UN Convention on the Rights of Persons with Disabilities (CRPD) Article 1 – Purpose To promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity. The Convention marked a ‘paradigm shift’ in attitudes and approaches to persons with disabilities. Persons with disabilities are not viewed as "objects" of charity, medical treatment and social protection; rather as "subjects" with rights, who are capable of claiming those rights and making decisions for their lives based on their free and informed consent as well as being active members of society. Interoperability Management Platform Service • 1st Generation Established in 2005, 2nd Generation in 2013, 3rd Generation est - 2022. • Objective was to create and then leverage a National Interoperability Framework (Technically, Commercially and Contractually) • Collects, Distributes and Processes Data among ETC tolling service providers and toll roads / chargers. • Used to facilitate national initiatives such as the Disability Toll Exemption Scheme (DTES) and the Low Emissions Vehicle Toll Incentive (LEVTI). Bye Laws Disabled Drivers The Bye-Laws references with respect to disabled drivers exemptions from tolls care for: ‘Speciallyadapted Vehicles driven by disabled persons’
Exemption Mismatch Bye Laws versus Motor Tax • Under Revenue scheme, eligibility is extended to the following situations: ➢ Drivers with Disabilities who purchase a vehicle with the intention of driving it themselves must apply to revenue as a driver with a disability; ➢ Passengers with Disabilities who cannot drive themselves and purchase a vehicle for their use as a passenger; ➢ Family Members of a person with a disability who purchase a vehicle for the transport of that person as a passenger.

Confusion Reigns
Disability Groups • Engagement between TII and Disability Groups. • Initial preference for all disabled drivers to be issued with tags. • Discussion on the practical difficulties that disabled drivers face at Toll Plazas. • Issues around unmanned Toll Plazas. • Suggestion of use of disc rather than a card to assist those with upper body mobility issues.
The Solution Centralised Disability Toll Exemption Scheme (DTES) managed by unique operator under the ERTO – Dublin Tunnel Tolling contract as delegated by TII. Eligibility criteria mirrors the current Tax Relief Scheme implemented by Revenue Commissioners in relation to Drivers and Passengers with Disabilities. Disability Toll Exemption Discs will be issued by scheme operator to eligible users. The discs are designed for visual inspection and need to be affixed to the adapted vehicle windscreen to assist Toll Road Operators identify the vehicle as exempt. All Toll Road Operators have signed an MOU to abide by the scheme rules developed for the issuing of Discs under the proposed terms of the scheme. White lists of registered vehicles will be distributed through the IMSP to Toll Road Operators.

Getting the message out • Various Toll Chargers sent letters out to current card holders advising them about the new DTES Scheme. • Toll Booth staff distributed information leaflets to card holders who presented their cards or exemptions at the plazas. • The DTES scheme was launched alongside the website www.dtes.ie on 3rd February 2020. • Over 3,000 applications have been made to date. • White lists are distributed daily by the IMSP.
Back in the day…. • Horses or carriages conveying sick, wounded or disabled officers. • Horses or carriages attending Her Majesty or any of the Royal Family. • Persons going to or returning from their usual place of Religious Worship tolerated by Law. • Inhabitants of any Parish or Township going to or returning from attending the funeral of any Person who shall die or be buried in the parish. • Sheep going to be washed!
