DRAFT JUNE 17, 2021 BOARD OF COMMISSIONERS MEETING MINUTES ROCK KOSHKONONG LAKE DISTRICT Chair Alan Sweeney called the meeting to order at 6:03 P.M. Board of Commissioner members present were Treasurer Mark Meyer, Susan Shearer, Michael Shumaker, Kerry Hull, Bill Burlingame, and Michael Hart along with several district members in person and remotely. Sweeney confirmed the meeting agendas were posted. APPROVE AGENDA: Chair Sweeney recommended the DNR move agenda item #9 – Wisconsin DNR Landing and Parking Study Report after item #4. A Shearer/Hart motion to approve the June 17, 2021 agenda passed, all voted in favor. APPROVE MINUTES: A Shearer/Meyer motion to approve the May 20, 2021 minutes passed, all voted in favor. LANDINGS AND LAKE ACCESS: Wisconsin DNR Landing and Parking Study Report DNR representatives Lance Stock and Laura presented the Wisconsin DNR Landing and Parking Study Report. The representatives recommended improving existing access points along with researching the best options presented for new lake access. Adam Walton, Pike Pole Fishing, presented the current Lake Ecology report. TREASURER'S REPORT: Meyer presented the Treasurer’s report. During the water control project, the RKLD will need to obtain a builder’s risk policy. A Burlingame/Shearer motion to approve the Treasurer’s report and the bills list in the amount of $42,862.96 as provided passed, all voted in favor. INDIANFORD DAM REPORT: Sweeney stated the bid will be posted in the June 23rd Edgerton Reporter and sent to qualified bidders for the water control project. A pre-bid meeting will be held June 30th at 10:00 a.m. at the Indianford Dam. Bids are due July 29th and will be opened at the Town of Fulton. The Indianford Dam has been given a fire address of 393 W County Rd M in Edgerton. Chair Sweeney presented Contract Amendment #6 for the services to design the north and south end anchor points, analyze the flow, and present specifications for the placement of the cleaning screens as needed. The amendment would add $23,500 to the final design. Meyer recommended postponing the discussion until the next meeting after more information is needed. A Shearer/Shumaker motion to postpone the discussion about Mead & Hunt Contract Amendment #6 until the next meeting passed, all voted in favor. Dam Operator Kim Bothom provided a dam maintenance update. LAKE MANAGEMENT Shumaker stated the new buoys have been placed. Six buoys to mark rocks will be placed this week. Meyer recommended discussion on repair, replacement, and possible insurance on the existing buoys. Shumaker and Burlingame will review the Recreational Safety Grant as a possible funding source. A Shumaker/ Hull motion to purchase six additional buoys used to mark rocks along with one red and one green channel marker buoys not to exceed $3,000 passed, all voted in favor. A Shumaker/Meyer motion to draft a letter to the DNR from the Rock Koshkonong Lake District requesting the
The annual meeting recommendation is Saturday, August 28th at Racetrack Park. Recording Officer Salvo will confirm the location is available. Recording Officer Salvo stated a post office box will be set up to increase options for general communication. LANDINGS AND LAKE ACCESS: Recording Officer Salvo presented the recommendation from Attorney Thompson to not sign the Memorandum of Agreement between Rock Koshkonong Lake District and the Town of Albion that includes the Town of Albion changes. Shearer recommended the landing funds be used towards an engineering study for all the possible access points on the lake. Meyer recommended the proposed Memorandum of Agreement be presented at the annual meeting. Sweeney requested more information from the DNR about the availability of the preliminary engineering prior to the commitment of the landing site. PUBLIC PARTICIPATION Recording Officer Salvo presented a letter from Jeff Rossing N839 Fairway Drive, Fort Atkinson petitioning his property is removed from the Rock Koshkonong Lake District. A Meyer/Shumaker motion to adjourn passed, all voted in favor.
DRAFT June 30, 2021 BOARD OF COMMISSIONERS MEETING MINUTES ROCK KOSHKONONG LAKE DISTRICT Chair Alan Sweeney called the meeting to order at 9:05 a.m. Board of Commissioner members present were Treasurer Mark Meyer, Susan Shearer, Michael Shumaker, Bill Burlingame, and Michael Hart. Sweeney confirmed the meeting agendas were posted. APPROVE AGENDA: A Burlingame/Shumaker motion to approve the June 30, 2021 agenda passed, all voted in favor. INDIANFORD DAM REPORT: Jeff Anderson from Mead and Hunt presented Amendment #6. The Scope of Services is modified to include designing the upstream and downstream mooring points and associated connections for the proposed debris boom enhancements; additional effort in preparing contract documents and permit application process. The due date for the Indianford Discharge Capacity Upgrades bid is July 30, 3021 at 11:00 a.m. The pre- bid meeting for potential bidders will be held June 30, 2021 at 10:00 a.m. A Shearer/motion to approve Amendment #6 with Mead & Hunt for an additional $23,500 passed, all voted in favor. LAKE MANAGEMENT: Indianford Dam Operator Kim Bothom provided an update on the water levels. At the time of the meeting the gates were open. Meyer presented the update of the Lake Koshkonong Water Information Summary that will be featured on the website. The page provides the Inflow Forecast, Stage Forecast, River Gauge locations, and 24 hour precipitation forecast. Resolution 2021-1 Rock Koshkonong Lake District Rock Koshkonong Lake District Annual Audit WHEREAS, pursuant to Section 33.29(2) Wisconsin Statutes, the Rock Koshkonong Lake District board of directors will direct an audit of all financial transactions of the district for each fiscal year. WHEREAS, the annual transaction audit report will be presented at the annual meeting of electors and property owners of the Rock Koshkonong Lake District. WHEREAS, open financial management is essential for efficient operations of the Rock Koshkonong Lake District NOW, THERFORE BE IT RESOLVED, Rock Koshkonong Lake District shall request the Wisconsin Towns of Albion, Fulton, Koshkonong, Milton and Sumner to appoint a representative to the annual audit committee of Rock Koshkonong Lake District and review and supply a financial report to the district’s electors and landowners prior to the annual meeting of the lake district. BE IT FURTHER RESOLVED, the Rock Koshkonong Lake District Treasurer shall provide to the audit committee general fund bank detail, invoices for the year, as well as all activity and interest statements for segregated funds and provide for review spending and annual budget over/under for budgeted items. MEMORANDUM TO: Rock Koshkonong Lake District FROM: Attorney Danielle H. Thompson RE: Voting Procedure at Annual Meeting DATE: July 13, 2021 ______________________________________________________________________________ The Board has requested my input regarding developing policy and procedures for voting at the annual meeting. Eligible Voters: Pursuant to Chapter 33 of the Wisconsin statutes, both electors and property owners are eligible to vote at the annual meeting. A qualified elector is a U.S. Citizen, 18 years of age or older, who has resided within the election district for 28 consecutive days before any election. Wis. Stat. §6.02(1). These requirements are consistent with general election principles that allow people to vote where they live. Lake Districts are unique in that they allow non-resident property owners, including business entities and organizational property owners to vote. For purposes of voting, “property owner” is defined as a person who is a U.S. Citizen and 18 years of age or older and who meets any of the following requirements: 1) The person’s name appears as an owner of real property on the tax roll of the previous year; 2) The person owns title to real property but the person’s name does not appear as an owner on the tax roll; or 3) The person is the official representative, officer, or employee who is authorized to vote on behalf of a trust, foundation, corporation, association, or organization that owns real property in the district. Wis. Stat. §33.01(9)(ar). Rather than verifying every voter’s eligibility at the onset, the District can have attendees sign an affidavit or certification attesting to their eligibility. Completed affidavits must be maintained by the District consistent with Wisconsin open records requirements. Distribution of Ballots: Wis. Stat. §33.30 governs the procedure for annual meetings. The election of commissioners must be done by secret ballot. Qualified electors (i.e. residents) and property owners in attendance at the meeting shall receive one ballot per person.
Historically, there has been some debate as to whether a person who a resident, a landowner, and/or an assigned representative of a corporation is entitled to multiple votes. The prevailing opinion is because there is not direct statutory authority stating otherwise, standard election principles allowing “one person, one vote” apply. As such, each qualified elector or property owner in attendance is entitled to one vote. Ownership of more than one parcel of real estate within the District does not entitle the owner to more than one vote. Corporations, governmental bodies, trusts, and other organization owners are treated as a single owner with one vote. If a resident or individual property owner also owns a business which holds title to property within the district, the business will need to authorize a separate person who is not otherwise eligible to vote in the election to serve as the business’s official representative and cast a separate ballot on behalf of the business. No absentee or proxy voting is allowed. All voters must be in attendance at the meeting. All ballots must be distributed before collection of the ballots commences. Counting Ballots/Recount: As to the election of commissioners, ballots must be counted immediately following the election and the results, including the vote counts, must be read to those in attendance at the meeting. Any candidate or their designee are permitted to observe the vote count. Any elector or candidate may request a recount. However, that request must be made prior the meeting being adjourned. The secretary must note the request for recount in the meeting minutes. The initial recount can be performed by the prior vote counters. If the total number of votes cast is fewer than 100, the recount results are final if after two successive recounts the results are identical. If the total number of votes cast is 100 or greater, the results are final after one recount unless the runner-up candidate requests another recount. If a runner-up candidate in an election where 100 or more votes are cast requests a second recount, the ballots must be enclosed in a tamper-evident sealed container. The container must then be delivered to the clerk of the most populous municipality in the district within two business days for a recount by the municipal clerk.
