Dear Friends, This year has been the worst year for abortion rights nationally since the landmark decision in Roe v. Wade. In 2021 alone, anti-choice extremists introduced, advanced, or passed more than 330 bills in states across the country attacking abortion access, and over 100 restrictions on abortion access have been enacted at the state level. With the Supreme Court allowing Texas to render Roe v. Wade meaningless in the state, and with the Court set to issue a decision this term in a case that directly challenges Roe, the legal right to abortion is hanging by a thread. If the federal constitutional right to abortion is overturned nationwide, abortion could be prohibited in half of the United States—the consequences of which will be felt all across the country. California will not be immune. If Roe falls, California will have an outsized role to play in helping women and pregnant people from all across the country access the care they need. The question for Californians to ask ourselves is not whether abortion will remain legal here in the Golden State, but will California be prepared to provide care to the thousands upon thou- sands of people who cannot get care in their own states? It is with this urgency in mind that NARAL Pro-Choice California is releasing its first Reproductive Freedom Legislative Scorecard in more than twenty years. The scorecard uses a robust methodology that allows elected officials, advocates, and members of the public to see a nuanced picture of the ways in which state legislators are—or are not—advancing reproductive freedom. In California, we take great pride that a strong majority of state legislators support reproductive freedom and expanding abortion access—a testament to their values and conviction. However, this is just the starting point for California to truly live up to our designation as a Reproductive Freedom State. This legislative scorecard is designed to recognize our champions for reproductive freedom and to incentivize legislators to strive to achieve champion status. The 2021 legislative session gives us insight into California’s preparedness to meet this moment should Roe fall and abortion rights go back to the states. Of the 15 proactive reproductive freedom bills scored this year, just seven of them were signed into law or accomplished through this year’s budget, a low success rate for a state like California. Some major accomplishments included passing the California Momnibus to reduce California’s alarmingly high rates of Black and Indigenous maternal mortality; expanding access to menstrual products in middle schools, high schools, and colleges; and providing reparations to survivors of forced and involuntary sterilization. Among the bills that stalled this year, however, were major bills to expand access to abortion care and birth control, a bill to curtail denials of reproductive and gender-inclusive care, and a bill to expand access to family leave. As we look ahead to 2022, NARAL Pro-Choice California and our nearly 300,000 members statewide look to our legislators to build on California’s long history as a national leader on reproductive freedom. We have much to be proud of, but also much still to do. We hope that in reviewing this year’s scorecard, legislators and community members alike will use this as a baseline and as an opportunity to step up and step into the role that is demanded of us on the national stage.
