BoomBet Pty Ltd Betting Rules 17th August 2021 Who we are • "BoomBet" refers to BoomBet Pty Ltd, a company registered in Australia under the Corporations Act 2001. • Our Australian Company Number (ACN) is 141 712 665. • BoomBet is licensed by the Northern Territory Government to accept bets on sports and racing, by both telephone and internet. General • These Terms are correct as of the date of this document • These rules relate to the use of www.BoomBet.com.au and any other websites, portals or mobile apps offered by the company. • BoomBet cares strongly for its public reputation and does not permit persons under the age of 18 years to hold an account. If your children have access to the computer you are using to log into BoomBet's Internet service, we encourage you to install a child protection software package (eg. Cyber Patrol, Net Nanny). • BoomBet reserves the right to refuse any wager or part of a wager without giving a reason at any time if any one or more of the following occur: 1. The Client is less then 18 years age. 2. The Client is betting on behalf of a person who is less than 18 years of age and/or 3. The Client is in breach of these rules • A Client is deemed to have accepted these Rules and BoomBet's Privacy Policy by opening an account or by placing a wager with BoomBet via the telephone or via the BoomBet website. Clients can view the Privacy Policy on the BoomBet website, or request this in writing. • BoomBet reserves the right to change, amend or add to these Rules and BoomBet's Privacy Policy as it sees fit without providing further notice other than posting the current Rules or Privacy Policy on this website (www.BoomBet.com.au). It is the Client's responsibility to ensure they are up to date with the current Rules of betting. • In addition, BoomBet reserves the right to close a Client's Betting Account and refund their balance without further explanation. In this event, outstanding wagers will be honoured unless BoomBet management can demonstrate that these bets were fraudulently obtained. • BoomBet reserves the right to refuse any wager • These Rules are intended to contain all the terms of our agreement with you in relation to your betting. If a member of staff has made a statement to you that is not covered by or is at variance with any provision of Rules you should inform Customer Services immediately before you commence betting with us. We warn you that the law favours written terms and it is therefore important that you bring any such statements to our attention before you commence your betting with us. Member Obligations • Members are responsible for ensuring that their Account details such as their address, telephone number, email address and payment/bank details (including any Credit card expiration details) are kept up to date and to notify us immediately of any incorrect Account 1
details. In the event that a Member has not kept their Account details up to date, we reserve the right to suspend the Account. Members are responsible for complying with their own local, national or state laws concerning betting prior to either applying to become a Member or placing a bet on their Account. In particular, if you are a resident of a country where online or telephone betting is prohibited, you must not register with us, attempt to use our services or use your payment card or other payment method to bet with us. For legal or commercial reasons, we do not permit Accounts to be opened by, or used from, customers who reside in certain jurisdictions, The list of Restricted Jurisdictions may be changed by us from time to time and you will be deemed to be aware of and accept any changes to this list. You agree that you shall not open an Account, nor attempt to use your Account, if you are within a Restricted Jurisdiction. • We periodically monitor transactions on Accounts. You accept that if we detect activity which indicates to us that you are or may be within a Restricted Jurisdiction and are or may be betting on your Account, we may, in our discretion, either suspend or permanently close your Account. You accept that the data available to monitor betting on an Account is not always accurate and BoomBet will use its discretion in accepting any bets on your Account while conducting any investigation. • In the event that Sportsbettinc.com.au discovers that an Account has been opened by someone who resides in a Restricted Jurisdiction, BoomBet may in its discretion close the Account and request proof of payment method, personal identification and bank account information prior to permitting a withdrawal of the original funds. Winnings may be forfeited if the Account holder opens the Account contrary to these Rules. • A Member must immediately notify BoomBet of any matter (including any potential mental impairment) which may lead us to reasonably infer that your ability to make sound judgments about betting in respect of your Account may be impaired. Identification Requirements • BoomBet is required to identify each person who opens an account. If your identification is not received within 14 days of opening your account, the account will be suspended until identification is received. All bets pending at the time of suspension will stand. • If an account is suspended following non-receipt of the required identification, any funds remaining in the account will be frozen. • In most cases we will attempt to verify your identification automatically using the information provided during your account application. This data will be checked against external registers such as electoral rolls. Where we are unable to verify your account automatically, you may be required to provide us additional information and/or documentation. • The requirements to verify your account may vary from time to time depending on multiple factors including our own internal policies, changes to government and licencing legislation and other external factors. Click here to see the current identification requirements. • If a Prepaid/Virtual/Electronic/Travel/Debit/Credit card is to be used by a Member to fund the Account, legible copies of the front of the applicable card may be requested by SBCA for its approval. SBCA reserves the right at its discretion to refuse to accept a Credit card including but not limited to in circumstances where the Credit card is dishonoured. Credit cards used to fund a Member’s Account must match the Member’s Account details. Credit cards with a name other than that which is registered with SBCA for the Account in question will be refused and the Account may be suspended until proof of consent is provided by the third-party cardholder. SBCA reserves the right to request a copy of the 2
front of the card registered on the Account at any time. Receipt of a card is no guarantee of Account activation/re-activation. • Should a Member deliberately falsify any ID or any other details for any purpose associated with applying for an Account or transacting on the Account, BoomBet reserves the right to suspend the Account and/or close the Account without prior notification to the Member. • All certified documents must be produced in the English language or they will be rejected. BoomBet reserves the right to carry out checks on the individual certifying documents and to get in touch with them to verify the validity of the document. BoomBet may in its discretion reject certified documents for any reason. Account Security • A Member is responsible for ensuring that their user name and security details (including any personal identification number (‘PIN’), password or Account number) (‘Secure Member Details’) are kept confidential. If a Member suspects that their Secure Member Details may no longer be confidential or that there may have been unauthorised use of their Account, they must notify BoomBet immediately, and BoomBet may provide the Member with new Secure Member Details. Where BoomBet provides the Member with new Secure Member Details, BoomBet reserves the right to invalidate any future transactions which attempt to utilise the previous Secure Member Details of that Member. • Where a Member wishes for another individual to have access to their Account or any Secure Member Details (including any family member, business or corporate entity or any other person whatsoever), this must first be approved by BoomBet and details for that person provided. BoomBet may refuse such request for access at its discretion. A Member remains solely responsible for their Account including but not limited to transactions, bets and Account changes made by any authorized individual. BoomBet reserves the right to request full certified identification documentation from any proposed nominee. • Members will be responsible for all bets on their Account in which their Secure Member Details are used. Members should check the balance of their Account each time they log on to their Account or at the time they place their bet. In the event of a query, it is the Member’s responsibility to notify BoomBet immediately. Fraud • Where it is determined that an account is being used by a third party or on behalf of a third party, BoomBet reserves the right to close a betting account or place restrictions on the account which may limit the products available to it. • Any other linked accounts may also be restricted or closed following an attempt to circumvent any of these betting rules at the sole discretion of BoomBet. • These Rules shall be governed by and construed in accordance with the Laws of the Northern Territory and each Client irrevocably submits to the exclusive jurisdiction of the Northern Territory Courts in respect of any dispute or matter arising from these Rules. • The regulatory authority is the Racing Commission or such other authority authorized by the Laws of the Northern Territory for that purpose. • A Client may only have one (1) Betting Account unless otherwise agreed to by BoomBet. If a Client has additional Betting Account(s), then the account balances of all associated Betting Accounts may be transferred into the original Betting Account and; 3
• If, after the transfers the original Betting Account has a debit balance, then BoomBet shall be entitled to receive payment for the debit balance immediately or, • If, after the transfers there is a credit balance in the original Betting Account, the credit balance will be held by BoomBet until such time as a determination has been made by BoomBet as to whether or not there has been a breach of these Rules. • We may have reason to suspect that you have been involved in fraudulent, improper, misleading, manipulative or other unacceptable activity (whether or not unlawful) in relation to your access to or use of our Services. Such activity can include (but is not limited to) that you: o used or attempted to use any software-assisted methods or techniques or hardware devices for participation or manipulation of any of our systems; o have introduced or attempted to introduce any virus or other harmful or malicious application or material to our systems; o have introduced or attempted to introduce any defamatory, obscene, abusive or unlawful material to our systems; o have abused or misused any bonus offer or promotion offered by us; Deposits There are four ways to deposit into your account with BoomBet; 1. POLi 2. Credit/Debit Card 3. BPAY 4. Bank Deposit POLi • POLi allows you to instantly transfer funds from your Australian bank account to your account with BoomBet. • You must have an internet banking facility already setup with your bank. • There are no fees or charges. • Visit the POLi website for more information. Credit/Debit Card • BoomBet only accepts Mastercard and VISA. • Credit/Debit card deposits can only be made in Australian dollars. If your account is held in another currency, you will be shown what amount of Australian dollars will be debited to your card. • To prevent credit/debit card fraud, any subsequent account withdrawals can only be made to the same credit/debit card. • BoomBet also records the IP address of your computer so that people fraudulently using credit/debit cards can be prosecuted by the authorities. BPAY • Australian customers can deposit funds using BPay • Australian banks allow money to be transferred overnight via telephone and internet banking, with no fees or limits. • Our BPay Biller Code is 23580. • After you have logged on, your BPay Reference number can be found in the banking section of our website. 4
• Deposits will only be processed between 8am and 3pm Monday to Friday. Bank Deposit • Australian law prohibits our customers from anonymously depositing "cash" into our bank account. • Australian customers can deposit cheques into our account, or transfer money directly from their bank account to ours. Funds will be available after they have cleared. • International customers can make telegraphic/wire transfers. • No fees are applicable. • Bank account details are available through the My Account section of our site. • Deposits will only be processed between 8am and 3pm Monday to Friday. Withdrawals There are two ways to withdraw from your account with BoomBet. 1. Credit/Debit Card 2. Bank Withdrawal Note: You may only request a withdrawal once you have turned over (bet) the total amount deposited. Withdrawals requested before funds have ben turned over will be cancelled. Funds must be returned to the original source where possible. For example, if you deposit funds by credit/debit card, withdrawals up the amount of your deposit will be sent via credit/debit card. Credit/Debit Card • If you deposit into your account using your credit/debit card, any subsequent account withdrawals can only be made to the same credit/debit card. • No withdrawals can be submitted until your card has been verified. Follow the steps outlined in your account to complete the verification online. Bank Withdrawal • Australian customers can have money deposited directly into their bank account. Deposits usually take place overnight. • International customers can receive telegraphic/wire transfers to their bank account. • Customers requesting telegraphic transfers must cover the costs charged by our bankers (currently $30 AUD). Withdrawals are processed each weekday (excluding Australian Public Holidays). Your withdrawal must be received by 3pm in order to be processed the same day. Responsible Gambling • Sportsbetting has implemented all areas of the National Consumer Protection Framework in accordance with our gambling licence issued by NTRC, and; o makes every reasonable effort to prevent self-excluded customers from returning and using our service; o provides pre-commitment facilities to help you control your spend (you can access these via the “My Account” section of our Website); and o provides a self-exclusion facility to help you if you feel that you have developed a gambling problem. At your request, we will prevent you from using your Account indefinitely. To this end, we may retain such personal information as is necessary (and for as long as is necessary) to implement the self-exclusion facility as effectively 5
as possible, including the following information: your name, address and payment details. For information on problem gambling generally, please follow the links at the bottom of this and/or other pages of the Website. • If you are a self-excluded customer: o you must not attempt to open an Account or place any bets with us (using your Account or otherwise) o you are fully liable for your actions, and for all activity and bets placed on your Account; and • Subject to these Rules, if BoomBet considers that you have deliberately circumvented our controls (e.g. by opening a duplicate Account) and placed bets while you are self-excluded: o (i) open/pending bets will be voided and the original stake returned to your Account; o (ii) resulted bets will stand; and o (iii) the balance of your Account will be returned to you. • BoomBet marketing and communications are aimed at over 18’s only. Sportsbetting does not market to individuals for whom gambling has become a problem. Information provided to governing bodies • BoomBet reserves the right to provide governing sporting bodies, upon their request, with: o records or documents in the possession or control of BoomBet (excluding bank account and credit card details) relating to betting transactions of the Client; and o the names, contact details and similar identifying information in the possession or control of BoomBet • Such information will only be provided to assist in a legitimate inquiry conducted by the governing sporting body to maintain the integrity of the sport. The Client consents to BoomBet providing the above information to the governing sporting body. "Governing sporting body" means an orgainisation charged with the administration of any particular sport or sporting event. General betting rules • All dividends shown are the return for a $1 investment • All amounts are shown in Australian dollars unless otherwise specified. • TAB based dividends shown on our website are approximate only and for indication purposes. • If a Client receives a bonus that requires a deposit to be made to claim the bonus, both the deposit and the bonus must be wagered. BoomBet reserves the right to remove the bonus and refund the remaining balance should a Client be in breach of these conditions. • BoomBet reserves the right to withhold funds from Clients who have not completed the identification process. Funds will be released as soon as this process has been completed • Your account will be charged an inactive fee if you have not made a deposit or placed a bet for a period of more than 12 months. In order to keep your account open, you will be charged $5 per month that the account remains dormant, but your account balance will not drop below $0.00 due to inactivity fees. • Inactivity fees will be deducted automatically and without notice. Fees will be visible within the Transactions section of your My Account screen. • BoomBet reserves the right to refuse any wager. 6
• We reserve the right to cancel and void any bet, regardless of whether it relates to a Promotional Offer or not and regardless of whether it is pending or resulted, where we determine that the bet is an irregular bet or there is an irregular betting pattern. • Each Client will be issued a Betting Account before wagers are accepted. • Winnings will be credited to a Client's Betting Account following confirmation of the final result. Should funds be credited to a Client's Betting Account in error, it is the Client's responsibility to notify BoomBet of the error without delay and the Client shall return to BoomBet any funds credited in error. Dispute resolution • As a first point of reference, you should direct your dispute to the Customer Service team by emailing support@BoomBet • If any dispute cannot be settled satisfactorily between BoomBet and the Client, the matter shall be referred to a representative of the Northern Territory Racing Commission. Any disputes can be referred to the Commission using their website for final determination and all wagers will be adjusted accordingly. • We reserve the right to close any pending Bet or alleged pending Bet that is the subject of a dispute by you as to any material term of the Bet in order to minimise the financial consequences of the Bet pending the resolution of the dispute and any such closure will be valid and effective as though made with your agreement. Terms under which wagers are accepted • All bets on an Account are considered to be placed and received in the Northern Territory, Australia. • BoomBet reserves the right to close and/or impose limits on a Member’s Account (including limits on any Sportsbetting products that a Member may wish to bet on but not for the purpose of avoiding the operation of the NSW bet requirements) and refund the balance of their Account, without providing reasons. In this event, we will honour any outstanding bets made pursuant to the Account, unless the Member’s Account has been used for any fraudulent transaction or purpose, in which case any such bets will be void. • Clients must be 18 years of age or older. • Wagers will be accepted up to the advertised start time of the event or such earlier time as dictated by BoomBet specified on the website at the event page. If a wager is inadvertently accepted in respect of an event after it starts, at the discretion of BoomBet management the wager may be deemed to have been made invalidly and will be refunded to the Client. • Clients should check their Client Account Balance each time they log on to their Betting Account or at the time they place their wager via the telephone. In the event of a query, it is the Client's responsibility to notify BoomBet at the earliest opportunity and provide the Client's own record of transactions since the Client Account Balance was last verified. • BoomBet may not accept a wager via the telephone where the wager is less than AUD$10.00. • The minimum wager via the Internet is AUD$1.00. • BoomBet shall make a recording of all telephone discussions with Clients when Clients are placing a wager, lodging a dispute or a query on their account. The Client acknowledges this and agrees to such recordings being made and, where a dispute occurs which cannot be resolved by BoomBet, the Client agrees that the relevant recording(s) and/or any records of a Client's transactions via the Internet may be made available to the regulatory authority to enable the dispute to be determined in accordance with these Rules. 7
• Clients are unable to cancel or change a wager once the wager has been placed and the acceptance confirmed. • All wager prices/lines are subject to variation and with the exception of tote-related or top fluctuation wagers will become fixed at the time the wager is accepted. • Each-way wagers placed on the Internet must be the same stake for the win and place portion. • Unless otherwise agreed, the maximum amount that may be paid out on any bet is $100,000. • In the event that your expected payout exceeds these limits you may see a cash deduction in your account for the corresponding amount. For example, if a bet pays you a win of $102,000, a deduction will be made of $102,000-100,000=$2,000. • Any deduction from your account balance will occur within 72 hours. If you have insufficient funds in your account, you will have 48 hours to send payment for the appropriate amount. • If your Bet has not been accepted in the first instance, BoomBet reserve the right to accept your bet at an equal or lower stake, as long as the price has remained the same and the event relating to the bet has not started. Minimum Bet Limit (MBL) Many racing bodies have minimum bet laws which dictate the minimum amount a wagering operator is required to accept a fixed-odds bet to win. Different racing bodies have different limits and times for bet acceptances as outlined below. Please note that individual bodies may impose different limit requirements for different wagering operators. For NSW Thoroughbred events, the following minimum bet levels will be applicable for wagers made, after 9.00am AEST or AEDT (whichever is applicable) on race-day for day meetings or 2.00pm AEST or AEDT (whichever is applicable) on race-day for night meetings: RACE TYPE BET (WIN AND/OR EACH WAY/*WIN & PLACE) Metropolitan NSW Thoroughbred races $2,000 (*place component $800) Non-metropolitan NSW Thoroughbred races $1,000 (*place component $400) For Victorian Thoroughbred events, the following minimum bet levels will be applicable for wagers made, after final fields are available: RACE TYPE IN ANY ONE WIN, WIN/PLACE OR IN ANY ONE EACH-WAY BET PLACE BET Metropolitan Victorian $2,000 $800 Thoroughbred races Non-metropolitan Victorian $1,000 $400 Thoroughbred races For Queensland Thoroughbred events, the following minimum bet level will be applicable for wagers made, after 9.00am AEST on race-day: 8
RACE TYPE IN ANY ONE WIN, WIN/PLACE OR IN ANY ONE EACH-WAY BET PLACE BET Metropolitan Queensland $2,000 $800 Thoroughbred races Non-metropolitan Queensland $1,000 $400 Thoroughbred races For South Australian Thoroughbred events, the following minimum bet levels will be applicable for wagers made, after 9.00am ACST on race-day for day meetings or 2.00pm ACST on race-day for night meetings: RACE TYPE IN ANY ONE WIN, WIN/PLACE OR IN ANY ONE EACH-WAY BET PLACE BET Metropolitan South Australian $2,000 $800 Thoroughbred races Non-metropolitan South Australian $1,000 $400 Thoroughbred races For Tasmanian Thoroughbred events, the following minimum bet level will be applicable for wagers made, after 9.00am AEST or AEDT (whichever is applicable) on race-day for day meetings or 2.00pm AEST or AEDT (whichever is applicable) on race-day for meetings commencing after 5.00pm AEST or AEDT (whichever is applicable): RACE TYPE FIXED ODDS WIN ONLY FIXED ODDS PLACE ONLY BET BET Any Tasmanian Thoroughbred $1,000 $400 races For Thoroughbred events conducted in Canberra, the following minimum bet levels will be applicable for wagers made, after 9.00am AEST or AEDT (whichever is applicable) on race-day: RACE TYPE BET (WIN AND/OR EACH WAY/*WIN & PLACE) Black Opal Stakes Race Meeting $2,000 (*place component $800) Standard Race Meeting $1,000 (*place component $400) For NSW Harness events, the following minimum bet levels will be applicable for wagers made, after 10.00am AEST or AEDT (whichever is applicable) on race-day: RACE TYPE BET (WIN ONLY) 9
Metropolitan NSW Harness races $1,000 Non-Metropolitan NSW Harness races $500 All NSW Harness races at that Platinum Race Meeting $2,000 For Victorian Harness events, the following minimum bet levels will be applicable for wagers made, after 10.00am AEST or AEDT (whichever is applicable) on race-day: RACE TYPE STAND TO LOSE (FIXED ODDS WIN ONLY) Victorian Metropolitan Meeting (Friday, Saturday or Sunday $1,000 at Melton) Victorian Country Meeting $500 For Queensland Harness events, the following minimum bet level will be applicable for wagers made, from within an hour prior to the scheduled start time of the opening race of the meeting / race programme: RACE TYPE IN ANY ONE WIN BET (TO LOSE) Any Queensland Harness Race $500 For Victorian Greyhound events, the following minimum bet levels will be applicable for wagers made, from within two hours prior to the scheduled start time of the opening race of the meeting/race programme:- RACE TYPE BET TYPE (WIN AND/OR PLACE) Group 1 Victorian Greyhound Race Meetings (Final Field) $2,000 (*place component • All Group 1 races that take place at The Meadows and $1,000) Sandown Park except for the Sale Cup. (Note: total aggregated risk is $2,000) Metropolitan Victorian Greyhound Race Meetings $1,000 (*Place component $500) • Primarily: (Note: total aggregated o Sandown Park – Thursday risk is $1,000) o The Meadows – Saturday Non-metropolitan Victorian Greyhound Race Meetings $500 (*Place component $250) (Note: total aggregated risk is $500) 10
For Queensland Greyhound events, the following minimum bet level will be applicable for wagers made, from within an hour prior to the scheduled start time of the opening race of the meeting / race programme: RACE TYPE IN ANY ONE WIN BET (TO LOSE) Any Queensland Greyhound Race $500 Errors • If the Website erroneously allows a Member to place a bet after a sports or racing event has commenced or been completed, the Member agrees that BoomBet may retrospectively void the bet and demand repayment where any winnings from the void bet have been withdrawn from the Member’s Account. • In such an instance, a Member agrees that BoomBet is entitled to issue the Member with an invoice in respect of the amount of the winnings paid in error, and that the invoice shall be evidence that the amount is immediately due and payable. BoomBet may request documents from a Member to assist in investigating such errors. Refund Policy • Please check your wagers carefully before submitting them to sportsbetting, as we cannot give refunds. • We may decide to refund certain bets at our discretion, but are under no obligation to, as all bets placed by clients should have been carefully reviewed and checked Racing • Where a race meeting is transferred from one racecourse to another, all bets placed before the transfer will be cancelled due to changed conditions. • If a race is abandoned then all live bets on that races will be cancelled and monies refunded, subject to BoomBet Betting Product Rules for specific bet types. • If a race is postponed then all wagers placed after final field stage on that race are cancelled and monies refunded, subject to BoomBet Betting Product Rules. All wagers placed before final field stage will stand. • In the event of a horse being withdrawn late by order of the stewards, all wagers will be paid as stewards from that meeting direct including deductions on remaining runners. • If a wager is accepted, but afterwards found to have been taken after the result of the race was known, or in the opinion of BoomBet management could have been anticipated (e.g. the runner was several lengths in front with a hundred metres to go), the wager will be voided and refunded. • We reserve the right to refuse the whole or part of any wager. • Where betting limits are in place, your wager may not be accepted in full. You will be notified of the value of the accepted wager at the time of acceptance. It is the sole discretion of BoomBet to limit bets due to multiple factors. • Where there are eight (8) or more runners in a race, the place dividend shall be paid on first, second and third places. • Where there are seven (7), six (6) or five (5) runners in a race, the place dividend shall be paid on first and second places only. • Where there are less than five (5) runners in a race, all wagers shall be "Win Only" 11
• In the case of a late scratching, for the purposes of the above rules the number of runners in a race will be determined at the time of placing the bet. • Subject to the endorsement of the NT Racing Commission, BoomBet reserves the right to void any or all wagers made by any individual or group of people acting together (or on behalf of another individual or group of people) in an attempt to gain financial benefit through the manipulation of tote based dividends or official starting prices. This can include persons, relatives, organisations, bookmakers and their employees. • All wagers are considered to be placed and received in the Northern Territory in the Commonwealth of Australia. • These Racing Rules apply to Australian and international thoroughbred, harness and greyhound racing events unless otherwise specified. Results • Unless a sports specific rule states otherwise, Where an event or match is postponed and rearranged to take place within 48 hours of the original scheduled starting time of the event or match, all wagers will stand. If the event or match is rescheduled for a time greater than 48 hours after the original scheduled starting time, all wagers will be void and stakes refunded. • In the case of all sports (except soccer) and all other contests that involve a set length of play or time limit, players must play and the event must run to the conclusion of the designated time to be considered official for betting purposes. • Overtime periods or extra time in all sports shall count towards the final result for the match except in relation to soccer (see rules for soccer below). • In the event of a Dead Heat or Draw, where such an option was not offered for betting purposes, the ticket will be paid out at face value divided by the number of Dead Heating winners of the event (The Dead Heat Rule). • For multiple wagers, if any leg/legs are void, the multiple wager will be recalculated excluding the voided leg/legs. Bonus Bets/Credit • At the sole discretion of BoomBet we may elect to reward customers with free bets, bonus bets or bonus credit. • Bonus bets and other such rewards are offered to individuals on a specific basis. You are not guaranteed or entitled to be offered a reward, regardless of any rewards given to other wagering customers. • You are only entitled to a bonus/promotion if we have communicated it to you directly. • Any such rewards can be offered for several reasons including but not limited to betting behaviour, for promotional reasons or as goodwill. • If your account is offered a reward you are under no obligation to use the free bet or credit. • Bonuses will not be rewarded after the fact - to get a bonus, you must follow all outlined steps including reading these terms and conditions. • The minimum odds for bets placed using bonus credit is 1.50. • We are not obliged to accept your bet to the full stake. If your full bet stake is not accepted, you may be partially accepted. In this case, the remaining amount will be returned to your bonus bet balance. • Bonus credit must be used within 14 days of it being granted. Any credit not used within this time will automatically be removed from your account. 12
• You may request for the removal/early expiration of any bonus that is credited to your account by contacting our support team directly. • Free bets, bonus bets and bonus credit may feature restrictions on the bet type or betting market, the acceptable odds or other such restrictions. • Any bonus bet may be subject to turnover requirements which will be advised, however all bonus bets require that the related deposit gets turned over before a withdrawal is approved at bets with minimum odds of $1.50. For example, your account makes a deposit of $1,000 and is awarded a bonus. Aside from any bonus bet turnover requirement, the deposit of $1,000 must be bet before a withdrawal is approved. • All rewarded bets and credits may feature expiry dates and be removed from your account if unused before the expiration date. • Free bets, bonus bets and bonus credit may feature terms and conditions specific to that reward. You will be provided access to these specific terms either before opting into a reward or when a reward is given to you. • Free bets, bonus bets and bonus credit is not real money and is not withdrawable. Only after the rewards have been used in accordance with the terms and conditions will the funds become part of your withdrawable account balance. • If you use a bonus and your bet wins, your account will only be credited with the winnings exclusive of the bonus stake. The bonus stake will not be returned. • Where the payout of the bet is less than the value of the bonus bet placed, the payout will be $0.00. • Bonuses are only offered to genuine account holders, who always act in good faith and with integrity and who place bets for the purpose of entertainment and/or recreation and comply with our terms and conditions. • Professional gamblers or others deemed to be abusing bonus bet policies by the management will have their right to participate in offers revoked and all decisions of the management will be final. • We reserve the right to change any terms related to bonuses at any time before, during or after the promotion. BoomBonus • BoomBonus eligibility is not a right and is your eligibility is communicated to you directly. • Professional gamblers or others deemed to be abusing bonus bet policies by the management will have their right to participate in BoomBonus revoked and all decisions of the management will be final. • BoomBonus accumulates in your betting account and is converted to bonus bet credit once your pre-defined redemption level is set. • BoomBonus is earned for every cash bet placed on your account of a minimum of $1.00. The amount of BoomBonus may vary based on the type of bet placed, other promotional offers and anything else communicated to you. • The amount of BoomBonus is calculated as a percentage of the bet value and will be calculated at a minimum of; o Racing Singles – 2% o Sport Singles – 1% o Pre-canned Same Game Multi – 1% o Multis – 5% • The value of the BoomBonus earned per bet will be rounded down to the nearest dollar. • You may have a chance to earn BoomBonus at a higher rate. Any increased rates or promotions are not a guarantee of future value, but an awarded benefit for prior activity. • Bets placed with bonuses will not be awarded any BoomBonus. 13
BoomBonus Redemption • You can change your auto-redemption level at any time. • Whatever redemption level is defined in your account when the award process runs is the amount that will be credited, not what it was at the time you reached the end of your meter. • BoomBonus is credited to betting accounts every 30 minutes. • When you reach the end of your BoomBonus meter, your bonus will be credited at the next award cycle. BoomBonus will continue to accumulate after your boom meter reaches the top, even if not visually represented. • The BoomBonus meter is a visual representation, and we attempt to keep it as accurate as possible at all times. However, due to network latency, speed of updates and system processes, it is possible to be out of synchronisation at times. BoomBet Betting Product Rules • General - The BoomBet products and Betting Products are intended for bona fide Clients, that is, those Clients who act at all times in good faith, sincerely, without fraud and who place wagers with BoomBet for the purpose of recreation and entertainment. If no bet type is specified the default bet type will be a win bet. • The range of products available to each customer may vary and the reasons for doing so will be based on a variety of factors. The available products may vary based on your own activity, the type of race and other market factors. Top Fluc Betting Rules: • Top Fluc also refers to Top Fluctuation. It is available on selected meetings only. • Top Fluc wagers can be placed up to the running of the previous race, or in the case of the first race of the program, 40 minutes prior to running. BoomBet reserves the right to cancel bets placed after these cut-off times. • BoomBet reserves the right to restrict the maximum net winnings paid out under Top Fluc wagers to $20,000 on win bets and $5,000 on place bets. Where a Client places a wager that would result in the Client winning more than the previously stated limits on a "Top Fluc" win bet, the balance of the stake that would result in a win in excess of the limits will be given at "Plus5" with a maximum dividend of $101, and on a "Top Fluc" place bet, the balance of the stake that would result in a win in excess of the limits will be given at "Plus5" with a maximum dividend of $101. • In regards to Top Fluc each-way bets, if at any stage of betting the race favourite reaches a dividend of less than $2 according to the official course fluctuations, and/or the field is reduced to nine or less runners, then the place portion of "Top Fluc" each-way bets shall be paid at a dividend equal to the "Plus5" place dividend for those bets. "Best Tote" Betting Rules: • Subject to the following rules, "Best Win Tote" guarantees a dividend to be equal to highest official Win dividend pertaining to the relevant result paid by any totalizator that is governed by an Australian State Governments regulations ("TAB") or the Official Starting Price when BoomBet offers Fixed Win on the event, and "Best Place Tote" guarantees a dividend to be equal to highest official place dividend pertaining to the relevant result paid by any totalizator that is governed by an Australian State Governments regulations ("TAB"). • BoomBet reserves the right to restrict the maximum net winnings paid out under "Best Tote" wagers to $5,000. BoomBet also reserves the right to restrict the maximum dividend paid out under "Best Tote" to $101. • Where a Client places a wager that would result in the Client winning more than the limits stated above on a "Best Tote" bet, the balance of the stake that would result in a win in excess of the limits will be given at "Plus5" with a maximum dividend of $101. 14
"Best of the Best" Betting Rules: • Subject to the following rules, "Best of the Best" guarantees a dividend to be the better of the "Best Tote" and the "Top Fluc" • BoomBet reserves the right to restrict the maximum net winnings paid out under "Best of the Best" wagers to $5,000. BoomBet also reserves the right to restrict the maximum dividend paid out under "Best of the Best" to $101. • Where a Client places a wager that would result in the Client winning more than the limits stated above on a "Best of the Best" bet, the balance of the stake that would result in a win in excess of the limits will be given at "Plus5" with a maximum dividend of $101. "Best of Two Totes" Betting Rules: • Subject to the following rules, "Best of Two Totes" guarantees a dividend to be equal to the highest official dividend paid by SuperTAB and NSW TAB. • BoomBet reserves the right to restrict the maximum net winnings paid out under "Best of Two Totes" wagers to $5,000. BoomBet also reserves the right to restrict the maximum dividend paid out under "Best of Two Totes" to $101. "Middle Tote" Betting Rules: • Subject to the following rules, "Middle Tote" guarantees a dividend to be equal to the second highest official dividend paid by any totalizator that is governed by an Australian State Governments regulations ("TAB"). • BoomBet reserves the right to restrict the maximum net winnings paid out under "Middle Tote" wagers to $5,000. BoomBet also reserves the right to restrict the maximum dividend paid out under "Middle Tote" to $101. "Exotics”: • A BoomBet Exotic is any of the following: 1. A Quinella; 2. An Exacta; 3. A Trifecta; 4. A First Four; 5. A Quadrella • BoomBet Exotics are available on all Australian racing events covered by the Victorian TAB (Thoroughbreds, Harness and Greyhounds). • For all BoomBet Exotics, BoomBet pays winning combinations as declared by the Victorian TAB, and all dividends at at a dividend equal to those declared by the Victorian TAB. • For all BoomBet Exotics, in the event that the location where the wager is struck is not covered by the Victorian TAB, the dividend paid will be equal to the dividend paid by another totalizator (TAB) that is governed by an Australian State Government's regulations. Quinella Betting Rules: • A Quinella is when two (2) runners are selected to place first and second in any order. • In the event of a Dead Heat, there will be as many dividends as there are correct order combinations as declared by the Victorian TAB. Exacta Betting Rules: • An Exacta requires that the first two (2) place getters are nominated in correct order. • In the event of a Dead Heat for first, second or both, there will be as many dividends as there are correct order combinations as declared by the Victorian TAB. Trifecta Betting Rules: • A Trifecta requires nominating the first three (3) place getters in correct order. • In the event of a Dead Heat for any or all of the place getters, there will be as many dividends as there are correct order combinations as declared by the Victorian TAB. First Four Betting Rules: • A First Four requires nominating the first four(4) place getters in correct order. 15
• In the event of a Dead Heat for any or all of the place getters, there will be as many dividends as there are correct order combinations as declared by the Victorian TAB. Quadrella Rules: • A Quadrella requires nominating the winner of four (4) races as nominated by the Victorian TAB. • In the event of a Dead Heat for any or all of the winners, there will be as many dividends as there are correct combinations as declared by the Victorian TAB. • In the event of a jackpot and no dividend being declared by the Victorian TAB, the dividend paid will be equal to the dividend paid by another totalizator (TAB) that is governed by an Australian State Government's regulations. Win, Place and Each-way Betting Rules: • Prior to the final field being declared, these wagers are accepted on an 'All In' basis. (i.e. no refunds for non-runners and no deductions from any runner). Dead Heat Rule: • In the event of a dead heat or a draw when the dead heat rule applies, the face value of the ticket is halved. For example a wager of $10 at $2.50 would return $12.50 in the event of a dead heat. Unfair Advantange/Price Manipulation: • If a bet is deemed to unfairly advantaged in regards to starting times of events we reserve the right to cancel it. If a bet is placed after a race has begun, We reserve the right to cancel the single bet and recalculate a multi bet, removing the relevant leg. • Sportsbetting reserves the right to cancel Your bets if Sportsbetting reasonably suspects that tote-based dividends have been manipulated. In the event that We do not cancel Your bet, We reserve the right to apply a payout limit on the bet that does not exceed the pool declared by VIC TAB. If this rule is waived at the discretion of Sportsbetting, it is not taken to be a precedent in relation to future payouts. • We reserve the right to limit any individuals/groups, so that the payout on any bet type does not exceed the largest relevant pool size on any bet type in any location. • At the discretion of Sportsbetting, individual Tote pools of under $500 may be disregarded in the calculation of Tote dividends. Racing Protest Rules: • What is a Racing Protest? A protest occurs when a trainer, jockey or stewards challenge the outcome of a race, often due to interference. • What happens if there is a protest? If your bet has already been paid and a protest is subsequently announced, your bet may be unfinalised, and there will be a period of time where we need to re-result your bet. • What is protest payout? If your selection comes first but is subsequently demoted to a losing position, you may be eligible for a protest payout. • Protest Payout Conditions: 1. Single Bets only. 2. Win Only bets. 3. Bets placed with bonus credit (bonus bets) do not qualify for a protest payout. 4. Does not apply to promotional or futures markets. 5. Only applies to races where the horse that is first past the post is relegated. Where a horse finishes in 2nd or 3rd and falls out of a placing as a result of the protest, there will not be a Protest Payout. 6. Only applies to Australian Thoroughbred and Harness racing. Not applicable to greyhound races or international races. 7. Maximum payout is $1,000 per customer, per race. 16
8. Only eligible customers, who have been previously notified of their qualification for promotions qualify for receiving a protest payout. Deductions Table • Wagers struck after the final field is declared are subject to refunds on scratched horses, and deductions may apply on remaining runners. This is regardless of the amount of outright winners ridden by either of these jockeys. • If any individual jockey in the market does not complete at least one (1) ride for the meeting, all wagers on the Jockey Challenge for that meeting will be cancelled and monies refunded. For this clause, the term "complete" will be defined as having started in a race, not finishing a race (e.g. if that jockey falls off mid-race it will still be considered that he has completed a race) • If the meeting is postponed or abandoned at any stage, all wagers on the Jockey Challenge for that meeting will be cancelled and monies refunded regardless of standings at the time. Australian Rules Football • The statistics used by the AFL website (www.afl.com.au) will be the statistics used for payout purposes on all AFL markets unless otherwise stated. • Payouts are based on the official declared result, but conditions may apply to specific betting options (e.g. end of normal time, including extra time - an extension of normal time - etc.). • Where a match is abandoned or postponed, and played within seven days of the original scheduled date, all wagers stand. Once the seven days have expired, all single wagers are void and wagers refunded. Affected multiple wagers will be recalculated excluding that leg. • Where the venue of a game is changed, all single wagers accepted prior to the venue change are void and wagers refunded. Affected multiple wagers accepted prior to the venue change will be recalculated excluding that leg. • When the Draw option is offered, the wager is decided on the result at the end of normal time (i.e. extra time - an extension of normal time - not included). For Margin Betting the 20
Draw option is always offered. When the Draw option is not offered, The Dead Heat Rule applies. • For match winners, player disposals, match ups, and most goals markets, all players must be in the starting line up for wagers to stand unless otherwise specified. • For first goal scorer markets, players listed in the BoomBet market but are not in starting line up are subject to a refund. • For clarification purposes, the starting line up refers to the final 22. Players named as the “Medical Sub” do not constitute as a player in the starting line up. • For leading Victorian or Interstate side: o When determining the leading Victorian or Interstate side for the season, the official AFL ladder standings will be used. o Using the round 22 ladder ranking, clubs eliminated in week one of the finals will be ranked seventh and eighth. o Those eliminated in week two of the finals will be ranked fifth and sixth. o The losers of the preliminary finals will finish third and fourth. o The AFL ranking system will determine which of the two teams eliminated on the same weekend will be ranked higher. o If two teams are knocked out on the same weekend, the AFL rankings will determine the winner. Baseball • Games are official after five innings of play. If the home team is leading, the game is official after four and half innings of play. If a game goes past five innings (including any extra innings) and is subsequently called off, suspended or postponed beyond either teams next scheduled game, the winner is determined by the score after the last full innings of play (except in the case when the home team score to tie, or take the lead in the bottom half of the innings in which the game is called off - the runs do count). • For run line and margin betting, the game is official after 9 innings if the visitor team is winning and after 8.5 innings if the home team is winning. For matches part of a double header and reduced to 7 innings, bets will be official after 6.5 innings if the home team is winning. • For run totals the game is official after 9 innings (8.5 innings if home team is winning) with the exception that at any time the run total is exceeded the wager is official. For matches part of a double header and reduced to 7 innings, bets will be official after 6.5 innings if the home team is winning. • Should a game not start on the day of the officially listed start time, as stated by the relevant governing body, due to a rain delay or other similar events, all bets will be void. • Extra innings are included in the settlement of all markets, where applicable • For futures markets, all bets stand whether there are postponements or other changes to the season/tournament, unless the official governing body of the league/tournament state there is no official winner, in which all bets will be void. Basketball • Payouts will be based on the official final score, extra time (an extension of normal time) included, unless otherwise specified. • Games are official after 43 minutes of play (NBA), 35 minutes of play (NCAA and NBL) and at the end of normal time (all other competitions). • In handicap and totals betting, where the line or total is a flat number, if the score lands on the line or total, all wagers are void and wagers refunded. Affected multiple wagers will be recalculated excluding that leg. 21
• If a game is abandoned, postponed to another date, or fails to meet the above criteria, single wagers are void and refunded. Multiple wagers will be recalculated excluding that leg. • Half Time/Full Time, Second Half, Tri-Bet and Highest Scoring Half markets are resulted on the official score at half time and full time, inclusive of overtime. Boxing/Mixed Martial Arts • Where a match is abandoned or postponed but fought within 14 days of the original scheduled date, all wagers stand. Once the 14 days have expired, all single wagers are void and wagers refunded. Affected multiple wagers will be recalculated excluding that leg. • All wagers on either fighter to win will be decided by the judge’s decision, which includes points, technical knockout (TKO), knockout (KO) or disqualification. • If a price is offered for the draw, in the event of a draw all wagers on either fighter to win will be losers. If there is a "technical draw" determined by the referee due to an accidental cut etc then the bout is deemed a "no contest" and all wagers are to be refunded. • In round-by-round betting, if a fighter fails to answer the bell, the fight will be deemed to have ended in the previous round. • For all wagers on a fighter to win on points, the full scheduled number of rounds must take place for the wagers to be deemed winners. • If the scheduled number of rounds is changed all "pick the round" wagers are void and wagers refunded. • When one of the fighters are substituted, all single wagers on the original fight will be void, with affected multiple wagers recalculated excluding that leg. • The official stopping of a round before the sounding of the bell does not constitute a full round. A full round is only considered for wagering purposes to have been completed when the bell sounds signifying the end of the round. • For Method of Victory markets, a Knock Out (KO) constitutes the following: referee stoppage while the fighter is standing or on the canvas, stoppage by doctor or the corner, or the fighter retires due to injury. • For Method of Victory markets a submission includes the following: referee stoppage due to tap out, technical submission, or fighter verbal submission (includes verbal submission due to strikes). Where there has been a change in the advertised contest, e.g. a contest changes from a title fight to a non-title fight, all bets will still stand. Cricket • Limited overs (including one-day internationals): o In one-day matches, shortened by weather, the outcome will be that determined by the competition rules. If the match is declared a 'no-result' all single wagers are void and wagers refunded. Affected multiple wagers will be recalculated excluding that leg. However, all decided bets, such as high bat, individual match ups and next man out, will stand. o For batting or bowling match-ups, both batsmen must reach the crease or both bowlers must bowl one ball for wagers to stand. Otherwise all wagers are void and wagers refunded. Affected multiple wagers will be recalculated excluding that leg. o If a match is transferred to a reserve day, all wagers accepted prior to the toss of the original game will carry over.
