ARTICLE 2 – BIDDER’S ACKNOWLEDGEMENTS 2.1 Bidder accepts all of the terms and conditions of the Instructions to Bidders, including without limitation those dealing with the disposition of Bid security. C. Bidder is familiar with and is satisfied as to all federal, State and local Laws and Regulations that may affect cost, progress and performance of the Work. D. Bidder has carefully studied all: 1. Reports of explorations and tests of subsurface conditions at or contiguous to the Site and all drawings of physical conditions in or relating to existing surface structures. E. Bidder does not consider that any further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times and in accordance with the other terms and conditions of the Bidding Documents. F. Bidder has correlated the information known to Bidder, information and observations obtained from visits to the Site, reports and drawings identified in the Bidding Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. G. Bidder has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has discovered in the Bidding Documents, and the written resolution thereof by Engineer is acceptable to Bidder. H. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. I. Bidder will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of the Agreement. A. Bidder accepts the provisions of the Agreement as to liquidated damages in the event of failure to complete the Work within the Contract Times. Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 1 Specification Sections, apply to this Section. 1.2 SUMMARY A. This Section describes the measurement and payment for the Work to be completed under each item in the Bid Form. The descriptions may not reference all of the associated Work. Work specified but not designated as a separate Bid item is considered incidental to all Bid items. The Contractor shall review all work associated with each work item and shall have no claim for being unfamiliar with the requirements of these specifications. 1. The lump sum price, which is based on the stated estimated quantity of material furnished and placed from off-site, shall be adjusted up or down per the actual volume of material transported from off-site, placed and accepted by the Engineer per Add/Deduct Bid Item No. ALT-16A. The price so-stated constitutes full and complete compensation for all products, materials, equipment, tools labor, overhead and profit, and incidentals required to finish the work and accepted by the Engineer Q. Bid Item No. ENC-17 – Natural Boulder Wall Construction 1. Work associated with this item will be paid for at the stated price including, but not limited to, work under the following: a. All or portions of Division 1 specifications, as applicable. b. Section 02300 Earthwork c. Includes, but is not limited to: Installing natural boulder wall along southern edge of Stick Bridge Road as depicted on the Contract Drawings and as directed by the Engineer. Also includes restoring disturbed areas along base of wall with loam and seed as indicated on the Contract Drawings. 2. Measurement: As measured by the Contractor and accepted by the Engineer, pro- rated with the Contractor’s progress of work in constructing respective items associated with this bid price item. 3. Payment: Natural Boulder Wall Placement will be paid for on a Lump Sum Basis, as stated on the Bid Form, complete and in place. R. Bid Item No. ENC-18 – Old County and Stick Bridge Roads Stabilization and Vegetative Restoration 1. Work associated with this item will be paid for at the stated price including, but not limited to, work under the following: a. All or portions of Division 1 specifications, as applicable. b. Section 02925 Site Restoration c. Includes, but is not limited to: Restoring non-paved or non-gravel roadway shoulder and adjacent sloped areas along Old County and Stick Bridge Roads with loam and seed; installing soil-filled stone slope and embankment scour and edge protection along Old County Road embankment slopes; and installing embankment slope restoration and salt marsh restoration plantings and vegetation as indicated on the Contract Drawings. 2. Measurement: As measured by the Contractor and accepted by the Engineer, pro- rated with the Contractor’s progress of work in constructing respective items associated with this bid price item. Payment: Old County and Stick Bridge Roads Stabilization and Vegetative Restoration will be paid for on a Lump Sum Basis, as stated on the Bid Form, complete and in place. 3.2 LIST OF EAST HARBOR CULVERT REPAIR CONTRACT BASE BID ITEMS A. Bid Item No. EH-1 – Mobilization/Demobilization and General Requirements 1. Work associated with this item will be paid for at the stated price including respective portions of work under all specifications necessary to initiate, sustain and conclude Contractor’s activities at the project site. a. All or portions of the Contract Requirements and Division 1 specifications, as applicable. b. Includes, but is not limited to: All labor, equipment, tools, and materials necessary to complete the work associated with the mobilization and demobilization, materials, personnel, and equipment to and from the project site. Mobilization shall be considered complete when the Contractor has commenced the work on-site. Demobilization shall be considered to be complete when the Contractor has achieved final completion of the work and removed all equipment and materials from the site. c. This work also includes Contractor's general requirements for completing the work, including insurance, bonds, administration and general requirements, meeting, schedules, temporary facilities and temporary measures not specified elsewhere and miscellaneous costs associated with the Work including incidentals not covered by other payment items. d. Also includes other incidental items such as field and laboratory testing, construction survey layout, and as-built mapping. 2. Measurement: As measured by the Contractor and accepted by the Engineer. Contractor will be paid 50% upon completion of mobilization, 25% upon earning 50% of the total base bid contract value, and the remaining 25% upon completion of demobilization from the site. 3. Payment: Mobilization and Demobilization and General Requirements will be paid for on a Lump Sum basis, complete and in place. B. Bid Item No. EH-2 – Traffic Control and Protection of Public 1. The Town will provide a police detail if needed for deployment/retrieval of traffic controls for Rt. 6 shoulder closures. 2. Work associated with this item will be paid for at the stated price including, but not limited to, work under the following: a. Includes, but is not limited to: Installation, maintenance and removal of all temporary markings, barricades, signs, cones, lights and other products and materials required for control of vehicular and pedestrian traffic to public and private properties within and abutting the project site and adjacent areas 3. Measurement: As measured by the Contractor and accepted by the Engineer, pro- rated with the Contractor’s progress of work in establishing, maintaining, and removing temporary public protection measures. 4. Payment: Traffic Control and Protection of Public will be paid for on a Lump Sum Basis, complete and in place. C. Bid Item No. EH-3 – Temporary Erosion and Sedimentation Control 1. Work associated with this item will be paid for at the stated price including, but not limited to, applicable portions of work under the following: a. All or portions of Division 1 specifications, as applicable b. Section 01572 – Temporary Erosion and Sedimentation Control c. Section 02300 – Earthwork d. Section 02925 – Site Restoration and Plantings e. Includes, but is not limited to: Installing, maintaining, removing and disposing all temporary erosion and sedimentation control measures and practices for completion of all work associated with the project. Includes removing and disposing of all accumulated sediment off site and installing/maintaining controls or establishing temporary vegetation in areas to remain dormant for extended periods as indicated on the Contract Drawings. 2. Measurement: As measured by the Contractor and accepted by the Engineer, pro- rated with the Contractor’s progress of work in providing, maintaining, removing and disposing all temporary and erosion control measures and practices required for completion of work. 3. Payment: Temporary Erosion and Sedimentation Control will be paid for on a Lump Sum Basis, complete and in place. D. Bid Item No. EH-4 – Control of Water 1.
