                                        Terms of Reference

                                                 Background
The Protection Sector in north-east Nigeria was established to ensure coherent and coordinated
support to the Government’s efforts to deliver timely and consistent protection response to the
affected and most vulnerable communities. Its objectives are:
    (1) Mitigate and respond to the harm caused to people who have suffered violence, coercion,
        exploitation, serious neglect or discrimination, and restore their capacity to live safe and
        dignified lives.
    (2) Strengthen targeted protection services to address the needs and vulnerability of persons at
        heightened risks of violence, exploitation, serious neglect or discrimination; enhance their
        capacities and reduce the risk of resorting to negative coping mechanisms.
    (3) Strengthen the protection environment through the identification, monitoring and
        strengthening of risk reduction strategies of the affected population, legal and political
        systems, and the capacity of local actors to respond to protection concerns
The Protection Sector in north-east Nigeria is led by the Ministry of Women Affairs and Social
Development (hereinafter “MWASD”) and co-led by UNHCR and Norwegian Refugee Council (NRC)
The Sector has four Sub-Sectors, each led by relevant government ministries and co-led by UN/INGO
agencies. This coordination structure is replicated in Adamawa and Yobe States, with Working
Groups.
In January 2019, the Borno State Anti-Trafficking in Persons Task Force was set up and it is co-chaired
by the National Agency for the Prohibition of Trafficking in Persons (NAPTIP) and the MWASD with
the International Organization for Migration, Heartland Alliance International and UNHCR
supporting the coordination of the task force. In July 2019, the General Protection Technical
Working Group was established.

                                                   Objective
The Strategic Advisory Group (SAG) will provide strategic technical direction and guidance to the
work of the Protection Sector and facilitate timely and effective decision-making.

Structure and Membership
The SAG will be composed of:
    ▪   The Borno State Ministry of Women Affairs & Social Development, the Chair of the SAG;
    ▪   The Protection Sector Coordinator (UNHCR), the co-chair of the SAG;
    ▪   The Child Protection (UNICEF), the Gender Based Violence (UNFPA), the Housing Land and
        Property (NRC) and the Mine Action (UNMAS) Sub-Sector Coordinators;
    ▪   The Protection Sector Lead Agency - UNHCR
    ▪   The Protection Sector NGO co-lead, currently held by the Norwegian Refugee Council;
    ▪   Two (2) representatives of national NGOs (NNGO);
    ▪   Two (2) representatives of international NGOs (INGO);
    ▪   Two (2) representatives of UN agencies;
    ▪   One (1) representative each from the Adamawa and Yobe Protection Sector Working
        Groups.

The SAG member organizations are expected to appoint a staff member with relevant protection
experience to be the SAG focal point with a designated alternate with similar expertise.

The National Protection Sector Working Group, ProCap and GenCap Advisors will play a support role
to the SAG and may attend the SAG meetings as observers. The ICRC and donors may also be invited
as observers.

                                                      Tasks
The main tasks of the SAG are as follows:
    A. Technical Support
      ▪ Build on the existing capacity of the Protection Sector for objective and evidence-based
        decision-making processes including decisions involving pooled funding allocations;
      ▪ Guide the Protection Sector through referencing of tangible implementation actions by
        other sectors on the centrality of protection to reinforce this as the key pillar of protection
        in humanitarian response;
       ▪ Reinforce cross sectorial issues (Gender, protection mainstreaming, Disability inclusion
         and diversity) as part of the information flow and practice within the protection sector
         and the sub sectors;
       ▪ Provide technical inputs and endorse key documents such as advocacy notes, reports,
         position papers, policy briefs, guidelines and tools, and support the strategic designing of
         implementation methodology of the afore-mentioned documents;
      ▪ Provide technical inputs/review in the Humanitarian Program Cycle processes;
      ▪ In conjunction with the Protection Sector and its AoRs, the SAG will contribute to the
        development of the Protection Sector’s strategic framework, conduct the final review and
        endorsement of the document and provide guidance on implementation of the work-
        plan; and
      ▪ SAG representatives may upon request meet with influential stakeholders to represent
        the Protection Sector. These stakeholders may include senior government delegates from
        donor and hosting countries, key donor representatives.

    B. Advocacy
     ▪ Support the Protection Sector in north-east Nigeria in developing and implementing an
       advocacy strategy.

    C. Capacity Building
      ▪ Guide the Protection Sector in north-east Nigeria in identifying and addressing
        institutional and technical capacity gaps within the protection response.
      ▪ Support the development and implementation of a clear capacity building strategy and
        work-plan based on identified gaps with measurable indicators.

    D. Sector Performance
        Oversee the review and resolution of matters affecting sectoral performance and response.

Methodology
i.    Meetings:
      ▪ The SAG will meet once every two months. However, ad hoc meetings will be convened by
        the Chair or the co-Chair on a needs basis.
      ▪ An agenda will be shared with good notice prior to the meeting date for members’ inputs;
        certain aspects of the SAG’s TOR will remain as standing agenda items. Minutes of the
        meeting will be shared by the Protection Sector Coordinator within two weeks of the
        meeting.
      ▪ Representatives from Adamawa and Yobe will be invited to attend the meetings either
        physically or via tele/video conference. They will also be encouraged to communicate issues
        they would like the SAG to address, via email at least two weeks prior to the meeting date.
      ▪ Quorum of the meetings will be constituted as follows:
         o At least two-thirds of the leadership (MWASD, Protection Sector Coordinator, the NGO
           co-lead agency) must be present at the meeting.
      ▪ All elected members are expected to be represented at the meeting either by the principal
        or the designated alternate.
      ▪ All AoR Coordinators are required to attend. An AoR coordinator who is unable to attend a
        meeting is required to notify the Protection Sector Coordinator in writing and submit their
        contributions to the meeting based on the agenda. In the event that an ad hoc meeting is
        called involving an issue raised directly relevant to an AoR, then that AoR Coordinator must
        be present at the meeting. An AoR Coordinator may be represented by the NGO co-lead
        where applicable.

ii.   Selection of NNGO, INGO and UN organizations’ representatives:
      ▪ The SAG Members representing the NNGOs, INGOs and UN will be elected on a rotational
        basis by one vote per PS member organization for a period of one (1) calendar year. The
        criteria for eligibility will include:
             o demonstrable protection technical expertise;
             o operational relevance in north-east Nigeria,
             o demonstrated capacity to contribute strategically and to provide practical support;
             o commitment to contributing consistently to the Protection Sector; and
             o Integrity, credibility and strict adherence to humanitarian principles (In the event
               that an organization is publicly experiencing issues which question its integrity, then
               that organization may not be nominated for election until such a time when it has
               cleared its name).
      ▪ For selection of the representatives, there should be at least 60% attendance of NNGO, INGO
        members of the PS and 50% of member UN Agencies for the selection to hold.

iii. Tenure of membership:
    The SAG Members representing organizations shall serve for a period of one (1) calendar year
    and can be selected to serve in the consecutive year based on the eligibility criteria. In
    circumstances where expertise in protection does not have a wider pool of choices the rotation
    timelines may adjusted, e.g. if only 2/3 protection agencies are available then the rotation rules
    may not be strictly adhered to.

                                                    Validity
These terms of reference will be reviewed on an annual basis.
