and Key Strategies for Identifying the Reptilian Approach
While the reptile theory has been discussed in general liability litiga-
tion, pervasive misunderstanding of the reptilian approach has caused
some medical malpractice practitioners to fail to recognize that the
strategy is being employed by opposing counsel until it is too late.
This session will bring clarity to the fundamental understanding of
what “the reptile” is and how to identify the issues indicating that you
               have a reptile case.

Early Motion Practice to Keep It out of Discovery
Seasoned medical liability litigators know that initial pleadings
and written discovery can create a minefield of issues as plain-
tiff’s lawyers pursue irrelevant and sometimes prejudicial informa-
tion. The reptile plaintiff is looking to secure the foundation of a case
against the defendant early and often, making initial written discov-
ery an easy trap for the unwitting attorney and carrier. Learn how to
approach written discovery in the reptile case, utilizing motions and

             Client Depositions, Including Physicians, Nurses,
Administrators and Other Health Care Employees
The 30(b)(6) deposition of the most knowledgeable health care exec-
utive is of the utmost importance in defending health care liability
claims. Preparing the 30(b)(6) representative for a reptilian attack,
and defending that deposition effectively, require the defense lawyer
to recognize the threat early and to react quickly. This comprehensive
and critical discussion will focus on how to identify the right 30(b)(6)
witness for a reptile deposition and preparing the health care depo-
nent, defending the deposition, and protecting the record for trial.

Resident’s Rights/Patient’s Rights and Other Tools in Combatting
Reptilian Use of Regulations, Policies, and Procedures
The reptile strategy continues to evolve with attacks on the standard
of care. A favorite reptilian strategy is to use regulations and policies
to establish safety rules and set the standard of care. This session will
provide tools and strategies for using regulations, policies, and proce-
dures as cover against the reptile attack.

Court on Reptile Theory in Motions in Limine and
Pretrial Proceedings to Keep It out of the Jury Box
Motions in limine can be the last, best tool to keep the reptile theory
from making it to the jury. Reptile-focused motions in limine must be
clear, specifically identify the evidence to be excluded, and sufficiently
founded in law to be persuasive. This session will present practical tips
for preparing and arguing effective motions in limine, including pre-
senting exemplar motions that will be instructive in all jurisdictions.

Examination, and Opening and Closing Statements and
How to Use the Reptile Theory to Your Advantage at Trial
This session will squarely address reptile theory’s endgame—
convincing the jury to punish medical providers for violating safety
rules. A jury consultant and seasoned trial lawyer will address how
to use voir dire to counteract a plaintiff’s reptile strategy and how to
conduct openings, witness examinations, and closings that neutralize

The opioid crisis has reached epidemic proportions, launching a new
wave of attacks on health care professionals. Likewise, plaintiffs are
finding new ways to build a reptilian case against insurers through
new theories for bad-faith claims. This session will discuss these and

Diversity and Inclusion in DRI: A Statement of Principle
DRI is the largest international membership organization of attorneys defending the i nterests of business and
                               individuals in civil litigation.
Diversity is a core value at DRI. Indeed, diversity, which includes sexual orientation, is f undamental to the
success of the organization, and we seek out and embrace the innumerable benefits and contributions that the
perspectives, backgrounds, cultures, and life experiences a diverse membership provides.
Inclusiveness is the chief means to increase the diversity of DRI’s membership and leadership positions. DRI’s members and potential leaders
are often also members and leaders of other defense organizations. Accordingly, DRI encourages all national, state, and local defense
organizations to promote diversity and inclusion in their membership and leadership.
Harassment and Discrimination
DRI is committed to the policy of equal opportunity regardless of race, color, religion, sex, sexual orientation, gender, national origin and
disability in all of its programs and activities, as well as maintaining an environment in our programs and activities which is free from all
forms of harassment or discrimination of any kind. Pursuant to this policy, if any person who attends our programs or activities experiences
unlawful discrimination or harassment, this should be reported to the Executive Director so that appropriate action may be taken.
