NOTICE INVITING TENDER
Sealed two bid tenders are invited from the eligible and reputed contractor for Annual Maintenance
Contract (AMC) of Gardens (including horticultural works) in the NIPER-Ahmedabad, Gandhinagar
campus. Bid document with other terms & conditions are also appended below and are to be submitted with
Tender Fee and EMD as given in tender document:

INSTRUCTIONS TO THE TENDERERS:

The Tender shall be submitted in accordance with these instructions, as under.

1. Eligibility Criteria:

    1. The bidder should have minimum 3 years of experience in the field of providing complete
       development and maintenance in gardens.
    2. The firm should provide at least 1 work order from any reputed large Central Govt/State Govt/ Semi
       Govt/Private organizations in Gujarat.
    3. The Bidder should be based in Ahmedabad or Gandhinagar. The address proof of the office
       premises should be provided.
    4. The average annual turnover of the bidder shall be minimum of Rs. 80,00,000/-(Rupees Eighty
       Lakhs) or more during last 3 Financial years i.e. 2017-18, 2018-19 & 2019-20. (Copy of Audited
       Annual Accounts for the last three years to be submitted).
    5. The Bidders should have submitted filed ITR for last Two years i.e. 2018-19, 2019-20. (Copy of filed
       Acknowledgments to be submitted).
    6. The bid document complete in all respect should reach to The Registrar, NIPER-Ahmedabad, at
       Palaj, Opp. Air Force Station, Gandhinagar-382355, Gujarat on or before 11:00 AM on 10/2/2021.
    7. No bids shall be entertained after the last date for tender submission.

2. Access to Tender documents:
      a) Tender form can be downloaded from our website: http://www.niperahm.ac.in and through e
         procurement portal
      b) At any time prior to the deadline for submission of bids, NIPER-Ahmedabad may amend the
         Bidding Documents by issuing addendum or corrigendum on the website only. The prospective
         bidders are advised to remain in touch with the Website for any update in respect of this tender.

3. Process of Submission of Tender:

    a)     The tender must be placed in a properly sealed bigger envelope containing sealed technical &
           financial bids addressed to

           The bigger envelope must be super-scribed “Tender for Annual Maintenance Contract (AMC) of
           Gardens” with tender inquiry number and its due date. The three sealed envelopes inside the bigger
           envelope must be super-scribed as:

           Envelope No-1: The said envelope is for technical bid & shall be superscribed as “Tender for the
           Annual Maintenance Contract (AMC) of Gardens - Technical Bid”

           Envelope No-2: The said envelope is for commercial bid & shall be superscribed as “Tender for
           Annual Maintenance Contract (AMC) of Gardens - Commercial Bid”.

           Envelope No-3: The said envelope is for Tender Fee and EMD & shall be superscribed as
           “Tender for Annual Maintenance Contract (AMC) of Gardens -Tender Fee and EMD”.

    b) for any delay, loss or non-receipt of bid document sent by courier or postal services.
    c) Tenders received in open covers/ letters/ fax/ email will not be considered.
    d) Any bids with “Zero”fee will be considered as unresponsive bid & liable to be cancelled

4. Essential Documents and its Sequence
1.   Technical bid (Envelope 1):

     a) Copy of Audited Annual Accounts for the last three years to be submitted. (for the year 19-20
        provisional accounts can be submitted only after certified by CA)
     b) Forwarding letter duly signed by the Authorized Person.
     c) Details of Horticulture & Landscaping done in the past.
     d) Details of present assignments.
     e) Latest Income Tax Clearance Certificates.
     f) Copy of the PAN CARD of the Firm (Copy to be enclosed)
     g) KYC of the promoter/founder of the company
     h) GST Registration Certificate.
     i) Annexure-I: Self-declaration to be provided by the bidder
     j) Annexure-II: Format for other Information
     k) Acceptance of all clauses of bids specification duly signed page-wise to be submitted.
     l) The Technical Bid should not contain any financial information.
2.   Financial Bid (Envelope 2):
        In the format of Annexure-III

3.    Tender Fee and EMD (Envelope 3):
     a) Tender fee in the form of A/C Payee DD in Favour of NIPER-Ahmedabad payable at Gandhinagar
        and EMD in the form of A/C Payee DD/Fixed Deposit Receipt/Bank Guarantee from any of the
        Commercial Bank in the Acceptable form in Favour of NIPER-Ahmedabad payable at Gandhinagar.

5. Tenure of the Work contract
   The Tenure of the work contract will be valid for a period of 1 year from the date of award of work order.
   The contract can be further extended for another year on mutual consent, based on the performance of
   the bidder.

6. Financial Bid Submission:
   a) The prices quoted should have inclusive of all other charges.
   b) The price quoted in financial bid shall be fixed and final and shall include all applicable taxes. All
      taxes, if applicable, should be quoted separately. Otherwise, it would be presumed that the quoted
      prices are inclusive of taxes (please see Financial Bid format). Any variation in the taxes etc. shall be
      to the bidder’s account.

7. Payment:
     a) Bill will be presented inclusive of every service.
     b) The payment of bills will be made by RTGS/NEFT/through PFMS (DBT) for which the bidder shall
        send bills in duplicate (original + copy) in every month, which will be sanctioned after verification of
        work done.
     c) TDS (Tax Deducted at Source) will be as per prevailing Laws and rules and regulations of Income
        Tax Department.
     d) Payments of bill shall be released only if it is accompanied by the proof of the following:
              i. Certified Attendance Sheet;
              ii. Entry challan of gardening materials provided and the bill thereof
     e) Payments of Security Deposit/ Earnest Money will be released after the contract is completed
        successfully only.

8. Scope of work:
    a) Complete maintenance of garden area
             Approx. 30,000 Sq ft of Carpet grass garden
             65000-70000 Sq. Ft. Normal grass in and around NIPER-A)
             Approx 10,000 Sq ft of Plantation bed
             Approx 80,000 sq ft sports ground/Cricket ground
             The above area also includes weeding, uprooting of wild grass, cleaning, watering, edge

cutting, trimming, pruning of hedge, trees shrubs, mowing, top dressing of lawn with good
                  quality earth & manure, preparation of seasonal flower bed growing of seedlings,
                  replacement of casualties, application of insecticides, pesticide, cleaning & removal of
                  garden rubbish as per direction of authorities.
    b)   The contractor may visit the area before submission of the Tender, after giving prior information to
         the Registrar.
    c)   Day to day maintenance of potted plants including preparing the flower pots of variety flowers and
         plants from open market.
    d)   Development of play ground/cricket ground 100 mtr (diameter)
    e)   The contractor will also procure new plants, shrubs, pots (Max 100 per month) and plant & maintain
         them as per the requirement for gap filling, New Development etc as per the instructions given from
         Time to Time by the Authorities
    f)   Safety and maintenance existing sprinkler system and its accessories shall be the contractor’s
         responsibility. If damaged/mutilated during the period, the same need to be replaced with similar or
         equivalent ISI approved material/parts. Any delay caused in replacing, and thereby harm to the
         plants shall be worked out accordingly and 100% damage liability shall be levied on the contractor
         as calculated by us.
    g)   A nursery needs to be developed for medicinal and other floral ornamental plants, which will be
         maintained by the contractor for the species grown in the premises
    h)   The Contractor is expected to keep the below tools and tackles at the institute for maintenance
         work

    q) The contractor shall employ the following minimum technical/skilled staff during the entire Garden
       maintenance period. Their attendance is compulsorily on full time basis.

    r) Any other related works as and when required and as directed by the officer in charge from time to
       time.

9. Other Conditions:

    a) The contractor will provide all necessary machinery, equipments, tools & tackles, etc as per Institute
       guidelines.
    b) Consumable materials as and when required for the work, like good earth, manure, fertilizers,
       insecticides, pesticides, seasonal seeds, seedlings, plants, shrubs etc. will be supplied by the
       Contractor.
    c) The successful tenderer has to pay 10% of the tendered amount (equivalent Annual Value of the
       contract) as security deposit in the form of crossed Bank draft or Bank Guarantee payable “NIPER-
       Ahmedabad” payable at Gandhinagar before commencing the work. Security deposit will remain
       with the institute as long as the contract is in force. The security deposit can also be made in the
       form of FDR or Bank Guarantee drawn in favour of ““NIPER-Ahmedabad” payable at Gandhinagar.
       The security deposit shall be submitted to the Office within seven days from the date of receipt of
       the work order.
    d) Commencement of work shall be permitted only after the receipt of Security Deposit.
    e) No Subletting of work will be permitted
    f) If the successful tenderer fails to deposit the Security Deposit within the notified period, it will be
       presumed, that the contractor is not interested in the contract and the offer of contract shall be

cancelled and the EMD of the contractor will be forfeited.
    g)  The tender shall be valid for a period of 180 days (6 months) from the date of opening of the
        Technical Bid of tender. Terms and financial details submitted in the bid shall be treated as firm
        during the said period of 180 days (6 months).
   h) If any Bidder withdraws his tender before the period of 180 days (6 months) from the date opening
        of technical bid or makes any modifications in the terms and the conditions of the tender which are
        not acceptable to the NIPER-Ahmedabad, then NIPER Ahmedabad shall, without prejudice to any
        other rights or remedy, be at liberty to forfeit the EMD. The EMD will also be forfeited as per the
        norms of GFR 2017.
    i) While submitting the tender, if any of the prescribed conditions are not fulfilled or are incomplete in
         any form, the tender is liable to be rejected.
    j) The contractor shall duly comply with all provisions of labour laws dealing with wages, working
         conditions and welfare measures and industrial relation by Central & State (Gujarat) Labour Laws
         and Rules are in force and these Laws and Rules are being enforced by the Labour
         Commissionerate, as amended from time to time and all other relevant statutes.
    k) Effect of revision of minimum wage as per revised circular of Office of the Labour Commissioner,
         Govt. of Gujarat may be considered.
    l) The contractor shall be responsible for and shall pay the expenses or providing any medical aid to
         any workman who may suffer bodily injury as a result of an accident or otherwise also.
    m) In the event of the Contractor’s failure to execute the work entrusted to it under this Agreement
         satisfactorily, NIPER-Ahmedabad shall make alternative arrangement to do it and the difference of
         cost incurred by NIPER-Ahmedabad thereby shall be recovered from the Contractor’s unpaid bills
         and Security Deposit.
    n) The contractor shall be responsible for making good towards the damages done to the existing
         property or work during construction by his workmen.
    o) The present contract is for a period of one year. However, the contract may be extended based on
         the performance of the contractor for a period of one more year.
    p) Director, NIPER-Ahmedabad shall be the final authority for settlement of any dispute, and his/her
         interpretation of any clause/term/condition(s) of this document shall be final and binding, and the
         jurisdiction of Court of Law shall be Gandhinagar
    q) In the event of any dispute the legal matter shall be subjected to the jurisdiction of Gandhinagar,
         Gujarat Court only.
    r) Non-Judicial stamp paper of Rs.300.00 (Rs. Three Hundred only) within fifteen days of the issue of
         the Letter of acceptance of BID. In the Event of failure on the part of the successful bidder to sign
         the Contract within the period stipulated above, the EMD shall be forfeited and the acceptance of
         BID shall be considered as cancelled.
