Bane NOR Network Statement 2021 BEST-L Bane NOR’s electronic system for infrastructure capacity applications (routes) for annual capacity allocation Firefighting train A trainset equipped with fire extinguishing equipment and intended for extinguishing fires Evacuation train A trainset intended for the evacuation of passengers from wrecked trains FIDO Bane NOR’s electronic system for allocation of routes and announcements Border crossing The point or station where a cross-border railway connection crosses to another infrastructure manager. The expression is only used when crossing national borders. Model of pre-planned train paths A model consisting of train paths in the system, developed so as to be able to keep traffic flowing on stretches of track with very high capacity utilisation. Due to the structure of the national railway network, with Oslo Central Station as the “hub” of a wheel and long stretches of single track, changes in the model of pre-planned train paths will affect train timetables throughout Norway. In addition to the Oslo area, models of pre-planned train paths have been developed for the Stavanger and Bergen areas. Assisting train A train that goes out to collect a train that is stationary on the line. Rail network The rail network managed by Bane NOR. The Norwegian rail network is the same as the rail network managed by Bane NOR. Capacity allocation Process for annual allocation of infrastructure capacity The (Norwegian) National Transport Plan A Report (White Paper) to the Norwegian Parliament (Stortinget) prepared by the Ministry of Transport and Communications. This report presents the Norwegian government’s transport policy. It is also a strategic plan for the development of the comprehensive system for road, rail, air and sea transport. Operative Capacity Allocation Allocation of infrastructure capacity in the applicable timetable. Operative Capacity Allocation involves allocation of residual capacity, see Residual Capacity. Salvage train Trainset intended for salvaging wrecked trains. The salvage train usually consists of an equipment wagon and a crew coach. The equipment wagon contains equipment for lifting and rerailing trains, extra couplings, etc. Residual capacity Unoccupied (free) track capacity in the network that has not been allocated for running trains or as an access track for infrastructure work in the established timetable Rush-hour train Train arriving on the train route between 07:00 and 09:00 or departing between 15:00 and 17:00 in major towns and cities on weekdays (not Saturdays or Sundays) Rail-mounted maintenance machines Machines that are employed to perform infrastructure work Exceptional transport A train can be regarded as an exceptional transport when the load’s and/or the rolling stock’s total weight, weight per metre, the profile of the load or other circumstances require special precautionary rules to be applied when running the train. See UIC Code 502 Maximum line speed The maximum speed that is permitted on a particular stretch of track Applicant A railway company or international consortium of railway companies or physical or legal entities, such as competent authorities in accordance with Regulation (EC) no. 1370/2007 on public passenger transport 7

Bane NOR Network Statement 2021 Part 1 – GENERAL INFORMATION 1.1 Introduction Bane NOR is the IM on the Norwegian rail network and has prepared and published Network Statement 2021, the 18th edition. 1.1.1 Bane NOR’s organisation Bane NOR is arranged into five divisions, each of which is responsible for its own areas, and four group staff teams with specialist responsibility across the divisions: • Development: Planning and implementation of projects linked with new infrastructure • Infrastructure: Administration, operation and maintenance, plus refurbishment of infrastructure • Customers and traffic: Traffic management, customer and traffic information, capacity allocation, operation and administration of traffic-related systems, contact with customers and contracts with railway undertakings • Property: Administration and development of property and hubs, plus operation and maintenance of stations, workshops and other service facilities • Digitisation and technology: Development and deliveries in the fields of digitisation and technology to the entire company, plus introduction and use of modern, customer-friendly solutions for passengers and operators The group staff teams bear overall responsibility for targets and strategies, frameworks and steering documents within their specialist fields across the divisions. 9
Bane NOR Network Statement 2021 1.1.2 The railway sector in Norway 1.2 Objective The objective of the Network Statement is to provide the RU and other applicants with necessary information on access to and use of the Norwegian rail network, as well as other railway-related services provided to the RU. Directive 2012/34/EU has been implemented in Norwegian law by means of the Railway Regulations and the Licensing Regulations. The Network Statement consists of a main document which describes the infrastructure in addition to the general conditions for operating services on the rail network. The Network Statement also includes annexes containing further detailed information. The Network Statement also includes useful links to publications and other relevant websites. 1.3 Legal framework The requirement for establishment of a Network Statement is stipulated in the Railway Regulations, § 5-1. More detailed requirements for the contents of the Network Statement are stipulated in the Railway Regulations, § 5-2. Requirements concerning access to and use of the Norwegian rail network, including the IM’s other railway- related services, are specified in the Railway Regulations. Norwegian laws and regulations applicable to the railways are available on the NRA website at www.sjt.no Some of these laws and regulations have been translated into English. Bane NOR Network Statement 2021 1.4 Legal status 1.4.1 General remarks As far as Norwegian legislation is concerned, the Network Statement is purely for information. This means that information in the Network Statement does not constitute legally binding obligations for Bane NOR. When the ATS refers to specific sections in the Network Statement, this is not a legally binding obligation for Bane NOR unless the ATS specifically indicates that it is a legally binding obligation for Bane NOR. The Network Statement is issued in two languages – Norwegian and English. Document content is the same in both languages. If there is any conflict between the Norwegian version and the English version, the Norwegian text takes precedence. Reference is made in a number of sections to Norwegian legislation and traffic rules issued by Bane NOR. Parts of the legislation, as well as the traffic rules, are only available in Norwegian. 1.4.2 Liability The information provided by Bane NOR in the Network Statement must be correct. Bane NOR nevertheless assumes no liability as a consequence of errors. Any errors that may be detected during the period of validity of the Network Statement will be corrected and announced on the Bane NOR website as described in Ch. 1.6.2. Bane NOR’s objective is to provide services in compliance with the service description provided in the Network Statement. The Network Statement may include information on planned changes during the period following the expiry of the document’s validity period, see Ch. 1.6 below. Such information is not binding for Bane NOR. The Network Statement refers to a certain extent to descriptions provided in other documents issued by Bane NOR. If Bane NOR is to make changes to documents which affect the rights or obligations of the RU, such changes must be sent to the RU for consultation before these changes are implemented. 1.4.3 Appeals procedure The RU and any other applicants that feel they have been treated unfairly, subjected to discrimination or have otherwise had their interests violated in any other way may submit an appeal to the NRA in accordance with the Railway Regulations, § 11-2. This is particularly applicable to decisions made by the IM, the RU or the party running service facilities with regard to: a) the draft and final version of the Network Statement b) criteria established in the Network Statement c) annual and operational capacity allocation d) the charging scheme e) the level or structure of infrastructure charges which the applicant must or may have to pay f) schemes for access in accordance with the Railway Regulations, §§ 2-1, 2-5 and 2-6 g) access to services, collection of charges and payment for services in accordance with the Railway Regulations, § 12-2 and the Railway Regulations, Ch. 4 h) framework agreements concluded Pursuant to the Railway Regulations, § 11-2 (2), the NRA must notify relevant parties of its decision on the matter within six weeks of having received all relevant information. 11
Bane NOR Network Statement 2021 1.5 Structure of Network Statement RNE has compiled a common structure for the structure and content of Network Statement’s (the Network Statement Common Structure). This Network Statement is compliant with RNE’s Network Statement Common Structure. The latest version of the Network Statement Common Structure is dated 5 March 2019 and can be found at www.rne.eu 1.6 Validity and updating process 1.6.1 Validity period Network Statement 2021 is applicable to: ▪ Access to and use of infrastructure, delimited by Timetable R21 ▪ Processing of capacity-demanding programmes for Timetable R21; this is also applicable if processing takes place before the start of Timetable R21 The Network Statement is published 12 months prior to the timetable period to which it applies and is valid for one timetable period. Timetable R21 commences on Sunday, 13 December 2020 and ends on Saturday, 11 December 2021. These dates have been established in accordance with the provisions of EU Directive 2012/34/EU1. 1.6.2 Updating process Bane NOR will use a supplement to Network Statement 2021 to announce any amendments or additions occurring after the publication of this Network Statement. See Change log Amendment of a public regulation referred to in the Network Statement will only be announced by means of a supplement to the Network Statement if: ▪ the amendment is not published in2, and ▪ The amendment may lead to restrictions in the use of railway infrastructure according to the basic service package, see the Railway Regulations, § 4-1 – see Ch. 6.1.1. 1.7 Publishing Network Statement 2021 and annexes will be available in both hardcopy format and electronically on the Bane NOR website, where it can be downloaded for free. The Network Statement will always be available in two languages, both Norwegian and English. Document content is the same in both languages. If the two versions do not match, the Norwegian version will take precedence. An RU can get in touch with an OSS with a view to applying for infrastructure capacity in an international rail network, and the OSS will then start the entire international coordination process. The OSS will work on the basis of contact with an RU and after a meeting with the managers involved: 1. Coordinate the handling of capacity-demanding applications for each requested international section within RNE in such a manner as to ensure that the applications are included correctly in the annual capacity allocation process. 2. Oversee and safeguard the customer’s optimum infrastructure capacity for the entire international infrastructure. Coordination of this process will mainly be carried out by means of simulation with RNE’s PCS system. Bane NOR Network Statement 2021 1.9 Rail freight corridors Regulation 913/2010/EU concerning establishment of a European rail network for competitive freight came into force on 9 November 2010. This regulation requires the member states to establish international, market- oriented rail freight corridors in order to meet the following targets: - to strengthen cooperation between infrastructure managers in important areas such as allocation of train paths, interoperability, interoperable systems and infrastructure development - to find the right balance between freight and passenger services along the freight corridors, provide sufficient capacity for freight in compliance with market needs, and ensure that common punctuality targets for freight trains are met - to promote intermodality between railways and other forms of transport by integrating terminals in the corridor management process Bane NOR is participating in freight corridor 3; Scandinavian-Mediterranean Rail Freight Corridor – ScanMed RFCtogether with Banedanmark, DB Netz, RFI, the Swedish Transport Administration, ÖBB Infrastruktur and the Øresund Bridge. Eleven international rail freight corridors (RFCs) have been established in the EU’s rail network, see http://www.rne.eu/rfc-corridors 1.10 RailNetEurope – international cooperation between Infrastructure Managers RailNetEurope (RNE) was created in January 2004 at the initiative of a number of European railway infrastructure managers that wished to establish a common European organisation in order to facilitate international services. To achieve this objective, RNE offers its members, railway undertakings, applicants and other stakeholders solutions and support with regard to compliance with the European legal framework. This involves developing and harmonising international railway processes, templates, handbooks and guidelines. It also involves developing the necessary IT tools that are streamlined and harmonised. More information on RNE can be found at http://www.rne.eu/organisation/rne-approach-structure/ 1.10.1 One Stop Shop OSS One Stop Shop (OSS) is a network of contact points representing IMs operating international services. CIS CIS is an infrastructure charges information system for applicants, supplied by IMs and allocation bodies (ABs). This Internet-based application provides quick information and indications of costs related to the use of European railway infrastructure, as well as estimating the charges for using international train paths. CIS is an umbrella application for the various railway infrastructure charge systems. CIS can be accessed for free and users do not need to register. TIS TIS is a network-based program that supports international administration of railway traffic by supplying real- time data relating to international trains. Relevant data is obtained directly from Bane NOR systems. IMs send data to TIS, where all the information from the various IMs is collated and combined so that it is possible to track the running of a train from departure or the initial destination to the final destination. This permits transboundary monitoring of the train, from start to finish. RUs and terminal operators are also able to access TIS. They are invited to participate in the RNE TIS Advisory Board: all members of this board are given full access to TIS data if they are involved in the same train running operation. If RUs and the terminal operators are not members of the RNE TIS Advisory Board, mutual agreements may be signed between the individual RUs and between the RUs and terminal operators. Bane NOR Network Statement 2021 Part 2 – ACCESS CONDITIONS 2.1 Introduction See the Railway Regulations, Ch. 2. Other relevant regulations can be found at www.lovdata.no and the NRA website at https://www.sjt.no/andre- valg/regelverk/ see section 1.3. 2.1.1 Access provisions by section 2.1.1.1 COTIF Norway is affiliated to the Convention concerning International Carriage by Rail (COTIF), see the COTIF Act. CIM lines: ▪ All railway lines in the Norwegian rail network CIV lines: ▪ All railway lines in the Norwegian rail network. OTIF (www.otif.org) has updated lists of all railway and ferry lines where CIM and CIV are applicable to international railway transport. 2.1.1.2 TEN – the trans-European conventional railway system See the Interoperability Regulations, Annex 1. Range of application The Norwegian part of the trans-European conventional rail network includes the following lines: ▪ The Østfold Line (Oslo – Moss – Kornsjø) ▪ The Vestfold Line (Oslo – Drammen – Skien) ▪ The Bratsberg Line (Nordagutu – Skien) ▪ The Kongsvinger Line (Oslo – Kongsvinger – Charlottenberg) ▪ The Sørlandet Line (Oslo – Hokksund – Stavanger) ▪ The Bergen Line (Oslo – Hokksund – Hønefoss – Bergen) (Oslo–Roa–Hønefoss) ▪ The Dovre Line (Oslo – Dombås – Trondheim) ▪ The Meråker Line (Trondheim – Storlien) ▪ The Nordland Line (Trondheim – Bodø) ▪ The Ofoten Line (Narvik – Vassijaure) 2.2 General access requirements See the Railway Regulations, Ch. 2. 2.2.1 Conditions for applying for capacity The following enterprises meet the conditions to apply for infrastructure capacity in Norway: 1. RUs which have access to service operation on the Norwegian rail network, provided that the company has a licence and a safety certificate for the type of transport and section in question. 16
Bane NOR Network Statement 2021 Enterprises that may be given access to service operation on tracks that form part of the Norwegian rail network can also apply for infrastructure capacity. The intention is to help ensure that potential RUs that are in the process of acquiring licences and safety certificates are able to participate in the capacity allocation process. Bane NOR permits such enterprises to apply for train paths. For the application to be taken into account when the timetable is established, Bane NOR can require the enterprise to substantiate the fact that it will have received permission prior to the consultation deadline for proposals for the timetable, see Ch. 4.4. 2. RUs and other applicants – an RU or an international Federation of RUs or physical or legal entities, such as competent authorities in accordance with Regulation (EC) no. 1370/2007 on public passenger transport services by rail and by road, which have a non-profit or business interest in being allocated infrastructure capacity, ref. the Railway Regulations, § 1-3, letter j). Such permission can be given either when the annual capacity allocation process begins or when applications for train paths have to be sent before which RU is to provide the services has been clarified. Any applicant that is not an RU must appoint an RU that will run the services and that must conclude or have concluded an agreement with Bane NOR in accordance with the Railway Regulations, § 10-1. The deadline for appointing an RU is 30 days before the planned departure time from the departure station. In accordance with the Railway Regulations, § 8-1 (2), transferring allocated capacity to others or another type of transport service is prohibited. When an RU provides a transport service on behalf of an applicant that is not an RU, this is not to be regarded as a transfer. 2.2.1.1 Access to space in the driver’s cab Personnel carrying out inspections of track sections for Bane NOR must be given access to driver’s cabs to the necessary extent. Bane NOR cannot demand such access if the RU has to reject this as a consequence of requirements in laws or regulations, or internal procedures that implement requirements in laws or regulations. RUs must formulate their procedures for access to driver’s cabs in such a way that it is possible to conclude an agreement providing an inspector with space in a driver’s cab at short notice (less than one hour). For its part, Bane NOR is responsible for ensuring that the inspector does not disrupt the train crew unnecessarily. The reason for this requirement is to avoid reserving more infrastructure capacity than necessary for inspection and maintenance, and also to ensure that Bane NOR has a realistic view of visibility conditions for the train crew. 2.2.1.2 Bane NOR’s primary operating responsibility See the Working Environment Act, Ch. 2. When several employers operate at the same work site simultaneously, employees may be subject to additional risk as a result of the activities being run by employers other than their own. Therefore, each employer must ensure that their own activities are arranged in such a manner that other employees are also protected in accordance with the rules stipulated in the Working Environment Act. Responsibility for coordination of protection and environmental work rests with the principal enterprise. Primary operating responsibility relating to railway activities: ▪ When personnel employed by RUs perform tasks relating to sections administered by Bane NOR, Bane NOR is to be considered the principal enterprise. For example, Bane NOR carries out section inspections with RUs. 17
Bane NOR Network Statement 2021 ▪ The primary operating responsibility for parts of the Bane NOR rail network, which constitute a natural part of terminals, workshop areas and shunting areas and where no regular passenger and freight services operate, rests with the company responsible for the main activity in the area. ▪ The principal enterprise at freight terminals is the company with the most employees at the terminal, or the company that is responsible for the main activity on the terminal site. If there is any doubt, emphasis is also placed on which company has a right to manage, and on any relationship that may be established between superior and subordinate. 2.2.2 Conditions for access to the railway infrastructure (passenger and/or freight trains) See the Railway Regulations, §§ 2-1 and 2-2. A RUs that have access to operate services on the rail network, see the Railway Regulations, § 2-1 This is applicable to RUs that have access to service operation on routes that are part of the rail network, provided that the RU has a licence and a safety certificate pursuant to the Licensing Regulations. The Railway Regulations, § 2-1 (1), letters a) to e) state which RUs have access to operate services on the rail network. To be able to exercise access rights to the rail network, RUs have to be affiliated to a joint trade association specified by the JDIR, see the Railway Regulations, § 2-1 (5). This access also includes necessary transport of vehicles on the rail network, as well as test running and running in connection with training, see the Railway Regulations, § 2-1 (2). B RUs that can apply to the MoT for access to operate services on the rail network in order to provide passenger transport, see the Railway Regulations, § 2-2 The following RUs may, in special cases, be given access to service operation on routes that are part of the rail network beyond the instances referred to in section A, provided that the RU has a licence and a safety certificate pursuant to the Licensing Regulations for the activity to be performed. ▪ RUs that only provide passenger transport in towns and suburban areas or regional passenger transport using their own infrastructure ▪ RUs wishing to provide passenger transport on parts of the rail network where Vy has suspended such services ▪ RUs wishing to run museum train businesses or other limited passenger transport and that do not wish to compete with regular scheduled services Access according to the first two points is given in instances where this will help to bring about appropriate traffic flow, see the Railway Regulations, § 2-2 (2). 2.2.3 Licences Licences pursuant to the Licensing Regulations are issued by the NRA.
