THE CORONA SITUATION IN GERMANY AND NRW • End of January 2020: First COVID 19 cases in Bavaria recognized in business travellers from China raise the attention to the pandemic as a real and immediate threat for Germany. • Quick worsening of the situation in Europe especially Italy, followed by Spain and France. • End of February: A COVID 19 outbreak with a high accumulation of cases in Heinsberg, a communal district in the western part of NRW, causes a regional lockdown and puts German authorities on higher alert. • Larger companies in NRW start executing their pandemic plans and requiring their employees to work from home. • Since March 13th, the government of NRW puts Anti Corona Measures in place which focus on restrictions of public life and social distancing including shut downs. • Measures to strengthen the medical health care system are introduced as well as a financial support framework for companies especially small companies and selfemployed persons. (Immediate Aid Program) • After peaking on April 5th the number of new infections per day declined steadily in Germany as well as in NRW, the number of acutely infected persons has stabilised at the beginning of June with a reproduction value of < 1,0. • The reproduction value has risen again during the holiday season to currently 1,22. 18
DEVELOPMENT OF CORONA VIRUS INFECTIONS IN GERMANY Fatalities Acute cases Recoveries Since the outbreak of the pandemic in Germany: • 206,926 persons diagnosed with the Corona-Virus • 9,128 COVID-19 related fatalities • 191,325 recovered COVID-19 patients • 6,473 acute Covid-19 cases as of July 29th • 3,773 new infections diagnosed in the last 7 days (4.5 per 100,000 inhabitants) 19

CORONA HELP MEASURES FOR BUSINESS: „ÜBERBRÜCKUNGSHILFE“ = BRIDGING AID • A Federal program for companies and selfemployed persons to bridge the negative business impact of the Corona pandemic. • For undertakings located in Germany and Preconditions registered at a German Tax Office • Application through certified Tax Advisers, Auditors or Sworn Accountabts only. • Severe business downturn/threat caused by the Corona Crisis has to be proven • Additional NRW State program: „Überbrückungshilfe+“ for self employed NRW persons and owners of companies with max. 50 employees for their personal life Überbrückungshilfe+ support for max. three months (June, July, August) • Calculation of the support amount applicable • Maximum available support amount 23
THE CORONA SITUATION IN GERMANY TRAVEL RESTRICTIONS (I) Important website of the German Foreign Office: https://www.auswaertiges-amt.de/en/einreiseundaufenthalt/coronavirus Travel within the EU or the Schengen area: The temporary entry restrictions for travellers from other EU countries, states associated with Schengen (Iceland, Liechtenstein, Norway, Switzerland) and the United Kingdom have been removed entirely since 21 June 2020. Travel to Germany from other EU states, the Schengen area and the United Kingdom has been possible without restriction since then. Travel from third countries: Since 17 March 2020 entry restrictions have applied throughout the EU for non-essential travel from third countries. These restrictions also specifically apply to travel to Germany. On 30 June 2020, in view of the improved global epidemiological situation in some regions, the Council of the European Union adopted a recommendation on relaxing the entry restrictions on the basis of a draft drawn up by the Commission. Germany implemented this recommendation from 2 July 2020 as follows: Third countries without travel restrictions: Since 2 July 2020, unrestricted travel to Germany is once again possible from the following third countries with low rates of infection: - Australia, Canada, Georgia, New Zealand, Thailand, Tunisia, Uruguay - China, Japan and South Korea, but: A lifting of entry restrictions is subject to confirmation of reciprocity (pending / under negotiations) This list of countries is to be regularly updated. The question of whether travel to Germany is permitted depends on where the person travelling has previously been staying, not on their nationality. 24
THE CORONA SITUATION IN GERMANY TRAVEL RESTRICTIONS (II) Options for travellers to Germany from all third countries Travel to Germany is also possible from third countries not included in the above list if there are important grounds for doing so. On this basis, travel to Germany is possible for the following groups or travel purposes: • German nationals and nationals from other EU countries, countries associated with Schengen (Iceland, Liechtenstein, Norway, Switzerland) and the United Kingdom; • Third-country nationals with a valid residence permit for Germany; • Family members of third-country nationals travelling to Germany for the purposes of family reunification or for visits for urgent family reasons; • Healthcare professionals, health researchers and elderly care professionals; • Foreign experts and highly qualified personnel whose work is necessary from an economic point of view and which cannot be postponed or carried out abroad; (* for definitions see next slide) • Diplomats, staff of international organisations, military personnel and humanitarian aid workers in the exercise of their functions • Transport personnel engaged in haulage of goods and other transport staff; Seasonal workers in agriculture; Sailors; • Foreign students whose studies cannot be continued entirely from outside Germany; • Persons in need of international protection or seeking protection for other humanitarian reasons; • Late repatriates; • Passengers in Transit. 25
THE CORONA SITUATION IN GERMANY TRAVEL RESTRICTIONS (III) * Foreign experts and highly qualified personnel whose work is necessary from an economic point of view…. Definitions: Skilled and highly qualified foreign workers within the meaning of the Council Recommendation on the temporary restriction on non-essential travel into the EU and the possible lifting of such restriction (Council document 9208/20) are: • skilled workers who have a concrete job offer as defined by law (§§ 18 (3), 18a, 18b of the Residence Act) for which proof is given in the form of certification of employment; • scientists/ researchers (section 18d Residence Act); • transfers (in accordance with section 19 (1) in conjunction with section 10 of the Ordinance on the employment of foreigners (BeschV)) and ICT limited to managers and specialists (sections 19 (2), section 19b of the Residence Act); • managers (section 19c in conjunction with section 3 of the Ordinance on the employment of foreigners); • IT specialists (section 19c (2) Residence Act in conjunction with section 6 of the Ordinance on the employment of foreigners); • employment of significant public interest (section 19c (3) Residence Act). Skilled workers or highly-qualified workers may enter Germany only if they prove their obligation to be present in Germany (e.g. by presenting a job contract) and provide evidence to substantiate that their employment in Germany is necessary from an economic perspective and the work cannot be postponed or performed abroad (by providing documentation from their employer/contract awarder). The economic necessity relates to the economic relationships and/or the economy of Germany or the single market. Relevant documentation is to be carried during travel and presented during border checks if requested. For foreign skilled workers and highly-skilled workers who (i) may enter into Germany for a long-term stay without requiring a visa in accordance with section 41 (1) of the Ordinance Governing Residence but who (ii) are nationals of a state that is not on the positive list, the following applies: To facilitate entry, persons who do not apply to the German diplomatic representation abroad for a visa for immediate commencement of their employment and instead acquire their residence permit after entering Germany may ask the German diplomatic representation responsible for their place of usual residence for certification of their eligibility for and of the urgency of their entry, based on the provision of documentation from their employer. The documentation from the employer must contain a job description. Please refer to the website of the Federal Foreign Office to find the German diplomatic representation abroad responsible for your usual place of residence. Entry at short notice is permissible for urgent business purposes. This is conditional, however, on the requirement to substantiate sufficiently (e.g. by presenting documentation from the employer or business partner in Germany) that entry is absolutely necessary even under the circumstance of a pandemic. 26
