48 June 23, 2021 The regular meeting of the Borough of Riverdale Mayor and Council opened on the above date at 7:30 p.m. with the Pledge of Allegiance. Mayor Carelli presiding. ROLL CALL: Present: Kheyfets, Oswald, Revis, Pellegrini Absent: Desai, Purcell The Municipal Clerk announced that proper notice of this meeting was made as to time, date, place and agenda. APPROVAL OF MINUTES: June 9, 2021 Councilman Oswald set forth the motion, seconded by Councilman Kheyfets, to approve the above listed minutes as read. ROLL CALL: Ayes: Kheyfets, Oswald, Revis, Pellegrini Nays: None (4 ayes – 0 nays – motion carried) BOROUGH ENGINEER REPORT: Borough Engineer Tom Boorady reported on the status and scheduling for the ongoing project on Loy, Parkway, Cedar, Sonya and Cotluss. He answered questions regarding his role and the role of his inspector in road projects. Councilman Kheyfets felt that it is a huge problem that this project is taking eight months and said it’s unacceptable. Mr. Boorady stated that it is a big project and it’s taking eight months because of weather and stopping for winter. Actual work time was twenty- two weeks. It was agreed that timing and scheduling will be more carefully considered for future projects. Mayor Carelli stressed the importance of having change orders for additional charges. He also discussed future paving plans, the roads to include in the FY 2022 DOT grant and an Incidental Scope Modification for the FY 2020 DOT grant paving project. Mr. Boorady reported that the generator at the Community Center is fully functioning and the Fire Department generator is being installed. OPEN PUBLIC COMMENTS ON RESOLUTIONS: Mayor Carelli opened the meeting to the public for comments. Mayor Carelli handed out a modification to resolution No. 103-2021 as discussed. There being no comments, Mayor Carelli closed the public session. He will contact them to discuss ways we might be able to assist them. UTILITIES: Councilman Oswald reported that the softball season ended and we had a great response about our fields being the best in the league. PUBLIC WORKS: Councilman Pellegrini reported that everything with the DPW is going good. PUBLIC SAFETY: Councilman Revis deferred to Police Chief Smith who reported on the police department. Chief Regeling reported on a house fire on Loy Avenue and fire department physicals. BOROUGH CLERK REPORT: No report. BOROUGH ATTORNEY REPORT: No report.
50 June 23, 2021 MAYOR REPORT: Mayor Carelli reported that the last of the cameras are being installed. We are having problems with Optimum internet so he is looking for another provider. He reported that there is a company that does testing of marijuana that is interested in potentially purchasing a building in Riverdale. They do not buy or sell and are not open to the public. Borough Attorney Oostdyk felt that it would not be prohibited by our cannabis ordinance. OPEN PUBLIC COMMENTS: Mayor Carelli opened the meeting to the public for comments. There being no comments, Mayor Carelli closed the public session. ALL IN FAVOR ADJOURNMENT: Councilman Oswald set forth the motion, seconded by Councilman Kheyfets, to adjourn the meeting. BOROUGH OF RIVERDALE NEW JERSEY ORDINANCE NO. 05-2021 ORDINANCE OF THE BOROUGH OF RIVERDALE, COUNTY OF MORRIS, STATE OF NEW JERSEY AMENDING CHAPTER 168 “ZONING” OF THE CODE OF THE BOROUGH OF RIVERDALE TO MAKE CANNABIS ESTABLISHMENTS PROHIBITED USES WITHIN THE BOROUGH OF RIVERDALE WHEREAS, the Legislature of the State of New Jersey recently enacted P.L.2021, c.16, known as the New Jersey Cannabis Regulatory, Enforcement Assistance and Marketplace Modernization Act (hereinafter referred to as “Act”); and WHEREAS, Section 31 of the Act authorizes a municipality to prohibit the operations of any one or more classes of cannabis establishments that may operate within the municipality subsequent to the adoption of the Act; and WHEREAS, the Borough Council of the Borough of Riverdale believes it is appropriate to prohibit the operations of cannabis establishments within its jurisdiction; NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Riverdale, in the County of Morris, and State of New Jersey, as follows: SECTION 1. Chapter 168, Zoning, Article III, District Regulations, hereby amended to in include a new Section 13, entitled “Cannabis Establishments and Uses Prohibited” to read in its entirety as follows: § 168-13. Cannabis Establishments and Uses Prohibited. The operation of all classes of cannabis establishments as defined by P.L.2021, c. 16, including but not limited to, cannabis retailers, cultivators, manufactures, distributors, wholesalers, testing facilities, delivery services, medical cannabis dispensaries, alternative cannabis treatment centers, including such operators holding a medical cannabis dispensary permit pursuant to P.L.2009, c.307 (C. 24:61- 7), are expressly prohibited uses within the jurisdictional boundaries of the Borough of Riverdale.” SECTION 2. This Ordinance may be renumbered for codification purposes. SECTION 3. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or inconsistent. SECTION 4. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid. BOROUGH OF RIVERDALE NEW JERSEY Resolution No: 105-2019 Date of Adoption: July 14, 2021 TITLE: AUTHORIZING THE PURCHASE OF ELECTRICITY SUPPLY SERVICES FOR PUBLIC USE ON AN ONLINE AUCTION WEBSITE WHEREAS, Borough of Riverdale has determined to move forward with the EMEX Reverse Auction in order procure electricity for the Local Unit; and WHEREAS, the Local Government Electronic Procurement Act (P.L. 2018, c. 156) (the “Act”) authorizes the purchase of electricity supply service for public use through the use of an online auction service; and WHEREAS, Borough of Riverdale will utilize the online auction services of EMEX, LLC, a division of Mantis Innovation which is an approved vendor pursuant to the Act; and WHEREAS, EMEX, LLC is compensated for all services rendered through the participating supplier that a contract is awarded to; and WHEREAS, the auction will be conducted pursuant to the Act. NOW THEREFORE BE IT RESOLVED, that the Mayor of the Borough of Riverdale is hereby authorized to execute on behalf of Borough of Riverdale any electricity contract proffered by the participating supplier that submits the winning bid in the EMEX Reverse Auction. BOROUGH OF RIVERDALE NEW JERSEY Resolution No: 109-2021 Date of Adoption: July 14, 2021 TITLE: RESOLUTION AUTHORIZING GRANT SUBMISSION TO NJ URBAN AND COMMUNITY FORESTRY PROGRAM – (UCF) STEWARDSHIP APPLICATION WHEREAS, the New Jersey Urban and Community Forestry (NJUCF) Program is providing funding to organizations to assist with the implementation of their approved Community Forestry Management Plan (CFMP); and WHEREAS, funding is available to assist communities in understanding their urban and community forest composition and structure, and to amend or update existing management plans, including tree inventories; WHEREAS, the Mayor or his/her designee is hereby authorized to submit a New Jersey Urban and Community Forestry Stewardship Grant Application to complete a Borough Tree Inventory in the amount of $1,125.00. BOROUGH OF RIVERDALE NEW JERSEY Resolution No: 110-2021 Date of Adoption: July 14, 2021 TITLE: RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE BOROUGH OF RIVERDALE AND ASSOCIATED APPRAISAL GROUP WHEREAS, the Borough of Riverdale (“Borough”) utilizes an annual reassessment of all the lands, buildings and improvements contained within the boundaries of the Borough; and WHEREAS, the Borough Assessor has recommended that the Borough retain Associated Appraisal Group for the purpose of assisting the Assessor with the necessary inspections and professional appraisal and reassessment services in the Borough; and WHEREAS, Associated Appraisal Group submitted a proposal for the performance of said services in the total amount of Twenty-Five Thousand ($25,000) Dollars for the service; and WHEREAS, the Borough Assessor and Borough Attorney have reviewed the proposal and have recommended the award of the contract to Associated Appraisal Group in accordance with its proposal dated June 29, 2021; and WHEREAS, the Borough Council wishes to award the contract to Associated Appraisal Group; and WHEREAS, the Borough’s Chief Financial Officer has certified that funds are available for this purpose. NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Riverdale, in the County of Morris and State of New Jersey as follows: 1. Associated Appraisal Group, 8 Commerce Drive, Suite 303, Cranford, NJ 07016, be and is hereby awarded a contract to perform the above-referenced reassessment project in the Borough in conjunction with the annual reassessment as set forth in a proposal dated June 29, 2021 attached hereto, which shall not exceed the amount of $25,000; and 2. This contract is awarded without competitive bidding as a "Professional Service" in accordance with N.J.S.A. 40A:11-5(1)(a) of the Local Public Contracts Law because the contract is for a service performed by a person(s) authorized by law to practice a recognized profession that is regulated by law. 3. A notice of this action shall be printed once in the legal newspaper of the Borough of Riverdale.
