Advertising Network Study on Popular Malaysian Piracy Sites Conducted by Veri-Site Commissioned by AVIA's Coalition Against Piracy (CAP)

2 EXECUTIVE SUMMARY Veri-Site (a division of Strategic IP Information Pte. Ltd, Singapore) tracked 52 of the most popular pirate sites in Malaysia, in January 2019, to understand the advertisement network support in place for these sites, and to identify companies advertising on these sites. This study found that the vast majority (92%) of the sites were ad supported and had the potential of generating millions of dollars for the companies and individuals promoting these sites, with their annual page views running into billions, a telling indication just of how popular these websites are in Malaysia and how openly copyright laws are being flaunted in the country. The content theft industry has low barriers to entry and video streaming sites are the new normal. Malaysia is no exception to this rule. These sites operate using cloud-based technology that allow pirate networks operators to quickly launch new sites in the event a site gets blocked or shut down. Pirate networks typically use multiple ad network services for the placement of programmatic ads on their sites. Our key findings include the following: • The use of ad delivery entities: 92% of the 52 most popular pirate sites in Malaysia are supported by at least one ad network. The two most visible ad networks in our study were Google Ad Sense (19 sites) and Google DoubleClick (32 sites), however we only found 2 mainstream ads placed by these ad networks. The study linking 92% mainstream ads to ad networks found that Steepo, Bebi Media and Adskeeper placed of the 52 sites in the highest number of mainstream ads. (Note: since ad networks target ads based on the sample study search history, it is possible that ads from other entities were not delivered.) were supported by at least one ad • Mainstream business advertisers at risk: Low levels of industry awareness locally network appear to be the reason why ads of legitimate Malaysian businesses appear on pirate sites. This study found as many as 184 different mainstream brands being advertised on the 52 most popular pirate sites in Malaysia. Popular brands being advertised include 11street.my, Perodua, Exabytes, q0010.sg, Amazon and Dell. • Social impact of advertising: Pirate networks also attract advertising from several high-risk advertisers from the following sectors: adult dating, pornography, malware, and gambling. This study found 133 advertisers in the high-risk category. • Illicit Steaming Devices (“ISDs”)and Mobile Apps: A recent study by YouGov in Malaysia found that consumers are cutting the cable and moving to ISDs and a recent study by Veri-Site found 854 sellers offering ‘fully loaded’ ISD boxes on online marketplaces such as Lazada.com.my, and 11street.my, in Malaysia. These sellers have been reported and removed successfully by AVIA’s Coalition Against Piracy (“CAP”) initiative. Additionally, ISDs and mobile devices are enabled by apps; Veri-Site studied 65 mobile marketplaces and found over 100 pirate apps on Android and Microsoft marketplaces. Approximately, 62% of the pirate apps were supported by at least 1 ad network and there was a high prevalence of mainstream ads.

Introduction Recent technological changes have impacted the way pirated content is being delivered to consumers globally, including within Malaysia – a market in which illegal downloading remains extremely widespread. With the recent crackdown on several popular torrent networks, such as The Pirate Bay and KickassTorrents, pirate sites have become more fragmented and rely on a host of ‘deepweb’ and ‘cloud based’ infrastructures to deliver pirated content, which continue to generate millions of dollars in advertising revenue. In the past year, Veri-site has identified thousands of sites distributing pirated content. In January 2019, fresh scans for sites were conducted by Veri-Site to identify pirate sites dealing in international (primarily English language) content, as well as in vernacular languages in Malaysia. A sample of 52 pirate sites were selected based on their popularity and ad network support in order to identify key institutions that are used by pirate sites. 7 The frequency distribution of the number of sites shows that 83% of the sites were supported by more than one ad delivery entity giving pirate sites access to all kinds of advertising revenue. On average , each pirate site is supported by 6 ad delivery entities. Two sites that are popular in Malaysia, namely www.kissasian.sh and www.kissasian.es, are each supported by a whopping 23 ad delivery entities. FIGURE 5 : NO. Assessment of advertiser composition There are essentially two kinds of advertisers that appear on piracy websites: Ÿ Mainstream brands (whose ads appear to have been placed on these sites without the knowledge of these brand owners); Ÿ Less reputable advertisers, such as the pornography, adult dating or illegal gambling industries (collectively known as HRA), that strategically place their ads on piracy websites (perhaps to cater to the younger demographic that forms the principal user base of such sites). 8 317 advertisers were found to be advertising on 48 pirate sites (4 of the websites were free of ads). 58% of these 317 advertisers were mainstream brands. The remaining 42% were high-risk ads. Mainstream advertisers 313 ads placed by mainstream brands appeared on 42 pirate sites. The breakdown of the mainstream advertisers shows that media & entertainment, ecommerce, gaming, banking services, social and IT service sites account for 90% of advertising on pirate sites. 9 We analysed 525 ads placed on 52 pirate sites (both mainstream and high risk advertising (“HRA”)) to determine which ad networks placed the ads. Our findings show that ad networks Steepto, Bebi Media and Adskeeper were the most active ad networks and responsible for the placement of mainstream ads. High-risk advertisers This study found 212 high-risk ads placed on 45 pirate sites. Consumer Risk Factors In addition to generating significant revenue to the detriment of mainstream advertisers and copyright owners, sites that share stolen content also place consumers at risk. This threat comes essentially from malware embedded in adverts or within streaming or torrent files. Our study found that 63% of pirate sites provided links to malware and most of these ads were displayed alongside mainstream brand ads, in an effort to stay undetected. In most instances, malware was hidden behind Download or Playbuttons, but in many instances it was not even necessary to click on a link to trigger the unwanted download. While most of the malware on these sites comprised adware (software that automatically displays or downloads advertising material such as banners or pop-ups when a user is online), 18% contained more dangerous forms of malware. These forms of malware were not analysed for the purposes of the study. 15 The following are examples of potential risks from adware: i. The direct download site, HDpopcorns.co, featured an on-click ad that launched pop- ups by clicking anywhere on the page. The user would find it difficult to navigate to the content without ultimately downloading some unwanted software. ii. The video streaming site 123movies.la features ads triggered via a 'download' button which operates as a back door for other software used to potentially launch denial of service attacks, gather personal data, or execute other computer programs.
16 Mobile Advertising on Illicit Streaming Devices A recent study by YouGov has revealed an increasing trend of consumers cutting the cable and migrating to copyright infringing apps preinstalled on TV boxes, also known as Illicit Streaming Devices (“ISDs”). The YouGov survey, commissioned by AVIA's Coalition Against Piracy found that 25% of Malaysian consumers use a TV box which can be used to stream pirated television and video content. The survey also found that of the 25% of 854 sellers were Malaysian consumers who purchased an illicit streaming device for free streaming, three identified offering in five (60%) stated that they cancelled all or some of their subscription to legal pay TV 'fully loaded' ISD services. Unfortunately ISDs are easy to find on various ecommerce marketplaces, social boxes on Malaysian media and electronic retail outlets. There was high prevalence of mainstream ads on 62 mobile apps, indicating that mobile ad networks need to do more to block advertising to pirate apps.

18 CONCLUSION This study clearly establishes that the top 52 piracy sites in Malaysia are largely supported by advertising revenue. Most pirate sites utilize ad networks to access all types of advertisers - big brands (both international and local), gambling sites, e-commerce sites, adult dating sites and unregulated products sites. Ad Networks appear to be exerting very weak control, if at all, when adding sites to their ad networks, thus allowing piracy to thrive. The study also highlights an alarming level of mainstream brands advertising on mobile applications, highlighting the need to address the same issues with mobile ad networks. While there is no silver bullet to fight piracy, our study has underlined the need for content rights owners, brands, and regulators to work together to reduce piracy by blocking their primary source of income, namely ad-generated revenue.

26 Authors of the Report BHARAT DUBE Chairman Veri-Site (a division of Strategic IP Information Pte (“SIPI”)) Contact: bharatdube@sipi-ip.com Bharat Dube earned a Juris Doctor degree from Duke Law School in 1986 and is a graduate of the United World College of the Atlantic, and Harvard University. He was a key member of the litigation and enforcement team of Richemont, the Swiss luxury goods conglomerate, between 1990 and 2010 and headed Richemont's global IP litigation team for several years. Prior to joining Richemont, Bharat worked with the World Intellectual Property Organization (WIPO), in Geneva. He has lectured extensively at IP symposia around the world, including events sponsored by the International Anti-Counterfeiting Coalition, the International Trademark Association, ACACAP, WIPO and various bar associations and universities. He is an honorary adjunct professor at the O.P. Jindal Law School in India. Prior to SIPI, Bharat was an Associate Director with EY where he worked in the Technology and Media group with a focus on Media. At EY, Bharat led the business development and advisory services program for companies operating in the media, e- commerce and advertising sectors. Throughout his career, Bharat has followed the digital and e-commerce industry closely and has advised startups in various capacities. Before joining EY, Bharat worked with Star TV, a subsidiary of News Corp, where he was responsible for the marketing and sales of several niche channels.
