Legal next steps Make EU law continue to apply in the UK after EU Implement the Regulation in Exit the UK EU Withdrawal Act IAS (Enforcement and Permitting) Order 2019 Make the EU Reg operable after EU Exit Invasive Non-native Species (Amendment etc.) (EU Exit) Regulations 2019 A working Regulation for the UK 5
The Operability Instrument • We are committed to implementing the Regulation • But, now or after any period of transition, we will need to tweak how it operates – eg. proposed The 49 GB NNS 49 species species of EU IAS Union of special Programme concern Committee concern Board inc. NI EU Proposed Scientific GB Forum NNRAP 6
Restrictions on listed species • Without a permit, licence or defence (such as a companion animal) it would be illegal to.... Release into the import Bred, environment allowed to reproduce keep Sell, use or exchange Transport – Grow, unless in the cultivate context of eradication 7
Rapid action & management measures • And if not widespread, they must be Reported and rapidly eradicated, or contained • Or, if the species is widely spread Eradicated/ contained/ controlled, according to management measures 8
IAS (Enforcement and Permitting) Order 2019 • Provides the measures needed to fully implement the Regulation • Enforcement – civil and criminal sanctions - Warnings, stop notices - Fines up to £250,000 - Prison sentences • Permits and licences – Permits only for ex situ conservation, research, and the advancement of human health – Licences for rapid eradication and management measures 9

Controlling plants or animals • Report new arrivals in UK • Aim to eradicate • Or if widespread, or eradication not feasible, then contain or control according to the management measures • Agreed management measures • These may allow licences to be granted to transport IAS away securely for dispatch and disposal • Remember, the Regulation applies to live IAS 11
Can I display listed species? • The Regulation only applies to live specimens and anything they can reproduce/grow from • Permits cannot be issued for education 12
