DEAR VALUED CUSTOMERS
This price book covers the vehicles for which we supply a range of SmartBar manufactured products which includes our bull
bars. It should be considered a replacement for all previous versions of SmartBar price lists.
We are continually sourcing and designing new products to add to our range, so if your vehicle or a particular accessory
is not listed here please enquire with one of our sales staff... we may have just what you’re after.
Due to the complex nature of this price and application list, inevitably human errors will occur, therefore we reserve the right to correct
any genuine errors, application errors and related issues. We will always be fair and reasonable if this results in a problem. SmartBar also
reserves the right to change prices without notification.
VEHICLE COMPATIBILITY
Please note that information contained in this guide is based on manufacturers’ specifications at the time of print. Changes to vehicles or
products may occur after this time that may render a certain accessory unsuitable for aparticular application.
Vehicle model dates contained in this guide are indicative, so please exercise caution when ordering accessories if your vehicle’s build
date falls close to a model change date. If in doubt, please consult your SmartBar distributor, who can assist with determining the correct
products for a particular vehicle.
The products detailed in this guide are fully compatible with air bag systems (when fitted), unless otherwise stated. For information on
the technology behind our products, and how air bag compatibility is achieved please contact the SmartBar technical team.
REMOVAL OF PARTS FROM YOUR VEHICLE
Please note that in some cases, it may be necessary to remove parts from your vehicle in order to carry out the fitment of replacement
parts and accessories.
In most cases, removal of these parts unavoidably destroys them and renders them unsuitable for re-use.
MADE TO ORDER
Please be aware that in some cases, products are not held in stock and are strictly made to order. These products are identified with
**MADE TO ORDER** in the price list; for accurate and current lead times in the event of an order, please contact SmartBar direct.
FREIGHT CHARGES
Prices shown in this book do not include any allowance for the cost of freight. In some states, territories and rural areas some additional
freight costs can be expected.
GST
Prices shown in this book are inclusive of GST.

COVER LETTER
FITTING TIME & CHARGES
Prices listed in this book do not include to the cost of fitment to the vehicle, it is advised to speak to your local supplier regarding
expected charges. The fitting time of the bars and their accessories have been listed as a guide, but please note that the figures are
based on the time required for an experienced installer. First time installers should allow extra time.
In addition, the fitment and wiring of any light accessories may incur additional costs. All wiring should be completed by a qualified
auto electrician. SmartBar bears no responsibility for any electrical failure caused by the incorrect fitment of the lamps or any electrical
components.
BLACK ONLY PRICING
Please note that all prices shown on SmartBar bull bars are for BLACK ONLY. Additional charges apply for alternative colours.
PAINTING/COLOUR CODING SMARTBAR
We are often asked if it is possible, and how to paint the SmartBar product to color code to a vehicle. Please note, we do not recommend
painting our product.
Painting a bar is done at your own risk and SmartBar accepts no responsibility for problems occuring as a result.
THREADED FITTINGS IMPORTANT NOTICE
SmartBar recommends the use of anti-seize on all threaded fittings
CAUTION: A torque specification of 28Nm (M10) or 55Nm (M12) is required for the bolts into the brass nutserts. These must not be over
tightened.
ADDITIONAL PURCHASING NOTES
Ensure all components, as listed in the bill of materials on the back page, are received prior to commencing the fitment. Please retain all
hardware until fit-up is complete.
Fitting instructions are supplied with each SmartBar. Please take the time to read the instructions thoroughly before proceeding with
fitment.

TERMS & CONDITIONS
TERMS AND CONDITIONS OF SALES OF ALL PRODUCTS AND SERVICES
All purchases of Goods or Services from SmartBar on and from 1 September 2017 are subject to these terms and conditions.
1. DEFINITIONS
These words have the following meanings in these terms and conditions:
• Customer means the entity or person purchasing the Goods.
• Goods means all vehicle accessories and associated products sold by SmartBar, including catalogues, brochures and drawings
• SB and/or SmartBar means trading as SmartBar ARB Corporation Limited ABN 31 006 708 756
• Order means an order for Goods or services made in accordance with clause 2.1
• Customisation includes colour coding.
2. ORDERING GOODS
2.1 SmartBar may issue quotations for Goods or services from time to time or otherwise offer Goods for sale. A contract is formed for the
supply of Goods and/or services between SmartBar and the Customer when SmartBar issues an invoice to the Customer or otherwise
notifies the Customer in writing that it accepts a request to purchase Goods. Accepted requests to purchase Goods or services comprise
Orders.
2.2 These terms and conditions apply to all Orders and take precedence over any prior representations, terms or conditions. Customers
should ensure that Orders contain the correct SmartBar product or part number and description and the Customer should use such
number and description when describing Goods.
2.3 Orders may only be varied or cancelled by the agreement of the parties evidenced in writing. Orders cannot be varied or cancelled
after manufacturing of any made-to-order Goods or Customisation of any Goods has commenced.
3. PRICE
3.1 Prices for Goods may vary from those quoted. Prices are fixed on the date of acceptance of the Order. Prices are GST inclusive.
3.2 The cost of delivery of Goods will be borne by the Customer.
4. TERMS OF PAYMENT
4.1 Payment for all Goods and services supplied by SmartBar to Customers holding a valid debtor’s account is due 30 days from the end
of the month in which the invoice for the Goods is issued unless otherwise agreed in writing. Accounts are to be conducted on a monthly
basis. The month end closes on the last calendar day and a statement will be forwarded shortly afterwards.
4.2 For all other Customers, payment for Goods is due at the time of supply or dispatch.
5. DEFAULT IN PAYMENT
5.1 If the Customer does not pay any amount owing to SmartBar for the Goods and services in accordance with the terms of payment,
SmartBar may charge interest on the amount owed at the rate of 12.5% per annum per month (prorated). The interest will be added to
the amount owed by the Customer to SmartBar on the first day of each month while an amount remains overdue and unpaid.
5.2 When an account Customer of SmartBar does not make payment in accordance with these terms and conditions, then SmartBar may
claim from the Customer all monies outstanding and payable to SmartBar at the time of that demand. Upon such claim, all monies owed
shall become immediately due and payable.
5.3 If the Customer does not make a payment in accordance these terms and conditions, then SmartBar may claim from the Customer all
amounts owed plus the costs of collection of monies due, including the fees of any mercantile agent or solicitor.
6. DELIVERY AND SUPPLY
6.1 No notification of anticipated time for delivery or availability of Goods will be construed as a term of contract between SmartBar
and the Customer. The Customer agrees that if SmartBar is not able to deliver Goods in accordance with estimated delivery dates,
the Customer will not make, and will ensure its customers or any party associated with the Customer will not make, any claim against
SmartBar in connection with or arising from the timing of delivery or the non-delivery of the Goods.
6.2 The bill of lading or carrier’s receipts in respect of Goods will be regarded as evidence of delivery of the Goods.
6.3 The Customer must inspect the Goods immediately upon delivery. The Customer must, within 7 days of receipt of Goods, notify
SmartBar in writing of any alleged claims for short or wrongful delivery or for any breach of these terms and conditions. If no such notice
is given, SmartBar will be deemed to have fulfilled theses terms and conditions.
6.4 While SmartBar will endeavour to deliver Goods within notified timeframes, it will not be liable to the Customer for any delays in
delivery.
6.5 If SmartBar is unable to supply Goods because of strikes, lock-outs, acts of God, acts of war or any other event beyond the reasonable
control of SmartBar, SmartBar will advise the Customer of the non-availability of any Goods as soon as reasonably practicable. Upon such
advice being given by SmartBar to the Customer, the Customer may cancel the Order or select alternative Goods, however, the Customer
will not be able to require SmartBar to supply the Goods originally ordered.

7. RETURN OF GOODS
No goods may be returned to SmartBar unless:
(a) the Goods are faulty;
(b) a return authorisation number and freight instructions are given by a SmartBar representative for the Goods;
(c) the Goods are returned within 21 days of the original delivery; and
(d) the Goods are be returned in salable condition.
A handling charge of 5% of the value of the Goods may be deducted from any credit for the retuned Goods unless the Customer shows
that the Goods were incorrectly supplied as the result of an error made by an SmartBar representative.
8. INTELLECTUAL PROPERTY RIGHTS
The Customer acknowledges SmartBar’s title to all product designs, illustrations, photography, designs, graphics, images, logos,
text and other related materials to be copyrights, trademarks, registrations and intellectual property of SmartBar. Use, duplication,
reproduction, distribution, display or transmission of same without the permission of ARB in writing is prohibited.
9. TITLE AND RISK
9.1 Risk in the Goods will pass from SmartBar to the Customer when Goods leave SmartBar’s warehouse for delivery to the Customer.
9.2 Title to the Goods passes from SmartBar to the Customer when payment for the Goods is made in full. Until title passes, the
Customer must:
(a) keep the Goods for SmartBar in the capacity of fiduciary and, store the Goods in such a way that they can be recognised as such;
and
(b) where the Goods are sold in the ordinary course of the Customer’s business, keep separate records in relation to the proceeds of
the sale of such Goods hold the proceeds of sale for the benefit of SmartBar.
9.3 If the Customer does not pay for any Goods on the due date, SmartBar is hereby irrevocably authorised by the Customer to enter
the Customer’s premises (or any premises where the Goods are stored) and take possession of the Goods without liability for the tort of
trespass, negligence or payment of any compensation to the Customer or any third party.
9.4 The customer acknowledges that SmartBar will have a Purchase Money Security Interest (as defined in the Personal Property Security
Act 2009 ( Act )) (PMSI) in any Goods supplied under these terms and conditions or any other contract between SmartBar and the
customer. At any time SmartBar may register the PMSI on the PPS Register (as defined in the Act), and the Customer:
(a) must provide SmartBar with any further information or consent necessary to do this; and
(b) waives its right to receive any notification from SmartBar under the Act.
10. LIMITATION OF LIABILITY
10.1 SmartBar’s liability in respect of the state, quality or condition of the Goods supplied to the customer is limited to the maximum
extent permissible by law to any liability arising under the Competition and Consumer Act 2010 or any other applicable law. Further, if any
Goods supplied by SmartBar are not of a kind ordinarily acquired for personal, household or domestic use then SmartBar’s liability will be
limited for failure to comply with a consumer guarantee under the Australian Consumer Law is limited to one or more of the following:
(a) the replacement of the Goods or the supply of equivalent goods;
(b) the repair of the Goods;
(c) the payment of the cost of replacing the goods or of acquiring equivalent Goods;
(d) the payment of the cost of having the Goods repaired.
10.2 SmartBar’s liability to any person or body for any loss or damage (consequential or otherwise) caused by or resulting from any
failure, defect or deficiency of whatsoever nature or kind in the Goods is limited to the maximum extent permissible by law.
11. JURISDICTION
The laws of South Australia will apply to this agreement, and the parties agree to submit to the jurisdiction of the courts of South
Australia.
