On November 13, 2007, the FCC released an order that it adopted on October 31, 2007 regarding exclusive access agree- ments. The FCC found that building exclusivi- ty clauses (as opposed to clauses that require exclusive wiring or exclusive marketing) cause significant harm to competition.
