2021 TRUCK HAULING SERVICES REQUEST FOR QUOTATION TRUCK HAULING SERVICES BROWN COUNTY PUBLIC WORKS DEPARTMENT GREEN BAY, WISCONSIN Sealed quotes will be received by the Brown County Public Works Department at 2198 Glendale Avenue, Green Bay, Wisconsin, 54303, until 2:00 p.m., Wednesday, December 9, 2020, for truck hauling services throughout 2021. The work under this contract consists of hauling construction materials for various project locations throughout Brown County on an as needed basis. Construction materials to be hauled includes, but are not limited to, road salt, removed pavement, culverts, common excavation material, borrow, base aggregate dense, breaker run, riprap, millings, and HMA pavement. Quotes shall be submitted on Brown County Public Works Department forms and specifications; which may be obtained by accessing the Brown County website @ www.browncountywi.gov, Departments, Public Works, Highway, Bids and RFP’s. 2021 TRUCK HAULING SERVICES GENERAL PROVISIONS A. GENERAL: The Brown County Public Works Department will receive sealed quotes for hauling construction materials on an as needed basis for various project locations throughout Brown County. Quotes shall be submitted on forms provided by, and addressed to, the Brown County Public Works Department, 2198 Glendale Avenue, Green Bay, Wisconsin, 54303, and marked "2021 Truck Hauling Services". Quotes will be received until 2:00 p.m., on Wednesday, December 9, 2020, at the above-mentioned address. These specifications are a part of the proposal and must remain attached to the same. Hereinafter, the Brown County Public Works Department will be referred to as the “Owner” and the successful contractor awarded the contract is to be the “Contractor” and the “Engineer” will be an employee of Brown County who is to carry out the project construction management. Quotes shall be on specifications as herein furnished and shall not be altered. Owner reserves the right to reject any or all quotes submitted, or to accept any part or combination thereof, to waive any technicalities, and to accept any quotes deemed most advantageous to Brown County, including the use of smaller quantities at the same cost per quoted price. Should the U.S. Government, by its action, affect or prevent a vendor from fulfillment of the terms of the quote, the vendor should immediately furnish proof of same in writing. Upon receiving such proof, vendor will be released from the contract. Brown County is exempt from Federal Excise Tax, but if there is a tax, it shall be shown in the quote. B. WITHDRAWAL OF QUOTES: Quotes may be withdrawn by written request received from the bidder or their agent prior to the time fixed for opening of quotes, without prejudice to the right of the bidder to file a new bid. Withdrawn bids will be returned unopened. Negligence on the part of the bidder in preparing his/her bid confers no right for withdrawal of the bid after it has been opened. C. METHOD OF AWARD: Brown County will accept all quotes to complete the work. Typically, qualified Contractors will be chosen on an as needed basis starting with the lowest quote received. If additional trucks are needed, typically the next lowest qualified Contractor will be selected until the appropriate amount of trucks are secured for each instance. A Contractor may request to be removed from the call list on a temporary basis when other commitments prevent the contractor from providing trucks. This is not an exclusive contract. The County specifically reserves the right to concurrently contract with other companies for similar work, if the County deems such an action to be in the County’s best interest. The County may choose not to award work to a Contractor due to high quoted prices. The County may remove or bypass contractors from the qualified contractor list due to safety concerns, unresponsiveness, low productivity, poor driver performance and attitude, or for any other reason deemed necessary by the County. 4
2021 TRUCK HAULING SERVICES D. PRICING: Pricing shall remain firm through December 31, 2021. E. RESERVATIONS: The Owner reserves the right to reject any or all quotes submitted, or to accept any part or combination thereof, to waive any technicalities, and to accept any quote deemed most advantageous to Brown County. F. SUBCONTRACTING: The Contractor shall be as fully responsible to the County for the negligent acts and omissions of its subcontractors and/or persons either directly or indirectly employed by it, as he is for the negligent acts and omissions of persons directly employed by Contractor. G. INDEMNIFICATION AGREEMENT & INSURANCE: Brown County and , hereinafter referred to as Contractor, enter into an agreement to construct, produce and/or deliver the specified work and materials. It is mutually agreed that at all times during the existence of this contract, the Contractor will hold harmless and indemnify Brown County, their agents, directors, officers, and employees against any and all losses, damages, claims, and costs of expense which Brown County may sustain, incur, or be required to pay by reason of any person(s) suffering personal injury, death, or property loss resulting from the Contractor’s acts or omissions during the term of the contract. Contractor will at all times during the terms of this contract, keep in force a liability insurance policy issued by a company authorized to do business in the State of Wisconsin and licensed by the Office of the Wisconsin Insurance Commission. Brown County shall be named as an additional named insured on such policy of insurance. In the event of any action, suit, claim, or proceeding against Brown County, their agents, directors, officers, or employees upon any matter herein indemnified against, the Contractor shall, within seven (7) working days, cause notice in writing thereof to be mailed to Brown County by certified mail, addressed to the Brown County Public Works Department, 2198 Glendale Avenue, Green Bay, Wisconsin, 54303. In the event, any such action, suit, claim, or proceeding is brought against Brown County pursuant to the terms of this agreement, shall, within seven (7) working days thereafter, cause notice in writing thereof to be mailed to the Contractor at their post office address. The limits of liability insurance shall provide coverage for not less than the following amounts, or required by law, whichever is greater: A. Worker’s Compensation: 1. State – Statutory 2. Federal (e.g., Longshoremen’s and Harbor – As Applicable Worker’s Act, Jones Act or Admiralty Act) 3. Policy shall have other state’s coverage B. Employer’s Liability: 1. The Contractor shall include the Owner, by endorsement, as additional insured on the Contractor’s General Liability Policy as respects on this project. F. The Contractor shall provide an Umbrella Liability Policy of “Two Million Dollars” ($2,000,000). The cancellation clause on all certificates of insurance shall read as follows: “Should any of the above-described policies be cancelled before the expiration date thereof, the issuing company will mail 30 days written notice to the certificate holder named therein.” (No modifications of this clause will be accepted.) The Contractor shall require all subcontractors to be bound by the same insurance requirements as Contractor. H. SAFETY OF PERSONS & PROPERTY: The Contractor shall take all reasonable precautions for the safety of, and shall provide all reasonable protection to prevent damages, injury or loss to: a. All employees on the work site, and all other persons, who may be affected thereby; b. All the work, materials, and equipment to be incorporated therein, whether in storage on or off the site, under the care, custody, or control of the Contractor or any of his subcontractors; and c. Other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures, and utilities not designated for removal, relocation or replacement in the course of construction. The Contractor must comply with all safety requirements set forth in the governing federal, state and/or local laws, including but not limited to, the Wisconsin Administration Code, Rules of the Industrial Commission on Safety and all applicable OSHA standards. 6
2021 TRUCK HAULING SERVICES I. EQUAL OPPORTUNITY: The Contractor, and all subcontractors, shall not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, or age. The Contractor shall take affirmative action to insure that applicants are employed, and that employees are treated during employment without regard to their race, religion, color, sex, national origin, or age. Such action shall include, but not be limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places, available to employees & applicants for employment, notices setting forth the policies of non-discrimination. The Contractor, and all subcontractors, shall in all solicitations or advertisements for employment placed by them or on their behalf, state that all qualified applicants will receive consideration for employment without regard to race, religion, color, sex, national origin, or age. J. ARBITRATION: Contract related claims and disputes between Owner and Contractor may be decided by arbitration, only if agreed upon by both parties. Arbitration shall be in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association. K. REGULATIONS: Contractor agrees to comply with all of the requirements of all federal, state and local laws related thereto. L. RIGHT TO AUDIT: The Owner, or its representatives, will have the right to audit the Contractor’s books and files including those of subcontractors when a dispute or claim arises from the contract. The audit shall be made during normal work hours and the Owner’s right to audit will terminate when the dispute or claim is settled. M. PAYMENT TO CONTRACTOR AND COMPLETION: The Contractor will prepare pay requests, and submit to the Owner for payment on a monthly basis based on actual work completed and/or materials delivered to the job site. 7
2021 TRUCK HAULING SERVICES SPECIAL PROVISIONS 1. PROSECUTION AND PROGRESS: Work is to be carried out on various county highway projects on an as needed basis throughout 2021. 2. NOTIFICATION PROCESS: Next day notice will be given before services are needed. Each notice from the County will include the number of trucks needed and the number of hours needed per truck. Advanced notice will be given when possible. In the event that a contractor cannot meet the schedule or the amount of trucks needed, the County reserves the right to move to the next lowest qualified bidder. The Contractor shall notify the County when trucks are expected to be unavailable for extended periods of time. The County can temporarily remove unavailable contractors from the notification list, at the request of the contractor, until the contractor’s availability changes. Work under this contract is weather-dependent, so the schedule may change due to weather conditions. The County is not responsible for payment of work that is cancelled due to inclement weather or equipment failure. 3. TRUCK HAULING SERVICES: A. Description This special provision describes providing hauling services on an as needed basis for various project locations throughout Brown County during the 2021 construction season, as specified in the State of Wisconsin, Department of Transportation, Standard Specifications for Highway and Structure Construction, 2020 Edition, and as hereinafter provided. Construction materials to be hauled include, but are not limited to, removal materials (pavement, culvert, bridge), common excavation material, borrow, base aggregate dense, breaker run, riprap, millings, and HMA pavement. B. Truck Requirements Quad axle dump trucks shall be used. The bed shall be clean of any debris and contaminates, and shall be reasonably smooth and free of any major indentations or depressions. All trucks shall be equipped with a tarp to cover the truck bed. C. Haul Route Obtain approval from the County for all proposed haul routes between the project and haul sites. Utilize roadways on the county highway system and state highway system whenever possible. Minimize use of City, Village and Town roadways as haul routes. D. Reporting to Work Report to the assigned construction site or haul site as directed by the County with a fully fueled truck. Work time will start when the Contractor reports to the project site at the time agreed to by the County, and work time will end when the Contractor leaves the project site at the time agreed to by the County. If starting or ending the day at a haul site, work time will begin at the “time loaded” and end at the “time dumped” time on the haul ticket. 8
2021 TRUCK HAULING SERVICES Hours between the start and end time on days committed to hauling for Brown County must be dedicated entirely to Brown County work. Work under this contract is weather-dependent, so the schedule may change due to weather conditions. Coordinate with the County on days of inclement weather to determine if the work will be cancelled or if the schedule will be changed. E. Time Keeping Document hours worked by completing a load tracking form (format of the form to be approved by the County) and by providing daily load slips (showing the time loaded and time dumped). Submit the daily load tracking form to the County project foreman for approval at the end of each working day. Avoid refueling during the work shift. If refueling is necessary, subtract the time needed to refuel from the documented daily hours, unless circumstances for refueling are warranted and approved by the County. F. Measurement The County will measure the number of documented hours acceptably completed. G. Payment Payment is full compensation for providing the dump truck, driver, fuel, and all incidentals necessary to complete the contract work. Costs of the construction materials and dump fee costs will be the responsibility of the County. 9
