CONTEST RULES OFFICIAL RULES The “Hockey is Everything” Contest (the “Contest”) will be held at IGA, IGA extra and IGA Coop supermarkets in Quebec and New Brunswick (each a “Participating IGA” and collectively the “Participating IGAs”) and is sponsored by Sobeys Capital Inc. (the “Contest Organizer”). The Contest begins on February 13, 2020 at 12:01 a.m. Eastern Time (“ET”) and ends on March 11, 2020 at your participating IGA’s closing time or at 11:59 p.m. (ET) (the “Contest Period”), whichever comes first in your region. 1. ELIGIBILITY TO BE ELIGIBLE TO ENTER THE CONTEST, you must: - be a resident of Quebec or New Brunswick; - have reached the age of majority in your province of residence at the time of Contest entry; - be enrolled in the AIR MILES® Reward Program (the “Program”) (an “Eligible Entrant”). EXCLUSIONS: The employees, agents and/or representatives of the Contest Organizer, its affiliates, participating IGAs, non-participating affiliated grocers, advertising agencies or any party involved in the administration of the Contest (the “Contest Parties”), as well as, respectively, any person with whom an Excluded Entrant is domiciled or any member of their immediate family (an “Excluded Entrant”). For the purposes of the Contest Rules (the “Rules”), “immediate family” includes the father, mother, brother, sister, child, husband, wife or common-law partner of an Excluded Entrant. For greater certainty, an Eligible Entrant who is not an Excluded Entrant is hereinafter referred to as an “Entrant.” IF THE ENTRANT IS NOT ENROLLED IN THE PROGRAM: they can enroll in the Program online at www.airmiles.ca/activate or at the customer service desk of a participating IGA by completing the enrollment form online. Enrollment in the Program is free, but requires Internet access (free Internet access is available in various public places). By enrolling in the Program, you agree to be bound by the terms and conditions of the Program, as amended from time to time. The Entrant must ensure that the contact information recorded in his AIR MILES® Collector Account (the “Collector Account”) is accurate at all times so that the Contest Organizer may contact the Entrant, if necessary. For the purposes of these Rules, the Entrant is the person whose name appears on the Collector Account and to whom the Prize will be awarded if they are selected and declared a winner. Limit of one Prize per Collector Account. Each Entrant must participate exclusively on his behalf and acting solely for his personal benefit. 2. HOW TO ENTER NO PURCHASE ENTRY – NO PURCHASE REQUIRED To enter the Contest without making a purchase, you must write an original handwritten letter of fifty (50) words or more explaining why you like to shop at your participating IGA. Please indicate, in your letter, your Collector number and the address of your participating IGA, in an envelope addressed to the offices of the Contest Organizer, located at 11281 Albert-Hudon Boulevard, Montréal-Nord, QC H1G 3J5, with the name of the contest, Attn: HOCKEY IS EVERYTHING CONTEST (the “No Purchase Entry”). The No Purchase Entry must
2 be received by the Contest Organizer no later than the last day of the Contest Period. Given the variable mail delivery schedule, the time of receipt for an Entry will be determined at the sole discretion of the Contest Organizer. Limit of one No Purchase Entry per Collector Account per day. ENTRY WITH PURCHASE Any purchase of products specifically identified as an “participating product” for the purposes of the Contest, at a participating IGA or by selecting a participating IGA on the online grocery shopping platform, will automatically enter the Entrant into the Contest for the number of entries associated with each participating product (each an “Participating Product”). Dedicated contest signage in participating IGAs will enable Entrants to identify Participating Products and the number of associated Entries. For example, one (1) Participating Product could be equivalent to: • one (1) Draw entry; • three (3) Draw entries; • five (5) Draw entries. The purchase of multiple Participating Products in a single transaction and upon presentation of the AIR MILES® card will allow the Entrant to accumulate the number of Entries associated with the purchased products, and the total number of Entries will be recorded on the sales receipt issued to all Entrants with their purchase. The no Purchase Entries and the Entries with purchase are referred to collectively as the “Entries.” 3. PRIZES FINALIST PRIZES Each of the two (2) Finalist Entrants (as defined) designated by the Draw will receive, in addition to the First or Second Grand Prize as determined at the Finalists’ Game (as defined), taking place at the Finalists’ Game Night (as defined), a Finalist Prize with an approximate retail value of CAD $7,600, including: - four (4) pairs of tickets to a Bell Centre suite for the Montreal Canadiens game that will take place on the Grand Prize Finalists’ Game Night on March 28, 2020, including one ticket for each Finalist Entrant and three (3) tickets for their respective guests; - meals and beverages served in the suite on the Grand Prize Finalists’ Game Night. Meal and beverage selection will be at the sole discretion of the Contest Organizer; - official Montreal Canadiens jerseys for each of the Finalist Entrants and their respective guests. The type and size of jersey will be at the sole discretion of the Contest Organizer; - two (2) nights’ accommodation at the Renaissance Hotel based on double occupancy (March 28-29, 2020) for each of the Finalist Entrants, with one (1) room for the Finalist Entrant and one guest and one (1) room for two guests. EXCLUSIONS: All fees and expenses other than those specified above, including, without limitation, travel, transportation, parking, accommodation (except as expressly provided above) and food and beverage expenses (except as expressly provided above), will be the sole responsibility of the Finalist Entrants and their respective guests. Please refer to the “PRIZE NOTES” for full details on any conditions, restrictions, limitations or other exclusions related to the Prize. FIRST GRAND PRIZE There will be one (1) First Grand Prize available to be won in the Contest (the “First Grand Prize”). The approximate retail value of the First Grand Prize is CAD $86,500 and includes:
3 - two (2) season tickets (location at the sole discretion of the Contest Organizer in the red level of the Bell Centre) to the Montreal Canadiens’ regular season games for a period of five (5) years, from the 2020-2021 season to the 2025-2026 season (each of the five (5) seasons an “Included Season”); - one (1) gift certificate of three hundred dollar ($300.00) per Season included, for a total of five (5) gift certificates, redeemable at Bell Centre restaurants during the Included Season. EXCLUSIONS: All fees and expenses other than those described above, including, without limitation, travel, accommodation, and food and beverage expenses not covered by the First Grand Prize gift certificates, will be the responsibility of the First Grand Prize Winner and their guest. Please refer to the “PRIZE NOTES” for full details on any conditions, restrictions, limitations or other exclusions related to the Prize. SECOND GRAND PRIZE There will be one (1) Second Grand Prize available to be won in the Contest (the “Second Grand Prize”). The Second Grand Prize consists of an eight (8) day trip to California for the Second Grand Prize Winner and three (3) guests (the “Stay”), an approximate retail value of CAD $32,600, including: - business class airfare for the Second Grand Prize Winner and three (3) guests (i) departing from the Montréal-Trudeau International Airport in Montréal, Quebec; (ii) between the first city in California and the city or cities in California where the Montreal Canadiens will be playing in the 2020-2021 season during the Stay (the “2020-2021 Season”); and (iii) between the city where the last Montreal Canadiens game will be held in the 2020-2021 Season during the Stay and the Montréal-Trudeau International Airport in Montréal, Quebec. The number of flights may vary depending on the number of Montreal Canadiens 2020-2021 Season games held in California during the Stay. Airline and seating selection for each flight is at the sole discretion of the Contest Organizer, which cannot guarantee contiguous seating; - car rental during the Stay. The number of rental days may vary based on the number of Montreal Canadiens 2020-2021 Season games held in California and the number of flights during the Stay. The type and model of car is at the sole discretion of the Contest Organizer; - double occupancy accommodation during the Stay. Hotels and destination cities may vary based on the number of Montreal Canadiens 2020-2021 Season games held in California and the number of scheduled flights during the Stay. Hotel selection is at the sole discretion of the Contest Organizer; - tickets to Montreal Canadiens games held in California during the Stay. The number of tickets and games may vary based on the number of Montreal Canadiens 2020-2021 Season games held in California and the number of scheduled flights during the Stay; - four (4) official Montreal Canadiens jerseys with the name and number of a player of the Second Grand Prize Winner’s choice, including the Second Grand Prize Winner’s choice for their three (3) guests; - five hundred Canadian dollars (CAD $500.00) of spending money per day for the Second Grand Prize Winner during the Stay. Please note that no spending money will be distributed to the Second Grand Prize Winner’s three (3) guests. EXCLUSIONS: Anything not included above will be the sole responsibility of the Second Grand Prize Winner and their guests, including, without limitation, travel and medical insurance, airport taxes and fees, excess baggage charges, meals, gratuities, room service, applicable sales taxes, transportation costs and other personal expenses and foreign currency conversion or exchange fees (USD). The Second Grand Prize Winner and/or their travel companions will be required to provide a valid credit card upon check-in during the Stay to
4 cover expenses in excess of the standard room rate. The actual retail value of the Second Grand Prize will depend on airfare fluctuations. Any difference between the approximate retail value and actual value of the Second Grand Prize will not be awarded to the Second Grand Prize Winner. Once the Stay itinerary has been finalized between the Second Grand Prize Winner and the Contest Organizer, no changes can be made unless initiated or approved by the Contest Organizer. The airfare, accommodation and car rental included in the Second Grand Prize do not qualify for loyalty points. The Second Grand Prize Winner and their three (3) guests are required to obtain all required travel documents, including a valid passport (or visa, if applicable), at their own expenses and must be authorized to travel outside Canada and comply with United States entry requirements, and fully release the Contest Organizer from any liability. Failure by the Second Grand Prize Winner and their three (3) guests to comply with these travel restrictions, including refusal of entry into U.S. territory during the Stay, and including a refusal or restriction issued by U.S. customs authorities once the trip has begun, will automatically disqualify the Second Grand Prize Winner and their three (3) guests, and another Second Grand Prize Winner may be selected at the sole discretion of the Contest Organizer. Please refer to the “PRIZE NOTES” for full details on any conditions, restrictions, limitations or other exclusions related to the Prize. SECONDARY PRIZES A total of one hundred (100) Secondary Prizes will be awarded in the Draw (as defined), including: - ten (10) IGA gift cards valued at three thousand five hundred dollars ($3,500) each; - twenty-five (25) IGA gift cards valued at one thousand dollars ($1,000) each; - five (5) pairs of tickets to the Club Desjardins for a Montreal Canadiens game played at the Bell Centre (date to be determined at the Contest Organizer’s sole discretion), including access to the fast food counters providing free food and non-alcoholic beverages at during the 2020-2021 season; - ten (10) official Canadiens jerseys with the name and number of a player of the Secondary Prize Winner’s choice; - fifty (50) Canadiens promotional items, including tuques, hats and scarves. The total approximate retail value CAD $67,250. The Secondary Prizes will be mailed to the winners by the Contest Organizer. The First Grand, Second Grand, Finalist and Secondary Prizes are collectively referred to as a “Prize”. PRIZE NOTES GENERAL: Prizes may differ from the photographic material, visual images used in advertising and promotional materials for the Contest, in particular print advertisements, website and electronic ad banner. Each Prize must be accepted (i) on an “AS IS” basis, WITHOUT WARRANTY OF ANY KIND, either express or implied, and (ii) may not be modified, transferred, assigned or exchanged for cash (unless expressly authorized by the Contest Organizer in its sole discretion). The Prize will be awarded only to the individual whose full name appears on the Collector Account associated with the Entry in question. No substitution will be permitted, except at the discretion of the Contest Organizer. The Contest Organizer reserves the right, in its sole and absolute discretion, to substitute any Prize or portion thereof with IGA gift cards of equal or greater value. HOCKEY TICKETS: The Contest Organizer assumes no responsibility for the cancellation, delay, suspension or postponement of a hockey game and the Entrant acknowledges that the outcome of the game is beyond the Contest Organizer’s control. The exact location of the tickets is at the sole discretion of the Contest Organizer, which cannot guarantee contiguous tickets. All other expenses not expressly included in the detailed
5 description of one of the Prizes will be the responsibility of the winner and their guests, as the case may be, including, without limitation, beverages, meals, transportation and parking. 4. DRAW AND AWARDING OF THE FINALIST AND SECONDARY PRIZES FINALIST ENTRANT AND SECONDARY PRIZE DRAW A single draw (the “Draw”) will be held on Friday, March 13, 2020 (the “Draw Date”) at the Contest Organizer’s offices located at 11281 Albert-Hudon Boulevard, Montréal-Nord, QC H1G 3J5, at approximately 10 a.m. (ET), during which will be electronically and randomly selected in the following order: (i) two (2) Finalist Entrants for the Finalists’ Game (as defined) (each a “Finalist Entrant”); and (ii) one hundred (100) Entrants for the Secondary Prizes from all Entries collected or sent and received during the Contest Period, in accordance with these Rules (each a “Selected Entrant”). The Finalist Entrant and the Selected Entrant are collectively referred to as a “Selected Entrant”. CONTACTING SELECTED ENTRANTS The Contest Organizer or its designated representative will make at least two (2) attempts to contact the Selected Entrants by telephone using the contact information provided in their Collector Account. Each Entrant is responsible for ensuring that their Collector Account information is up to date. The Contest Organizer cannot be held liable for invalid, inaccurate or out of date telephone numbers in the Entrants’ Collector Accounts. Each Selected Entrant will have forty-eight (48) hours of the time of initial contact, to call back the Contest Organizer or its representative, failing which they will be disqualified. Once contacted by telephone, the Selected Entrant will receive a Release Form (the “Release Form”) at the email address provided in their Collector Account. Response time will be determined solely by the Contest Organizer. BEFORE BEING CONFIRMED AS A FINALIST, the Selected Entrant must: - correctly answer, without mechanical or other aid, a mathematical skill-testing question; - duly complete and sign the Release Form, have each guest complete and sign the Release Form for the Finalist Prize, and return all Release Forms within twenty-four (24) hours of receipt of the said Form, in accordance with the instructions provided by the Contest Organizer; - confirm their availability and the availability of their guests to participate in the Finalists’ Game Night on March 28, 2020; - agree to participate in the Finalists’ Game in accordance with the participation requirements set out in these Rules; - consent to their name, address, voice, image, and statements in connection with the Contest, and any photograph, video, audio and/or video recording, including at the Finalists’ Game Night, being published, reproduced or otherwise used by or on behalf of the Contest Organizer for publicity purposes or other promotional or commercial use by or on behalf of the Contest Organizer, in any medium, now known or hereafter developed, including print media, broadcast, television broadcast and the Internet, without further notice, additional compensation or right of inspection; - provide photo identification upon request. If it is impossible to contact the Selected Entrant as described in the “CONTACTING SELECTED ENTRANTS” section, if the Selected Entrant a) incorrectly answers the mathematical skill testing question, b) fails to return
6 the duly completed and signed Release Forms and any other required information or documents within the prescribed period, c) fails to accept (or refuses to accept) the Finalist Prize as awarded for any reason, including their refusal to participate in the Finalists’ Game Night, and/or d) is found to have violated these Rules (as determined by the Contest Organizer at its sole discretion), he will be disqualified (and will forfeit the Finalist Prize) and the Contest Organizer reserves the right, in its sole and absolute discretion and time permitting, to electronically and randomly select a new Entrant from the remaining Draw Entries (in which case the provisions of this paragraph shall apply to the new Selected Entrant). Limit of one (1) Prize per Selected Entrant. BEFORE BEING CONFIRMED AS A SECONDARY PRIZE WINNER, the Selected Entrant must: - correctly answer, without mechanical or other aid, a mathematical skill-testing question; - duly complete and sign the Secondary Prize Release Form, and return the Release Form within twenty-four (24) hours of receipt of said Form, in accordance with the instructions provided by the Contest Organizer; - consent to their name, address, voice, image, statements in connection with the Contest, and any photograph, video, audio and/or video recording, being published, reproduced or otherwise used by or on behalf of the Contest Organizer for publicity purposes or other promotional or commercial use by or on behalf of the Contest Organizer, in any medium, now known or hereafter developed, including print media, broadcast, television broadcast and the Internet, without further notice, additional compensation or right of inspection; - provide photo identification upon request. Each a “Secondary Prize Winner.” If it is impossible to contact the Selected Entrant as described in the “CONTACTING SELECTED ENTRANTS” section, if the Selected Entrant a) incorrectly answers the mathematical skill testing question, b) fails to return the duly completed and signed Release Form within the prescribed period, c) fails to accept (or refuse to accept) the Secondary Prize as awarded for any reason, and/or d) is found to have violated these Rules (as determined by the Contest Organizer at its sole discretion), he will be disqualified (and will forfeit the Secondary Prize) and the Contest Organizer reserves the right, in its sole and absolute discretion and time permitting, to electronically and randomly select a new Entrant from the remaining Draw Entries (in which case the provisions of this paragraph shall apply to the new Selected Entrant). Limit of one (1) Prize per Selected Entrant. FINALISTS' GAME NIGHT The Finalists’ Game Night will take place during the Montreal Canadiens game on March 28, 2020 (the “Finalists’ Game Night”). Attendance by the Finalist Entrant is mandatory, and each Finalist Entrant will be presented with the Finalist Prize and must agree to participate in person in the Finalist Game in order to determine the allocation of the First and Second Grand Prizes. FINALISTS' GAME The Finalists’ Game will be held at such time as the Contest Organizer may determine during the Finalists’ Game Night and will proceed as follows: - The Finalist Entrants will get ready on the ice a referee designated by the Contest Organizer will be assigned to the Finalists’ Game. - An even number of giant cards will be placed on the ice with the Contest logo designated by the Contest Organizer facing up, each with the words SEASON TICKETS (First Grand Prize) or CALIFORNIA TRIP (Second Grand Prize) on the back.
7 - The referee will randomly determine which Finalist Entrant will be the first to select a card of his choice. - The first Finalist Entrant will be able to flip over a card of his choice. The second Finalist Entrant will then be able to flip over a card of his choice, and so on. - The first Finalist Entrant to flip over two (2) identical cards will win the Prize shown on the cards. - In the event of a tie, the referee will turn the cards upside down again and the Finalist Entrants will restart the game (as described above) until one of the two Finalist Entrants flips over two (2) identical cards. FINALISTS’ GAME NOTES At the sole discretion of the Contest Organizer, the Finalists’ Game could be played using interactive electronic tools and images projected onto the ice, and the Finalist Entrants could participate by video, live from the Bell Centre suite at the Finalists’ Game Night. BEFORE BEING CONFIRMED AS THE FIRST OR SECOND GRAND PRIZE WINNER, the Finalist Entrant must: - correctly answer, without mechanical or other aid, a mathematical skill-testing question; - duly complete and sign the First or Second Grand Prize Release Form, and return the Release Form within forty-eight (48) hours of receipt of the said Form, in accordance with the instructions provided by the Contest Organizer; - for the Second Grand Prize, consent and obtain the consent of their guests to have a film crew designated by the Contest Organizer accompany the Second Grand Prize Winner and their guests throughout the Stay to shoot videos, take photographs and capture their experiences throughout the Stay (collectively, the “Filming”); - consent to their name, address, voice, image, statements in connection with the Contest, and any photograph, video, audio and/or video recording, including the Filming, being published, reproduced or otherwise used by or on behalf of the Contest Organizer for publicity purposes or other promotional or commercial use by or on behalf of the Contest Organizer, in any medium, now known or hereafter developed, including print media, broadcast, television broadcast and the Internet, without further notice, additional compensation or right of inspection; - provide photo identification upon request. The First Grand Prize Winner will be referred to as the “First Grand Prize Winner,” the Second Grand Prize Winner will be referred to as the “Second Grand Prize Winner,” and they will collectively be referred to as the “Grand Prize Winner.” If the Grand Prize Winner a) incorrectly answers the mathematical skill testing question; b) fails to return the duly completed and signed Release Forms within the prescribed time; c) fails to accept (or refuses) the First or Second Grand Prize as awarded for any reason; and/or d) is found to have violated these Rules (as determined by the Contest Organizer at its sole discretion), they will be disqualified (and forfeit the Prize) and the Contest Organizer reserves the right, at its sole discretion, to electronically and randomly select a new Entrant from the remaining Draw Entries (in which case the provisions of these Rules with respect to the Secondary Prizes shall apply to the new selected Entrant). For greater certainty, in the event of a disqualification, there will be no Finalist Prize or Finalists’ Game and will instead be a First or Second Grand Prize only, to be awarded at the sole discretion of the Contest Organizer.
8 ODDS OF WINNING For the Finalist and Secondary Prize Draw, the odds of winning depend on the number of Draw Entries collected or sent and received during the Contest Period, in accordance with these Rules. For the Finalists’ Game and the awarding of the First and Second Grand Prizes, each Finalist Entrant will have a one (1) in two (2) chance of winning the First Grand Prize. 5. TERMS & CONDITIONS: The Contest is subject to all applicable federal, provincial and municipal laws and regulations. The decisions of the Contest Organizer with respect to all aspects of this Contest are final and binding without right of appeal, including any decision on the validity or disqualification of Entries or Entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION AT THE SOLE AND ABSOLUTE DISCRETION OF THE CONTEST ORGANIZER AT ANY TIME. By participating in the Contest, you agree to release and hold harmless the Contest Organizer, Contest Parties, LoyaltyOne Co., Montreal Canadiens, National Hockey League and member teams of NHL Enterprises Canada L.P., as well as their respective affiliates entities, officers, directors, employees, mandataries, agents, representatives, successors and assigns (collectively, the “Released Parties”) for i) your Entry in the Contest; ii) any failure of a website during the Contest, iii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, or computer equipment or software; iv) any fraudulent call; v) any delay or inability to act resulting from any event or situation beyond the control of the Released Parties including, without limitation, a strike, lock-out or any other labour dispute, vi) the failure of any Entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website, vii) any damage to the computer or any other device belonging to the Entrant or to a third party as a result of Entry in the Contest; viii) the awarding, use or misuse of any Prize or portion thereof, ix) any Prize lost or damaged during transport and shipping, x) any situation that may limit or prevent any person from reading the entry rules, and xi) any combination of the foregoing. Furthermore, by accepting a Prize, the winner and each of their guests, as the case may be, release the Released Parties from any liability, obligation, claim, suit, charge or any other claim for damages, regardless of cause, arising from or related to his entry in this Contest, the acceptance or use of a Prize, including, without limitation, and subject to limitations under applicable law, in the event of injury, death, damage or loss of property. Upon acceptance of the Prize, the obligations relating to it are the responsibility of the service providers and the Released Parties are fully released from all liability. The Contest Organizer reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Contest Organizer in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Contest Organizer reserves the right to seek remedies and damages to the fullest extent permitted by law. The Contest Organizer, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules in any way without prior notice or obligation, in the event of any accident, printing, administrative or other error of any kind, or for any other reason, whatsoever. Without limiting the generality of the foregoing, the Contest Organizer reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
9 The Contest Organizer reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Organizer, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. By entering this Contest, each Entrant consents to the Contest Organizer, its agents and/or representatives, to store, share and use the personal information submitted with their Entry through the information contained in the Collector Account for the sole purpose of administering the Contest and awarding the Prize, including, without limitation, to communicate with the Entrant about the Contest and their Entry.
