August 12, 2021 Ms. Janice Stevanovic Town of Zionsville 1100 West Oak Street Zionsville, IN 46077 Re: HUB I-65 Buildings 3 & 4 Modification of Commitments Narrative Dear Ms. Stevanovic, Concurrent with the Development Plan and Primary Plat submittal packages for the HUB I-65 Buildings 3 & 4, it is the applicant’s understanding that two modifications to previous zoning commitments (Instrument No. 2020013512) will be required based on feedback obtained from the Town of Zionsville Fire Department and site design constraints caused by Duke Energy. Please below for the commitments which require modification and reasoning. Commitment #9: The development of the Real Estate shall comply with the submitted Site Plan and the buffer yard requirements for Rural development standards and process outlined in the Town of Zionsville Zoning Ordinance. All dimensions and layouts on the Site Plan are subject to final site design requirements. Deviation & Reasoning: The site plan that was attached to the zoning commitment document notes a 40’ Buffer Yard Type H along the subject site’s entire frontage to C.R. 300 E. Approximately 1,800 linear feet to 1,950 linear feet from the CR 300 E and CR 400 S intersection, a Duke Energy transmission easement crosses CR 300 E. Duke Energy will not allow existing grades to be increased or trees to be placed within their easement, therefore the 4’ berm and required plantings within the 40’ Buffer Yard Type H cannot be placed within this stretch. Due to this site constraint, the applicant seeks relief from this commitment for this limited stretch. Commitment #12: The development shall not have vehicular access off either CR 400 S or CR 300 E. Deviation & Reasoning: There is only one point of public ingress/egress proposed for the Building 3 and 4 development located along the east property line between Buildings 3 and 4. During the project’s pre-filing meeting, the Zionsville Fire Department noted that a secondary emergency entrance will be required for life-safety purposes in the event this one public entrance is blocked. Page 2 that would be gated with a Knox Box for fire access. This gated entrance would not be open to the public and has been strategically located to avoid a break in the berm in an area that would otherwise be a landscaped berm. The applicant seeks relief from this commitment to allow for an emergency access drive for use by the Zionsville Fire Department.
