Southwest Perennials, Inc. 2021 – 2022 Catalog INFORMATION TERMS: Regular terms are cash unless credit with Southwest Perennials has been established. Southwest Perennials accepts checks in advance and credit cards. All credit accounts are due and payable net 30 days from the invoice date. Past due accounts will be subject to a 1.5% finance charge per month AND WILL BE ASSESSED TO ALL DELINQUENT CREDIT ACCOUNTS. Southwest Perennials also reserves the right to suspend orders on delinquent accounts. All return checks are subject to a $30.00 charge. Mastercard, Visa, and Discover credit cards can be accepted for payment with a 2% processing fee. We do not accept American Express. IF legal action is necessary, TEXAS jurisdiction applies. Prices are subject to change without notice. A valid state (Texas) sales tax certificate is required for all Texas customers before shipment. There will be no retail sales. CLAIMS: All shipments must be examined upon receipt by the customer or consignee. Remove trays from the box immediately and place trays in a well-lit area with proper heat/air, water if necessary. When removing plugs, please be careful. Use a dislodging tool or a blunt cake spatula – do not pull the plant out by leaves and stems. If you receive any unacceptable/questionable material, you must contact Southwest Perennials within 48 hours. Cell phone pictures of at least half the shipment will be required. One picture of half a tray will not suffice. Southwest Perennials reserves the right to have all questionable product returned at our expense in Southwest Perennials’ original boxes. If the material is transplanted or discarded, Southwest Perennials will deny refunds/credit. Do not destroy the boxes! If you destroy the boxes, you have agreed to accept and buy the material. If you plant the product, you have agreed to accept and buy the material. Failure to report any unacceptable or questionable product within 48 hours will result in denial of any refund/credit. Refunds beyond 48 hours will be at the sole discretion of Southwest Perennials. Transportation problems and quality problems incurred by transportation will be the responsibility of the customer/consignee to initiate a claim, noting condition of the plant material and boxing on the bill of lading. The customer/consignee must immediately notify the carrier for an inspection. Also, the customer/consignee must notify the broker or Southwest Perennials of the problem. Southwest Perennials limits its liability to the purchase price of the plant material. ORDER DEADLINES: Based on current demand, we need your orders as soon as possible. Typically, if we receive your orders by noon (Central Time) Wednesday, we can normally ship on Monday or Tuesday of the following week. During peak demand, it may be necessary to push the order back one to two weeks. We can no longer accept last minute orders. Those orders will be moved back as necessary. SHIPPING: Southwest Perennials cannot guarantee against loss by freight carriers. Southwest Perennials takes extra precautions by wrapping our product to keep it from being knocked out of the pot by the carrier. Southwest Perennials ships plant material by Fed Ex, Lone Star Overnight, and numerous LTL freight carriers. Pallet shipment with a minimum of four (4) boxes usually offers the best rate with our LTL carriers. Please call for shipping estimates. Southwest Perennials does not file freight claims with Fedex express. You must ship Fedex express at your own peril. SWP does not use UPS. The shipping company is the agent of the purchaser (all shipments become the property of the purchaser when the shipping company picks up the order). BROKERS must file freight claims on their accounts. Customer pickup is welcome at our warehouse. All pickups must make an appointment. Please give a 72 hour notice. Also, please realize that if you arrange a pickup time, we prioritize our shipping and pulling crews based on that schedule. If you forget or change your time at the last minute, you affect other orders in that shipping cycle. We typically ship orders on Monday and Tuesdays. Wednesday, Thursday, and Friday mornings are usually the best times for customer pickups during the spring. Orders not picked up within five business days will be canceled and returned to stock. Southwest Perennials, Inc. 2021 – 2022 Catalog DORMANT MATERIAL: Dormant material may be shipped during the winter months. This is a necessary process for vernalization of some species. Please give plant material adequate time to come out of its dormancy (please take proper care of dormant plants). If you do not wish to receive dormant material, please state so on your order. We will try to arrange a different ship date. AVAILABILITY: Varies throughout the year. Availability lists are posted on our website. (www.southwestperennials.com) Advance orders are encouraged to insure product when you need it. No cancellations four (4) weeks prior to ship date. Minimum Order is $300. $2.25 per tray packing charge applies for all boxed orders. (boxing charge subject to change.) PHYTO INSPECTIONS: There is a $40 Charge for Phyto treatments going into the following states: CALIFORNIA, ARIZONA, IDAHO, WASHINGTON, OREGON, NEVADA, AND UTAH. Treatment Charge also applies for Ipomea liners (sweet potato) shipped into certain counties in Alabama, Arkansas, Georgia, Louisiana, Mississippi, South Carolina, Texas and the entire state of Florida. All phyto orders must be treated and inspected by the Texas Department of Agriculture; we must receive all phyto orders by noon (Central Time) Wednesday to insure shipment on Monday or Tuesday of the following week. RESTOCKING FEE: If Southwest Perennials pulls your order and customer/broker cancel/change order or if the order is not picked up in a timely manor – a 25% restocking fee for that product will be charged. A $50 repack fee will be incurred if the order is changed after boxing. Contracted or crops ‘grown to order’ are not subject to cancellation. BACKORDERS & SUBSTITUTIONS: Southwest Perennials endeavors to fill all orders completely, however, weather and other factors beyond our control can interfere with the crop cycle. If a plug liner order is unavailable on your ship date, these items will be backordered unless you specify “NO BACKORDERS”. Please advise if we may substitute another variety or another product to fill the box. TRAY SIZES: Southwest Perennials bills plant material on a per plug price in tray units. All trays are now billed for full count. ORDER DISCOUNTS: All previous discounts are void. Southwest Perennials now offers volume discounts based on each individual order. Basically the more you order, the more you save. Discounts are based on a single invoice for a single ship date. Cumulative invoices or multiple ship dates do not qualify. Invoices that require designations for multiple locations do not qualify. The discount breakdowns are as follows: 4% on 24 trays 6% on 48 trays 8% on 96 trays There are no discounts for invoices with less than 24 trays. There are no further discounts available beyond 8%. Brokers will continue to buy under their existing agreements and they are expected to pass this discount to their clients. There are no backorders and if there is a shortage, it is at the sole discretion of Southwest Perennials on a case by case basis to apply the discount.
