Improving the Schengen evaluation and monitoring mechanism

              Resumen The European Commission proposed to improve the Schengen evaluation and monitoring mechanism established by
                        Regulation (EU) No 1053/2013. The accompanying impact assessment (IA) provides a well defined problem definition,
                        substantiated with evidence. Furthermore, the stakeholder opinions are reported consistently throughout the IA and are
                        used as input for the combination of measures under the preferred option. Moreover, the data sources underpinning
                        the IA are recent, reliable, consistently referenced and publicly available at the time of writing. However, the focus of
                        the IA analysis is predominantly on the administrative costs and benefits, while the assessment of economic, social
                        and fundamental rights impacts of the Mechanism’s functioning remains very limited and their quantification was not
                        possible.

              Resumen States must treat asylum-seekers and refugees according to the appropriate standards laid down in human rights and
                        refugee law. The current migration crisis revealed wide divergences in the level of reception conditions provided by
                        Member States. While some are facing problems in ensuring adequate and dignified treatment of applicants, in others
                        the standards of reception provided are more generous. This has led to secondary movements of asylum-seekers and
                        refugees, and has put pressure on certain Member States. The aim of the proposed recast directive, which would
                        replace the current Reception Conditions Directive, is to ensure greater harmonisation of reception standards and
                        more equal treatment of asylum-seekers across all Member States, as well as to avoid ‘asylum shopping’ whereby
                        asylum-seekers choose the Member State with the highest protection standards for their application. Although the co-
                        legislators reached provisional agreement on the proposal in trilogue, Coreper was not able to confirm the Council’s
                        support for that text and trilogue negotiations have yet to restart. Fourth edition. The ‘EU Legislation in Progress’

              Resumen The global flow of refugees and migrants poses challenges, opportunities and obligations for countries around the
                        world. At the very heart of the debate on migration management is how to ensure that the different interests and needs
                        are addressed within a strong human rights framework. The United Nations (UN) is investigating the issue in great
                        depth, and one of the main outcomes of the UN General Assembly in 2016 was a declaration demanding greater
                        international cooperation on managing migration. This declaration was widely endorsed, including by the European
                        Union (EU). As a result, two global compacts have been adopted in 2018, for refugees and for other migrants; this
                        briefing will focus on the latter. According to the International Organization for Migration (IOM), the UN migration
                        agency in charge of the global compact for safe, orderly and regular migration, these compacts 'provide the opportunity
                        to move ahead in strengthening the norms, principles, rules and decision-making processes that will allow for more
                        effective international cooperation in responding to what is a defining issue'. Providing continued institutional support to
                        address these issues and implement the outcomes of the global compacts will be a challenge. This an updated version
                        of a briefing from December 2017, jointly authored by Joanna Apap, Daniela Adorna Diaz and Gonzalo Urbina Trevino.

The global compact on refugees: Strengthening international cooperation to ease the plight of refugees in
the world

              Resumen Recent large-scale flows of refugees and migrants have brought to the world's attention more forcefully than ever the
                        plight of persons who are forced to flee their homes because of war, insecurity or persecution. They have also exposed
                        how ill-prepared the international community has been to deal with this challenge and how uneven the distribution of
                        the burden of caring for such people has been among countries. In 2016, to enhance preparedness for refugee crises,
                        improve the situation of refugees and relieve the burden on host societies, the United Nations (UN) member states
                        convened in New York and adopted a declaration paving the way for a non-binding international compact on refugees.
                        They annexed to this declaration a comprehensive refugee response framework that spelled out a series of short- and
                        longer-term measures to address refugee crises. The framework has been applied in several pilot countries and the
                        lessons learnt fed into a global compact on refugees. The compact was drafted by the UN Refugee Agency (UNHCR)
                        following broad consultations with various stakeholders, and its definitive version was adopted by the UN General
                        Assembly with a large majority on 17 December 2018. The global compact focuses on international-, regional- and
                        national-level mechanisms for achieving a fairer distribution of the responsibilities related to refugees, and on areas
                        where action can be improved. It has been criticised, among other things, for its non-binding character and for
                        excluding victims of natural disasters from its scope. This is an updated edition of a Briefing published in June 2018.

              Resumen EU leaders’ discussions will mainly focus on the 2021-2027 Multiannual Financial Framework (MFF), the single market
                         and migration. EU leaders will hold their first substantial exchange of views on the 2021-2027 MFF, debating its
                         political priorities, the overall level of expenditure and the timetable for the MFF negotiations. On migration and the
                         single market, the European Council will review the implementation and state of play of its previous orientations. Other
                         items to be addressed include the challenge of disinformation, the fight against racism and xenophobia and climate
                         change, as well as external relations, in particular the preparation of the EU-Arab summit on 24-25 February 2019.
                         They will also be informed on preparations for the 2019-202 4Strategic Agenda. The Euro Summit is expected to
                         discuss the reform of European Monetary Union as well as the taxation of digital companies.

              Resumen The European Council (Article 50) meeting of 17 October 2018 made neither made progress towards finalising a
                        withdrawal agreement nor decide on holding an extraordinary summit on Brexit. At the European Council meeting of 18
                        October 2018, EU leaders stressed the need to cooperate with countries of origin and transit as well as fighting people
                        smuggling-networks. On internal security they adopted conclusions regarding many of the new threats the EU is
                        facing, including cyber-attacks, disinformation campaigns, and terrorism. Additionally they addressed a number of
                        external relations related issues, such as EU-Africa relations, the upcoming EU League of Arab States meeting and
                        Climate change.

The Cost of Non-Europe in Asylum Policy

                Resumen Current structural weaknesses and shortcomings in the design and implementation of the Common European Asylum
                         System (CEAS) have a cost of EUR 50.5 billion per year, including costs due to irregular migration, lack of
                         accountability in external action, inefficiencies in asylum procedures, poor living conditions and health, and dimmer
                         employment prospects leading to lower generation of tax revenue. Seven policy options for the EU to tackle the
                         identified gaps and barriers would bring about many benefits including better compliance with international and EU
                         norms and values, lower levels of irregular migration to the EU and costs of border security and surveillance, increased
                         effectiveness and efficiency of the asylum process, faster socio-economic integration of asylum-seekers, increased
                         employment and tax revenues and reinforced protection of human rights in countries of return. Once, considered the
                         costs, the net benefits of these policy options would be at least EUR 23.5 billion per year.

                Resumen As has become the norm with European Council meetings, EU Heads of State or Government will convene on 17 and
                          18 October 2018 in different formats with varying compositions and levels of formality: a regular meeting of the
                          European Council, and an enlarged Euro Summit of 27 Member States on 18 October, preceded by a European
                          Council (Article 50) meeting on the 17 October over dinner. The agenda of the European Council meeting focuses on
                          migration and internal security. Specific foreign policy issues might also be addressed at this meeting. The Euro
                          Summit will discuss the state of play of negotiations on the deepening of Economic and Monetary Union (EMU), with a
                          view to the next Euro Summit in December. However, the priority issue for Heads of State or Government will be
                          Brexit. At the European Council (Article 50) meeting, EU-27 leaders are expected to discuss the progress that has
                          been achieved in the negotiations so far, and possibly call for an extraordinary summit in November 2018.

                Resumen The year 2017 was good for the EU, politically and economically. For the first time in almost a decade, the EU was not
                           beset by crises, although Brexit posed a difficult challenge. The European Council met the Brexit challenge by
                           approving guidelines for the negotiations in April, and agreeing to move to a new stage in December, while convening
                           in a new format: Article 50 (TEU) meetings of the EU-27. The European Council launched another new formal in 2017:
                           Leaders’ Meetings, held under the auspices of the Leader’ Agenda, to discuss challenging issues such as migration
                           and EMU reform. By the end of the year, the European Council could look back at an eventful but largely successful
                           twelve months.

               Resumen     Funding instruments in the field of migration and asylum management cover, on the one hand, different EU policy
                           fields, such as enlargement, neighbourhood, development cooperation and common foreign and security policy, as
                           well as, on the other, international projects such as those managed by the International Organization for Migration
                           (IOM) and the United Nations Refugee Agency (UNHCR) at a more global level. The legal basis of each funding
                           instrument provides for the range of its geographical and thematic coverage. In addition, interaction takes place
                           between the different areas covered by the thematic and geographic programmes and other external financing
                           Instruments. The funding landscape changed in 2013 with the new Financial Regulation applicable to the EU budget.
                           This enabled the European Commission to create and administer Union Trust Funds in the field of external action, from
                           2014: these include multi-donor trust funds for emergency, post-emergency or thematic actions such as the Bêkou and
                           the Madad Fund. The European Parliament welcomed this development in an April 2013 resolution, considering that it
                           would allow the EU to raise the visibility of its external action and to have greater control over the delivery chain of
                           such funds. Following the Valletta Summit in November 2015, an Emergency Trust Fund for stability, to address the
                           root causes of irregular migration and displaced persons in Africa was created. To meet the increased migratory
                           challenges, EU funding for the 2015-2018 period has more than doubled. Moreover, the crisis in Syria and in the
                           neighbouring region led to the creation of different funding instruments, by the EU and the international community. EU
                           agencies active externally are also funded through the EU budget. For the 2015-2018 period contributions for support
                           to such EU agencies and their operations reaches €1.4 billion. Funding is one of the main instruments for EU
                           cooperation with third countries in the area of migration, asylum and borders. This paper aims to map and clarify the
                           different funding instruments established for migration-related projects, financed by the EU as well as by the
                           international community.

              Resumen This study presents a comparative overview of recent policy developments in Greece, Hungary and Italy, which
                         present some similarities as regards their position in the migration routes, but also very different approaches.
                         The focus of the analysis is on progress achieved in the last three years in the adaptation of the reception and
                         integration system for the high numbers of new arrivals and on the main challenges encountered, with a focus on
                         labour market integration measures.
                         Further, special attention is given to changes in perceptions, public opinion and political discourse with respect to the
                         asylum and integration of refugees and how this influenced policy strategies.

              Resumen Despite the significant EU action and cooperation that has taken place, the rights and detention conditions of those
                       suspected of committing a crime and serving a sentence in the Member States continue to fail to live up to international
                       and EU standards. Judicial cooperation within the EU is not yet fully adapted to this reality, it operates in absence of an
                       EU mechanism monitoring Member States' compliance with practical fundamental rights and lacks specific guidance
                       for alleged violations. EU legislation on suspects' rights is limited to setting common minimum standards. Even so,
                       there are already indications of shortcomings concerning key rights to a fair trial, such as the right to interpretation,
                       translation, information and legal assistance during questioning by the police. Furthermore, certain areas have not
                       been comprehensively addressed, such as pre-trial detention, contributing to prison overcrowding in a number of EU
                       Member States. The outstanding divergent levels of protection also create discrimination between EU citizens.
                       Criminal justice systems remain inefficient and fail to achieve the aims of convicting and rehabilitating the guilty, while
                       protecting the innocent. This impacts on the individuals concerned, in terms of a denial of their rights and material and
                       immaterial damage; on their families; and on Member States' societies more generally. The gaps and barriers identified
                       also have substantial cost implications. Finally, this study assesses the added value of a number of options for EU
                       action and cooperation to contribute to closing these gaps and taking further steps to ensure the effective protection of
                       the rights of suspects and detained persons.

Growing impact of EU migration policy on development cooperation

               Resumen The sudden substantial increase in the number of migrants in recent years has had a profound effect on the external
                         relations dimension of European Union migration and asylum policy. The main components structuring EU external
                         migration policy – the Global Approach to Migration and Mobility (GAMM), European Agenda on Migration, and
                         proposed migration compacts – explicitly underline the link between development and migration. Grounded in the need
                         to address the root causes of migration and to maximise its development impact, the development-migration nexus has
                         evolved from the traditional treaty-based development policy approach, with its requirement of ensuring that all EU
                         policies contribute to development objectives, to a more complex configuration. That, accordingly, many fear, may lead
                         to the ‘instrumentalisation’ of development aid for migration management purposes. The European Parliament has
                         taken a clear stand on this issue, calling, in a number of its recent resolutions, for the retention of poverty alleviation as
                         the main goal of EU development policy, even when its instruments are used at the same time to tackle the root
                         causes of migration. Along with the non-governmental organisations (NGOs) active in this field, the European
                         Parliament opposes aid conditionality dependent on partner countries cooperating on readmission and return, as laid
                         out in the migration compacts. Addressing the current migration challenge without jeopardising development policy
                         achievements and objectives is one of the key issues of the revised European consensus on development, from June

               Resumen Since the entry into force of the 1997 Treaty of Amsterdam, the EU offers its citizens an area of freedom, security and
                         justice (AFSJ). In this area, the free movement of persons should be ensured in conjunction with appropriate measures
                         with respect to external border controls, asylum and migration, as well as the prevention and combating of crime. Since
                         then, the Union has adopted its own Charter of Fundamental Rights, and the European Parliament has been fully
                         engaged in shaping the AFSJ as a co-legislator. Two decades later, however, the Union and its Member States still
                         face major challenges in delivering this objective. Problems have been identified in upholding democracy, the rule of
                         law and fundamental rights, ensuring a high level of security (notably in the fight against corruption, organised crime
                         and terrorism), protecting external borders, guaranteeing the right to asylum and developing a common migration
                         policy. Surveys show that citizens expect the EU and its Member States to deliver in these areas, notably in the area of
                         migration and the fight against terrorism and fraud. In October 2016, the Parliament's Civil Liberties, Justice and Home
                         Affairs (LIBE) Committee requested the European Parliamentary Research Service (EPRS) to produce a 'Cost of Non-
                         Europe Report' on the AFSJ. This paper contains an overview of the existing gaps and barriers in the main policy
                         areas covered by the AFSJ, and assesses their economic impacts as well as impacts at individual level on
                         fundamental rights and freedoms. It also assesses options for action at EU level that could address those gaps and
                         barriers, together with an estimation of their potential cost and benefits.

                 Resumen The principal result of the European Council meeting of 19-20 October 2017 was the endorsement of the ’Leaders’
                           Agenda’ setting out the main issues and work-plan for the European Council up to June 2019. EU leaders also agreed
                           on changes to the working methods of the European Council itself, including a more ’political approach’ to its
                           discussions, enabling more direct engagement on politically sensitive issues, more ‘rigorous follow-up’ to European
                           Council meetings and decisions, and an increase in the frequency of meetings, if needed. The EU Heads of State or
                           Government also took stock of progress in the implementation of EU migration policy, recognising the significant
                           contribution made by Italy in the Central Mediterranean and committing to ensure sufficient funding to stem the flow of
                           illegal migrants from Africa. They adopted detailed conclusions on Digital Europe, including on cybersecurity and e-
                           Government, before welcoming the significant progress in preparing Permanent Structured Cooperation (PESCO) in
                           defence. EU leaders also discussed developments in North Korea (DPRK), as well as the situation in Iran and in
                           Turkey. EU-27 leaders met on 20 October in a separate formal European Council (Article 50), without the United
                           Kingdom, to discuss the latest developments in the latter’s withdrawal negotiations. While postponing the decision on
                           starting the second phase of negotiations on the EU's future relations with the UK, due to insufficient progress made to
                           date, EU-27 leaders called for further work to consolidate the convergence of EU-UK views and to be able to move to
                           the second phase of negotiations as soon as possible. They will reassess the state of progress in the negotiations at
                           the next meeting of the European Council (Article 50), in December 2017.

                Resumen This In-Depth Analysis by the European Council Oversight Unit of the European Parliamentary Research Service
                          (EPRS) is the second in a series of annual publications examining the activity of the European Council. In 2016, the
                          Heads of State or Government devoted most of their attention to three policy areas: migration; foreign and security
                          policy; and economic governance, competitiveness and trade. The publication also considers the impact of the United
                          Kingdom referendum vote on the proceedings of the European Council, both procedurally (EU 28 and EU-27
                          meetings) and thematically (policy priorities and debates on the future of a Europe-at-27). The European Council has
                          carried out its strategic, deliberative, and follow-up roles throughout the year. This was particularly notable when it
                          dealt with migration, which attracted 50 % of the attention of the Heads of State or Government, as shown in the
                          conclusions of their debates. The European Council President, Donald Tusk, continued to report to the European
                          Parliament on the outcomes of the European Council meetings, as required by the Treaties.

                Resumen As flagged up in the EPRS Outlook for the European Council on 15 December 2016, this European Council meeting
                          concentrated on migration and internal and external security, as well as economic and social development. As events
                          unfolded, EU leaders discussed external relations at greater length, in particular Syria, and found a solution for the
                          Association Agreement (AA) with Ukraine. Martin Schulz, addressing the European Council for the last time as
                          President of the European Parliament, called upon Heads of State or Government to ‘take proper ownership’ of their
                          decisions and to involve the European Parliament, more closely in the ‘migration compacts, the Bratislava agenda and

                 Resumen At their 15 December 2016 European Council meeting, EU Leaders will mainly discuss migration, and internal and
                           external security, as well as economic and social development. Particular attention will be paid to assessing the
                           implementation of previous European Council conclusions. For the first time, the European Council will apply recently-
                           agreed new working methods, including a change in the order of proceedings: The meeting will begin at 12:30 and
                           finish by 18:00, with the European Parliament President speaking to the Heads of State or Government before lunch.
                           Unusually, this European Council will consist only of a one-day meeting, followed, however, by an informal dinner of 27
                           Heads of State or Government, without the presence of the British Prime Minister, Theresa May. The objective is to
                           discuss among the EU-27 the structure and the process of the negotiations to be held once the United Kingdom
                           formally notifies its intention to withdraw from the European Union under Article 50 TEU.

                 Resumen Australia has established a refugee policy which has proved highly effective in deterring irregular migrants, but has
                           attracted much criticism from human rights organisations. Its main drivers have been mandatory detention and offshore
                           processing of irregular asylum-seekers arriving by boat. Since it was enacted, drownings at sea no longer occur and
                           irregular migration by boat to its shores has completely stopped. However, the conditions in the offshore centres in
                           Nauru and Papua New Guinea, where people arriving by boat have been sent, have been criticised as inappropriate by
                           civil society organisations, and these people's indefinite detention there was deemed to constitute arbitrary detention
                           under international law. Further to such criticism, recently, the two countries have decided to allow asylum-seekers to
                           move freely and, if determined to be refugees, to settle in the community. However, the situation of the refugees in the
                           two countries remains extremely precarious and no lasting solution is yet in sight, despite Australia's efforts to secure
                           resettlement agreements with other third countries. At the same time, Australia has remained open to asylum-seekers
                           and refugees who enter through official channels, and is one of the countries admitting most refugees resettled through
                           the UNHCR. This briefing is an extended and updated version of an earlier publication, from October 2015.

                           conclusions. Other topics discussed were global and economic issues, external relations and trade issues, in particular
                           the Comprehensive Economic and Trade Agreement with Canada. This was the first formal European Council meeting
                           since the informal meeting of 27 Heads of State or Government on 16 September 2016 in Bratislava, and it
                           demonstrated how the meetings in this format are shaping the European Council’s agenda. The European Council
                           President, Donald Tusk, had already made clear that the Bratislava declaration and roadmap would guide leaders’
                           actions at their regular European Council meetings.

                Resumen Designed to be the first in a series of annual publications, this In-Depth Analysis by the European Council Oversight
                          Unit of the European Parliamentary Research Service (EPRS) examines in detail the activity of the European Council
                          in 2015 in all of the six policy areas which have most attracted the attention of the Heads of State or Government:
                          namely migration, economic governance, foreign and security policy, terrorism, and work towards a new settlement for
                          the United Kingdom in the European Union. Although European Council’s principal mission is meant to be strategic, in
                          2015 the institution mainly engaged in crisis management, due principally to the outbreak of the migration crisis. This
                          led to an increase in the number of meetings: eight meetings of the Heads of State or Government were held, two of
                          which were of an informal nature. Except for one informal meeting, the European Council President, Donald Tusk,
                          reported to the European Parliament on the outcome of the meetings of the Heads of State or Government as required
                          by the Treaties.

                Resumen This study was commissioned by the European Parliament's Policy Department for Citizens' Rights and Constitutional
                         Affairs at the request of the LIBE Committee. It examines the performance of Dublin and of relocation schemes, and
                         assesses the Commission’s “Dublin IV” Proposal in this light. It argues that by retaining the Dublin philosophy and
                         betting on more coercion, Dublin IV is unlikely to achieve its objectives while raising human rights concerns. It
                         advocates re-centring EU responsibility allocation schemes on one key objective – quick access to asylum procedures.
                         This requires taking protection seekers’ preferences seriously and de-bureaucratising the process. Such a reform
                         would need to be accompanied by (a) stepping up the enforcement of refugee rights across the EU, (b) moving
                         solidarity schemes from a logic of capacity-building to one of compensation, and (c) granting protected persons real
                         mobility rights.

                         Affairs at the request of the LIBE Committee, analyses the Schengen area in the wake of the European ‘refugee crisis’
                         and other recent developments. With several Member States reintroducing temporary internal border controls over
                         recent months, the study assesses compliance with the Schengen governance framework in this context. Despite
                         suggestions that the end of Schengen is nigh or arguments that there is a need to get ‘back to Schengen’, the research
                         demonstrates that Schengen is alive and well and that border controls have, at least formally, complied with the legal
                         framework. Nonetheless, better monitoring and democratic accountability are necessary.

               Resumen The study lists currently applied measures re-introducing temporary border controls within Schengen area and
                         evaluates them in the light of different policy options and smart Single Market regulation criteria. The study highlights
                         the added value of free movement within the Schengen area for the Single Market and quantifies the costs of re-
                         establishing internal border controls, with particular reference to the transportation sector. Welfare of consumers is
                         affected by “non-Schengen”, as the prices of imports increase relative to domestic goods due to higher trade costs. A
                         failure of Schengen would not only reduce the future benefits of the Single Market, but also undermine other aspects of
                         EU integration.

                 Resumen The review of the implementation of the Dublin legislation shows that the weaknesses identified since its inception
                           remain, i.e. most of the transfers agreed by MS under the Dublin system do not take place. It is also unclear whether
                           the system has had any effect on secondary movement which has remained at around 15%. As long as differences
                           between MS asylum processes and socio-economic conditions remain, and as long as MS continue to centre their
                           concerns on the national impact of migration, the Dublin system on its own is unlikely to work. In the absence of more
                           detailed information on how the re-distribution mechanism suggested by the European Commission would work in
                           practice, it is difficult to assess whether the proposals would effectively address the shortcomings of the Dublin system.
