Great Britain’s Premier Sale of Sport and Riding Horses

Incorporating the 8th Official British Connemara Pony Society (BCPS) Sale.
Wednesday 14th September 2016

Sale of Horses under saddle and presentation and sale of in-hand horse entries, four
years old and under and broodmares.

Horses may demonstrate their paces and abilities in the show rings from 8.00am onward.

Presentation period of in-hand young stock commences at 10.00 am in Ring 3.

Sale commences at 11.30
Ridden horses and ponies can be shown in rings 1, 2 and 4
There will be loose jumping facility in Ring 1 (behind stable block).

There will be a £3.00 car parking charge in operation at this sale.

IMPORTANT
All persons attending do so entirely at their own risk. Horses can be dangerous, especially
when handling those with which you are not familiar.
Please do not enter those areas and walkways reserved for horses.
Please note - Hardhats must be worn by riders at all times on the Showground.
GENERAL INFORMATION

SITUATION
The Sale will be held at the Three Counties Showground, Great Malvern, Worcestershire WR13 6NW.

DELIVERY
All Lots must be on sale premises no later than 8.30am on the day of sale.

CLEARANCE
All lots must be removed from the Showground before 5.30pm on the day of Sale. Any lots left after this
time will be locked onto the showground and overnight charges will be made to the Purchaser or Vendor,
unless prior arrangements are made with The Auctioneers and Three Counties Showground.

RESERVE PRICES
Unless written instructions are lodged with The Auctioneers on the form provided, Lots will be sold
without reserve.

VETERINARY SURGEON
A Veterinary Surgeon will be available at the office ½ an hour before sale start time until the end of the
day for anyone seeking professional advice.

INSURANCE
Insurance of purchases may be arranged at time of payment.

COMMISSIONS
Should any prospective purchaser be unable to attend the sale, The Auctioneers will personally be pleased
to execute Commissions on their behalf, at no extra charge, Lots being obtained as cheaply as other bids
allow.

PRIVATE SALES
All Private Sales on the Sale Day must be booked through The Auctioneers.

PASS-OUTS
No Lots will be allowed to leave the premises until a Pass Out has been obtained from the office. In the
event of labels missing for Lots, these will not be allowed to leave until identified to the satisfaction of the
Auctioneers representative.

PAYMENT AND PURCHASE TERMS
Purchasers will be required to pre-register and obtain a buyer’s number. Horses will be sold in (£) Sterling,
in addition 10% + VAT, Buyers Premium will be added to Purchasers account. All Lots must be paid for
prior to collection. Cheques will only be accepted from persons previously known to The Auctioneers,
unless arrangements are made with Barclays Bank, Hereford. All major credit/debit cards are accepted.
Credit cards, not Debit or Switch, will be subject to an additional 3% + VAT Bankers surcharge on total
transaction.

REGISTRATIONS
Registrations are based on information supplied by the Vendor. They are believed correct but
responsibility is entirely with the Vendors in this regard.
SHOWGROUND

ACCESS
All cars and lorries attending the Sale must enter through the Yellow Gate and use the parks indicated.
The Showground gates are open from 4.00pm until 9.00pm on Tuesday 13th September and from 7.00am
until 5.30pm on the day of sale. We regret no deliveries or collections outside these times.

STABLING & SALES AREA
See plan on the inside front cover of this catalogue. Every entry will be allocated a Loose Box from 5.00pm
the evening before the day of sale.

All Box allocations will be dealt with by The Stable Manager Mr. Derek Morgan, tel. 07798 881345 whose
office is at the end of the Stable Blocks. Straw will be available. Hay, water buckets and mangers are NOT
supplied by the showground. We regret that under no circumstances will stabling be made available for
horse not entered for the Sale.

Charge for additional boxes, if available, will be £20.00 per day payable in cash in advance.

AMENITIES
A list of Hotels and Guest Houses in the area is printed in the catalogue. For those staying on the
showground, hot showers will be available in the toilet blocks.

CATERING
Will be available on the showground. Hot and cold meals together with snacks will be available from
8.00am.

SPECIAL NOTICE TO VENDORS
You have signed an undertaking not to sell your Lot(s) prior to on the day of sale. We trust that everyone
will abide with this rule as withdrawals only mean wasted journeys and disappointment for potential
buyers.

A penalty of £100 plus VAT and full commission on Reserve Price and debarment from future sales will be
levied on those in breach. This penalty also applies for sales made privately on the sale premises and not
booked through the Auctioneers.

PLEASE NOTE ALL LOTS WILL BE CHECKED IN THROUGH THE GATES AND ONLY PERMITTED TO LEAVE WITH
THE APPROPRIATE PASS FROM THE OFFICE. THE AUCTIONEERS RESERVE THE RIGHT TO RANDOM BLOOD
TEST. ANY ANIMAL SHOWING SIGNS OF COUGHING OR OTHER CONTAGIOUS & INFECTIOUS DISEASE
SYMPTOMS MAY BE ASKED BY THE VETERINARY SURGEON OR AUCTIONEERS TO REMOVE THE LOT

VETERINARY EXAMINATION PROCEDURE CONDITIONS OF SALE

ALL HORSES IN THIS CATALOGUE, EXCEPT THOSE SOLD FOR A HAMMER PRICE OF £1000 (£800 for ponies
14.3hh and under) OR LESS WHICH ARE SOLD AS THEY STAND, ARE SUBJECT TO VETERINARY
EXAMINATION AS STATED IN CONDITIONS OF SALE AT BACK OF CATALOGUE. ALL OTHER QUESTIONS OF
DESCRIPTIONS AND CONDITIONS BEING ENTIRELY AT THE RISK OF THE PURCHASER.
This Sale is held under the Conditions of Sale printed herein, with the important proviso that Warranties
as to Veterinary Correctness cease to have effect once the horse has been removed from the Sale
Premises.
All entries are sold subject to veterinary re-examination on the day of sale (unless sold for a hammer
price of £1000 or less, when they will be sold as they stand), however vendors may wish to (but are not
required) provide a pre-sale veterinary certificate if they so wish. The pre-sale veterinary certificate does
not constitute any warranty and all horses sold with this certificate are still subject to post-sale veterinary
examination on the day of sale if required by the purchaser. Any pre-sale veterinary certificates will be
lodged with the Auctioneers and will be available for purchasers to view on the day of sale.

An independent panel of Veterinary Surgeons will be pleased to examine lots on behalf of Purchasers, at
a Fee of £200.00 including VAT, for a full veterinary examination or £80 including VAT for a partial
veterinary examination, which is payable in advance of the examination and paid directly to the
Veterinary Clerk either by cash or cheque. The full examination will include blood being taken. With the
important proviso that if any Horse fails the Veterinary Examination the Vendor has the right to request
a second opinion by the Chief Veterinary Surgeon at a fee of £25.00 including VAT Whose opinion shall
be binding on both Vendor and Purchaser.

PROCEDURE
   1. Purchasers must submit in writing to the Veterinary office - situated at the end of the stables
      application on the appropriate form, that they require examination within one hour of the time of
      purchase. NOTE: TIME IS OF THE ESSENCE - LATE APPLICATIONS WILL RESULT IN LOSS OF
      WARRANTY
   2. Payment will be required in advance. If payment needs to be added to Purchasers account, please
      notify sales office as soon as possible after purchase.
   3. Examination will only take place on production or written authorisation from the Veterinary office.
   4. Vendors should consult the board exhibited outside the Veterinary Office, which will list those
      Lots which examination has been requested and arrange for presentation at examination.
   5. Whilst Lots are the responsibility of the Purchaser from the fall of the hammer - Vendors are
      responsible for producing the Horse for Examination, providing all tack, Equipment and if
      necessary a rider.
   6. Should the Veterinary Surgeon acting on behalf of the Purchaser find that the horse is in, their
      opinion returnable under the Conditions of Sale, the Auctioneers retained Veterinary Surgeon will
      then be called to examine the horse on behalf of the Vendor, and to make a joint decision as to
      whether or not the horse complies with the catalogue description. A fee is chargeable to the
      Vendor for this service.
   7. Commission at half the standard rate will be charged on all Returned Lots.

The Veterinary Surgeons in attendance do not consider it advisable to test very young horses for wind
unless they have been previously lunged.

NOTE: Veterinary Examinations are to safeguard all parties. Time consuming procedures will be expedited
if both Purchaser and Vendors ensure that they are represented, and have the horse ready for inspection
when called. Immediate registration of Veterinary Examination is strongly advised.
ROYAL INSTITUTION OF CHARTERED SURVEYORS RULES OF CONDUCT 2007.

19.1 This market is not required to comply with Rule 8 of the RICS Rules of Conduct (Clients’ Money).

NO monies paid to this market are covered by any scheme for the protection of clients’ money operated
by the Royal Institution of Chartered Surveyors.

A more detailed explanation can be obtained in writing from: The RICS Regulation Department,

NOTICE RE VACCINATIONS RECORDS:
Purchasers are welcome to come to the Office to check the Vaccination Record (especially dates), if any,
of their Lot. The Documents will be forwarded by post as soon as possible after sale.

ADDITIONAL CONDITIONS OF SALE
Vendors - Please note the following supplementary conditions (to be drawn to your attention by order of
H.M Customs and Excise).

H.M. CUSTOMS & EXCISE RULES
Would all vendors please note that we (Brightwells) will raise a self-billing tax invoice for the proceeds of
any goods in this or any other sale held by us. It is a Custom and Excise requirement that this is the only
tax invoice raised for those items.

We must have your VAT registration number (where appropriate) together with your name and address
for inclusion on any self-billing tax invoice raised by ourselves. You must notify us immediately if your VAT
registration number is cancelled, or if you are issued with a new VAT registration number.

Any vendor not agreeing to this system of self-billing tax invoices being raised by us must notify us prior
to the commencement of the sale. Regrettably, we can only operate with a self-billing system in place,
and therefore will not sell the goods of any vendor who is unable to accept this system.

     Schoolmaster who has been PSG trained, and has done dressage, event, show jumping and
     has hunted. “Marni” was PSG trained as a youngster and then evented and show jumped
     up to 1.50m. He is great to hack, box, shoe and handle in every way. A real confidence
     giver for someone coming off of ponies, he is always in the ribbons and has a very low
     mileage. A sad sale.

      Unfortunate circumstances force the sale of this lovely event mare. She has 26 BE points,
      1 Star at Intermediate level, is very well bred and has good future paddock value. Through
      lack of time she has been totally wasted over the last two years and is now looking for a
      new and loving home.

      Registered: Weatherbys.
      Stunning Eventer that has been there and got the T Shirt! A true schoolmaster that always
      goes clear cross country and is horse that has done it all. Evented to Novice Level, highly
      successful with 28 BE points and now ready to take his next jockey to the top. Bold scopey
      jump, show jumping, does a lovely dressage test and is brave cross country. Currently
      hunting every week and has been used as a hunt horse so is good with hounds. He is a
      horse with low mileage and is good to: ride out alone or in company, in traffic, to load,
      travel, wash, catch and shoe. He is only for sale as we have too many hunt horses.

      A lovely horse with manners to die for. Easy to handle on the ground he is also great to
      hack either alone or in company. Registered British Dressage with points at Novice Level
      and has won at unaffiliated Elementary Level. Loves his hunting and has hunted in Ireland,
      Cheshire and with the Ledbury Hounds. Sustained a scar on his back leg from hunting as a
      4-year-old but it has never affected him. He has also team chased and previously show
      jumped in Ireland and England. Good to shoe, box, clip, bath, load, travel and catch. Teeth,
      back and vaccinations are all up to date.

    Marigold is a beautiful broodmare by a stallion who is the sire of very many successful
    show horse and ponies. She has been shown in-hand, with success as a hack last season,
    but is not now a 100% sound behind which does not affect her ability to be a good mum.
    Produced a stunning filly foal this year which has been shown (2nd of 6), presented at BEF
    futurity as a potential eventer (gaining a higher first premium of 8.83), which is being
    retained. This mare is ideal for putting to a smaller sire to produce show ponies as she
    passes on her good movement and stunning quality head. A brilliant mum who does her
    foals very well and is currently empty.

6   JAZZ IV, PIEBALD MARE, 12 YEARS, 15.1HH APPROX.
    Registered: CHAPS.
    Successfully shown at local and County level, including recently qualifying for the CHAPS
    (UK) Championship show. Competed up to novice level in dressage, scoring 65.7% in her
    last outing with the scope to progress. Has done all Pony Club activities and some
    unaffiliated eventing. Hacks alone and in company, will go first or last and is not fazed by
    traffic or machinery. Good in open fields and on the beach and excellent out hunting and
    will stand all day. Good to clip, shoe, catch etc and lives in or out.

    mare that has been there and done it all. A lovely worker on the flat and is safe and
    sensible with a soft snaffle mouth at all times. Loves Fun and Farm rides, goes first or last,
    is bombproof on the roads and doesn’t buck, kick or rear. Good to box, shoe, clip, travel
    etc.

    and 4th in his first 3 chase starts. A good looking horse who would make a fantastic
    hunter/team chaser/schoolmaster. Goes first or last and is excellent on roads. With good
    paces he lives in or out and is good to box, shoe, clip etc. Only for sale as owner has
    youngsters coming through. Has been seen to windsuck without a collar.

    A super mare who we have owned since she was a 4-year-old. She has won and been
    placed at County level in Irish Draught classes and easily jumps a course up to 3 foot, with
    the scope and enthusiasm to jump bigger and better yet. She will hack out alone and in
    company as well as being good to shoe, clip, box etc. I now have two small children and
    just haven’t the time to do as much with her as I would have liked, and she is being
    completely wasted as she could do so much more. She has been genuine enough to come
    straight back into work after my two pregnancies without any fuss, and really deserves a
    more useful life. A very attractive mare who is looking for a new rider and owner to fulfil
    her potential.

   Registered: Irish Draught Horse Society (IDHS)
   Jack is a very eye-catching Irish draught x Belgian Warmblood horse. Brought as a 3-year-
   old, he has hunted in the field and whipped -in for the Teme Valley for 2 seasons. Jumps
   over a metre with ease he has also been a part of the Pony Club show jumping teams and
   has competed intermediate level Pony Club dressage. Good to hack alone or in company
   and very good with traffic. Always been a snaffle mouth and is good to shoe, clip, load and
   box etc. He recently won a Working Hunter class and championship at The Ludlow Hunt
   show. He has mild stringhalt which never affects his movement in any way.

   Newcomers and recently jumped his first Foxhunter class. A horse with talent, scope and
   potential to excel with any serious rider who is looking for future success both show
   jumping and eventing. Easy to handle, clip, shoe, catch, load etc.

   She is a lovely honest mare who has competed Showing, Working Hunter, Dressage Show
   Jumping and is cross country trained. A serious contender for HOYS and RIHS she is ideally
   suited by a competitive rider (not a novice ride) who is looking for future success. She can
   be slightly cold-backed at times.

   The Duke of Beaufort’s Hounds, evented up to BE100 and also competed in the show ring.
   She would make a lovely Hunter, Eventer, Working Hunter or Team Chaser. A truly sad
   sale due to her owner moving abroad.

   KP is a smart, dark bay Irish thoroughbred by a well-known sire. Same home for the last 2
   years and is registered RoR. Laid back kind temperament and is good to catch, box, shoe,
   clip and in traffic. Hacks out on own or in company and is snaffle mouthed at all times. Has
   competed BE90 and show-jumped. He has super paces and would suit Riding Club,
   dressage and show. Fully vaccinated and travels in a lorry or trailer with no partition. Has
   a small scar on his front leg which doesn’t affect him and a sarcoid on the front of his neck

   A beautiful mare with lots of presence. She is a fantastic mover and has a very smart big
   jump. Successfully evented, including winning at Kelsall Hill last season. Ariel hunted all
   last season with the North Staffordshire Hounds, being safe and mannerly and going first
   or last. Easy to ride with a wonderful temperament and not at all mareish. Good to box,
   catch, clip and shoe.

   Lovely homebred gelding. He has good balanced paces and has been placed at local
   dressage, county and local showing and always bringing home a ribbon. He has a lovely
   shape over a jump and won his novice workers at The Welsh Performance Show in 2016

BRITISH CONNEMARA PONY SOCIETY

The Connemara Pony is an ancient breed indigenous to that area west of the Lough Corrib in Co Galway, Ireland
known, as the Connemara. This pony has always been vital to the survival of the people who live there. It carried
turf and seaweed to fertilize the fields, which it then ploughed. It provided means of transport for its owners.

The BCPS is a small Breed Society with charity status which is run to raise awareness of these wonderful Native
ponies, maintain the Stud book, preserve the Breed Standards through inspections and grading of young stock,
encourage ownership, educate young people through seminars and open days and look after the welfare of the
Connemara Ponies in this country. It also maintains a part-bred register open to all cross-breds with a minimum of
25% Connemara blood. The thoroughbred cross is particularly successful producing, in many cases, an ideal
Competition horse with that drop of pony blood to give hardiness, cleverness and jumping ability.

Following the presentation of the in-hand young horses, Vendors in the Connemara Pony section
will have an opportunity to present their entries in a parade in the show rings in front of the
stables. This parade will not be judged, but is seen as a good opportunity to present your entries
in a formal fashion in front of prospective purchasers. Entries may be ridden or produced in-hand.
Please listen to any announcements on the day of sale for further information.

Please note: The purchasers of Connemara entries will be charged a passport transfer fee of
£15.00, on Official BCPS passports and £35.00 for all other Connemara Society issued passports.
These fees will be added to the purchasers’ invoice at point of sale. Passports can then be
forwarded to the BCPS for new owner registration.

        turned away this summer.

                             Brightwells Loose Horse Policy

   1. Ensure all gates are closed
   2. Porters to move public away from the area where the horse is loose to
      avoid accidents e.g. kicks or bites.
   3. Porter or vendor (trained personnel) to secure the horse calmly and
      efficiently using a bridle and lead rope. If the horse is wary approach
      slowly and with caution and keep the rope etc hidden.
   4. The horse should then be led to its original destination e.g. back to the
      stable, pen or the sales ring.

   You should be aware that horses are large, unpredictable animals that may
   kick, bite or step on you.
PERFORMANCE PONY SECTION

Ridden ponies, will have the opportunity to show their paces, jumping and loose jumping ability
on the day, in the show rings, both in front and behind the stable blocks.

        company but isn’t a novice ride to hack alone. A fun pony for someone wanting to do a bit
        of everything. A very sad and genuine sale, as he was sadly mis-sold to a complete novice
        for happy hacking alone. His flu vaccinations and teeth are up to date.

The Festival Sale: Auction Conditions of Sale
All horses and ponies in this sale, are subject to the following conditions of sale, and sold under Brightwells General Conditions of Sale which are
available on request and will be displayed in the office on the day of sale.

All horses and ponies in this sale are subject to the following conditions of sale, except Lots which are sold for £1000 (£800 for ponies 14.3hh and under)
or less. These Lots will be sold as they stand; with all other questions of description & condition being entirely at the risk of the Buyer.

1. Entry
(1) A horse shall be entered for a sale on completion of an entry form by or on behalf of the Seller and upon payment to the Auctioneer of the prescribed
entry fee.
(2) On completion of the entry form, which the Seller warrants is complete and correct; they undertake to bring forward the entry for sale. They are warned
that the Auctioneers reserve the right to refuse future entries from Sellers who without good reason have failed to fulfil their obligation to present all Lots for
Sale.
(3) In the event that the Seller wishes to place a reserve on a lot, the amount of the reserve must be specified in Pounds Sterling on the entry form or the
Reserve and Additional Information Sheet. Unless written instructions are lodged with the Auctioneers either on the entry form or the Reserve and
Additional Information Sheet provided by the Auctioneers, lots will be sold without reserve.
(4) The Seller warrants to the Auctioneer and to the Buyer that on the day of the Sale, the horse will have no contagious diseases, and produce a DEFRA
approved passport except foals sold at foot which are under 6 months old.

2. Commission, Buyer’s Premium & Selling Fees
(1) The Seller will pay to the Auctioneer a commission of 6% of the hammer price of each Lot plus VAT. There will be a minimum Commission of £50 +VAT
(2) Where a horse is “Bought In” the Seller will pay a minimum commission fee of £100 plus VAT or 6% of the hammer price, (whichever is the greater).
(3) Commission is payable in full by the Seller to the Auctioneers even if a horse is subsequently returned by the Buyer to the Seller in accordance with the
complaints procedure hereunder or for any other reason.
(4) In the event that a horse is sold subject to veterinary examination and in the event that a horse is returned by the Buyer in accordance with a veterinary
certificate obtained on the day of the Sale, then the Seller shall pay to the Auctioneer a commission of 3% of the gross sale price plus VAT.
(5) A horse, having been entered for a Sale may be withdrawn prior to the Sale upon a payment of a withdrawal fee of £100 plus VAT in addition to the entry
fee.
(6) The Buyer will pay 10% plus VAT buyer’s premium on the hammer price.
(8) Any private sale made on the day of sale must be booked through the Auctioneers.
(9) An inward Sales Sponsorship levy of 0.75% +VAT i.e. 90p in every £100 will automatically be deducted from the hammer price of sold Lots.

3. Catalogue Description
(1) The Auctioneer accepts no responsibility for the accuracy of any particulars of a Lot given in the catalogue. The Seller is solely responsible for any
catalogue description of a Lot.
(2) Upon receipt of a catalogue, the Seller undertakes immediately to check the accuracy of the relevant catalogue description of the Lot and to notify the
Auctioneer immediately in writing of any correction amendment or addition that needs to be made to the catalogue description.:-
(3) The following words have the following meanings when used in a catalogue description:
  (i) Unbroken - must be quiet to lead and to halter.
  (ii) Partly Broken - must be capable of being ridden by a competent rider in an enclosed school.
  (iii) Green - must be capable of being ridden by a competent rider at slow paces in open country.
  (iv) Quiet to Ride - must be quiet and easy to manage and ride away, quiet and easily managed at all paces on grass, quiet and mannerly with all traffic on
         the road.
  (v) Hunter - must be quiet ride and quiet with hounds - capable of jumping a Novice Country.
  (vi) Jumper - must be able to jump a course commensurate with described capability when ridden by a competent rider.
  (vii) Potential - where described as “having potential” for a specific purpose, the horse must have the physical capabilities to undertake this purpose or
         purposes and must be examined as such by the Veterinary Surgeon.
  (viii) Driving Horses - the same guarantees as apply to riding horses in respect of ii, iii, and iv above.
  (ix) Pony under 15 hands - must be easily manageable by a child of average competence and age appropriate to the size of the pony.
(4) The authenticity and accuracy of each entry’s passport is the sole responsibility of the Seller. Any inaccuracies that may occur should be dealt with
between the Seller and Buyer.
(5) The Auctioneers may amend or add to any catalogue description during the course of a Sale and may declare a Sale to be subject to veterinary
examination or not during the course of a Sale, in which event any announcement by the Auctioneer takes precedence over any entry in the catalogue.

4. Conduct of the Sale
(1) The Auctioneers may at their absolute discretion:
  (a) Refuse to accept any bid or bidder.
  (b) Regulate the bidding as the Auctioneer sees fit.
  (c) Arrange, consolidate or withdraw any Lot.
  (d) Cancel or postpone a Sale on account of bad weather or other supervening causes. In the event that a Sale is cancelled, moved or rearranged, the
       Auctioneer shall not be liable to pay compensation to any Seller, Bidder or any other party.
(2) The Seller reserves the right to bid through the Auctioneer acting as the Seller‘s agent.
(3) The Buyer shall be the highest bidder. In the event of a dispute between two or more bidders as to which is the Buyer, the Auctioneer shall have the right
to declare the buyer or at the Auctioneer’s discretion, to immediately re-offer the disputed Lot for sale.
(4) The Buyer shall immediately on the fall of the hammer inform the Auctioneer of the Buyer’s name and address and provide any proof of identity that the
Auctioneers may require. Failure in this respect entitles the Auctioneer immediately to offer the Lot for re-sale and the original Buyer shall be liable to make
good any difference in price to the Seller.
(5) Any Buyer bidding as agent for a Principal shall be deemed to have bid on his own behalf as well as on behalf of his Principal and the highest bidder shall
be personally liable along with the Principal to the Seller.
(6) To gain entry on the Sale Premises all lots must travel with their Passport.
