National Association of REALTORS® Code of Ethics Mandatory Requirement *The National Association of REALTORS® online Code of Ethics course must be completed every two years. Must be completed online again between January 1, 2019 and December 31, 2020* COURSE OBJECTIVES: • to heighten member awareness of the key tenets of the Code of Ethics; • to create an awareness of and appreciation for the role the Code can and should play in their professional lives; • to enhance professionalism and competency; and • to encourage REALTORS® to view their Code of Ethics as a living, viable guide in their daily dealings with clients, customers, and the public.

Create Videos • 1 out of 2 people on the internet go to YouTube to watch over 4 billion videos every day. • People remember 70% of what they see and hear versus 20% of just what they hear or 30% of what they read. • Creating videos doesn’t have to take a lot of time or even a lot of money. Videos Continued • Depending on the type of video, length should be about 2-3 minutes. • Pick your topics: • What’s going on in the community • Quarterly update in the real estate market • Instructional • Client Testimonials • Have fun and be relaxed: • This is the hard part. We have to practice. No one likes the way they look or sound on camera. • Truth is that this is how everyone sees and hears you. Be comfortable with yourself. • The more videos you do the easier it will be. Pg 11

Encrypt Files and Emails! • 90,000 new viruses hit the internet every day! 30,000 Americans everyday are hacked! • Code of Ethics: Article 1-9 says: “The Obligation of REALTORS® is to preserve confidential information provided by their clients in the course of any agency relationship….”, This means it is YOUR responsibility to make sure that not only is your data safe but any client data that is given to you is secured. • Tax records • Bank statements • Any document that has personal information about your client. • We need to make sure proper precautions are taken to secure data. Antitrust: A Video
Sherman Antitrust Act of 1890 • First Federal act that outlawed monopolistic business practices • Violation occurs when there is an agreement or understanding among competitors that unreasonably restrains competition • In real estate, price fixing and group boycotts are the most common antitrust violations One of the bedrock principles of antitrust compliance is that neither associations nor their members collectively set the price of services provided by real estate professionals. That is a decision made independently by each firm. Packet Pg 12-13
Antitrust • Price Fixing is a per se offense • This means there are no exceptions or extenuating circumstances that will excuse an antitrust violation • Most price fixing violations are unwritten or verbal agreements • These “agreements” can take place in casual settings... Country club or a coffee shop • Don’t assume your comments will be kept private! Packet Pg 12-13
Antitrust: Price Fixing Competitors may not agree to: • List properties or represent buyers only on the same terms and conditions • Offer the same co-op compensation through the MLS Don’t be lazy when responding to a client about your commission... • “It’s the rate we all charge.” • This sounds like all REALTORS® have agreed to charge a set commission. Antitrust: Group Boycotts Beware of those who agree as a group to: • Not cooperate with a particular broker • Not show a certain broker’s listings • Not advertise in certain media • Not use a particular vendor Pocket Listings may be fodder for potential antitrust violations... if you’re marketing a property outside the MLS to a set group (i.e. investors group), it could be seen as anticompetitive. When in doubt, consult your broker, brokerage’s attorney, or call C.A.R.’s Legal Hotline (it’s free). Packet Pg 12-13
REALTORS® continue Focus on Fair Housing, Commemorate 50th Anniversary of Act “Fair Housing for All” • NAR firmly believes in equal opportunity in housing. • No person of this country should have the right to rent or purchase shelter of choice abridged because of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. • Furthermore, these rights should not be limited because of existing or desired ethnic, racial, or religious proportions in any defined area. The nation and NAR did not always support fair housing rights. In fact, NAR opposed passage of the Fair Housing Act, and at one time allowed local Associations to exclude members based on race or sex. Our understanding of fair housing rights changed over time and today NAR leads efforts to expand those rights. www.nar.realtor.org or
