Latest Updates on Antitrust – September, 2021 – Part III September 20, 2021 This is a rundown of last week’s news updates on Antitrust: BASF obtains favourable verdict for patent-licensing antitrust claims Chemical company BASF Corp has succeeded in their claims against rival chemical company Ingevity Corp for antitrust claims of tying a license to a patent to an obligation to buy the consequent product. The jury in this case had reached an award of $28 million, however, based on a provision of US federal antitrust law, the award is to be tripled to nearly $85 million. The issue arose out of Ingevity suing for patent infringement of their “honeycomb scrubbers” for reducing auto emissions, which led to BASF countersuing for patent invalidity.
CCI finds Google abused its dominant position through its Android operating system The Competition Commission of India (CCI), the country’s antitrust regulator, has reached a finding that tech giant Google had abused its dominance over its Android operating system with the use of financial factors to strong arm competitors. The CCI found that Google had limited the “ability and incentive of device manufacturers to develop and sell devices operating on alternative versions of Android”. However, it is said that senior CCI members will scrutinise the report, affording an extra opportunity to Google to counter the allegations, and thereafter choose to include penalties or not. Minnesota court denies motion to dismiss in beef packers antitrust class action lawsuit The Federal District Court of Minnesota has dismissed a motion by four large beef packer companies to dismiss a class action antitrust lawsuit, finding that the plaintiffs had plausibly pled that the defendants had supressed fed cattle prices and increased the price of beef. The plaint alleges a violation of the Sherman Act by way of a price fixing conspiracy, as well as other specific Acts. Latest Updates on Privacy – September, 2021 – Part III September 20, 2021 This is a rundown of last week’s news updates on Privacy: Joint Parliamentary Committee on data protection bill to comb through over 100 drafting changes The Joint Parliamentary Committee tasked with ironing out a number of issues with the personal data protection bill will
now look at over a 100 legislative drafting and cosmetic changes to be made to the bill, with one of them being the change of name from the personal data protection bill to the data protection bill. One other proposed change has been to the proposed Section 49 to expand its ambit to include all data breaches, as compared to its previous scope of merely personal data breaches. The bill however is likely to face protracted deliberations owing to a number of members of the committee being substituted due to their predecessors’ appointments to the Cabinet. IRDAI’s Insurance Information Bureau Rules not sitting well with privacy experts The Insurance Regulatory Development Authority of India’s rules which establish an Insurance Information Bureau under the Andhra Pradesh Societies Registration Act has come under fire for creating a monopoly over insurance data, as the Rules stipulate that data of life and non-life insurance holders will be transferred to the Bureau. Experts also fear that such a move will clash with policyholders right to privacy. The Bureau is also not expected to provide any benefits for insurance holders similar to what credit rating agency CIBIL does with good credit scores. Supreme Court to pass interim orders in Pegasus case The Supreme Court has decided to pass interim orders in the Pegasus spyware case after the Government had refused to file a detailed affidavit relating to the use of the software on Indian journalists. The Government cited national security reasons stating that a public discourse would alert terrorists as to the use of such software. As a middle ground, the
Government had suggested a committee of domain experts with no connection to the Government and which would report solely to the Supreme Court, to investigate into the allegations of spying on Indian journalists and citizens. Delhi High Court issues notice to Unique Identification Authority of India (UIDAI) over Google Pay privacy concerns The Delhi High Court has issued notice to the UIDAI in a petition alleging that digital payment app Google Pay is skirting existing banking laws, and a possible breach of privacy over unauthorised access. The petition alleges that Google Pay’s terms and conditions stipulate that the app will be collecting and sharing either bank account details or the Aadhaar details of a user. Latest Updates on E-Commerce and Licensing – September 2021- Part II September 20, 2021 This is a rundown of last week’s news updates on E-Commerce and Licensing Amazon signs MoU with Gujarat The e-commerce platform Amazon India signed a Memorandum of Understanding with the Industries and Mines Department, Gujarat Government with a view to provide a global platform to the homegrown businesses. As per the MoU, Amazon India will conduct trainings/ workshops/ webinars etc. for exporters and MSME owners from key clusters like Ahmedabad, Vadodara, Surat, Bharuch, and Rajkot. Amazon will share expertise regarding B2C e-commerce exports which will help the state-based businesses to grow further. “Gujarat has a vibrant gems and jewellery,
apparels and textiles and handicraft sector which is held together by lakhs of MSMEs. One of our key priorities has been to boost exports from Gujarat and through this partnership with Amazon, we aim to empower lakhs of MSMEs in Gujarat to embrace e-commerce exports. It will help them leverage Amazon’s global presence to showcase their products to customers across the world”, stated Chief Minister Vijay Rupani. Flipkart expands in Haryana The e-commerce giant, Flipkart expanded its supply chain network in Haryana. Flipkart opened four new fulfilment and sortation centers in Haryana ahead of the upcoming festive season. The newly opened centers will help in providing support to thousands of sellers, MSME owners, kiranas and small farmers from the state and nearby areas. These centers will help cater to the growing customer demands and provide faster deliveries. This will also create various employment opportunities for all. Government to adopt a ‘balanced’ approach on e-commerce rules After receiving various suggestions from key stakeholders on the proposed Consumer Protection (e-commerce) Rules,2020, the Government has decided to take a balanced approach. The Government is aiming to protect the interests of both the consumers and other key parties through the amended Consumer Protection (e-commerce) Rules, 2020. “We have received a lot of suggestions. We will now have to come out with best formulations from the consumer perspective taking into account the wide and varied diverse views received on the draft rules,” Consumer Affairs Secretary Leena Nandan told reporters. “It would be difficult to give a timeline as many suggestions have come and all of them require deliberations and discussions. But it is certainly work in progress”, she said. “We are going into great detail on each provision of the rules as there are many wide views from both sides. It has to be calibrated and a balanced perspective has to be arrived at.
We are in that process,” she added. BNPL : the new flavor of the season The BNPL (Buy Now, Pay Later) scheme has created a niche for itself amongst the consumers. With the festive season around the corner, various e-commerce platforms, banks and retailers have introduced BNPL for their customers. For eg. Amazon and Flipkart are offering a free credit period through the Buy Now, Pay Later option and are also giving cashbacks for availing this facility. However, all that glitters is not gold! Experts warn the public to be wary of such schemes and read all offer related conditions carefully before opting for such facilities. There is a possibility that the buyer may end up paying more than the original purchase cost of the product or service. Experts advise to opt for BNPL only if one is sure of paying the entire amount before the due date. ProQR Therapeutics N.V. shakes hands with Eli Lily and Co. This is a strategic collaboration to develop and commercialize the allogeneic cell therapies to treat various oncology indicators. “We believe allogeneic cell therapies could be a game-changing approach for developing personalized therapy platforms based on individual cancer patients’ unique needs,” as stated by Dr. James Sabry , global head of Pharma Partnering, Roche. “This partnership, which combines Adaptimmune’s allogeneic platform with Genentech’s expertise in developing personalized therapies, complements our other efforts to discover and develop personalized cell therapies. The draft rules contain various contradictions that are being flagged by the players and are seeking further amendments. “The definition of related party certainly needs some more clarity, otherwise it will be difficult not only for foreign players like Amazon and Flipkart, but even homegrown companies like Tata and Reliance to have their various brands such as 1mg, Netmeds, Urban Ladder, Milkbasket, etc. sell on their super-apps,” a Delhi-based retail executive said on the
broad definition of ‘related party’. 70% growth expected in B2B e- commerce : Sandeep Juneja Sandeep Juneja, Vice-president of sales and Marketing of DHL Express, India recently stated that the B2B e-commerce sector is to grow by 70% in next six years. “Logistics is the biggest part of the cost component in e-commerce… if not done properly, or without it, e-commerce can’t exist,” says Sandeep Juneja. “Until last year, cross-border e-commerce was growing at more than 25 per cent every year,” Juneja states. He states that india competes with countries like ‘Vietnam, South Korea and China’ and has the potential of becoming a global sourcing hub. “Over the next six years, B2B e-commerce is going to go about 21 trillion, which is 70 per cent more than what it was in 2019.” New, revamped DSP program of Amazon Amazon is now set to provide enhanced support to its partners in technology, hiring and logistics by revamping its Delivery Service Partner program in India, US, Canada, UK, Germany, France, Italy, Spain, Ireland, Brazil and Netherlands. “We launched the DSP program in 2015 and we already have more than 300 partners working with us. India is the 11th country where Amazon is rolling out the revamped program, under which we will offer newer services, including allocation of an account manager to the DSP partner and value-added tools for hiring, legal and technological support,” Amazon vice president- customer fulfilment (APAC, MENA and LATAM) Akhil Saxena told PTI.
‘Dattun’ gets a new look ‘Neem Tree Farms’, a US based e-commerce company has launched dattun as organic toothbrush with an attractive packaging. It is being sold at $24.63 (approx. Rs.1800). The brand has described this as a “one-of-a-kind” and “original”. This is not the first instance where Indian product has been ripped off and sold by a foreign entity. Recently, a New Zealand Website was found selling the ‘charpai’ as ‘Vintage Indian Daybed’ for Rs. 41,000. Balenciaga was found selling the Indian ‘Thailas’ for Rs. 1.5 Lakhs. Acer Smart TV and Indkal Technologies enter into a new licensing Agreement Acer, a company famous for its computer hardware and accessories has decided to enter the smart TV space in India along with Bangalore based Indkal Technologies. “The need for home entertainment has increased in the past twelve months , thus boosting the demand for televisions. This makes a great time to enter the market with Acer, which is one of the most trusted and reliable brands across markets. As the current surge in sales is expected to grow till Diwali, we will find immense opportunities to showcase the value addition that Acer Televisions will bring to the market and towards improving the overall TV viewing experience”, Anand Dubey, CEO of Indkal Technologies stated in his announcement. Shopee is coming to India! Shopee Pte Ltd., a Singapore based multinational technology company which focuses on e-commerce is planning to enter the Indian e-commerce market. It has launched a recruitment campaign for sellers to sell on ‘Shopee India’ and has also
started a recruitment campaign. The Southeast Asian group has found success in India with its game ‘Free Fire’. Shopee is a strong player in e-commerce in Southeast Asia brining in roughly Rs. 8,800 crores globally in revenues. Reliance gets control of Just Dial Reliance Retail Ventures, a subsidiary of Reliance Retail has acquired the sole control of the 25 year-old search and discovery firm Just Dial for Rs. 3,497 crore. “RRVL has now taken sole control of Just Dial Ltd in accordance with the SEBI Takeover Regulations with effect from September 1, 2021. “The acquisition represents 15.63 per cent of the post- preferential issue paid-up equity share capital of Just Dial,” the statement said. In July, reliance Retail ventures had acquired 1.31 crore equity shares of Rs. 10 each of Just Dial at a price of Rs. 1,020 per equity share from VSS Mani, the founder and chief executive of Just Dial in a block deal. Indian Trademark Statistics A decrease of three percent (3%) in the total number of trademark applications examined by the Trademark Office this week. There has been a decrease of eight percent (8%) in the total applications disposed through show cause hearings. There has also been a decrease of eighty nine percent (89%) in the total number of hearing notices issued. However, six thousand two hundred and eighty-nine (6289) applications were published in the previous week, exhibiting a seventeen percent (17%) decrease in publications since last week. Additionally, four thousand two hundred and eighty-two (4282) registration certificates were issued, and two thousand and seventy-four (2074) renewal notices were issued. South Korea fines Google $177 million for abuse of dominance South Korea’s new Telecommunications Business Act, colloquially referred to as the ‘anti-Google’ law looks to empower South Korea’s antitrust regulator in trying to control Google’s abuse of its dominant market position, and has resulted in the company facing a $177 million fine for allegedly blocking customized versions of its Android operating system. The Alliance of Digital India Foundation (ADIF), a representative body of more than 350 digital startups, has also urged the Indian government to enact a similar legislation to curtail the market dominance of big tech companies. U.S. House Energy and Commerce Committee approves $1 billion fund for FTC privacy probes The U.S. House Energy and Commerce Committee voted on 7th September, 2021 to give the Federal Trade Commission, the US antitrust watchdog, $1 billion to set up a bureau dedicated to improving data security and privacy and fighting identity theft. The US Federal Trade Commission has started forcing corporations to better protect consumer data and privacy as it enforces rules against deceptive practices. Facebook criticizes UK’s Competition and Markets Authority over order to sell Giphy Facebook has criticized the Competition and Markets Authority’s (CMA) provisional decision ordering Facebook to sell Giphy as being grossly unreasonable and disproportionate.
The CMA opened an investigation over the acquisition shortly after Facebook announced its $400 million acquisition of Giphy as it believed that that would stifle competition for animated images. Latest Updates on Privacy – September, 2021 – Part II September 20, 2021 This is a rundown of last week’s news updates on Privacy: Delhi HC: Plea for changing Aadhaar Number opposed by UIDAI On September 9, 2021, a plea before the Hon’ble Delhi HC for issuance of a new Aadhaar number was opposed by the UIDAI. The petitioner asserted an apprehension of possibility of unlawful activities by way of exploitation of his identity, on account that his Aadhaar number was linked to an overseas entity which was not known to him. The Court herein differed from the petitioner’s submissions, on the grounds that an allotted Aadhaar number cannot be amended at the whims and fancies of an already existing user. The next hearing is posted for January 2022. Rajasthan Government fines Vodafone ₹27 lakh for improper handling of customer data Telecom company VIL (Vodafone Idea Ltd.) was fined ₹27 lakh by the Rajasthan Government under the Information Technology Act 2000, owing to the issuance of a SIM card of one customer to another, resulting in the latter withdrawing ₹68 lakh from the overdraft account of the former. ₹44 lakh was recovered from the accused and the victim had filed a complaint under the IT Act for the remaining amount. The adjudicating officer therein
ordered VIL to pay the penalty amount due to the victim within a month failing which a 10% interest per annum would be levied. Cyber Insurance norms issued by IRDAI for covering cyber fraud activities New cyber insurance norms were issued by the Insurance Regulatory Development Authority of India for insurance policies against monetary losses incurred due to online fraud and cyber theft activities. The norms stipulate that such cyber insurance policies would cover identity theft, theft of funds, cyber stalking, phishing, email spoofing, and cyber extortion among other things, and would also provide a threshold limit for each of these risks.
