We are excited to present our prize list for the Arizona Winter Circuit. You’ll see a lot of changes from last year. We have done a lot of soul searching on the winter circuit for this coming season. For the future of the sport, we are passionate about ensuring the success of our Arizona circuit. We need to be equally successfully with Arizona as we are starting to be with our big program in Thermal. So in many ways I consider this year to be our starting year. First and foremost, we have changed our team entirely. I couldn’t be more thrilled to welcome Jay Mullen as our new show manager, Paul Jewell as our new technical coordinator, and Valerie Beyer as our new office manager. This team has had enormous success in revitalizing shows such as Arizona. I think a fresh team is exactly the place to start and I’m confident we have the right new team in place. Second, we have resized the circuit to four weeks. We need to grow from a position of strength and ensure the circuit is the right size. We can always expand in the future. But we want to see four vibrant weeks this season. Third, we have changed the schedule significantly. We have upgraded the shows back to A rated, National level Hunters and Level 3 Jumpers. We’re hopeful that this attracts more folks back to the circuit. We have also rebalanced the prize money and added a USHJA National Hunter Derby each week. We are hopeful that you are as excited as we are with this fresh start and look forward to seeing everyone in Arizona this season. I am excited to welcome everyone to the 2021 Arizona Winter Circuit! My new team looks forward to the challenges and adventures of the upcoming horse show year. Certain things will remain the same, however there will be many new and exciting changes that myself and our team think many customers will embrace and enjoy. With aspirations to create an environment that provides an individualized “Tucson experience”, we are rethinking certain aspects to ameliorate the setup of the whole show. The circuit has been streamlined from six weeks to four, however, all four weeks are now USEF National rated hunters and level three jumpers. A $2,500 USHJA National Hunter Derby will be a nice addition to all four weeks of showing. New jumps are on the way for the hunter rings as well as the jumper ring, including some beautiful sponsor jumps. I am very open to listening to our exhibitors and will try my hardest to make appropriate modifications. As some already know, the property presents some challenges, but our team’s philosophy, as well as Apex Equisport’s, is to bring you the very best show that we can. COVID-19 has posed some difficulties for all, but if we work together and follow the protocols in place, this can be a wonderful small-scale horse show. AWC will never be a mass event with thousands of exhibitors, and that leaves the door open for this show to be a very distinctive boutique option for those who do not want to feel crowded. With plenty of fresh air and ample room to be socially distant, as well as hand washing stations and restrooms available throughout, with mask wearing we as a whole horse show family can make this a safe circuit. With diverse yet similar backgrounds and much experience, all of us will strive to make the “Tucson experience” one you will always remember. WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT For and in consideration of United States Equestrian Federation, Inc. dba US Equestrian (“USEF”) allowing me, the undersigned, to participate in any capacity (including as a rider, driver, handler, vaulter, longeur, lessee, owner, agent, coach, official, trainer or volunteer) in a USEF sanctioned, licensed or approved event or activity, including but not limited to equestrian clinics, practices, shows, competitions and related or incidental activities and ________________________________(“USEF Event” or “USEF Events”); I, for myself, and on behalf of my spouse, children, heirs and next of kin, E and any legal and personal representatives, executors, administrators, successors,, and assigns, hereby agree to and make the following contractual repre- sentations pursuant to this Agreement (the “Agreement”): N A. ACKNOWLEDGMENT OF RISK: I knowingly, willingly, and voluntarily acknowledge the inherent risks associated with the sport of equestrian and know that LI horseback riding and related equestrian activities are inherently dangerous, and that participation in any USEF Event involves risks and dangers including, with- out limitation, the potential for serious bodily injury (including broken bones, head or neck injuries), sickness and disease (including communicable diseases), trauma, pain & suffering, permanent disability, paralysis and death; loss of or damage to personal property (including my mount & equipment) arising out of the unpredictable behavior of horses; exposure to extreme conditions and circumstances; accidents involving other participants, event staff, volunteers or specta- N tors; contact or collision with other participants and horses, natural or manmade objects; adverse weather conditions; facilities issues and premises conditions; failure of protective equipment (including helmets); inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the USEF Event organizers and competition management; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). EQUINE ACTIVITY LIABILITY ACT WARNING: O CAUTION: HORSEBACK RIDING AND EQUINE ACTIVITIES CAN BE DANGEROUS. RIDE AT YOUR OWN RISK. Under the laws of most States, an equine activity sponsor or equine professional is not liable for any injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities. C. ASSUMPTION OF RISK: I understand that the aforementioned Risks may be caused in whole or in part or result directly or indirectly from the negligence IT of my own actions or inactions, the actions or inactions of others participating in the USEF Events, or the negligent acts or omissions of the Released Par- ties defined below, and I hereby voluntarily and knowingly assume all such Risks and responsibility for any damages, liabilities, losses, or expenses that I incur as a result of my participation in any USEF Events. WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND INDEMNITY: In conjunction with my participation in any USEF Event, I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties: USEF, USEF Recognized Affiliate Associations, the United States Olympic & Paralympic Committee (USOPC), USEF clubs, members, Event participants (including athletes/riders, coaches, trainers, judg- es/officials, and other personnel), the Event owner, licensee, and competition managers; the promoters, sponsors, or advertisers of any USEF Event; any UB charity or other beneficiary which may benefit from the USEF Event; the owners, managers, or lessors of any facilities or premises where a USEF Event may be held; and all directors, officers, employees, agents, contractors, and volunteers of any of the aforementioned parties (Individually and Collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss, or expense (including court costs and reasonable attorney fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the USEF Events, including claims for Liability caused in whole or in part by the negligent acts or omissions of the Released Parties. COMPLETE AGREEMENT AND SEVERABILITY CLAUSE: This Agreement represents the complete understanding between the parties regarding these issues TS and no oral representations, statements or inducements have been made apart from this Agreement. Assumption of Risk and Waiver: Participant understands and accepts the risks of engaging in Equine Activities (as defined below), as well as merely being near a horse or pony (collectively “equine”), including, illness, injury, death, property damage, or any other loss (collectively “Loss”) resulting from faulty tack and equipment, a failure of Released Parties to make a reasonable and prudent effort to determine the ability of the Participant to engage safely in the Equine Activity or manage safely the particular equine, and/or the result of a dangerous latent condition, as well as: (a) the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them (ex.: jump, run, kick, buck, bolt, spin, rear up, strike, bite, stumble, fall, etc.), (b) the unpredictability of an equine's reaction to sounds (ex.: machinery, equipment, doors, rain, wind, thunder, voices, ATV’s, gun shots, cars, trucks, snakes, etc.), sudden movement (ex.: rider or jump falling, loose horse or dogs, etc.), and unfamiliar objects (ex.: jumps, poles, barrels, flowers, water, flags, golf carts, etc.), persons (ex.: riders, visitors/guests, spectators, etc.), other animals (ex.: leashed or unleashed dogs, cats, wildlife, etc.), or other things, (c) certain hazards such as surface and subsurface conditions (ex.: ground holes, uneven terrain, slippery, hard, or deep footing or flooring, construction material, other dangerous latent conditions of the property, etc.), (d) collisions with other equines or objects, and (e) the potential of a participant to act in a negligent manner that may contribute to injury to participant or others, such as failing to maintain control over the equine, or not acting within his or her ability. Participant understands the Loss that may result from the accepted risks of engaging in Equine Activities or just being near an equine, that equines are powerful and potentially dangerous, even without warning, and that the risks listed in this Release are just a sampling and Participant is not relying on Released Parties to list all possible equine-related risks. Participant agrees that no warranties or representations as to the condition or safety of Released Parties’ facility have been made. Participant agrees that engaging in Equine Activities under this Release includes, but is not limited to, those defined under California law, as well as petting, leading, feeding, watering, bathing, or grooming an equine, or assisting with any of these activities, and otherwise interacting with or merely being in the vicinity of equines (collectively “Equine Activities”). Participant understands and agrees that Participant is required to wear an ASTM-standard F1163/SEI-certified equestrian helmet (“Helmet”) while on an equine. Participant is not relying on Released Parties to provide, check fitting, or monitor the wearing of a Helmet. Participant accepts responsibility for the execution of this Release by anyone at Released Parties’ facility at Participant’s request, invitation, or permission, whether or not engaging in Equine Activities. Participant agrees to be responsible for his/her personal health and safety, to purchase and maintain his/her own insurance, remain financially responsible for his/her medical expenses, and hereby waives his/her right to any claims arising from participation in or observation of any Equine Activities or merely being present on property owned, leased, rented, visited, organized upon, or otherwise occupied or utilized by Released Parties, regardless of the reason for Participant’s presence on the property. The following shall be included as Released Parties under this Release: Coachella Horse Park LLC, doing business as Desert International Horse Park, CHP Land Company LLC, CHP Show Management Company LLC, doing business as Apex Equisport, and each of their respective parent, affiliate and subsidiary companies, agents, successors, assigns, employees, volunteers, contractors, representatives, assistants, sponsors, members, managers, shareholders, officers, directors, owners, trustees, licensees, invitees, related entities, as well as any other person or entity acting on their behalf or in any manner connected with the ownership and management of the above listed parties (collectively “Released Parties”). Participant acknowledges that he/she hereby waives on his/her behalf and on behalf of his/her heirs and assigns, and fully understands the effect of such waiver, all benefits flowing from any state statute that would otherwise limit the scope of this Release, including but not limited to Section 1542 of the California Civil Code, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” 2. Release/Hold Harmless/Defend/Indemnify/Photo Release: Participant agrees to release, hold harmless, defend, and indemnify Released Parties for Loss incurred by Participant or Participant’s property, even if such Loss is caused by negligence or other fault of Released Parties (except gross negligence, recklessness, or intentional misconduct). Participant grants permission for Released Parties to use his/her photograph and video depictions in any format engaging in Equine Activities and/or related moments. 3. Governing Law/Time Limitation/Attorneys’ Fees/Jury Waiver: This Release shall be construed and enforced in accordance with California law. All disputes relating to the interpretation and enforcement of this Release shall be resolved exclusively by the state court in Los Angeles, California. Participant submits to this jurisdiction and venue for such purpose. Participant agrees that this Release does not expire and that any and all claims and/or causes of actions for Loss by Participant against the Released Parties surviving this Release must be brought within one (1) year of the date accrued and any claim for personal property Loss is limited to Two Hundred Fifty Dollars ($250). Participant agrees to reimburse Released Parties for any attorneys' fees and costs incurred by Released Parties in enforcing this Release and/or in defending or prosecuting any claims or causes of actions involving, or in any way relating to, Participant. Participant agrees to waive trial by jury in any action, proceeding, or claim brought by Participant against Released Parties on any matters related to, arising out of, or connected with this Release. 4. Severability/Modification: If any provision of this Release shall be determined to be invalid or unenforceable, the remainder of this Release shall not be affected thereby. Each provision of this Release shall be valid and enforceable to the fullest extent permitted by law. Statement of vaccination must be on Official Letterhead and must contain the Show Name of each horse. PRESENTATION OF HEALTH REQUIREMENTS These documents must be presented upon entry to the show grounds and copies must be filed in the Show Office before any competition numbers will be issued. The results on all required papers must indicate the horse’s registered (show) name. Any horse not accompanied by these documents will be directed to the Show Veterinarian to obtain the required documents and/or vaccinations, and/or will be placed in quarantined stabling until the proper documents are obtained. Horses and ponies are not required to show in any other class at the competition, but may compete in any class for which they are otherwise eligible. Owners, Riders and Trainers must be current Active Competing Members of USEF and USHJA. Horses and ponies must have USHJA Registration. Change of rider after the First Round is not permissible. CONDITIONS AND SPECIFICATIONS - Fences 3’0”, with at least four (4) option fences 3’5” per round. To be judged under the Open Numerical scoring system by two panels of two judges each. One Panel will be designated the tie-breaking panel for Round 1; this panel will also be the tie-breaking panel for the jump-off, if any. The other Panel will be the tie-breaking panel for Round 2. To be scored on quality, movement, jumping style, manners and way of going. Pace and brilliance are to be rewarded. Jumping decorations to utilize a shorter track is not permissible in any round. Round 1: To be shown over a Hunter Classic course of at least 10 fences. In addition to the base score, each judging panel must award an Option Bonus Score consisting of one additional point for every higher height option fence jumped. Scores will be added to determine the total score for the round. The top 12 will return in reverse of scores for the Second Round. In the case of ties, the Base score of the tie-breaking panel will be used to break the tie. Round 2: To be shown over a Handy Hunter course of at least 8 fences. In addition to the base score, each judging panel must award an Option Bonus Score consisting of one additional point for every higher height option fence jumped. Handiness is taken into account in the judges’ base score. Scores will be added to determine the total score for the round. In the case of ties, the Base score of the tie-breaking panel will be used to break the tie. Scores from Round 1 and Round 2 will be added to determine the overall winners. In the case of a tie for First Place, a jump-off will be held. In the case of ties for all other places, the Base score of the Round 2 tie-breaking panel will be used to break the tie. POINTS AND AWARDS - In order to earn USEF Horse of the Year points, exhibitors must declare in which section points are to count by submitting a completed USHJA Declaration Form to the Show Office by the end of the competition. Points accrued by horses shown by Professionals may be awarded to the declared Green Hunter 3’0”, Green Hunter 3’3” Performance Hunter 3’3” or Small Hunter. Points accrued by horses shown by Juniors or Amateurs may be awarded to the declared Green Hunter 3’0”, Green Hunter 3’3” Performance Hunter 3’3”, or the applicable Children’s, Pony, Adult Amateur, Amateur Owner 3’3”, Small Hunter or Junior Hunter 3’3. The money won and points won in the USHJA National Hunter Derby will only be awarded towards a declared Hunter section for HOTY points if a horse competes in the declared section a minimum of 1 time during the competition year. National HOTY championship points will not be awarded. (see HU192.9b) HORSE INSPECTION - Horses entered in this class will NOT be required to jog for soundness. Any unsoundness during the competition will be reflected in the scores from the judges (GR 1033.6). SCHOOLING REQUIREMENTS - During the 24 hour period prior to the two rounds of the class, horses must be ridden in official horse show schooling areas only unless Management designates a specific schooling area for National Hunter Derby horses. Competition number must be worn at all times while mounted. ORDER OF GO - The Order of Go for the First Round will be drawn. The Order for the Second Round will be reverse order of scores from Round 1. Should a jump-off occur, horses will return in the same order in which they competed in the second round.
