VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS PREAMBLE 1. APPLICATION 1.1. In accordance with 33.1 of the Volleyball Victoria Constitution, these By-Laws are adopted by the Volleyball Victoria Board 1.2. These By-Laws set out the rules that apply to the conduct and administration of the Volleyball Victoria State League under the auspices of Volleyball Victoria and shall be known as the Volleyball Victoria State League By-Laws. 1.3. The Junior Division By-Laws are to be applied in conjunction with the Volleyball Victoria State League By-Laws with any disputes to be decided by the Referee Delegate or Volleyball Victoria. 1.3.1 The Junior State League By-Laws can be located in Appendix A of these By-Laws. 2. DEFINITIONS AND INTERPRETATION 2.1. Unless the context requires otherwise, the following terms shall have the following meanings: By-Laws: The Volleyball Victoria State League By-Laws. Club: A club that competes in State League and is financially responsible for all teams that they enter in the State League competition. Club Registered A player that registered with a club and: Player: • intends to compete in the current season of State League; and • participated in at least one match in a senior team in the immediately previous season; or • participated in at least one match in the current season of the VV State League. Club Team/Team: An eligible team that represents a Club and competes in State League. Eligible Player / Coach An eligible player / coach / team staff / club that has successfully met the / Team Staff / Club: requirements outlined in these By-Laws. Finals Series: The finals series of the State League competition comprising of qualified teams as determined by the final rankings of all teams entered within their gender division of State League. Financial Clearance: A declaration by a Club that a Player who is or was a member of that Club has no outstanding financial obligations to that Club. FIVB: Fédération Internationale De Volleyball - The world governing body for volleyball. FIVB Rules: The current Official Volleyball Rules 2017 - 2020 Approved by the 35th FIVB Congress 2016. Free agent: Any player that: • intends to compete in the current season of the VV State League; and • has previously competed in any State League around Australia; or • did not participate in the immediately previous season of the Volleyball Victoria State League; or Page 5 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS • is returning to a club where the player competed in a minimum of four (4) consecutive State League seasons in which the player participated in a minimum of five (5) regular season matches in each season; or • is returning to a club where the player competed in a minimum of three (3) consecutive State League seasons in which the player participated in a minimum of five (5) regular season matches in each season and in which the club was not entered in the Premier divisions; or • is returning to a club where the player competed in a minimum of two (2) Junior State League seasons in which the player participated in a minimum of five (5) regular season matches in each season; or • has only competed in the Junior State League. Division: A gender division where a group of teams entered state league by Clubs who will compete against each other in the regular season of State League to achieve qualification into the finals series of State League. Gender Division: A division comprising of teams who solely consist of either male or female players. Guaranteed earliest The scheduled match start time as determined by the State League draw start time (GEST): published by VV. Inter Club Transfer: A player transfer from one club to another club. Junior Player: A junior player is a player that does not turn eighteen (18) years old, or older, during the calendar year the Volleyball Victoria State League or Junior State League seasons are operating. Junior State League: The Volleyball Victoria State League competition that is limited to junior players. Ladder: A table used to show a Team's ranking compared to the other teams entered in the same division of the State League competition. Masters Division: A Volleyball Victoria State League division that is limited to Masters players. For the purposes of the By-Laws Masters divisions will be treated as a Reserves division that is classified between Reserves Division 1 and Reserves Division 2. Any disputes relating to a Masters division will be decided by the Referee Delegate and/or Volleyball Victoria. Masters Player: A Masters player is a player that turns thirty (30) years old, or older, during the calendar year the Volleyball Victoria State League seasons are operating. Match: An officially sanctioned State League match between teams, either in the regular season or finals series of competition. Metropolitan A club who’s main training venue (the venue where your highest classified team Melbourne based trains the majority of a season) is located within the Metropolitan Melbourne Club: area geographically as defined by the Victorian government and Local Government Areas. Official Start Time Either the guaranteed earliest start time a match or the new start time of a (OST): match due to a delay to the guaranteed earliest start time as determined by the 1st referee Participants Any person directly engaged in State League in any way. This includes but is not limited to club members, coaches, officials, players, team staff, and VV staff. Page 6 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS Points Percentage: Determined by dividing the total points won by a team, for a club in their division, by the total points lost by the team, for a club in their division. Promoted: Where a team in a division is entered to play in the immediately higher division during the following State League season in accordance with these By-Laws. Regional Victorian A club who’s main training venue (the venue where your highest classified team based Club: trains the majority of a season) is located within the Regional Victorian area geographically as defined by the Victorian government and Local Government Areas. Registered Member of A player, coach, official and/or team staff that has completed the correct VV: category of registration with VV and paid the required payment. VV shall retain the right to withdraw and/or reinstate a registration status in accordance with its policies. Regular Season: The regular season of State League competition (not being the finals series). Relegated: Where a team in a division is entered to play in the immediately lower division during the following State League season in accordance with these By-Laws. Senior Team: Any team entered in the Premier, Reserves or Masters divisions. Set Percentage: Determined by dividing the total sets won by a team, for a club in their division, by the total sets lost by the team, for a club in their division. State League: Volleyball Victoria State League. State League Inter- The transfer of a Player from one Club to another Club within a State League Club Transfer: season or between consecutive State League seasons. A State League Inter-Club Transfer also requires a Financial Clearance. Volleyball Functions: A formal or social event or ceremony hosted by Volleyball Victoria. Volleyball A formal or social competition hosted by Volleyball Victoria where teams are Tournaments: entered into divisions to compete against each other. Volleyball Tours: A series of professional sporting events hosted by Volleyball Victoria. Volleyball: Victoria Victoria's premier volleyball competition governed under the FIVB Rules, State League: Guidelines & Casebook and guided by these By-Laws VA: Volleyball Australia. VV: Volleyball Victoria VVRC: Victorian Volleyball Referees Commission 2.2. In the interpretation of these By-Laws unless the context requires otherwise: • words importing the singular shall be deemed to include the plural and vice versa. • words importing any gender shall be deemed to include the other gender. • headings are included for convenience only and shall not affect the interpretation of these By-Laws. • "including" and similar words are not words of limitation. • any words, terms or phrases defined in the remainder of these By-Laws shall have the meaning as prescribed with the By-Law. • words, terms, or phrases not otherwise defined in these By-Laws shall be given their ordinary meaning. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS SECTION I COMPETITION STRUCTURE 3. FIVB RULES 3.1. State League shall be played in accordance with the current FIVB Rules unless otherwise stated in these By-Laws. 3.2. Any changes to the FIVB Rules will be adopted into State League from the date they are enacted by the FIVB unless otherwise stated by VV. VV shall notify Clubs of the adoption or delayed adoption of any amended FIVB Rules by displaying the changes on the VV website and by emailing each Club. 3.3. Except for By-Law 3.4 all FIVB Rules specifically written and highlighted in "bold" are for FIVB, World and Official Competitions and do not apply to the State League competition. 3.4. The following FIVB Rules specifically written and highlighted in "bold" for FIVB, World and Official Competitions apply to the State League competition: • The attack line is extended by the addition of broken lines from the side lines, with five 15 cm short lines 5 cm wide, drawn 20 cm from each other to a total length of 1.75m • Up to 14 players may be recorded on the scoresheet and play in a match. • During all time-outs, the players in play must go to the free zone near their bench. • If a team has more than 12 players recorded in the scoresheet, TWO Liberos are mandatory in the team list. • The re-designated libero should, if possible, wear the same style and colour of jersey as the original libero, but should keep his/her own number. 4. COMPOSITION OF STATE LEAGUE 4.1. State League shall comprise of the following male and female gender divisions: • Premier Division 1 • Premier Division 2 • Reserves Division 1 • Reserves Division 2 • Reserves Division 3 • Masters 4.1.1 VV in its sole discretion has the right to establish further divisions from time to time as it sees fit. 4.2. The Premier divisions must comprise of at least eight teams. VV in its sole discretion has the right to allow for exemptions to this By-Law. Page 8 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 5. CLUB AND TEAM ELIGIBILITY 5.1. VV in its sole discretion has the right to determine whether individual Clubs and/or Club teams are eligible to enter State League. VV has unlimited discretion to accept or reject team entries for each individual club. 5.2. To be eligible for entry into State League each Club is expressly subject to: • Providing to the referee roster, for at least one (1) match each per round, at least two (2) minimum Level 1 qualified referees. The referees can also be players and do not have to be the same two (2) referees each round; and • entering a Junior State League team; or • displaying to the satisfaction of VV that they are operating a sufficiently extensive junior program and satisfying any further criteria published by VV in relevant policies or By- Laws. 5.2.1 To be eligible for entry into State League each Club, in their inaugural season only, is expressly subject to: • entering a minimum of one (1) team per gender in any Reserves division; and • are ineligible to enter the Premier divisions. 5.3 In addition to the entry requirements contained in By-Law 5.2, entry into the Premier divisions is expressly subject to each Metropolitan Melbourne based Club: • entering exactly one (1) team in each Premier division; and • entering a minimum of one (1) team per gender in the Junior State League. 5.3.1 In addition to the entry requirements contained in By-Law 5.2, entry into the Premier divisions is expressly subject to each Regional Victoria based Club: • entering one team in each Premier division. 5.4. All promotions are subject to the club and team entry requirements described in By-Law 6. 5.4.1 Clubs can apply for promotion into the Premier divisions for any future State League season. 5.4.2 Clubs can apply for promotion into the Premier divisions subject to: • agreeing to adhere to all Premier division entry requirements under By Law 5.2 and 5.3; and • entering, in the immediately preceding season prior to promotion, a minimum of two (2) teams per gender in any Reserves division; and • entering, in the immediately preceding season prior to promotion, a minimum of one (1) team per gender in Reserves Division 1; and • entering, in the immediately preceding season prior to promotion, a minimum of one (1) team per gender in the Junior State League. 5.4.3 To apply for promotion into the Premier divisions Clubs must send a formal application, in writing, to VV. The application must outline: • previous and current team entries that display the Club’s ability to meet the Premier eligibility requirements set out in By-Law 5.2; and • current Club structure including the composition of the club committee; and • their long-term sustainability plan to maintain and grow the sport in Victoria. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 5.4.4 VV in its sole discretion has the right to determine whether a Clubs promotion into the Premier divisions is approved. 5.4.4.1 VV will consider each application based on the requirements outlined in By-Laws 5.4.2 and 5.4.3 as well as the Club’s recent previous history adhering to: • Volleyball Victoria State League By-Laws; and • Volleyball Victoria Codes of Conduct 5.5. There will be no relegation in State League. Notwithstanding this, a club may be removed from the Premier divisions if the Club fails to meet the Premier divisions eligibility criteria outlined in By-Law 5.3. 6. CLUB AND TEAM ENTRIES 6.1. Clubs must be affiliated with VV prior to entering their teams in the State League. 6.1.1 A Club shall only be considered affiliated with VV once VV has received its yearly Affiliation Fee as set out in Appendix B. 6.2. Clubs seeking to enter team/s in the State League must complete the 'State League Entry Form' and pay the team entry fee as determined each year by VV. The ‘State League Entry Form’ is an online form with a copy of the form provided in Appendix C. 6.3 If a team is withdrawn by a Club: • The team entry fee is non-refundable; and • the relevant Club shall pay to VV the withdrawal fee as determined by VV and outlined in Appendix B. 6.4 If VV does not accept entry of a team in the State League, the Club shall be eligible for a refund of the team entry fee. 6.5 A Club shall be held liable for any fees owed by one of its teams entered in the State League. 6.6 Clubs must pay their fees according to the deadlines as set down by VV from time to time. 6.6.1 Clubs failing to pay entry fees and other levies by the final deadline date, or as prescribed by VV, shall be penalised the Late Payment Penalty each week as outlined in Appendix B until the payment is made in accordance with VV’s payment rules. Failure to pay the required amount after a time specified by VV (including any late payment penalty fines) may result in suspension from the State League or disqualification from VV until such time the payments are made and cleared. 6.6.1.1 Any team suspended from the State League shall forfeit any matches they are scheduled to play during that time. 6.7 Clubs are prohibited from nominating more than one (1) team entry in each gender of the Premier divisions. 6.7.1 Clubs are prohibited from nominating more than two (2) team entries in each gender of Reserves Division 1. 6.7.2 Clubs may choose to nominate a team entry in only one gender in each division. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 6.8 VV shall, at the beginning of each State League season, determine the number of entrants to the Reserves divisions. In making such a determination, VV must take into consideration the following factors including but not limited to: • any relevant entrants under By-Law 6.9; and • the best interests of State League; and • the development of Volleyball in Victoria in general; and • the number of eligible entries; and • the availability of court space; and • the availability of court time 6.9 Clubs are permitted to nominate unlimited teams for entry in each gender of Reserves Division 2, Reserves Division 3, and Masters, subject to VV’s sole discretion to determine entrants under By- Law 5.1 and the conditions set out in By-Law 6.8. 6.10 The eight (8) or more Clubs fielding teams under By-Law 4.2 have an exclusive right to enter a team in Reserves Division 1 if they so choose, irrespective of the considerations contained in By- Law 6.8. 7 STATE LEAGUE DRAW 7.1 VV in its sole discretion shall determine: • the number of matches scheduled for each division of State League; and • the length of the scheduled season of each division of State League. 7.2 VV shall, prior to the commencement of each State League season, provide all Clubs with a detailed draw containing all scheduled matches for each division. 7.2.1 Where it is not possible to determine the scheduling of any given match, VV shall provide notice to the affected State League Clubs and details as to how the match will be scheduled and incorporated into the draw. 7.2.2 All matches shall be played on such days and times VV determines will be of benefit to the State League competition. 8 PLAYING VENUES 8.1 In addition to By Law 7.2 VV shall nominate on the draw the venues for all regular season and finals series matches. 8.1.1 All playing venues, including address and contact number, are listed in Appendix Q. 8.2 The nominated venue must meet the standard volleyball requirements as designated by VV. 8.3 VV may in its sole discretion nominate country or regional venues for any match. 8.4 All matches, regardless of venue, must comply with these By-Laws unless otherwise approved by VV. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 9 CHAMPIONSHIP POINTS 9.1 Championship points shall be awarded as follows for each match: • four points to a winning team • zero points to a losing team • zero points to a forfeiting team • zero points to a disqualified team. 10 STATE LEAGUE LADDER 10.1 VV shall establish and keep updated a Ladder for all divisions. VV shall publish the updated Ladder on the State League website at the completion of each round of the regular season. 10.2 Teams will be ranked on the ladder in accordance with the total of each team's championship points at any given time. 10.2.1 If there is a tie between two or more teams the higher ranked team will be determined in the following order: • If there is a tie between two or more teams the greater set percentage between teams of equal championship points will determine the higher ranked team. • If there is still a tie between two or more teams, the greater point percentage between teams of equal set percentages will determine the higher ranked team. • If there is still a tie between two or more teams, the winner of the greater number of matches played during the current regular season between the two or more equal teams will determine the higher ranked team. • If there is still a tie between two or more teams, VV shall determine an appropriate method to determine the higher ranked team. 11 FINALS SERIES 11.1 The following teams shall qualify for the finals series in a division that is not split into pools: • In a division with less than twelve teams entered, the highest four ranking teams on the Ladder at the conclusion of the regular season; or • In a division with twelve or more teams entered, the highest six ranking teams on the Ladder at the conclusion of the regular season. 11.2 The following teams shall qualify for the finals series in a division that is split into pools: • In a pool of 4 to 7 teams (inclusive) entered, the highest three ranking teams on the ladder from that pool at the conclusion of the regular season; and • In a pool of 8 or more teams entered, the highest four ranking teams on the ladder from that pool at the conclusion of the regular season. 11.3 The finals series shall be determined by VV at the time the full fixture is released. VV in its sole discretion may amend, alter, or restructure the finals series where circumstances require, subject to complying with these State League By-Laws. VV will endeavour to provide as much notice as possible to all Clubs where this occurs. Page 12 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 11.4 Prizes for each division, including but not limited to trophies, medallions and/or prize money shall be awarded at the discretion of VV. 11.5 VV, must appoint the following officials for all grand final matches: • one 1st referee; and • one 2nd referee; and • two lines judges; and • one scorer. 11.6 Where possible, VV will appoint the above-mentioned officials for all finals series matches. A finals series match other than a grand final shall not be void if all the above-mentioned officials are not appointed. 11.6.1 Where all duties for a finals series match (excluding a grand final) are not performed by VV- appointed officials under By-Law 11.5, they must be performed by the Club (or Clubs) with the lowest-ranked team (or teams) participating in that round of finals series matches (i.e. if 2 semi- finals are 1 vs 4 and 2 v 3, the Clubs entering the Teams ranked 4 and 3 would perform the duties in the other match). 12 RESCHEDULING OF MATCHES 12.1 No match shall be rescheduled from its originally fixtured, time, venue and/or date without the prior approval from VV. 12.2 Rescheduling a match shall be done in accordance with the “Match Reschedule Request Flow Chart” in Appendix F. 12.3 A Club may request to reschedule the time, venue and/or date of a match via the online form on the State League website. A copy of the form is also provided in Appendix G. 12.3.1 To reschedule a match the following conditions shall apply: • The match is a regular season State League match. • The reschedule request for a match must be made no later than 30 calendar days prior to the originally fixtured date of the match. • The proposed rescheduled date of the match must be no later than 30 calendar days after its originally fixtured date. • The match can only be rescheduled to a date prior to the commencement of the final series for the match's division. • The Club that requested the reschedule shall be required to fulfil any duty requirements of the rescheduled Match that either they, or the opposition Club had, in the original fixture unless an adjustment to the State League draw has been made by VV. • The Club that that reschedules a Match shall be responsible for any costs associated with the reschedule. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 12.3.2 The reschedule request must include: • reason(s) for the team requesting a reschedule; and • the proposed date, time, and venue for the match; and • a guarantee by the club that a duty team including a 1st referee will be present for the rescheduled match 12.4 Within 7 business days of receiving any request to reschedule a match, VV shall contact the Club in writing, notifying them of its decision to either: • approve the reschedule at the proposed new date, time and/or venue; or • reject the reschedule at the proposed new date, time and/or venue; or • reject the reschedule request outright. 12.4.1 If VV approves the request, the Club requesting the reschedule must pay to VV the prescribed reschedule fee, as outlined in Appendix B. 12.4.2 Should VV reject the reschedule at the proposed new date, time and/or venue, the Club requesting the reschedule may elect to again request an alternate date provided By-Law 12.3.1 is satisfied. 12.4.2.1 If there is not a mutually acceptable reschedule between the Club requesting the reschedule and VV the Club that has requested the reschedule shall either: • accept any proposed reschedule date, time and/or venue provided by VV; or • play the match in accordance with the original schedule. 12.4.2.2 If the Club requesting the reschedule chooses to accept VV's proposed reschedule, it shall do so regardless of any inconvenience to themselves, including but not limited to: • scheduling the match at the opposition's venue; or • scheduling the match at a non-optimal time. 12.4.3 If VV rejects the reschedule request outright, the match shall be played in accordance with the original schedule. The Club requesting the reschedule shall have no right of appeal against this decision. 12.5 Should a match be rescheduled under By-Law 12, VV shall notify the other Club playing in the match within 3 business days of accepting any reschedule request. VV has the right to compel a Club to accept the rescheduling of a regular season match where it believes that doing so is in the best interests of the players, the State League, or the sport. If a Club refuses to play the rescheduled Match at the new time, venue and/or date then that team shall forfeit the match and be penalised the Forfeit Penalty. 12.6 If VV reschedules a match by its own accord, VV will attempt to provide a 1st referee. Any failure by VV to provide a 1st referee for the rescheduled match shall not in any way invalidate the match or the match result. Page 14 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 13 MEETINGS 13.1 VV must hold a minimum of 3 meetings of Club Delegates (known as Delegate’s Meetings) each calendar year to discuss various aspects of Victorian volleyball, including State League. 13.2 VV may hold a Technical Meeting(s) before or during each State League season if it is deemed required. VV and the VVRC shall discuss, at that meeting, rules, By-Laws, and protocols that shall apply for the current or the next State League season. 13.2.1 Each team must send one (1) representative (preferably the Coach) to that meeting. Where the changes between seasons do not necessitate a technical meeting, VV may choose another form of communication to provide information for the season to the Clubs. Page 15 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS SECTION II PARTICIPANTS 14 PARTICIPANT CONDUCT 14.1 Participants choosing to engage in State League in any way are bound by the Fair Play Code of Conduct located in Appendix E of the By-Laws. 14.1.1 All State League players are also bound by the Players Code of Conduct located in Appendix E of the By-Laws 14.1.2 Any participant found to be in breach of a Code of Conduct, may be required to face a behavioural tribunal and may be disqualified from State League and other Volleyball Victoria events. 14.2 Any person registered on the team list during a match that is sanctioned with a “Disqualification” by the 1st referee may face a behavioural tribunal and may be disqualified from State League and other Volleyball Victoria events. 14.3 A player may be disqualified from participating State League or any other Volleyball Victoria events for various reasons which include but are not limited to: • Breach of the Fair Play and/or Players Code of Conduct located in Appendix E of these By- Laws. • Being sanctioned with a “Disqualification” by the 1st referee during a match • Non-payment of any debts to VV 14.3.1 Any disqualified player under this By-Law or the VV rules and regulations may be considered by VV to be disqualified from any VV activities (other than as a spectator), including but not limited to participation in: • volleyball matches; and/or • volleyball tournaments; and/or • volleyball teams; and/or • volleyball tours; and/or • volleyball functions. 15 PARTICIPANT REGISTRATION 15.1 To be eligible for any match participants must, prior to the scheduled match start time, be a registered member of VV. 15.1.1 The below table is a guide as to the minimum membership type required for participants. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 15.1.2 Participants may register with VV at any time. 15.1.3 Upon registering for the State League participants acknowledge and agree that they are bound by, including but not limited to, the rules, regulations, and decisions of VV including these By-Laws. 15.2 In addition to the membership requirements contained in By-Law 15.1, coaches, players, and team staff must also be registered as a member of the Club they are representing. 15.3 Prior to the beginning of each State League season VV shall nominate at its discretion the following: • Details and procedures for participant registration and deadlines for that registration; and • Fees for participant registration; and • Details and procedures to determine which participants are registered. 15.4 A person that has never competed in any State League in Australia is not subject to By-Law 16 and may register with a Club at any time. 15.5 Any player wishing to compete in State League for any Club other than: • the Club they are currently registered with; or • the last Club they competed in State League for, shall be required to complete a Financial Clearance or an Inter-Club Transfer as outlined in By-Law 16. 15.6 If a team has an unregistered coach, player, or team staff participating in a match the team shall be deemed incomplete and forfeit the match. The team shall also receive an Unregistered player/coach/ team staff penalty outlined in Appendix B. 15.7 A team forfeiting a match under By-Law 15.6 shall have no right of appeal. 15.8 VV may, at its discretion and at any time, withdraw participants registration for non-payment of any debt to VV. Should this withdrawal occur, the relevant participant shall be considered unregistered for the purpose of these By-Laws at the moment the withdrawal is made. 16 PLAYER TRANSFERS 16.1 A Club Registered Player, as defined by these By-Laws, wishing to transfer to another Club in the following State League Season will require a: • State League Inter-Club Transfer, which can only be applied for during the State League transfer period; and • Financial Clearance; and 16.1.1 A Free Agent, as defined by these By-Laws, wishing to transfer to another Club in the following State League Season will require a: • Financial Clearance. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 16.2 The transfer period shall: • open on the date the VV office opens, according to the VV calendar; and • close midday AEST on the Friday prior to round seven (7) of that State League season for State League-Inter-Club Transfers; or • close at the end of the regular season for Financial Clearances. 16.2.1 Any player requesting a transfer outside of the transfer period must apply in writing to VV. 16.2.2 The General Manager of VV may in their sole discretion on behalf of VV, convene a special committee to determine whether to allow a transfer under By-Law 16.2.1, having regard to any factors that they (or VV) consider relevant. 16.3 A player must not compete in State League for a new Club until their transfer has been finalised. 16.3.1 A transfer is completed for a Club Registered Player when all the following are complete: • the ‘To Club’, which is the club a player is transferring to, ‘Requests a Clearance’ online via GameDay and selects ‘Transfer Clearance’ as the ‘Reason for Clearance’ • the ‘From Club’, which is the club the player is transferring from, approves the clearance online via GameDay • the player is a ‘Registered Member of VV’ for the calendar year the Volleyball Victoria State League season is operating • VV approves the transfer clearance online via GameDay • the ‘To Club’ approves the clearance online via GameDay • GameDay notifies all relevant parties via a ‘Clearance finalised’ email 16.3.2 A transfer is completed for a Free Agent when all the following are complete: • the ‘To Club’, which is the club a player is transferring to, ‘Requests a Clearance’ online via GameDay and selects ‘Financial Clearance’ as the ‘Reason for Clearance’ • the ‘From Club’, which is the club the player is transferring from, approves the clearance online via GameDay • the player is a ‘Registered Member of VV’ for the calendar year the Volleyball Victoria State League season is operating • VV approves the financial clearance online via GameDay • the ‘To Club’ approves the clearance online via GameDay • GameDay notifies all relevant parties via a ‘Clearance finalised’ email 16.4 Where a player competes in a match for their new Club before their transfer has been finalised under By-Law 16, the team shall be deemed incomplete and forfeit the match. The team's Club shall also receive the Abuse of Transfer Penalty in Appendix B. 16.5 Any dispute arising from a transfer shall be dealt with by the General Manager of VV at their sole discretion. 16.6 A Club that is entered in the Premier divisions must not receive more than two (2) transferred Club Registered Players, as defined by these By-Laws, per team, per division entered, excluding Junior divisions, per gender in each State League season. 16.6.1 A Club that is not entered in the Premier divisions must not receive more than two (2) transferred Club Registered Players, as defined by these By-Laws, per senior team entered, limited to five (5) senior teams inclusive, per gender in each State League season. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 16.6.2 In addition to By-Laws 16.6 and 16.6.1 a Club may receive up to two (2) club Registered Junior Players, as defined by these By-Laws, per Junior State League division entered per gender in each State League season. 16.6.3 A Club may receive an unlimited number of transferred Free Agent players, as defined by these By-Laws, in each State League season. The players still require a Financial Clearance as per 16.1.1 and 16.3.2. 16.7 A Club must not play or list more than two (2) transferred Club Registered Players, as defined by these By-Laws, on the scoresheet of any Premier division match. 16.7.1 A Club must not play or list more than three (3) transferred Club Registered Players, as defined by these By-Laws, on the scoresheet of any Reserves or Masters division match. 16.7.2 A Club may play or list on the scoresheet of any given match an unlimited number of transferred Free Agent players, as defined by these By-Laws. The players still require a Financial Clearance as per 16.1.1 and 16.3.2. 16.7.3 Where a team plays or lists more than two (2) transferred Club Registered Players, as defined by these By-Laws, on the scoresheet of any Premier division match, the team shall forfeit the match. The team shall also receive the Abuse of Transfer Penalty in Appendix B. 16.7.4 Where a team plays or lists more than three (3) transferred Club Registered Players, as defined by these By-Laws, on the scoresheet of any Reserves or Masters division match, the team shall forfeit the match. The team shall also receive the Abuse of Transfer Penalty in Appendix B. 16.8 A player competing in the current season may transfer during the State League season during the first four rounds providing they have participated in three or less games during the current season. 16.9 Where a player’s Club ceases entering a team in the State League division that the player was competing in the player shall be considered a Free Agent subject to: • If the transfer is during the State League season, the player had that season played in the majority of his or her matches in the division that the Club is ceasing to enter a team in at the time of submitting the Financial Clearance to VV; OR • If the transfer is between State League seasons, the player had in the immediately preceding season played a majority of his or her matches in the division that the club is ceasing to enter a team in. 16.9.1 Where the player has not played a majority of his or her games in the division from which that player’s Club ceases to participate in or the Club the player is transferring to has not entered a team in the division from which that player’s Club ceased to participate in, the player shall be considered a Club Registered Player and may transfer to another Club subject to By-Law 16. 16.10 Subject to 16.8 and 16.9 a State League Inter-Club Transfer during the State League season is prohibited. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 16.11 A player, that competes in the Premier divisions, who played their first registered Volleyball in any country before Volleyball in Australia requires an ‘International Transfer Certificate’ before competing in each State League season. 16.11.1 The International Transfer process must be initiated by the relevant player, prior to each State League season, via the online ‘International Transfer Register’ on the State League website. A copy of the form is also provided in Appendix P. 16.11.2 The International Transfer is completed when the ‘International Transfer Certificate’ is received. 16.11.3 VV will not be liable for any International Transfer fee or fine required from the Country of Origin. 17 JUNIOR PLAYERS 17.1 Any junior player competing in State League must play for his or her Club's junior team (if any) should that player wish to compete in the Junior State League. 17.1.1 If the junior player's State League Club has not entered a Junior State League team, the junior player may play Junior State League for any other Club during that State League season. 17.1.2 If a junior player is competing in the Junior State League for a different Club than his or her State League Club under By-Law 17.1.1, a Financial Clearance shall be required prior to the junior player's first game in the Junior State League for that different Club. 17.2 No person under 15 years of age shall be permitted to participate in the State League unless permission has been granted by VV. VV shall require the U15 Parental Waiver form to be completed and submitted to VV via the online form on the State League website before such a request will be considered. A copy of the waiver is also provided in Appendix D. 18 COACH AND ASSISTANT COACH 18.1 In all divisions, on the scoresheet, any person listed on the team list as a coach or assistant coach for any team must hold, as a minimum requirement, a Volleyball Australia Level 1 accreditation. 18.1.1 In the Premier divisions, on the scoresheet, any person listed on the team list as a coach for any team must hold, as a minimum requirement, a Volleyball Australia Level 2 accreditation. 18.1.2 The below table is a guide as to the minimum accreditation of coaches and assistant coaches. VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 18.1.3 If a Premier division team coach does not hold, as a minimum, a Level 2 Volleyball Australia Coaching Accreditation, the coach's Club must provide evidence that their coach is attending the next available coaching course. Such evidence includes but is not limited to the registration of an individual into the next scheduled course. 18.1.4 If a coach has an international equivalent coaching accreditation, they must contact VV to organise a ‘Recognition of Prior Learning’ to meet all requirements in By-Laws 18.1 and 18.1.1. 18.2 If any team lists, on the scoresheet, a coach that is not qualified that team will receive an Unaccredited Coach Penalty as set out in Appendix B. 18.3 Should a coach also be a player: • The person in question must be listed in both the player list and staff list on the scoresheet. • The person in question will be subject to all requirements set out in By-Law 18. 18.4 If a team does not list a coach on the scoresheet the captain may edit the team lists and provide line-ups prior to each set. 18.4.1 In this instance the captain would not be considered a coach for all other purposes pre, during and post-match. 19 PLAYER PARTICIPATION 19.1 A player must not compete in more than one match during each State League round except where permitted under this By-Law. 19.1.1 Where a team is scheduled to play multiple matches in the same State League round, each player in that team is permitted to participate in those matches during that State League round. 19.1.2 Where a team is scheduled to play multiple matches in the same State League round, the team may elect to promote or demote players during the same round provided the relevant players do not play more than two (2) matches in each State League round and abide by By-Law 20. 19.2 Junior players are permitted to participate in a maximum of two State League matches within any given round. 19.2.1 The two State League matches cannot be within the same division unless the team is scheduled to play multiple matches in the same State League round. 19.2.2 Junior State League matches are included in the participation restriction set out in By-Law 19. 19.3 Any team that registers a player or players on the scoresheet of a match who has played in more than one match during a State League round, unless subject to the exceptions provided in By-Law 19, shall be deemed incomplete and forfeit the match. The team shall also receive the Extra Game Forfeit Penalty outlined in Appendix B. Page 21 of 79
VOLLEYBALL VICTORIA STATE LEAGUE BY-LAWS 20 PLAYER MOVEMENT BETWEEN DIVISIONS 20.1 State League Clubs may move players between divisions at any time subject to By-Law 20. 20.2 Clubs are permitted to make the following maximum number of demotions in each round: DIVISION PLAYER RELEGATION LIMITATIONS Premier Up to two (2) players can be demoted into Premier Division 2 Division 1 Premier Up to two (2) players can be demoted into Premier Division 2 from Premier Division 1 Division 2 Up to two (2) players can be demoted from Premier Division 2 into the next immediate lower division that the Club has entered in the relevant gender. Reserves Up to two (2) players can be demoted into Reserves Division 1 from Premier Division 2 Division 1 Up to two (2) players can be demoted from Reserves Division 1 into the next immediate lower division that the Club has entered in the relevant gender. Reserves Up to two (2) players can be demoted into Reserves Division 2 from the next immediate Division 2 higher division that the Club has entered in the relevant gender. Up to two (2) players can be demoted from Reserves Division 2 into Reserves Division 3 Division 3 Up to two (2) players can be demoted into Reserves Division 3 from the next immediate higher division that the Club has entered in the relevant gender. Masters Up to two (2) Masters players can be demoted into Masters from any division. Juniors Unlimited junior players can be demoted into Juniors from any division, subject to By- Law 17. 20.2.1 If a Club has multiple teams entered in a division the maximum number of player relegations between the corresponding lower division does not multiply by the number of teams the Club has entered in that division. 20.2.2 No player may be relegated by more than one division between State League rounds 20.2.3 A Club is only permitted to demote a player or players beyond the limits of By-Law 20.2 where VV provides its permission in writing. The Club must apply in writing to VV for approval no less than 72 hours prior to the scheduled start time of the match in question using the online form on the State League website. A copy of the form is also provided in Appendix H of these By-Laws. VV has sole discretion to either grant or deny permission. 20.3 There is no limitation as to how many divisions a player is promoted between nor is the player required to be promoted one (1) division at a time. 20.4 Should a Club have multiple teams entered in the same division: 20.4.1 A maximum of two (2) players may move between those teams during a given State League regular reason round. 20.4.2 Once a player has played more than three (3) matches for a team during the State League regular season, that player may not play for another Club team within the same division. 20.4.3 A player may be demoted or promoted between divisions subject to By-Law 20, however when the player is relegated or promoted back into the division where the Club has multiple teams entered that player must represent the Club team that the three (3) or more matches were participated in.
