SHANTARAM POTDUKHE COLLEGE OF LAW Legal Education at S.P. College of Law: A Unique and Dynamic Venture Over decade or so legal education has passed through tremendous transformation in India. Today, the students do not enter legal profession or law education only in the absence of anything better to do rather a large chunk of students opt it as their first, and sometimes, the only choice. According to some recent surveys legal education is one of the most sought after courses in India. The reasons for its present increased status may be attributed to the growing vacuum in the field of legal practitioners, increasing demand for legal outsourcing, advent of thousands of law firms, demand for legal officers in banks, companies and various other commercial organizations, vacant posts in judicial services and, last but not the least, earning fame and money through advocacy. As the old Darwinian theory reveals only those who are responsive to change would survive suits the occasion. Shantaram Potdukhe College of Law, a premier law institute in Central India, understands the Darwinian Theory and believes firmly in this change both inwardly and outwardly with the changing scenario. So far, the college has left no stone unturned in catering to the increasing demands of legal education and its quality. An institution should always be like a stream and not a stagnant pond. That is why since the last 43 years of its journey S.P. College embarked on its spirit of maintaining higher standards of legal education from time to time. One of the biggest symbols of this change is the numerous new programs started by the college like Masters Degree in Human Rights and Duties Education, P.G. Diploma Cyber Law, Panchayat Raj, Law, Health and Medicine, Dr. B.R. Ambedkar Thoughts, P. G. Diploma in Taxation Law’s etc. This is an attempt cope up with the changing system of education and to equip students in fast changing mode of education. Today the college is proud to announce that almost every year students of this institution have developed a habit of securing University ranks. At times, the students of this institution even grabbed all three top ranks in law examinations like B.A.LL.B. 5 year, LL.B. 3 year and LL.M. Alumina of the college now work in various High Courts and Supreme Court as lawyers. Some have gone to foreign countries and a lot many are working in Judiciary in various capacities like Public Prosecutor, JMFC, District and Sessions Judge etc., For a college situated in a tribal and Muffasil belf, these achievements are simply dreams coming true. But there is hardly any time to rest, rather the college continues to march forward towards excellence, innovation and progress. The journey of S.P. College of Law started way back in 1974. In the beginning it was a faculty of law affiliated to Nagpur University as a part of Sardar Patel Mahavidyalaya, Sarvodaya Shikshan Mandal, and the devoted co-operation of the teaching faculty, drawn from eminent jurists of Chandrapur Bar, the law faculty grew from success to success. In the beginning LL.B. 3 Year course was taught in the evening session at the old building. B.A.LL.B. 5 year course was added in 1982 when the course was introduced in the country for the first time. The Govt. of 3
Maharashtra conferred a rare privilege when it allowed the law faculty to start Post-Graduate Studies and Research in Law, in Chandrapur, in 1990. The law Faculty became one of the few institutions in Maharashtra which became another colourful feather in the cap of S. P. College. The Govt. of Maharashtra allowed conversion of the Law Faculty into an independent Law College from the academic year 1995-96 onwards. The college took a new nomenclature, Shantaram Potdukhe College of Law. The foundation stone of S. P. College of Law was laid at the honorable hands of His Excellency Dr. P.C. Alexander, Chancellor of Nagpur University and Governor of Maharashtra in a function held on 13th September 1998. Mrs. Akkamma Alexander, Mrs. Shobhatai Fadnavis, the then Guardian Minister, Hon’ble Shri. Chopne, Vice- Chancellor, Shri. Wamanrao Gaddamwar, Ex-State Minister, Mr. Abdul Shaffi, Ex-M.P. Shri. Shantaramji Potdukhe, President, S. S. Mandal, Shri. Ramesh Mamidwar, Vice-President, S. S. Mandal, Arvind Poreddiwar, Principal, K.U. Nimbalkar, Secretary, S.S. Mandal, Principal P.H. Dhankar, Joint Secretary, S. S. Mandal Divisional Commissioners, Shri. Arun Bongirwar, Principal Secretary, academicians and other dignitaries were present. The New Campus of the College is situated at sprawling premises on Tadoba Road, Tukum, Chandrapur nearer to the District Court, Collectorate, Bus Stand and Railway Station. The college shifted to its own new premises in June 2000. A faculty started with 60 students in 1974 has now grown up to a college having 500 plus pursuing studies in various graduate and post graduate courses like LL.B. 3 Year, B.A.LL.B. 5 Year, LL.M., M.L.S., M.H.R.D.E., Master of Cyber Law & IT, Diploma courses in Consumer Laws, Human Rights, Cyber Law, Panchayat Raj Administration, Taxation and many more. With permanent affiliation from Rashtrasant Tukadoji Maharaj Nagpur University and Gondwana University the College has been included in the 2(f) and 12B status from the University Grants Commission and got financial assistance for various academic and infrastructural activities from the session 2010-11. With highly qualified teaching staff and sound infrastructural facilities the college provides a great opportunity to the students of this institution to pursue legal education. ADMISSION PROCESS FOR U.G. COURSES For Admission in LL.B. 3 years and B.A. LL.B. 5 years students shall appear for MH-CET Law Conducted by DTE, Maharashtra. The dates for application for CET and the dates of CET Exam will be announced by DTE through notification. ADMISSION PROCEDURE FOR CLASSES OTHER THAN LL.B. (3 Yrs.) AND B.A. LL.B. (5 Yrs.) COURSES 1) Issue of Application Forms - 1st July onwards. 2) Admission up to first Monday of August or any date fixed by Gondwana University. *15 days period from the declaration of results of law examinations of Nagpur University and Gondwana University. 3) Admission will be made by the Admission Committee and with due approval from the Principal. 4) Approved Admission forms will be accepted for admission along with fees mentioned in fee schedule during office hours. 5) Admission form is available on website which can be downloaded. Programme. The Fourth digit indicates semester. The Fifth one is for code of area of subject (F-Foundation, C-Core & E-Elective). The Sixth digit indicate group or non-group subject (0 for Non group) & Seventh digit indicate serial No. of the subject. ESE : External Semester Examination IA : Internal Assessment P : Proficiency Level Proficiency Level is to be judged by a committee of three faculty member of the one Institution after completion of 45 days from the date commencement of the semester. SPECIAL ACTIVITIES ACTIVITIES THAT MARK S.P. COLLEGE OF LAW DIFFERENT Legal Aid Clinic : The Students can participate in the legal aid activities organized by the clinic. It is one of the most active Legal Aid Clinics in the State having organized more than 1000 Legal Literacy Camps, Legal Aid Programme and Lok Adalats in the rural areas of the district. National Service Scheme : Nagpur University has sanctioned one N.S.S. unit for this Academy comprising 50 Students form the session 1997-98 and onwards. During the session 2013-2014 the Gondwana University sanctioned the addition of more students i.e., 150 students. The students can participate in rural upliftment programmes through N.S.S. They are selected to participate in Inter-collegiate, Inter university, State & International level camps for which incentive marks are allotted. Computer Practical Training-Computer Lab : Every Student has to attend both theory class on computer application and practical period in the computer lab every week. Environment Club : The Club aims at inculcating among the students to be sensitive to the environment. The College organizes activities like afforestation, cleaning the surroundings etc. Library : The Library Committee of college has announced a prize for student who utilizes maximum number of library books for securing maximum marks in the university examination. 30
SPARC Publication : The College has published books on law subjects. To carry out the adult legal literacy mission Kaydyachya Rajyat Amhi (Rule of Law, Part II-III) are published by college Publication Department. Human Rights of Women in Detention, Juvenile Justice Act-2000 and the Rights of Orphan/Abandoned Infants, S.P. Law Review 2007 to 2017, Administration of Criminal Justice : Issues and Concerns and S.P. Law Review series are Published by SPARC Publication. S. P. Law Review : In addition to Smruti, the college Magazine, college will bring out its issue of S.P. Law Review during the academic year containing critical comments and articles on legal topics including judgments delivered by the Supreme Court and the High Courts. E-Journal : In addition to Smruti & S.P. Law Review the college brings out its E-Journal on various Socio-legal Topics. Book Bank : With the assistance of the Social Welfare Department of Government of Maharashtra, the college library is running a Book Bank for the students belonging to the SC & ST categories. Cantten : The College runs a canteen to cater to the needs of students and staff. 31
SRC Room : We have provided SRC room for Student’s Representative Council members to assemble and have meetings. Sports & Games : Facilities for participating in various sports and games will be provided to the students. Various teams are also formed to represent the Academy in the inter-collegiate/ university level / inter / university competitions. Sports Room : We have sports room for assembly of students and meeting on sports activities. Sports Medicine Room : This cell especially established for the annual and periodical medical check-up of students. Debating Club/Reading & Public Speaking Club : To inculcate a habit of public speaking among students, Debating Club is functioning in the College. The Club also takes up programmes like Debate, Elocution, Essay writing, Mock Parliament, etc. The club is formed to nurture shared reading among the students. The students will collect paper and magazine clippings which will be filed and kept with the in-charge of the club and which will be made available to the students on request. Grievance Cell : There are two grievance redressal cells-one for the staff and other for the students. 32
Suggestion Box : A suggestion box is kept in front of the Principal’s Chamber. Any student can put in suggestions regarding curricular and non-curricular activities which will be periodically seen by the committee and the Principal and if necessary, proper action will be taken. Guidance and Placement Cell : The college has a guidance and placement cell which helps the students to find job opportunities. Whenever any vacancy falls in, the department announces them through the notice board and necessary guidance is also given. Guidance Center for Judicial and Other Competitive Examination : The college has a well-functioning Guidance Center for preparing the students to appear for Judicial and other competitive examinations like NET, SET, MPSC, UPSC, Bank Services etc. Girl’s Hostel : Girl’s hostel built from the MP’s LAD fund can house 32 girl students. Out of these students 2 Students from the backward classes will be given free accommodation on the basis of their financial incapacity. Boy’s Hostel : Boys Hostel constructed with MP’s LAD Funds is open from 2013-14 academic session. Alumni Association : The college keeps contact with its Ex-Students. They are invited to major functions of the college and their help in various needs of the college is commendable. Discovery : An organisation of the students to find out hidden talents and to encourage the students to participate in all kinds of academic activities both inside and outside the college. 33
Anti-Ragging Cell : As per the directions of the Hon’ble Supreme Court, Central Government and the UGC the constitution of an Anti-Ragging Cell in every college is mandatory whose duty is to prevent, prohibit and eliminate the scourge of ragging. Following the UGC Regulations on Curbing the Menace of Ragging in Higher Educational Institution, 2009 the college has formed this anti- ragging cell. Any matter of ragging inside the college premises should be immediately referred to the in-charge of the Cell, Dr. S. K. Dutta (Cont. No. 9423416288) and Co-ordinator Dr. A. U. Shaikh (Cont. No. 9420012037) whenever there occurs any such incident inside the campus. No student of the college should involve, actively or passively, in the act or abet the act of ragging, and if found guilty of ragging and/or abetting ragging, action will be taken against those who directly or indirectly found involved in any form of ragging. Remedial Coaching Cell : Remedial coaching is an integral part of college curriculum. Academically weak and failure students are invited to attend extra classes and all permanent and guest faculty teachers take special class for these students. Under the XIth Plan of UGC the college is supposed to receive financial assistance from the UGC academic session 2012-13 for remedial coaching of backward class students. Women Cell : Women Cell is established for the redressal of grievance of Girl’s Students of the College. Police Sarthi App has been introduced. 34
STUDENTS CHARTER RULES OF DISCIPLINE The chief objective of maintaining a good standard of discipline is to provide clear-cut guidelines on how the students are expected to conduct themselves in their day-to-day work and how are expected to behave inside the college campus. Adherence to these guidelines will help in providing an open, tolerant and friendly atmosphere that is conductive to learning. It also aims to promote higher standards of discipline. The college disciplinary rules are given below. The violation of any rule by any student will constitute breach of discipline and the offenders will be dealt with disciplinary action which may be warning, fine or expulsion from the college. The students of the college are expected to : 1. Maintain discipline and peaceful atmosphere. 2. Students must be in college uniform throughout the academic session whenever they enter the college premises during the working days. They must appear in prescribed uniform in the class-rooms, college functions whenever informed by the authorities to come to the college in uniform. 3. Be regular and punctual in attending the classes and always carry the College Identity Card. 4. Not to be absent from the classes without permission. 5. Avoid seeking permission to be absent from the classes on flimsy grounds. 6. Not to instigate the fellow students to indulge in any unlawful activities. 7. Not to disturb other students when the class is in progress by way of making noise or asking irrelevant questions. Normally reserve questions or doubts to be asked towards the end of the period. 8. Handle college properties like furniture, equipment, tools, etc. carefully without causing any damage. 9. Make it a habit to see the Notice board for keeping one-self well-informed about various programmes and activities taking place in the college. 10. Not to make noise in the Academy area when the classes are in progress. 11. Take active part in extra-curricular activities as these are meant for all round development of the students. 35
12. To pay the fees or any other dues in time. 13. Not to cause damage to the institute’s property or the property of the fellow students. 14. Not to disturb the peace of institute. 15. Not to indulge in malpractices during internal tests and not to be absent from such tests. 16. Not to indulge in any unlawful activities, physical violence or any other activities which may be in violation of law of the land. 17. Not to resort to ragging. If any incident of ragging comes to the notice of the authority, the concerned student shall be given liberty to explain and if his/her explanation is not found satisfactory, the authority will expel him from the institution. Every ragging complaint will be reported to the police. 18. Not to be disrespectful to the college staff and fellow students. 19. Not to chew Pan, Ghutka, Kharra or bubble gum etc. while attending classes and in the college premises. Smoking is strictly prohibited. 20. No student is exempted from attending the National Festivals like Independence Day and Republic Day organized in the college. 21. Students are advised to switch off their mobiles before entering the class.
