holds a public hearing during 30-day comment period
ISSUANCE OF DESIGNATION DECISION AND MAP AMENDMENT • Final Designation Decision issued by CZM within 60 days of end of comment period • Decision is effective immediately • Notice published in Environmental Monitor and sent to relevant parties
PROCESS Boundary Review CZM meets with CZM issues is initiated by CZM agency and 30 days written designation or city/town town/city report representatives to scope work plan and schedule City/town submits information necessary to Public comment proceed period; Monitor and 30 days local notice; Public Local public hearing meetings and information Public comment gathering 30 days period; Monitor and 60 days local notice CZM issues final CZM arranges written 6 months Close of designation consultation consultation period decision session

DESIGNATION STANDARDS • Areas not eligible for review • Standards for designation of waters • Standards for designation of lands
AREAS NOT ELIGIBLE FOR REVIEW • Subject of decision within previous 5 years • WDI use has occurred within previous 5 years, unless that use did not take place on a continuous basis for a substantial period • Recommended for exclusion from review by city council or other zoning body • Land area is entirely bounded by existing DPA lands and/or waters
PLANNING UNITS • CZM applies the following eligibility criteria to groups of parcels (planning units) rather than individual properties • DPA-related attributes vary across different parcels such that the combined characteristics are not accurately reflected in the characteristics of any single property • Geographic areas reviewed are sized and configured in a manner that allows consideration of all relevant factors affecting eligibility to accommodate water-dependent industrial uses
STANDARDS FOR DESIGNATION • An area of water/land reviewed shall be included in a DPA if CZM finds that the area is in substantial conformance with the following criteria governing suitability to accommodate water-dependent industrial use: • Designation of waters • The water includes or is contiguous with other DPA waters that include • A navigable entrance or main channel with a design depth of at least 20 feet AND • Substantially developed shoreline with piers, wharves, bulkheads, or other structures that establish a functional connection with land meeting the criteria for DPA lands • Configuration, size, and location of water area is conducive to DPA uses; and • DPA water area includes, at a minimum: • All channels, mooring areas, and turnaround areas serving as access channels to DPA lands/waters • Water lying between entrance/main channel and DPA land/waters
STANDARDS FOR DESIGNATION • Designation of lands • Land area includes or is contiguous with other DPA lands that include a substantially developed shoreline with a functional connection to DPA waters • Reasonable proximity to rail/road links to major routes and water/sewer facilities capable of supporting industrial use; • Topography that is conducive to or easily adapted to industrial use; and • Use character is predominately industrial or reasonably capable of becoming predominately industrial
C ASE STUDY • South Boston DPA Boundary Review • Report and decision issued in 2018 • Boundary removed one planning unit from DPA and added another
