I.      BACKGROUND and JUSTIFICATION

UNICEF and Ministry of Justice (MoJ) have a long-standing cooperation in the field of Justice
for children. In the context of children’s rights, UNICEF gives utmost importance to use of
detention as a last resort and for the shortest period of time possible; therefore, supports
programmes across the world to enhance alternatives of imprisonment. The “Development of
an Effective Risk Evaluation System for Children in Turkish Probation Services” Project (also
known as the DENGE Juvenile Probation Programme – hereinafter DENGE) has been
developed with this understanding; to improve the probation services for children in Turkey.
The Project is co-funded by the European Union, the Government of Turkey and UNICEF, and
is being implemented by the Ministry of Justice Directorate General for Prisons and Detention
Houses Probation Department with UNICEF technical support. The overall objective is to
increase the efficiency and effectiveness of the juvenile justice system in Turkey through the
development of a more effective, preventive and rehabilitative probation system. The Project
is ultimately expected to ensure their successful reintegration in society as well as supervision
and follow-up in the community. In this regard, various national and international consultancy
teams are currently working on the development of the risks and needs assessment tool,
which, as an integral component, includes various supportive intervention programmes tailored
for those identified risks and needs.

During the initial development phase of the assessment tool and programmes, the current
programmes which are being implemented for those children under probation were also
reviewed and the initial findings clearly indicated the need for additional programmes and
innovative tools as well as more guidance for the probation officers who are working with those
children in the field.

In this context, strengthening the skills on working with families and groups has been identified
one of the major areas where the probation experts need substantive guidance.

Thus, under the DENGE Probation Programme, UNICEF Turkey is seeking a short term
national individual consultant to develop a guidebook for the probation experts on the
principles of group work and working with families.

II.       GENERAL PRINCIPLES

The Consultant(s) will work under the supervision of the Justice for Children and Child Rights
Monitoring Specialist of UNICEF in Turkey in accordance with the standards, rules and
procedures of UNICEF. The consultant(s) are also expected to maintain constant contact with
UNICEF JFC & CRM team, Directorate General for Prisons and Detention Houses, Probation
Department officials and other relevant partners.

The Consultant(s) should comply with the ethics and visibility rules of UNICEF, MoJ and the
EU while preparing the documents, implementing the activities and particularly seeking and
incorporating the opinions of children in the process. While writing reports terminology, ethical
rules and publication and citation guidelines of UNICEF should be followed. Necessary
guidelines will be provided by UNICEF on demand.

All documents to be produced shall respect gender equality and be in line with the UN
Convention on the Rights of the Child and other human rights instruments.

The intellectual property rights of all documents and related materials shall separately
appertain to UNICEF and MoJ and the documents and materials should not be used by a
consultant and/ or a third party with another purpose. To use the documents and materials by
giving reference will be object to the written permission of the parties.

III.      SCOPE of the WORK

The needs of child offenders who are under probation vary. In addition, they are often under
the obligation of not reoffending as well as complying with some additional tasks– in order not
be incarcerated again - during their time of probation; which is supervised by a probation
officer. It is therefore crucial for probation officers to be able to coach their clients along the
way while identifying potential risks which may hinder their collaboration, as well as their well-
being, and refer them to available services. In the case of children, usually this also requires
to establish a constant trust relation with the family system, which can be a very strong driving
force towards positive change.

Probation officers working in the field are often conduct group sessions (both with child
offenders and their families) to ensure share of similar experiences. Although this is a proven
useful practice, in order to perform a successful group work and establish a constructive
relationship with the families, probation officers should be equipped with fundamental
information concerning how to handle group work, work with families and what kind of
operational procedures and referral pathways should be followed in such cases.

As per the results and activities stipulated in the logical framework of the Project, and in close
collaboration with the Project team (composed of MoJ and UNICEF staff as well as other
Project consultants where necessary) the consultant is expected to develop a guidebook
tailored for the needs of the probation experts who are conducting group work with
children under probation and/or working with their families.

The steps of the assignment, and the expected deliverables are as the following:

       a. Desk review

The consultant(s) are initially expected to conduct a desk-based analysis on the probation
system in Turkey as well as the nature of group and family work that is conducted within. The
desk review should also look into the best-practices around the globe on the matter.

A desk-review report and a brief outline of the guidebook is expected by the end of this process.

b. Workshop with Probation Experts

Upon agreement on the outline, the consultant(s) are expected to plan and moderate a five-
day workshop, composed of at least 10 professionals working with the relevant cases. The
participants as well as the venue will be identified by the MoJ and UNICEF, if feasible in
consultation with the consultants.

The main objective of the workshop is to identify the actual needs in the field, as well as to
gather the expectations of the field workers and to finalize the content to be included in the
guidebook.

A brief workshop report is expected by the end of this process.

      c. Development of the guidebook

The developed guidebook should address issues including (but not limited to) the following:

      i.    Working with families:

      -     Assessing the family as a system
      -     Identifying the family needs (as a group and as individuals)
      -     Coping mechanisms for the families in the event of child offending
      -     Reintegrating child offender into the family

      ii. Group Work

      -     Fundamentals principles of group work and what works
      -     Establishing a group to work (for which cases and how)
      -     Identification of the participants
      -     Coping with non-cooperative group members
      -     Specific considerations concerning group work with child offenders.

The consultant(s) are expected to present a first draft in September and finalize it by the end
of October as per the comments of the Project partners.

      ii.      Final Report

The final report should contain a clear information of the consultancy process, major findings,
and clear guidance as well as recommendations on the implementation, supervision and
monitoring of the activities attained to the guidebook. If any, the final report should address the
possible challenges and bottlenecks against its use, along with suggested solutions.

V.        LOCATION & TRAVEL REQUIREMENTS

There is no pre-determined location for providing the consultancy services and most of the
required work can be conducted home/office based.

The consultant will be required to travel within Turkey for the workshops and at least 5
provinces to be selected.

UNICEF will cover the accommodation and travel expenses of the official approved trips within
Turkey.

VI.       DURATION & COST of ASSIGNMENT

      •   Duration: Assignment will cover a 4-month period (01 July – 30 October 2018) and
          payments will be effected upon the delivery of the outputs. It is estimated that 46
          person/days will be required for the completion of tasks.

      •   Estimated Cost of Consultancy: UNICEF will issue an individual contract in Turkish
          Liras. UNICEF will cover travel and accommodation costs arising from event
          organizations. Travel and accommodation expenses may only cover those items
          identified by UNICEF and shall not exceed the pre-determined limits of the daily
          allowances rate of UNICEF. Other costs related to administrative tools,
          communications, etc. shall be covered by the consultant.

      •   Reservations: UNICEF reserves the right to terminate the contract and/or withhold all
          or a portion of payment if the rules and the regulations regarding confidentiality, ethics
          and procedures of UNICEF and the partners are not followed, the performance is
          unsatisfactory, or work/deliverables are incomplete, not delivered or fail to meet the
          deadlines.

In addition, UNICEF reserves the right to work with multiple consultants for the same
assignment, if necessary. Where this is the case, all consultants are expected to work in
cooperation and coordination.

In case of submitting a proposal as a team with the participation of more than one expert,
UNICEF will evaluate each team member separately and as per the rules will sign a separate
contract with each team member.

VII.       QUALIFICATIONS AND SPECIALIZATION REQUIRED FOR THE ASSIGNMENT:

The consultant who will be recruited to complete the assignments is expected to have the
following qualifications:

Technical requirements:

       -   At least Master’s degree in social sciences (social work, psychology, psychological
           counselling etc.) - (minimum for the team leader in case of team applications; holding
           a PhD or higher academic degree will be a strong asset).
       -   Experience in juvenile juvenile justice system and particularly probation.
       -   Experience in working for EU funded projects is a major asset.
       -   Working experience with local or central government agencies (e.g., Ministry of
           Justice), public institutions, international organizations (e.g., United Nations’
           agencies) and/or civil society organizations is an asset.

Skills and personal traits:

       -   Organizational skills to arrange meetings, trainings, workshops, conferences, study
           visits, missions, etc.
       -   Respecting different cultures, accepted local norms, religious beliefs and practices,
           personal interaction and gender roles, disability, age and ethnic identity.
       -   Excellent communication and interpersonal skills.
       -   Ability to work closely with national and international actors and working group within a
           tight schedule to facilitate the coordination of the process.
       -   Computer literacy.

Language:

       -   Proficiency in oral and written English.

IIX.       APPLICATIONS

Applicants are expected to submit to UNICEF their proposals and the CVs in compliance with
the instructions in this ToR, with the announcement and where available with the attached
templates.

Technical proposals are expected to explain the methodology to be utilized to perform the
work in detail and should contain brief information on (including but not limited to) the below
matters:

       ▪   Main objectives
       ▪   Methodology including preliminary structure of the deliverables
       ▪   Estimated amount of time required for each task and time table and logistic
           requirements (if any)
       ▪   References and examples from previous works
       ▪   Risks and assumptions
       ▪   Ethical considerations

IX.        CRITERIA FOR JUDGING THE PROPOSALS

Proposals submitted in response to this call will be evaluated in terms of technical quality and
financial offer. Technical quality will be evaluated using the criteria outlined below:

The financial proposals will be opened only for the technical proposals that reach or exceed
fifty (50) points out of maximum seventy (70) points. Thirty (30) points will be awarded to the
institutional consultant that presented the lowest fee for the services requested. The remaining
financial offers will receive proportional points ([lowest bid/bid] x 30 points). The purpose of the
evaluation of Consultants’ Financial Proposals is to verify that the costs itemized in the financial
proposals adequately cover the services offered in the Technical Proposals.
