What Is MSRRA and how does it work? (EDD Box #3) – On November 11, 2009, the Military Spouses Residency Relief Act (MSRRA) was enacted to extend certain protections to military spouses. Pursuant to the MSRRA, a military spouse who is present with a member in a particular State under military orders does not have to pay State income taxes on wages earned in that State as long as that State is not the spouse’s legal residence or domicile. – The MSRRA does not allow a spouse to pick or choose a domicile in any State. Rather, domicile is established, which means that the spouse must have actually been present in the State, established it as his or her domicile, and maintained it by forming and maintaining the necessary contacts, such as registering to vote, owning property, registering vehicles, or indicating a State of probate in a last will and testament. Prior Military Entitlements MILITARY BUY BACK • If you served in the military and now hold a civilian position, your military time may apply toward your civil service retirement. To buy back your military service, you will have to pay a deposit, (in most cases 3% of your base pay earned during your military service if you are FERS, 7% if you are CSRS. • Interest - If the deposit is paid in full within the first 3 years of Federal civilian employee, no interest is owed. If you have been a Federal civilian employee for more than 3 years, you can still pay the deposit, but you will owe interest. The sooner you pay the deposit the less interest you will have to pay, so the sooner you pay the deposit the better. • **The Office of Personnel Management (OPM) now requires Military Service Deposits be paid in full before your date of separation or retirement. Prior Military Entitlements Disabled Veteran Leave Entitlement Under the Wounded Warriors Federal Leave Act of 2015 (Public Law 114-75, November 5, 2015): a employee hired on or after November 5, 2016, who is a veteran with a service- connected disability rating of 30 percent or more from the Veterans Benefits Administration (VBA) of the Department of Veterans Affairs (VA)is entitled to up to 104 hours of disabled veteran leave for the purposes of undergoing medical treatment for such disability.
